which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Small Business Administration, in consultation with the Under Secretary of Commerce for Minority Business Development, to establish a grant program to create or expand programs at minority-serving institutions and historically Black colleges and universities that promote minority business ownership and entrepreneurship, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Minority Entrepreneurship Grant Program Act of 2023</short-title></quote>.</text></section><section id="id9CAD493A541944568DE5DEF4FEA577ED"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idF662944A64FC4ECFB058E507F3A3943D"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="id1E75B52F937A4F5489132E1813F2150B"><enum>(2)</enum><header>Board</header><text>The term <term>Board</term> means the Minority Entrepreneurship Advisory Board established under section 4(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD04DCF0AAA514ABE82C6B737208F45E0"><enum>(3)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> means a part B institution, as that term is defined in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9F79A35BC3DC40EEB8099865BEAE0B06"><enum>(4)</enum><header>Minority</header><text>The term <term>minority</term> includes an individual who is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id38B3EFF88B9F4FE597A0442EEEE4E316"><enum>(A)</enum><text>Black or African American;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8558944B6F64E8E8377DC9A29B275C6"><enum>(B)</enum><text>Hispanic or Latino;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7521AAC2800F4D4E8EE38E60EC18CCCD"><enum>(C)</enum><text>Native or Indigenous American;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFD98BD7DD6A546CA81B9A89B7B19B299"><enum>(D)</enum><text>Asian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id610932F6F8644CBD9C656D260F516836"><enum>(E)</enum><text>Native Hawaiian or other Pacific Islander;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id825FFFBA079A45E4A2DD473CB92F77EA"><enum>(F)</enum><text>Native Alaskan; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88E6AA12C18C49F0901FD883DEC6D664"><enum>(G)</enum><text>a member of a group that the Minority Business Development Agency of the Department of Commerce determines under part 1400 of title 15, Code of Federal Regulations, as in effect on November 23, 1984, is a socially disadvantaged group eligible to receive assistance.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAE55379FBA114141920728248604E74F"><enum>(5)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means any of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idA34A6F94BADC41CEA30935A09EC6E119"><enum>(A)</enum><text>A Hispanic-serving institution, as that term is defined in section 502(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1710380CD37345949BC1F3CFE94E3FA2"><enum>(B)</enum><text>A Tribal College or University, as that term is defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91D325B366914EF5B3495C1A015B6FB6"><enum>(C)</enum><text>An Alaska Native-serving institution, as that term is defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65C8492F3D85489AA54EB5680935D176"><enum>(D)</enum><text>A Native Hawaiian-serving institution, as that term is defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D0BB0AAF33C44F482FAA7E62063C2D9"><enum>(E)</enum><text>A Predominantly Black Institution, as that term is defined in section 318(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e(b)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id868D253BD64A483083E4CE5357C31620"><enum>(F)</enum><text>A Native American-serving, nontribal institution, as that term is defined in section 319(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059f">20 U.S.C. 1059f(b)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB6444F772E7B4D65B11AC4B42C763A64"><enum>(G)</enum><text>An Asian American and Native American Pacific Islander-serving institution, as that term is defined in section 320(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g(b)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4ECACAE5E5C4070813B62BA748E4692"><enum>(6)</enum><header>Program</header><text>The term <term>Program</term> means the grant program established under section 3(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9CCF0E8257B4D2782B9D364D80C2570"><enum>(7)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCD8F6D554EFE4103B6892B249694972E"><enum>(8)</enum><header>Student entrepreneur</header><text>The term <term>student entrepreneur</term> means a student who is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4085FF69120F4136874A29F25B693E56"><enum>(A)</enum><text>a minority;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1A764A1F00A24D13BE95B17E7D16214E"><enum>(B)</enum><text>enrolled at a minority-serving institution or a historically Black college or university; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD72884E52B7F4A53B33A09FF7C8C4AF7"><enum>(C)</enum><text>seeking to establish or develop a business.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e19af5207b34410811f9bdde25447d2"><enum>(9)</enum><header>Under Secretary</header><text>The term <term>Under Secretary</term> means the Under Secretary of Commerce for Minority Business Development.