<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1398</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230502">May 2, 2023</action-date><action-desc><sponsor name-id="S417">Mr. Budd</sponsor> (for himself, <cosponsor name-id="S346">Mr. Lee</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S407">Mr. Hagerty</cosponsor>, <cosponsor name-id="S357">Mrs. Fischer</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit agencies of the government from soliciting or entering into agreements with nongovernmental organizations to conduct voter registration or voter mobilization activities on the property or website of the agency or from using Federal funds to carry out activities directed under Executive Order 14019, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H09C1BE9FAA4E41839FA3B8E146B20365"><section section-type="section-one" id="HA52B77EFD3364C9892F57F0A16E9911A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Free and Fair Elections Act</short-title></quote>.</text></section><section id="HEC8ABE0009AF40E996CE69F4E9E1AB4C"><enum>2.</enum><header>Prohibiting promotion of voter registration by agencies</header><subsection id="HD66AEF6AF1EF4C46A250256ED0446C0E"><enum>(a)</enum><header>Agreements with nongovernmental organizations</header><text display-inline="yes-display-inline">None of the funds made available for the salaries and expenses of an agency may be used to solicit or enter into an agreement with a nongovernmental organization to conduct voter registration or voter mobilization activities, including registering voters or providing any person with voter registration materials, absentee or vote-by-mail ballot applications, voting instructions, or candidate-related information, on the property or website of the agency. </text></subsection><subsection id="H135C3FF992834469A627BE92EA8AA4A9"><enum>(b)</enum><header>Activities under Executive Order 14019</header><paragraph id="H9B3C91A438F44AADAF11845C254E4098"><enum>(1)</enum><header>Delay in implementation</header><subparagraph id="HC1CD80B4724F423988CA5CBE4C1645D2"><enum>(A)</enum><header>Delay</header><text>Except as provided in subparagraph (B), none of the funds made available for the salaries and expenses of an agency may be used to implement activities directed under Executive Order 14019 (86 Fed. Reg. 13623) until—</text><clause id="HABA245A12FA24625A72EB4AB03C63434"><enum>(i)</enum><text>in the case of an agency that is required to submit a report to the appropriate congressional committees under paragraph (2)(A), 180 days after the agency submits the report; or</text></clause><clause id="H96383440364C4E318D044ED671B7B9F3"><enum>(ii)</enum><text>in the case of an agency that is required to submit a report to the appropriate congressional committees under paragraph (2)(B), the date on which the agency submits the report. </text></clause></subparagraph><subparagraph id="HDAEC9EEB83BE49C1A1BADA9055BC4FD9"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to any activity described in section 7(c) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20506">52 U.S.C. 20506(c)</external-xref>).</text></subparagraph></paragraph><paragraph id="H47CFDADEEBAA494E989C8C8BEAE3C2AC"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the head of each agency shall submit to the appropriate congressional committees—</text><subparagraph id="H2A231D74CC024348A47058049F18696B"><enum>(A)</enum><text>a copy of the strategic plan of the agency for promoting voter registration and voter participation under section 3(b) of Executive Order 14019 (86 Fed. Reg. 13623) that the agency developed or submitted to the Assistant to the President for Domestic Policy; or</text></subparagraph><subparagraph id="HF2870CEE4F284D14AEECAEFF2AFF9F53"><enum>(B)</enum><text display-inline="yes-display-inline">if the agency did not develop or submit a plan described in subparagraph (A) to the Assistant to the President for Domestic Policy, a certification signed by the head of the agency that the agency did not develop or submit such a plan.</text></subparagraph></paragraph></subsection><subsection id="H3E5191743AE64644B43F49767C38852C"><enum>(c)</enum><header>Effective date</header><text>Except as provided in subsection (b)(2), this section shall apply with respect to fiscal year 2023 and each succeeding fiscal year.</text></subsection></section><section id="H2D4B133A72F94DFE9A99A52270F343D8"><enum>3.</enum><header>Additional report on voter registration and mobilization</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the head of each agency shall submit to the appropriate congressional committees a report describing the activities carried out by the agency pursuant to sections 3 and 4 of Executive Order 14019 (86 Fed. Reg. 13623).</text></section><section id="id671d99a6c0724e74a628374c90094c00"><enum>4.</enum><header>Prohibiting voter registration and mobilization in Federal work-study programs</header><text display-inline="no-display-inline">Section 443(b)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-53">20 U.S.C. 1087–53(b)(1)</external-xref>) is amended—</text><paragraph id="id6b193b808a6449c2aea9e230d59f80ca"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote>;</text></paragraph><paragraph id="id0a0938bf18bc499a81d6a375a7045228"><enum>(2)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></paragraph><paragraph id="idc3619868659e4b0fa1f2876d049cd443"><enum>(3)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id545a067242734cc1b741712500cff4fe"><subparagraph id="id4581db50995844979a95a9ad73bb4b48"><enum>(D)</enum><text>does not involve registering or mobilizing voters on or off the campus of the institution; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H2D8AB4495B8740B39B18212735B5E38E"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id39F1EDAC3DAC4790AAC9D11D56277E56"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 3502(1) of title 44, United States Code, except that for purposes of section 2(b) of this Act such term does not include an independent regulatory agency as defined in section 3502(5) of title 44, United States Code.</text></paragraph><paragraph id="id7C82BFC3D26542629CB3D4138E0DA500"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id3FFB9478335A4F579D477172968F3334"><enum>(A)</enum><text>the Committee on Rules and Administration of the Senate; </text></subparagraph><subparagraph id="id2CEC70F136A84337A839AA9278E3C6CC"><enum>(B)</enum><text>the Committee on Judiciary of the Senate; </text></subparagraph><subparagraph id="id63B5D5A3092440D4A2278CF886CEF3E1"><enum>(C)</enum><text>the Committee on House Administration of the House of Representatives; and</text></subparagraph><subparagraph id="id4AAD418C14694E7F8611445A0DB3CBFD"><enum>(D)</enum><text>the Committee on Judiciary of the House of Representatives. </text></subparagraph></paragraph></section></legis-body></bill>
