which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Resources Development Act of 1992 and the Flood Control Act of 1968 to provide for provisions relating to collection and retention of user fees at recreation facilities, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lake Access Keeping Economies Strong Act</short-title></quote> or the <quote><short-title>LAKES Act</short-title></quote>.</text></section><section id="id32E0B00EDD68455DB03333D998B9E592"><enum>2.</enum><header>Challenge cost-sharing program for management of recreation facilities</header><text display-inline="no-display-inline">Section 225 of the Water Resources Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/33/2328">33 U.S.C. 2328</external-xref>) is amended—</text><paragraph id="id129224A0A7884A7981CB6F50E22EB01A"><enum>(1)</enum><text>by redesignating subsections (a) through (d) as subsections (b) through (e), respectively;</text></paragraph><paragraph id="id94BEB02B715643A8814359FF3A379326"><enum>(2)</enum><text>by inserting before subsection (b) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id66234D54861941ECB79E1DD6ED9C50CF"><subsection id="id9E34793A8D124FC0AC8D15C145C1D542"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBF045101DE55429B8ADE9A59C090A611"><enum>(1)</enum><header>Non-Federal public entity</header><text>The term <term>non-Federal public entity</term> means a non-Federal public entity as defined in the document of the Corps of Engineers entitled <quote>Implementation Guidance for Section 1155 of the Water Resources Development Act of 2016 (WRDA 2016), Management of Recreation Facilities</quote> and dated April 4, 2018. </text></paragraph><paragraph id="idEA123F62B3634ABDB5C3ED58C0E741E6"><enum>(2)</enum><header>Private nonprofit entity</header><text>The term <term>private nonprofit entity</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idF2E2D2E460D94A71B35A3A012BC51CDA"><enum>(3)</enum><text>in subsection (b) (as so redesignated), by striking the subsection designation and heading and all that follows through <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8416136D0E74D4C9394CFC785189F0E"><subsection id="idBC686B2BBD2F4B9097A8C6D7726D8ACB"><enum>(b)</enum><header>Authorization</header><text>The Secretary</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id3161CC622946448396C20027B7BA637B"><enum>(4)</enum><text>in subsection (c) (as so redesignated)—</text><subparagraph commented="no" id="idBBFF500EC4EC4B5BA9DD7BB7C84FAF74"><enum>(A)</enum><text>by striking the subsection designation and heading and all that follows through <quote>To implement</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id22C9C57C1EF54B839E02817B9E4B7C51"><subsection commented="no" id="idF5A5B3272B65479FA1F101BFADF8E41E"><enum>(c)</enum><header>Cooperative agreements</header><paragraph commented="no" id="id8FC10AD22F2C4176B4785DDFB5B58EC0"><enum>(1)</enum><header>In general</header><text>To implement</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id123C1001EEED4C94BF4DA6B4E4B3C755"><enum>(B)</enum><text>in paragraph (1) (as so designated), by striking <quote>non-Federal public and private entities</quote> and inserting <quote>non-Federal public entities and private nonprofit entities</quote>; and </text></subparagraph><subparagraph commented="no" id="id3339137028E5402FBE6095981735462E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idED6C7EEA9CC44734A5886A49CF24D1F5"><paragraph commented="no" id="idF37991BC3C12462AAA44031B8B12AADB"><enum>(2)</enum><header>Requirements</header><text>Before entering into an agreement under paragraph (1), the Secretary shall ensure that the non-Federal public entity or private nonprofit entity has the authority and capability—</text><subparagraph commented="no" id="id9DFCCD346F4D4E2AB7B6DD0585B03D5B"><enum>(A)</enum><text>to carry out the terms of the agreement; and</text></subparagraph><subparagraph commented="no" id="id34DB31B15C9E4E11A4FE744557D0CB6D"><enum>(B)</enum><text>to pay damages, if necessary, in the event of a failure to perform.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0CB95DC5679945F39C45D6641D0C54A6"><enum>(5)</enum><text>by striking subsection (d) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6AB2577608D74A3A9C90C99BAD58E34F"><subsection id="idD28BAAF445C04202B9BE9A82B12B5994"><enum>(d)</enum><header>User fees</header><paragraph id="idC44D6C198C054F07839F638A492E40B4"><enum>(1)</enum><header>Collection of fees</header><subparagraph id="idF249C2F98F4746C28E8E1FA1E53BCF75"><enum>(A)</enum><header>In general</header><text>The Secretary may allow a non-Federal public entity or private nonprofit entity that has entered into an agreement pursuant to subsection (c) to collect user fees for the use of developed recreation sites and facilities, whether developed or constructed by that entity or the Department of the Army. </text></subparagraph><subparagraph id="id07D948E7DA6F4279AADFA12D51C84174"><enum>(B)</enum><header>Use of visitor reservation services</header><clause id="idAF4CACE4301D444A9A7566D5439D7BC8"><enum>(i)</enum><header>In general</header><text>A non-Federal public entity or a private nonprofit entity described in subparagraph (A) may use, to manage fee collections and reservations under this section, any visitor reservation service that the Secretary has provided for by contract or interagency agreement, subject to such terms and conditions as the Secretary determines to be appropriate.</text></clause><clause id="idbc17112639ef4a65a07f580c4553457c"><enum>(ii)</enum><header>Transfer</header><text>The Secretary may transfer to a non-Federal public entity or a private nonprofit entity described in subparagraph (A), or cause to be transferred by another Federal agency, user fees received by the Secretary or other Federal agency under a visitor reservation service described in clause (i) for recreation facilities and natural resources managed by the non-Federal public entity or private nonprofit entity.