which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240618">June 18, 2024</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To redesignate land within certain wilderness study areas in the State of Wyoming, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wyoming Public Lands Initiative Act of 2023</short-title></quote>.</text></section><section id="idA884F92251A647899C72232D3F51FFCC" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6085CD0811B14DB592766DD5B3BB3A89"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="id31487E4BE33740B18B99E0F17B11B038"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of the Interior.</text></paragraph><paragraph id="idB1D14EFDAB39471E9FF8B74191BE7F44"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau of Land Management.</text></paragraph><paragraph id="id96B5C52E29C74B6184B9E8622101FCF4"><enum>(4)</enum><header>Emergency</header><text>The term <term>emergency</term> means a situation that requires immediate action because of an imminent danger—</text><subparagraph id="id4D24D9CD2A184865A79517CA58673440"><enum>(A)</enum><text>to the health or safety of people; or</text></subparagraph><subparagraph id="id16CE4AA638C845E4B3BB2E8057DB7B7A"><enum>(B)</enum><text>of harm to property.</text></subparagraph></paragraph><paragraph commented="no" id="idB3751EA0068C48BF9712FA2802522F38"><enum>(5)</enum><header>Range improvement</header><text>The term <term>range improvement</term> has the meaning given the term in section 3 of the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1902">43 U.S.C. 1902</external-xref>).</text></paragraph><paragraph id="id78BF9410079F4400A7C6114975C4C486"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Wyoming.</text></paragraph></section><section id="idE5DEFFFCD7DB406099A78CC6A576073A" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Designation of land in Carbon County, Wyoming</header><subsection id="id511AFA198B6948B49415BC95CE77B1AB"><enum>(a)</enum><header>Designation of wilderness areas</header><paragraph id="id8DB5A307929A4ED698390841570FB73A"><enum>(1)</enum><header>Encampment River Canyon Wilderness</header><subparagraph id="idB3F6E707AAFC40C3963D65ECA6B98CD2"><enum>(A)</enum><header>Designation</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except as provided in subparagraph (B), the land within the boundaries of the Encampment River Canyon Wilderness Study Area is designated as wilderness and as a component of the National Wilderness Preservation System, to be known as the <quote>Encampment River Canyon Wilderness</quote> (referred to in this paragraph as the <quote>Wilderness</quote>).</text></subparagraph><subparagraph id="id31F0878A687E4A4DAFB52A0C2A10C4B2"><enum>(B)</enum><header>Excluded land</header><clause id="id9BA640EB2E214CAAB37D2D1AB47B88CB"><enum>(i)</enum><header>Definition of Water Valley Road</header><text>In this subparagraph, the term <term>Water Valley Road</term> means the road in Carbon County, Wyoming, that is 50 feet wide and 17,340 feet long, consisting of approximately 19.904 acres of land in T. 14 N., R. 84 W., including—</text><subclause id="id03d63244526b4429a50ca441334301be"><enum>(I)</enum><text>in sec. 22, land in—</text><item id="idE8D946FF7DB84C94A56F9BCAD1149211"><enum>(aa)</enum><text>the NE<fraction>1/4</fraction>SW<fraction>1/4</fraction>; and </text></item><item id="idFF626E24755D444E9C6B20508678B640"><enum>(bb)</enum><text>the S<fraction>1/2</fraction>SW<fraction>1/4</fraction>;</text></item></subclause><subclause id="id41aa37a465bc474bbd6fcca1b1763b5d"><enum>(II)</enum><text>in sec. 27, land in lots 4, 6, and 7 of the NW<fraction>1/4</fraction>SW<fraction>1/4</fraction>;</text></subclause><subclause id="id3ed620c79d6b481f9a1989d3d4c3e22f"><enum>(III)</enum><text>in sec. 28, land in lot 1 of the NE<fraction>1/4</fraction>SE<fraction>1/4</fraction>;</text></subclause><subclause id="id125cf1ec7d7d49f1a9ecf353c4ecbb42"><enum>(IV)</enum><text>in sec. 34, land in—</text><item id="id23E69F77801C45649DF2491120C0B366"><enum>(aa)</enum><text>the S<fraction>1/2</fraction>NE<fraction>1/4</fraction>; and</text></item><item id="id680B948FF48345B793F16AF4239E8480"><enum>(bb)</enum><text>the E<fraction>1/2</fraction>NW<fraction>1/4</fraction>; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ide0c65387046348569127ec901ec82b72"><enum>(V)</enum><text>in sec. 35, land in—</text><item