</text></paragraph></section><section id="id11366C58FC4B4B77A3A6B7682CE5165B"><enum>3.</enum><header>Grant program</header><subsection id="id081C2D018A2E47DFB94EF9DEBC498E59"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Under Secretary, shall establish a grant program within the Small Business Administration, the purpose of which shall be to create or expand programs at minority-serving institutions and historically Black colleges and universities that foster, promote, and increase opportunities for minority business ownership.</text></subsection><subsection id="idB4221984B1DC4B37B70218EC614D30DA"><enum>(b)</enum><header>Application process</header><text>A minority-serving institution or a historically Black college or university seeking a grant under the Program shall submit to the Administrator an application that contains a description of—</text><paragraph id="id69A65E5D66B74EE6A4D87D71B29C31EA"><enum>(1)</enum><text>the need for the grant funds to promote minority entrepreneurship and business ownership among student entrepreneurs enrolled at the minority-serving institution or the historically Black college or university; </text></paragraph><paragraph id="id4323514CE10A4B5BA92C4C9CD74F8987"><enum>(2)</enum><text>how the grant funds will be used to carry out the activities described in paragraph (1);</text></paragraph><paragraph id="idAB154E55C08D493A8AF7BC2BE72A0F90"><enum>(3)</enum><text>how the programs created or expanded with the grant funds will provide support to student entrepreneurs enrolled at the minority-serving institution or historically Black college or university who— </text><subparagraph id="id4268102360E044359D20E1DD6E931CB7"><enum>(A)</enum><text>seek support for an established business; or </text></subparagraph><subparagraph id="idD0A7C335775044A9B5DD26F0BBCFED2A"><enum>(B)</enum><text>need assistance in establishing a business; and</text></subparagraph></paragraph><paragraph id="id4EFC8927A4974C0A9E25B263677DD6C2"><enum>(4)</enum><text>how the minority-serving institution or historically Black college or university will create or expand programs or initiatives that— </text><subparagraph id="id148AD29A178A485EA828B1992604C155"><enum>(A)</enum><text>increase minority business ownership; and </text></subparagraph><subparagraph id="idC72EC42FBD944DF099F8AE2130D6E1E6"><enum>(B)</enum><text>expand business resources to student entrepreneurs enrolled at the minority-serving institution or historically Black college or university.</text></subparagraph></paragraph></subsection><subsection id="idF61A0C1BEA85453CBBC1C9FB27264FE5"><enum>(c)</enum><header>Amount of grant</header><text>A grant made to a minority-serving institution or a historically Black college or university under the Program shall be not less than $250,000.</text></subsection><subsection id="id550F3AF13D274833AA0E836B037E22A1"><enum>(d)</enum><header>Use of grant funds</header><text>With a grant received under the Program, a minority-serving institution or a historically Black college or university shall support the creation or expansion of programs or initiatives that offer business development resources that support student entrepreneurs enrolled at the minority-serving institution or historically Black college or university, such as— </text><paragraph id="idE36BF3647BBF474688FCB337776BC3A7"><enum>(1)</enum><text>free legal, accounting, human resources, information technology, marketing, training, counseling, networking, and technical assistance; and </text></paragraph><paragraph id="id2B01E69D48D140B0A21A52D7638664C2"><enum>(2)</enum><text>access to capital resources, such as the costs associated with forming a new business enterprise.</text></paragraph></subsection><subsection id="id891717E3B5FD4A1EBC3302BA9D5124FD"><enum>(e)</enum><header>MSI submission requirement</header><text>A minority-serving institution or historically Black college or university to which a grant is made under the Program shall, each year, submit to the Administrator a mid-year and year-end report, each of which shall contain, for the period covered by the report, the number of—</text><paragraph id="idB484E9866530467191EEC66E371692EF"><enum>(1)</enum><text>student entrepreneurs trained, assisted, and counseled with the grant funds;</text></paragraph><paragraph id="idF91DA9913F914365B31D4A6CF301A6C2"><enum>(2)</enum><text>businesses created through the expenditure of the grant funds, including, with respect to each such business—</text><subparagraph id="id11A9C6A33DF143DB9EBC73821EBD86C9"><enum>(A)</enum><text>the name of the business;</text></subparagraph><subparagraph id="idB662EAA984254588B702AB7E4AC69936"><enum>(B)</enum><text>a description of the business; and</text></subparagraph><subparagraph id="idADF3273F7A8E44B389CA6D1918174439"><enum>(C)</enum><text>the amount of grant funds expended in creating the business; </text></subparagraph></paragraph><paragraph id="id9D6514F263CB43B6B540B1EE2C3552C0"><enum>(3)</enum><text>student entrepreneurs referred to other resources of the Small Business Administration; and</text></paragraph><paragraph id="id598F1A2225BA49F5B0715CDB8A942ED0"><enum>(4)</enum><text>student entrepreneurs participating in programs created or expanded through the expenditure of the grant funds, which, to the extent possible, shall be disaggregated by sex, race, and ethnicity.