which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to provide for the enrollment of citrus land in the conservation reserve program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation Reserve Program Amendments Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id713c701569e54eb0b225548ed6fa5a50"><enum>2.</enum><header>Conservation reserve program amendments</header><subsection commented="no" display-inline="no-display-inline" id="idb19770a08b794be98420813cdbd15481"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1231 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3279cfd8ee764442bc267da75af7a834"><enum>(1)</enum><text>in subsection (b)(5)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7cd65a96e24649d39db28e9c32554e9b"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8558cb41d23d46d6b1e60b1f8c751811"><enum>(B)</enum><text>in subparagraph (E), by inserting <quote>or</quote> at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id324d779595aa4773bfef3d514c8286a6"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddac8b1a92f044d049c6e73b7e5d3b37b"><subparagraph id="id0faac5cd4266418cbf698eee159bf031"><enum>(F)</enum><text>the land has, during the 10-year period preceding the date of enactment of this subparagraph, been used to plant a citrus crop;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id39c91747a5e2431f9c672eaa33d7e0c5"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide96779ed4bfd4fd992893573ad56269c"><subsection id="id674547d512e849328fbad1ac82f8bc33"><enum>(j)</enum><header>Citrus land</header><paragraph id="ide81f021246dc4e09b29b6a61b3dfec8f"><enum>(1)</enum><header>In general</header><text>In enrolling acres of citrus land described in subsection (b)(5)(F) in the conservation reserve, the Secretary shall enroll the land using the continuous enrollment procedure described in subsection (d)(6).</text></paragraph><paragraph id="idb84d77c7395a4b0790e969c68c168e8d"><enum>(2)</enum><header>Priority</header><text>In enrolling acres of citrus land described in subsection (b)(5)(F) in the conservation reserve, the Secretary may give priority to land that, as determined by the Secretary—</text><subparagraph id="id1fbf308456224b80aab4c3c41ab63d09"><enum>(A)</enum><text>is at risk of conversion or development;</text></subparagraph><subparagraph id="id105499d7687a4bb6802b7a3b05cce094"><enum>(B)</enum><text>is affected by huanglongbing; or</text></subparagraph><subparagraph id="id1a5a882106d44b5995799de3afefeacc"><enum>(C)</enum><text>is of ecological significance, including land that—</text><clause id="id2e8dde3129284f858c930d4ec08b6077"><enum>(i)</enum><text>may assist in the restoration of threatened or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="id849acd308a5141d88fb10767e047664b"><enum>(ii)</enum><text>may assist in preventing a species from being listed as a threatened or endangered species under that Act; or</text></clause><clause id="idf1a3f428cee54e84b0869a97b90338bc"><enum>(iii)</enum><text>improves or creates wildlife habitat corridors.</text></clause></subparagraph></paragraph><paragraph id="idb702f83e4afa4567a8bacda0b52a14c8"><enum>(3)</enum><header>Incidental land</header><text>In enrolling land in the conservation reserve, land owned by an owner of citrus land described in subsection (b)(5)(F) that is incidental to agricultural production may be considered for enrollment if the Secretary determines that the incidental land is at risk of conversion or development and is of ecological significance as described in paragraph (2)(C).</text></paragraph><paragraph id="id61363543b0bc49c9b1d892db07c44df3"><enum>(4)</enum><header>Fallow groves</header><text>Not later than 180 days after the later of the first day of the period of enrollment of citrus land described in subsection (b)(5)(F) in the conservation reserve and the date on which Secretary notifies an owner or operator of the decision of the Secretary to enroll citrus land described in subsection (b)(5)(F) in the conservation reserve, the owner or operator of the citrus land enrolled in the conservation reserve shall provide evidence to the Secretary that any fallow groves that are affected by huanglongbing within the enrolled area have been removed.</text></paragraph><paragraph id="idcf281fe42cef4dbda43b7300b6ec6825"><enum>(5)</enum><header>Duration of contracts</header><text>For the purpose of carrying out enrollment of citrus land described in subsection (b)(5)(F), the Secretary shall enter into contracts of not less than 1, and not more than 5, years.</text></paragraph><paragraph id="id4ffb33c8642a48e4bbd56ad99f85c592"><enum>(6)</enum><header>Limitations</header><text>For each of fiscal years 2024 through 2028, the total acreage of citrus land described in subsection (b)(5)(F) enrolled in the conservation reserve shall not exceed 100,000 acres.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idead5e6a93fc2436cac5b7219ee367beb"><enum>(b)</enum><header>Exclusion of adjusted gross income limitation</header><text>Section 1001D(b)(2)(C) of the Food Security Act of 1985 (7 U.S.C. 1308–3a(b)(2)(C)) is amended by striking <quote>the Food Security Act of 1985.</quote> and inserting <quote>this Act (other than a payment or benefit under the conservation reserve program under subchapter B of chapter 1 of subtitle D of that title with respect to citrus land described in section 1231(b)(5)(F)).</quote>.</text></subsection></section></legis-body></bill>