commented="no" display-inline="no-display-inline" id="idC268EBA200DB4092AEB08E4955109951"><enum>(aa)</enum><text>the N<fraction>1/2</fraction>SW<fraction>1/4</fraction>; </text></item><item commented="no" display-inline="no-display-inline" id="id979607CAAB2A4994A7B0C177B944FEF4"><enum>(bb)</enum><text>the NW<fraction>1/4</fraction>SE<fraction>1/4</fraction>; and </text></item><item commented="no" display-inline="no-display-inline" id="id43BC13CE1D594CD190B40694D2CA5804"><enum>(cc)</enum><text>the S<fraction>1/2</fraction>SE<fraction>1/4</fraction>. </text></item></subclause></clause><clause id="id53E66F3C3CCA4653A1EDE372AC9F7CDF"><enum>(ii)</enum><header>Land excluded from the Wilderness</header><text>The following land is not included in the Wilderness:</text><subclause id="id4DB9AF29B2B34885B032B0C9F5D3F280"><enum>(I)</enum><text>Any land in the NW<fraction>1/4</fraction>NW<fraction>1/4</fraction>NW<fraction>1/4</fraction> sec. 24, T. 14 N., R. 84 W.</text></subclause><subclause id="id0E67C3F6D26F49AD81578C5AA7FDCD39"><enum>(II)</enum><text>Any land within 50 feet of the centerline of—</text><item id="id075F5E4ABAD44A4E8D294B2404391E4A"><enum>(aa)</enum><text>County Road 353; or</text></item><item id="id014E0F054EBA40D595C5EA78BB3E08BA"><enum>(bb)</enum><text>Water Valley Road.</text></item></subclause></clause></subparagraph><subparagraph id="idD7291CDA953F4B3A977A71F42BFB76E6"><enum>(C)</enum><header>Maintenance of roads</header><text>Necessary maintenance or repairs to County Road 353 or Water Valley Road (as defined in subparagraph (B)) shall be permitted after the date of enactment of this Act, consistent with the requirements of this subsection.</text></subparagraph><subparagraph id="id95B5D23F55234DCFA8A62FEA22B4923C"><enum>(D)</enum><header>Wildfire suppression</header><clause id="idE33741A5119F4FABAD4996664BC071CE"><enum>(i)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall establish a fire suppression plan for the protection of—</text><subclause id="idD4360540453E4E42B97D94F8AD82AE7A"><enum>(I)</enum><text>any individual or structure adjacent to the Wilderness; and</text></subclause><subclause id="id8E148AD46B9D42B7833968B5A71C01D4"><enum>(II)</enum><text>the population centers of—</text><item id="id8FFBD9C2DB6B4388B009DEEDD70EA852"><enum>(aa)</enum><text>Encampment, Wyoming; and</text></item><item id="idB9E2ECB120AD4C8C8D13344932EEC938"><enum>(bb)</enum><text>Riverside, Wyoming.</text></item></subclause></clause><clause id="idBD17961665E6496EB3A88FAB54F6A5ED"><enum>(ii)</enum><header>Coordination</header><text>In carrying out clause (i), the Director shall coordinate with—</text><subclause id="id62624700CB07435D8306AC5EAEF26A0B"><enum>(I)</enum><text>the Wyoming State Forestry Division; and</text></subclause><subclause id="id826AB7BB88084238B3C357F94B75D7F8"><enum>(II)</enum><text>Carbon County, Wyoming.</text></subclause></clause></subparagraph></paragraph><paragraph id="id4EE0EDF4A7B84BCCBD88244E566125FB"><enum>(2)</enum><header>Prospect Mountain Wilderness</header><subparagraph id="id3390A74FC8F644DB8BF137459AF7EF37"><enum>(A)</enum><header>Designation</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except as provided in subparagraph (B), the land within the boundaries of the Prospect Mountain Wilderness Study Area is designated as wilderness and as a component of the National Wilderness Preservation System, to be known as the <quote>Prospect Mountain Wilderness</quote> (referred to in this paragraph as the <quote>Wilderness</quote>).</text></subparagraph><subparagraph id="id0C80863CC69342C684A5F7DAE443639A"><enum>(B)</enum><header>Excluded land</header><text>Any land within 100 feet of the centerline of Prospect Road is not included in the Wilderness.</text></subparagraph><subparagraph id="id1F3F759BB2AE4725B5C9ECDBC9D24667"><enum>(C)</enum><header>Maintenance of Prospect Road</header><text>Necessary maintenance or repairs to Prospect Road shall be permitted after the date of enactment of this Act, consistent with the requirements of this subsection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF77678D80ADF48A2A54594764A85FDAA"><enum>(3)</enum><header>Management of wilderness areas</header><subparagraph id="idC0E18E0B895342CC9E14C2A652C7EE22"><enum>(A)</enum><header>Administration</header><text>Subject to valid existing rights, the wilderness areas designated in paragraphs (1) and (2) (referred to in this paragraph as the <quote>Wilderness