</text></paragraph></subsection><subsection id="idF793D56E87FE401E91A9B31F3B37CBFA"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 18 months after the date on which the first grant is made under the Program, and annually thereafter, the Administrator shall submit to Congress a report that contains information regarding the minority-serving institutions and historically Black colleges or universities to which grants were made under the Program for the period covered by the report, which shall include—</text><paragraph id="idF3F0118420154D8E89E96A830B25D0F5"><enum>(1)</enum><text>the name of each such minority-serving institution and historically Black college or university and the amount of each such grant;</text></paragraph><paragraph id="idB884C4CC77BC433DB6AA5998C3EA818D"><enum>(2)</enum><text>the number of student entrepreneurs trained, assisted, and counseled with Program grant funds—</text><subparagraph id="idD180B878C09A490D8F9C08FB3C9C1FD8"><enum>(A)</enum><text>at each minority-serving institution and historically Black college or university to which a grant was made under the Program; and</text></subparagraph><subparagraph id="id016AD788370345A7B3B8951BA53EC394"><enum>(B)</enum><text>in total under the Program;</text></subparagraph></paragraph><paragraph id="id7D1A2CFC1DCB44EDBAA4CCF171D729E9"><enum>(3)</enum><text>the number of businesses created through the expenditure of Program grant funds—</text><subparagraph id="id11E6F58928BD446EA0F0CD73887011EA"><enum>(A)</enum><text>with respect to each minority-serving institution and historically Black college or university to which a grant was made under the Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDEE1408907B84F40BA98EFC868CB185D"><enum>(B)</enum><text>in total under the Program;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17EC87C1C9474BDEAFB789F51A8B4427"><enum>(4)</enum><text>the number of student entrepreneurs referred to resources of the Small Business Administration—</text><subparagraph id="idB635D66178D548AD81BC4FCD637E437A"><enum>(A)</enum><text>at each minority-serving institution and historically Black college or university to which a grant was made under the Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96BF7D5E437A45FBB9E18B6405ABEC10"><enum>(B)</enum><text>in total under the Program; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBCDDE98826E24FB4A0FBD84B1DE7CE32"><enum>(5)</enum><text>the number of student entrepreneurs participating in programs created or expanded through the expenditure of Program grant funds at each minority-serving institution and historically Black college or university to which a grant was made under the Program, and in total under the Program, which, to the extent possible, shall be disaggregated by sex, race, and ethnicity; and</text></paragraph><paragraph id="idE812B9EEECF744A5BBC1774FC4188FC4"><enum>(6)</enum><text>a statement regarding whether any amounts made available to carry out this section remain unexpended, as of the date on which the report is submitted.</text></paragraph></subsection><subsection id="idE84927616DB2413892BD0AB4A0C28884"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator $50,000,000 to carry out this section.</text></subsection></section><section id="id2314768414254AC9B83BDED5E69F7ADD"><enum>4.</enum><header>Advisory board</header><subsection id="id0B32864B13A246EB8B087E0DD666D1F4"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a Minority Entrepreneurship Advisory Board to develop recommendations regarding how minority-serving institutions and historically Black colleges and universities can better serve minority businesses and entrepreneurs.</text></subsection><subsection id="idF8557AAC18424444A86A9497873C907F"><enum>(b)</enum><header>Membership of Board</header><text>The members of the Board shall be— </text><paragraph id="idF628066637514653A0C32CCF3BAC1EC9"><enum>(1)</enum><text>appointed by the Administrator; and</text></paragraph><paragraph id="id5BB7A192B71845CA837AE70B27C9F920"><enum>(2)</enum><text>individuals with— </text><subparagraph id="id7426C091BD52442EA6E5055D55134EE3"><enum>(A)</enum><text>outstanding qualifications; </text></subparagraph><subparagraph id="id2F688B1EDABD4C168E82FF5ACF9D6B2C"><enum>(B)</enum><text>knowledge regarding the needs of small business concerns that are owned by minorities; and</text></subparagraph><subparagraph id="id4BA3B06ADCFC40A899178CDA554C410B"><enum>(C)</enum><text>experience— </text><clause id="id6615EACD96984B60931C62C16E515FA9"><enum>(i)</enum><text>working with startups; or </text></clause><clause id="id2E7171A7723443FDA06FA58F92326271"><enum>(ii)</enum><text>in providing consultation to small business concerns.</text></clause></subparagraph></paragraph></subsection><subsection id="id05BED2806B794CAAA3921BCDB99DE3B5"><enum>(c)</enum><header>Submission to Congress</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to Congress the recommendations developed by the Board under subsection (a).</text></subsection><subsection commented="no" id="idD53A26B06F2644738C00BC00A9E14EC0"><enum>(d)</enum><header>Inapplicability of Federal advisory committee requirements</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply with respect to the Board or the activities of the Board.</text></subsection></section></legis-body></bill>