</text></clause></subparagraph></paragraph><paragraph id="id6173C5ED227B45C78DB3A28076955184"><enum>(2)</enum><header>Use of fees</header><subparagraph id="id3000B104230443F69C92F6935436135F"><enum>(A)</enum><header>In general</header><text>A non-Federal public entity or private nonprofit entity that collects user fees under paragraph (1)—</text><clause id="idba6302b1693e48de9535d77685edc23d"><enum>(i)</enum><text>may retain up to 100 percent of the fees collected, as determined by the Secretary; and</text></clause><clause id="id9af3632b5c304589b33e20e3eeb30efa"><enum>(ii)</enum><text>notwithstanding section 210(b)(4) of the Flood Control Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/16/460d-3">16 U.S.C. 460d–3(b)(4)</external-xref>), shall use any retained amount for operation, maintenance, and management activities related to recreation and natural resources at the water resource development project at which the fee is collected. </text></clause></subparagraph><subparagraph id="idB86AB04736644F11AB32AB5AA6AF365F"><enum>(B)</enum><header>Requirements</header><text>The use by a non-Federal public entity or private nonprofit entity of user fees collected under paragraph (1) shall—</text><clause id="id306ADAE95800467C84D4DF92EC3046F8"><enum>(i)</enum><text>be limited to activities covered by an agreement between the entity and the Secretary; </text></clause><clause id="id3ABF075A743A4E369B796DA3E649C427"><enum>(ii)</enum><text>remain subject to the direction and oversight of the Secretary; and </text></clause><clause id="idB1F7C22A3BD74A66B5BEF037545E7DA0"><enum>(iii)</enum><text>not affect any existing third party property interests, leases, or agreements with the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id2ec30f9a9b51487a93b2ab1a42ab464a"><enum>(3)</enum><header>Terms and conditions</header><text>The authority of a non-Federal public entity or private nonprofit entity under this subsection shall be subject to such terms and conditions as the Secretary determines necessary to protect the interests of the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id0B44E066BEEB481684D6B7B2D664FFB7"><enum>(6)</enum><text>in subsection (e) (as so redesignated), in the first sentence, by striking <quote>non-Federal public and private entities</quote> and inserting <quote>non-Federal public entities, private nonprofit entities, and other private entities</quote>. </text></paragraph></section><section id="id7cdfcb257fe24822a231a60d06596ff4"><enum>3.</enum><header>Retention of recreation fees</header><subsection id="idad01400824b2465482ae90fb19317c8c"><enum>(a)</enum><header>In general</header><text>Section 210(b) of the Flood Control Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/16/460d-3">16 U.S.C. 460d–3(b)</external-xref>) is amended—</text><paragraph id="id834492432ac848a98e20270fc084454c"><enum>(1)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id10999f8c9781410f9b80b80bc9deb3a9"><paragraph id="id5e1103435e2442f89b1c767c5b8bf18d"><enum>(4)</enum><header>Deposit into Treasury account</header><text>All fees collected under this subsection shall—</text><subparagraph id="id60BAC50A47F1409F956FF3C47BC1E826"><enum>(A)</enum><text>be deposited in a special account in the Treasury; and </text></subparagraph><subparagraph id="id5F72DE46F5E04EEE963248912886ABD1"><enum>(B)</enum><text>be available for use, without further appropriation, for the operation and maintenance of recreation sites and facilities under the jurisdiction of the Secretary of the Army, subject to the condition that not less than 80 percent of fees collected at a specific recreation site are utilized at that site.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id46ee166980314047b4eda5a853cb691e"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB3DC79B5B3C24118B2531450AF8A39BE"><paragraph id="id882cfd48156049a793583a41016751f4"><enum>(5)</enum><header>Supplement, not supplant</header><text>Fees collected under this subsection—</text><subparagraph id="id2F83BCFEAB544D7994CBCB4B264E3644"><enum>(A)</enum><text>shall be in addition to annual appropriated funding provided for the operation and maintenance of recreation sites and facilities under the jurisdiction of the Secretary of the Army; and </text></subparagraph><subparagraph id="id5258FAA115A8438D876C846E54A26565"><enum>(B)</enum><text>shall not be used as a basis for reducing annual appropriated funding for those purposes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id89868201ef6b440a8cca8ee3bf52e41e"><enum>(b)</enum><header>Special accounts</header><text>Amounts in the special account for the Corps of Engineers described in section 210(b)(4) of the Flood Control Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/16/460d-3">16 U.S.C. 460d–3(b)(4)</external-xref>) (as in effect on the day before the date of enactment of this Act) that are unobligated on that date shall—</text><paragraph id="id4506D06016804FB688718BE3A4626C33"><enum>(1)</enum><text>be transferred to the special account established under section 210(b)(4) of the Flood Control Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/16/460d-3">16 U.S.C. 460d–3(b)(4)</external-xref>) (as amended by subsection (a)(1)); and</text></paragraph><paragraph id="idA4BB534887454810AE71C57E641E4BA7"><enum>(2)</enum><text>be available to the Secretary for operation and maintenance of any recreation sites and facilities under the jurisdiction of the Secretary, without further appropriation.</text></paragraph></subsection></section></legis-body></bill>