Areas</quote>) shall be administered by the Director in accordance with—</text><clause id="id8B623D307CD54D26851C8F30CC4253BF"><enum>(i)</enum><text>this paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4A87183758E74FCCBE0ECCF38E74F89A"><enum>(ii)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF562104E34184DF0AE6A2521502D999A"><enum>(B)</enum><header>Grazing</header><text>Grazing of livestock in the Wilderness Areas, where established before the date of enactment of this Act, shall be allowed to continue in accordance with—</text><clause id="idCB11F0EB4FD44F8D859C58962E5187F2"><enum>(i)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id529B355A8045422EAC051F727D50DAFA"><enum>(ii)</enum><text>the guidelines set forth in the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 5487 of the 96th Congress (H. Rept. 96–617); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id53C428F12F674FAABE336FEAE68E7FC6"><enum>(iii)</enum><text>the guidelines set forth in appendix A of the Report of the Committee on Interior and Insular Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph id="id9A5E76F2C6FB4EBFB154863820BC9E49"><enum>(C)</enum><header>Review of policies, practices, and regulations</header><clause id="idD2DB8F984A3845D4AE17AFA0F4058F6C"><enum>(i)</enum><header>In general</header><text>To ensure that the policies, practices, and regulations of the Department conform to and implement the intent of Congress regarding forest fires and the outbreak of disease or insects, not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall review all policies, practices, and regulations of the Department applicable to the Wilderness Areas that pertain to—</text><subclause id="id91A27F5C9BA4497E90C006E841C6FA1C"><enum>(I)</enum><text>wildland fires, including the use of modern methods of fire suppression (including mechanical activity, as necessary); or</text></subclause><subclause id="idF3DC1A6C0D344D45BD989BEA61286C29"><enum>(II)</enum><text>the outbreak of disease or insect populations.</text></subclause></clause><clause id="idC88A17DB7E814E1F9E60901F9942D44F"><enum>(ii)</enum><header>Revisions</header><text>On completion of the review under clause (i), the Secretary of the Interior shall revise or develop policies, practices, and regulations for the Wilderness Areas—</text><subclause id="id9291924BBA7C457992600EE38B5E2730"><enum>(I)</enum><text>to ensure the timely and efficient control of fires, diseases, and insects in the Wilderness Areas, in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEA94253BBBDB4F45B1A7F4F62C6F9CF3"><enum>(II)</enum><text>to provide, to the maximum extent practicable, adequate protection from forest fires, disease outbreaks, and insect infestations to any Federal, State, or private land adjacent to the Wilderness Areas. </text></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98221252BBA74D02A7477E9676314245"><enum>(b)</enum><header>Designation of Bennett Mountains Special Management Area</header><paragraph commented="no" display-inline="no-display-inline" id="idD9EDFCA435884E718D7A246E3A8D7D26"><enum>(1)</enum><header>Designation</header><text>The land within the Bennett Mountains Wilderness Study Area is designated as the <quote>Bennett Mountains Special Management Area</quote> (referred to in this subsection as the <quote>Special Management Area</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDEA62B7337524EDDBF86A7CFC33DA809"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Director. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAED0D0F272BB45708106DF08365EF63C"><enum>(3)</enum><header>Roads; motorized vehicles</header><subparagraph commented="no" display-inline="no-display-inline" id="idF31EF348FA9341F3AB8E6B563E116E09"><enum>(A)</enum><header>Roads</header><clause commented="no" display-inline="no-display-inline" id="id67A5A6B63BCD4DDD90A77A982056F3BE"><enum>(i)</enum><header>Prohibition on new permanent roads</header><text>The construction of new permanent roads in the Special Management Area shall not be allowed.</text></clause><clause commented="no" display-inline="no-display-inline" id="idB1066F686D664255BA056BB56664D71A"><enum>(ii)</enum><header>Temporary roads</header><text>The Director may authorize the construction of new temporary roads to respond to an emergency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE59E5F6B6C74F29B4FE1BA6701C61DE"><enum>(B)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, to respond to an emergency, or to develop range improvements, the use of motorized and mechanized vehicles in the Special Management Area shall be allowed only on existing roads and trails designated for the use of motorized or mechanized vehicles by the travel management plan established under subparagraph (C).