which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the exchange of certain Federal land and State land in the State of Utah.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Utah School and Institutional Trust Lands Administration Exchange Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idaeda9a8379c04d6887d420fa68f17c7e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9C3A9E1611294D7383F5A0F893A72A03"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Utah School and Institutional Trust Lands Administration.</text></paragraph><paragraph id="idC891D525CD874FE2A80C6827B61A312F"><enum>(2)</enum><header>Agreement</header><text>The term <term>Agreement</term> means the agreement between the Administration, the State, and the Secretary to exchange certain Federal land and interests in Federal land for certain State land and interests in State land managed by the Administration entitled <quote>Memorandum of Understanding—Exchange of Lands</quote> and dated March 17, 2023.</text></paragraph><paragraph id="id5f277afc1fed4f30a79ff5a33ae1669a"><enum>(3)</enum><header>Legal description</header><text>The term <term>Legal Description</term> means a legal description that is included in Exhibit A to the Agreement and that is part of the Agreement as of the date of the conveyance of the applicable land under this Act.</text></paragraph><paragraph id="id8C5ACF37BB2649DE818051AFE37A698C"><enum>(4)</enum><header>Map</header><text>The term <term>Map</term> means the map described in the Agreement.</text></paragraph><paragraph id="idDA554213E2C446CD8A767EB2344FA9D7"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id44A388C4D37C4C6488B0F9A9F57C9892"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Utah. </text></paragraph></section><section id="idfe6a6473686c4873b9bc75507ed16c4f"><enum>3.</enum><header>Ratification of agreement between the Administration, the State of Utah, and the Secretary of the Interior</header><subsection commented="no" display-inline="no-display-inline" id="iddbfe345c5cf140779410b8254ef77432"><enum>(a)</enum><header>Ratification</header><text display-inline="yes-display-inline">All terms, conditions, procedures, covenants, reservations, and other provisions included in the Agreement—</text><paragraph commented="no" display-inline="no-display-inline" id="id3f4100b0f91b48ad93605e85705c9b59"><enum>(1)</enum><text>shall be considered to be in the public interest;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b6c1280178d4c0192912b3b4e9ff3e5"><enum>(2)</enum><text display-inline="yes-display-inline">are incorporated by reference into this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd84a4c192c224bc3b1318890e704389d"><enum>(3)</enum><text display-inline="yes-display-inline">are ratified and confirmed by Congress; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17497f3495f94b1c9c8a713b2ec2facf"><enum>(4)</enum><text display-inline="yes-display-inline">set forth the obligations of the United States, the State, and the Administration under the Agreement as a matter of Federal law.</text></paragraph></subsection><subsection id="idc39ef959ed134a0e8c2e2ae60c2f3aac"><enum>(b)</enum><header>Implementation</header><text>The Secretary shall implement the Agreement.</text></subsection></section><section id="id3bdcd49577a0465d8c6fcecad87658ca"><enum>4.</enum><header>Conveyances</header><subsection commented="no" display-inline="no-display-inline" id="iddb4eb921174f40f7a5ca5213c65d1658"><enum>(a)</enum><header display-inline="yes-display-inline">Public interest determination</header><text>The land exchange directed by the Agreement shall be considered to be in the public interest.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7af82b817a524dd6b10869a4834acdec"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization</header><paragraph id="id9463c415928348869f6fbd583ac3139d"><enum>(1)</enum><header>Conveyances</header><text>Notwithstanding any other provision of law, the conveyances of land and interests in land described in paragraphs (2), (3), and (5) of the Agreement shall be executed in accordance with this Act and the Agreement.</text></paragraph><paragraph id="id2eb85e5b6c5945c5b3919782e40a7e8f"><enum>(2)</enum><header>Deadline for certain conveyances</header><text>The conveyances of land and interests in land described in paragraphs (2) and (3) of the Agreement shall be completed not later than 45 days after the date of enactment of this Act.</text></paragraph><paragraph id="id53e4b86c084741a395d75e4feedfdb79"><enum>(3)</enum><header>Requirement</header><text>If necessary, the conveyances of land and interests in land described in the Agreement shall be equalized in accordance with section 5(b).</text></paragraph></subsection><subsection id="id0416a63a73c34262be82e2314c685265"><enum>(c)</enum><header>Map and legal descriptions</header><paragraph id="id06a778c9e7f343aaadf5d2f52618dbca"><enum>(1)</enum><header>Public availability</header><text>The Map and Legal Descriptions shall be on file and available for public inspection in the offices of the Secretary and the State Director of the Bureau of Land Management.