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idED1A81D4E7B44B359B1A36AC6ADA1803"><enum>(C)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall establish a travel management plan for the Special Management Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id096218BA64624DBF87CE02F7C6FEF0B8"><enum>(4)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered—</text><subparagraph commented="no" display-inline="no-display-inline" id="id92F7C78EC1884EE8A33AC0F2E49EB8BF"><enum>(A)</enum><text>as a nondiscretionary use; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5DD4825EB4B24CF4A44C85E017F99E1D"><enum>(B)</enum><text>in accordance with the laws generally applicable to land under the jurisdiction of the Bureau, including—</text><clause id="id2edbd1cb88b64615911d6ab077b4ed91"><enum>(i)</enum><text>the Act of June 28, 1934 (commonly known as the <quote>Taylor Grazing Act</quote>) (48 Stat. 1269, chapter 865; <external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315 et seq.</external-xref>);</text></clause><clause id="id4EDDF15FA40F41C5A6F9E13F098FAD07"><enum>(ii)</enum><text>the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and </text></clause><clause id="idB579E78B03EC4B9F812D7A192EADA78A"><enum>(iii)</enum><text>the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1901">43 U.S.C. 1901 et seq.</external-xref>). </text></clause></subparagraph></paragraph><paragraph id="id511027BF72E34A3FA0BE4F4DE50C9D7E"><enum>(5)</enum><header>Fire management and suppression</header><subparagraph id="idABAB1D6DE49745A9BF9D3924612BA212"><enum>(A)</enum><header>In general</header><text>The Director shall carry out fire management and suppression activities in the Special Management Area in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subparagraph><subparagraph id="id7FA0BFAF50B84E26BACB7AC1DADA649B"><enum>(B)</enum><header>Review of policies, practices, and regulations</header><clause id="idC8227730A369485389A1471D463292FA"><enum>(i)</enum><header>In general</header><text>To ensure that the policies, practices, and regulations of the Bureau conform to and implement the intent of Congress regarding forest fires, not later than 180 days after the date of enactment of this Act, the Director shall review all policies, practices, and regulations of the Bureau applicable to the Special Management Area that pertain to wildland fires, including the use of modern methods of fire suppression.</text></clause><clause id="id2E5068A121F248DEB00868185EE2FE66"><enum>(ii)</enum><header>Revision</header><text>On completion of the review under clause (i), the Director shall revise or develop policies, practices, and regulations for the Special Management Area—</text><subclause id="idC65EE6C948B1402598F15DC5F1B8E275"><enum>(I)</enum><text>to ensure the timely and efficient control of fires in the Special Management Area; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id935168A2D90F415AAAA0F3AFF2235404"><enum>(II)</enum><text>to provide, to the maximum extent practicable, adequate protection from forest fires to any Federal, State, or private land adjacent to the Special Management Area.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44969E9A90474881835C990D39DA1EAD"><enum>(6)</enum><header>Timber harvesting</header><text>Commercial timber harvesting shall not be allowed in the Special Management Area.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB50F9C4A36A44A4B9DE1DFF14164B0D3"><enum>(7)</enum><header>Withdrawal</header><subparagraph commented="no" display-inline="no-display-inline" id="id6AAB541500354329A600E1EB86D2C91F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from—</text><clause commented="no" display-inline="no-display-inline" id="id0EF983BC41AB448EA24271CBE70FE711"><enum>(i)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idABF94D0ADB6446439B2689740FC9E55A"><enum>(ii)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBD4B9BA14884BA09B8993BF396D0EB8"><enum>(B)</enum><header>Exception</header><text>The Secretary of the Interior may lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause commented="no" display-inline="no-display-inline" id="id6DF6BAB058CC4C40AD2DA630A1C092D3"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idCC47E2FB2E1B48FB88AF6D8CA91F236D"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id002151974D6C42B89F3BA144EB182BE1"><enum>(c)</enum><header>Designation of Black Cat Special Management Area</header><paragraph commented="no" display-inline="no-display-inline" id="id5ECCF469AB2D45E399D2AAB8D9E41BF4"><enum>(1)</enum><header>Designation</header><text>The land described in paragraph (2) is designated as the <quote>Black Cat Special Management Area</quote> (referred to in this subsection as the <quote>Special Management Area</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC871ADBB2D1A4EE4812CA7540A04B9CF"><enum>(2)</enum><header>Included land</header><text>The Special Management Area shall consist of—</text><subparagraph id="id887dea13176842d9b8668e6d6b9548e1"><enum>(A)</enum><text>the Federal land in T. 14 N., R. 81 W., sec. 35, that is managed by the Forest Service; and</text></subparagraph><subparagraph id="id8C76A5553A584162A1E0AC3997B42995"><enum>(B)</enum><text>the portions of T. 14 N., R. 81 W., secs. 26, 35, and 36, that are south and west of the North Platte River.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3DEA5744A6654E179C64DCCD8C016078"><enum>(3)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Secretary of Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42F4AC5073144AE5BC8F309129492ADB"><enum>(4)</enum><header>Roads; motorized vehicles</header><subparagraph commented="no" display-inline="no-display-inline" id="idAF88312553FA4A418DB47D96EC0AD7F6"><enum>(A)</enum><header>Roads</header><clause commented="no" display-inline="no-display-inline" id="idB24A7A3F8FE2412F84286F81D090DA18"><enum>(i)</enum><header>Prohibition on new permanent roads</header><text>The construction of new permanent roads in the Special Management Area shall not be allowed.</text></clause><clause commented="no" display-inline="no-display-inline" id="idA80142F47AE94FE3A0B13F271D4755EA"><enum>(ii)</enum><header>Temporary roads</header><text>The Secretary of Agriculture may authorize the construction of new temporary roads to respond to an emergency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63B4E34FABE6417F86059CA0CFB9BCC4"><enum>(B)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, to respond to an emergency, or to develop or maintain range improvements, the Secretary of Agriculture shall prohibit the use of motorized and mechanized vehicles in the Special Management Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01EC4DE004E4460EB7E79500E2056F59"><enum>(5)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Areas shall be administered—</text><subparagraph commented="no" display-inline="no-display-inline" id="idF5D5ECFA0D1246129E17BCA8CD47FD8E"><enum>(A)</enum><text>as a nondiscretionary use; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A360DC7FAF64DF786884A38DAC69160"><enum>(B)</enum><text>in accordance with the laws generally applicable to the National Forest System, including—</text><clause id="id3129B2F674A7485D9729A53C3681D476"><enum>(i)</enum><text>the Multiple-Use Sustained-Yield Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/16/528">16 U.S.C. 528 et seq.</external-xref>);</text></clause><clause id="id650D138978F54A76839F0B23D988E024"><enum>(ii)</enum><text>the Act of June 28, 1934 (commonly known as the <quote>Taylor Grazing Act</quote>) (48 Stat. 1269, chapter 865; <external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315 et seq.</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id88F877F87E634E3D97F3900C2AE8FDDA"><enum>(iii)</enum><text>the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1901">43 U.S.C. 1901 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id756AEC8387CD4F23B432CA4DD4EF5BC6"><enum>(6)</enum><header>Fire management and suppression</header><subparagraph id="idB362D6C4A5E04CDBB3DA99341998AA18"><enum>(A)</enum><header>In general</header><text>The Secretary of Agriculture shall carry out fire management and suppression activities in the Special Management Area—</text><clause id="id9E38C00BF93B44CC845FC97F647714F6"><enum>(i)</enum><text>in accordance with the laws generally applicable to—</text><subclause id="idDEFEFE838CAB47AEA4C63D5595A7F47B"><enum>(I)</enum><text>the National Forest System; and</text></subclause><subclause