</text></paragraph><paragraph id="id19622435c772431abb358a6b9eb0fec1"><enum>(2)</enum><header>Conflict</header><text>In the case of any conflict between the Map and the Legal Descriptions, the Legal Descriptions shall control.</text></paragraph><paragraph id="idd351920de934404e8f427d482d5f2e9e"><enum>(3)</enum><header>Technical corrections</header><text>Nothing in this Act prevents the Secretary and the Administration from agreeing to the correction of technical errors or omissions in the Map or Legal Descriptions.</text></paragraph></subsection><subsection id="id68468009663048efa057bff33f1cdba6"><enum>(d)</enum><header>Adequacy of applicable plans</header><text>A conveyance of Federal land or an interest in Federal land to the State under the Agreement shall be considered to comply with any applicable land use plan developed under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></subsection></section><section id="id8e99a757bf164c8ba04ec234e9117720"><enum>5.</enum><header>Equalization of the exchange</header><subsection id="idf21802ef52254697a333f017acd1f1cf"><enum>(a)</enum><header>Appraisal</header><paragraph id="id7352a488f1a4408f8487acf6a9b01722"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of execution of the exchange under section 4, the total value of the land exchanged shall be determined by an appraisal in accordance with paragraph (5) of the Agreement, that shall—</text><subparagraph id="id85d33804a999444da49e1e127531f914"><enum>(A)</enum><text>be based on land and mineral values determined as of the date of enactment of this Act;</text></subparagraph><subparagraph id="idff214ca8676043f4a71a0382924a603a"><enum>(B)</enum><text>be conducted in accordance with section 206(d) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(d)</external-xref>); and</text></subparagraph><subparagraph id="id38cc8c7dff9f48818514307be0f72544"><enum>(C)</enum><text>use nationally recognized appraisal standards, including—</text><clause commented="no" display-inline="no-display-inline" id="idb64442474cc24556a497b086018726b9"><enum>(i)</enum><text display-inline="yes-display-inline">the Uniform Appraisal Standards for Federal Land Acquisitions; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id232869c1a6fd4f039b44813fbd7127d9"><enum>(ii)</enum><text display-inline="yes-display-inline">the Uniform Standards of Professional Appraisal Practice.</text></clause></subparagraph></paragraph><paragraph id="id9a1f69bf1fb24d9482a908fa98dbe1ea"><enum>(2)</enum><header>Minerals</header><subparagraph id="id4663d50f4e224cb28cb215da5505ce71"><enum>(A)</enum><header>Mineral reports</header><text>The appraisals conducted under paragraph (1) may take into account mineral and technical reports provided by the Secretary and the Administration in the evaluation of mineral deposits in the land and interests in land exchanged under the Agreement.</text></subparagraph><subparagraph id="id46365a1ed0de451ead52836bf702af71"><enum>(B)</enum><header>Mining claims</header><text>The appraisal of any parcel of Federal land or interest in Federal land that is encumbered by a mining claim, mill site, or tunnel site located under the mining laws shall be conducted in accordance with standard appraisal practices, including, as appropriate, the Uniform Appraisal Standards for Federal Land Acquisition.</text></subparagraph><subparagraph id="ida923aec18e994fc8b795e13c748241b8"><enum>(C)</enum><header>Validity examinations</header><text>Nothing in this paragraph requires the United States to conduct a mineral examination for any mining claim on the Federal land or interest in Federal land conveyed under the Agreement.</text></subparagraph></paragraph><paragraph id="id19c3c81efae640529992de382e2b4ea8"><enum>(3)</enum><header>Adjustment</header><subparagraph id="ida0395c7ef8f642009ea06895ffe53f8c"><enum>(A)</enum><header>In general</header><text>If value is attributed to any parcel of Federal land or interest in Federal land through an appraisal under paragraph (1) based on the presence of minerals subject to leasing under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>), the value of the parcel or interest in Federal land (as otherwise established under this subsection) shall be reduced by the percentage of the applicable Federal revenue sharing obligation under section 35(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191(a)</external-xref>).</text></subparagraph><subparagraph id="id6abec59c2d554376804b1fe6cbf72032" commented="no"><enum>(B)</enum><header>Limitation</header><text>Any adjustment under subparagraph (A) shall not be considered to be a property right of the State.</text></subparagraph></paragraph><paragraph id="id5fddc9f9fbc7436ebdec8b294a3161de"><enum>(4)</enum><header>Approval; duration</header><text>An appraisal conducted under paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7979746986cf43b0ae9fa9fbe9179dbc"><enum>(A)</enum><text display-inline="yes-display-inline">be submitted to the Secretary and the Administration for approval; and</text></subparagraph><subparagraph id="id4a642802f97948289d091d56fb947356"><enum>(B)</enum><text>remain valid for 3 years after the date on which the appraisal is approved by the Secretary and the Administration under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id3f6320d3a80b4554b980e318765d5e87"><enum>(5)</enum><header>Dispute resolution</header><text>If, by the date that is 90 days after the date of submission of an appraisal for review and approval under paragraph (4)(A), the Secretary and the Administration do not agree to accept the findings of the appraisal with respect to any parcel of land or interest in land to be exchanged, the dispute shall be resolved in accordance with section 206(d)(2) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(d)(2)</external-xref>).</text></paragraph></subsection><subsection id="id3cb5627364c542baad70877374a0fda2"><enum>(b)</enum><header>Equalization of values</header><text>If the total value of the State land described in paragraph (2) of the Agreement and the total value of the Federal land and interests in Federal land described in paragraph (3) of the Agreement, as determined under subsection (a), are not equal—</text><paragraph commented="no" display-inline="no-display-inline" id="ida93ae6234374408c9a168da61c215875"><enum>(1)</enum><text display-inline="yes-display-inline">the value shall be equalized in accordance with paragraph (5) of the Agreement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2af2f0454e14d68b3c6365a505146c5"><enum>(2)</enum><text display-inline="yes-display-inline">the conveyance of equalization parcels, in accordance with paragraph (5) of the Agreement, shall occur not later than 45 days after the date of the identification of the appraised equalization parcels or portions of parcels to be conveyed to ensure that the exchange is of equal value.</text></paragraph></subsection></section><section id="ida1de58e4450843ada490c419700818f0"><enum>6.</enum><header>Withdrawals</header><subsection id="ida6bce6e1de8c49ab945561817ab8254d"><enum>(a)</enum><header>Withdrawal of Federal land from mineral entry prior to exchange</header><text>Subject to valid existing rights, the Federal land and interests in Federal land to be conveyed to the State under section 4(b) are withdrawn from mineral location, entry, and patent under the mining laws pending conveyance of the Federal land and interests in Federal land to the State.</text></subsection><subsection id="idb5b96878779d404fa99c8039da6d90ed"><enum>(b)</enum><header>Withdrawal of State land conveyed to the United States</header><text>Subject to valid existing rights, on the date of acquisition by the United States, the State land described in paragraph (2) of the Agreement acquired by the United States under section 4(b), to the extent not subject to previous withdrawals, is permanently withdrawn from all forms of appropriation and disposal under—</text><paragraph id="id114a5a61e6e74993987618f876413ac5"><enum>(1)</enum><text>the public land laws (including the mining and mineral leasing laws); and</text></paragraph><paragraph id="id9e6e753c4bc74cf19b64cda9afae3b43"><enum>(2)</enum><text>the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id93bd01feff434ab9933624515ade893b"><enum>(c)</enum><header>Withdrawal revocation</header><text>Any withdrawal of the parcels of Federal land and interests in Federal land described in paragraph (3) of the Agreement to be conveyed to the State under section 4(b) from appropriation or disposal under a public land law shall be revoked to the extent necessary to permit the conveyance of the Federal land parcel to the State free of any encumbrances associated with power site reserves or classifications.</text></subsection></section><section id="id0084bfd2135e4e8ea5560a992a4d5b98"><enum>7.</enum><header>Sunnyside, Utah, water supply provisions</header><text display-inline="no-display-inline">The Act of January 7, 1921 (41 Stat. 1087, chapter 13), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C54D7DD897F44E9B455D7C4A784044F"><section id="id936BFCBEFDDF42C78945ABA5C79E8A04"><enum>5.</enum><header>Certain exclusions</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, the provisions of this Act of shall not apply to the following: </text><paragraph id="idD27C5C9B707A4D1A98CFE8288226A017" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">S<fraction>1/2</fraction>SW<fraction>1/4</fraction> sec 34, T. 13 S., R. 14 E., of the Salt Lake Meridian.</text></paragraph><paragraph id="id20E8A1B218A149CBA330894A57F6FBEA" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Lots 1–4, T. 14 S., R. 14 E., sec. 11, S<fraction>1/2</fraction>N<fraction>1/2</fraction> and S<fraction>1/2</fraction>, of the Salt Lake Meridian.</text></paragraph><paragraph id="id2061848FCED146948224705BB5D4343B" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Lots 3 and 4, T. 14 S., R. 14 E., sec. 12, S<fraction>1/2</fraction>NW<fraction>1/4</fraction> and SW<fraction>1/4</fraction>, of the Salt Lake Meridian. </text></paragraph><paragraph id="idF6E58896A95D45D5A8D05D1F40DDE3D1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Lots 1 and 2, T. 14 S., R. 14 E., sec. 13, NE<fraction>1/4</fraction>, W<fraction>1/2</fraction>, and N<fraction>1/2</fraction>SE<fraction>1/4</fraction>, of the Salt Lake Meridian.</text></paragraph><paragraph id="idB6F1FB58028D4D66A26EED4642F371DF" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">T. 14 S., R. 14 E., sec. 14, of the Salt Lake Meridian.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