id="idACBEFC4E64A64A0DACED4A956FEA20E8"><enum>(II)</enum><text>the land within the boundaries of the Special Management Area; and</text></subclause></clause><clause id="id24488426CEA443CB893E638ED74311C5"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idCB1040BB5C7A45BC93C74EF88B2F7AC9"><enum>(I)</enum><text>if a land management plan has been established for the Special Management Area, in accordance with that land management plan; or</text></subclause><subclause id="id5BBF4771907E4D689F4FC1E376D572E4" indent="up1"><enum>(II)</enum><text>if a land management plan has not been established for the Special Management Area, in a manner consistent with land that is similarly situated to the land within the boundaries of the Special Management Area, as determined by the Secretary of Agriculture. </text></subclause></clause></subparagraph><subparagraph id="id921574AEBBAD40F58E4191C2A3C817F6"><enum>(B)</enum><header>Review of policies, practices, and regulations</header><clause id="id33021DC47F644A8D91203DEDD64A5A13"><enum>(i)</enum><header>In general</header><text>To ensure that the policies, practices, and regulations of the Department of Agriculture conform to and implement the intent of Congress regarding forest fires, not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall review all policies, practices, and regulations of the Department of Agriculture applicable to the Special Management Area that pertain to forest fires, including the use of modern methods of fire suppression.</text></clause><clause id="idA104CDAD1DF1402888562FE7106FCBC4"><enum>(ii)</enum><header>Revision</header><text>On completion of the review under clause (i), the Secretary of Agriculture shall revise or develop policies, practices, and regulations for the Special Management Area—</text><subclause id="id2E14E8C68BA24244884AAE1E08E86F2D"><enum>(I)</enum><text>to ensure the timely and efficient control of fires in the Special Management Area; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6F13AED4B2FF4F0AB31F989BC3E8DE60"><enum>(II)</enum><text>to provide, to the maximum extent practicable, adequate protection from forest fires to any Federal, State, or private land adjacent to the Special Management Area.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BA0B9BC3E6D4D1AB9D665F929D6F54D"><enum>(7)</enum><header>Timber harvesting</header><text>Commercial timber harvesting shall not be allowed in the Special Management Area.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD159DD7F2164061A174C95490C19BC4"><enum>(8)</enum><header>Withdrawal</header><subparagraph commented="no" display-inline="no-display-inline" id="id220AF954ED5D47ED9ECAAB2F692E845A"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from—</text><clause commented="no" display-inline="no-display-inline" id="idB3376F3D6C1C493E9D37BE7C40B224B3"><enum>(i)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id593F41C5E3344E58AA2A52F405ACD4DC"><enum>(ii)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E5EA227B5AA422983C68BD483F40CAB"><enum>(B)</enum><header>Exception</header><text>The Secretary of the Interior may, with the approval of the Secretary of Agriculture, lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause commented="no" display-inline="no-display-inline" id="idDC6C8DF974D547258AFC7C70EAA67953"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id02F94582EFE244D8AD35BABFC49F4027"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id52297D5269784A4E9F3D9F6C1F2FBFE0"><enum>(d)</enum><header>Release of wilderness study areas</header><paragraph commented="no" display-inline="no-display-inline" id="id964880C12F924A4EA73DE6F0C7236DD6"><enum>(1)</enum><header>Finding</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), any portion of a wilderness study area described in paragraph (2) that is not designated as wilderness by this section has been adequately studied for wilderness designation. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCA63874ECF14B9581982EF16DE11D02"><enum>(2)</enum><header>Description of land</header><text>The wilderness study areas referred to in paragraphs (1) and (3) are—</text><subparagraph commented="no" display-inline="no-display-inline" id="id47824A113FBC4CC6952D55E4DB3EFC7D"><enum>(A)</enum><text>the Encampment River Canyon Wilderness Study Area;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5F957BFE3F4E4267B19F69D971F14206"><enum>(B)</enum><text>the Prospect Mountain Wilderness Study Area; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBFC86126E92249B8B11BDE91F1316382"><enum>(C)</enum><text>the Bennett Mountains Wilderness Study Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id565A128F1A57476286D4C466924CDD56"><enum>(3)</enum><header>Release</header><text>Any portion of a wilderness study area described in paragraph (2) that is not designated as wilderness by this section is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34DECE6DAE614948BAC6CC04CF4E4A1D"><enum>(4)</enum><header>Management of released land</header><subparagraph commented="no" display-inline="no-display-inline" id="idCA9787BF07E24D1AA66BBAE304CEEB95"><enum>(A)</enum><header>Encampment River Canyon Wilderness Study Area</header><text>The Director shall manage the portion of the Encampment River Canyon Wilderness Study Area released under paragraph (3) in a manner consistent with a resource management plan that is applicable to any land that—</text><clause commented="no" display-inline="no-display-inline" id="id2C168E3B38CE48F287404D619D645988"><enum>(i)</enum><text>is adjacent to that released portion; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8F4102C9C180416EBB48268F6C851017"><enum>(ii)</enum><text>is not included in the Encampment River Canyon Wilderness designated under subsection (a)(1). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE4C944859174FC8ADECA2DC73FA0A72"><enum>(B)</enum><header>Prospect Mountain Wilderness Study Area</header><text>The portion of the Prospect Mountain Wilderness Study Area released under paragraph (3) shall be managed in accordance with—</text><clause commented="no" display-inline="no-display-inline" id="id0EF6946C927F40C78E71C67C9F8E82B0"><enum>(i)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idDFB0A1233FF14FECAE24E5B00DF30FD7"><enum>(ii)</enum><text>any other applicable law.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC8C6ABABBE7E41B9A1A6DF7845C70BA3"><enum>(C)</enum><header>Bennett Mountains Wilderness Study Area</header><text>The Director shall manage the portion of the Bennett Mountains Wilderness Study Area released under paragraph (3) in accordance with subsection (b).</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idCFC080311BB346ADB5E3880E95F2E89A" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>4.</enum><header>Designation of land in Fremont and Natrona Counties, Wyoming</header><subsection commented="no" display-inline="no-display-inline" id="idD0F74DFDDE164B019D1E218F723AD674"><enum>(a)</enum><header>Designation of Upper Sweetwater Canyon and Lower Sweetwater Canyon wilderness areas</header><paragraph commented="no" display-inline="no-display-inline" id="id036CDA146E1E4A139182F22B853A24C8"><enum>(1)</enum><header>Designation</header><subparagraph commented="no" display-inline="no-display-inline" id="idE7D70C001D1544D9B760EBC158F74C78"><enum>(A)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the land within the boundaries of the Sweetwater Canyon Wilderness Study Area is designated as wilderness and, as described in subparagraphs (B) and (C), as 2 components of the National Wilderness Preservation System, to be known as the <quote>Upper Sweetwater Canyon Wilderness</quote> (referred to in this subsection as the <quote>Upper Wilderness</quote>) and the <quote>Lower Sweetwater Canyon Wilderness</quote> (referred to in this subsection as the <quote>Lower Wilderness</quote>).</text></subparagraph><subparagraph id="id2b26df3d91234554865208b23283ed7b"><enum>(B)</enum><header>Upper Sweetwater Canyon Wilderness</header><clause id="id2CDD172E35F84E60B84AC7241BAABAEC"><enum>(i)</enum><header>Boundary</header><subclause id="id203FFAEA1E514B02A72BDC1B791492E4"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), the boundary of the Upper Wilderness shall conform to the boundary of the Sweetwater Canyon Wilderness Study Area.</text></subclause><subclause id="id6DEE43FCFBFD4F7E9859D7D6073F8FF3"><enum>(II)</enum><header>Eastern boundary</header><text>The eastern boundary of the Upper Wilderness shall be 100 feet from the western edge of the north-south road bisecting the Upper Wilderness and the Lower Wilderness, known as <quote>Strawberry Creek Road</quote>.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id44997E7F3CD54B3DB8C6C5BF8B016471"><enum>(ii)</enum><header>Exclusion of existing roads</header><text>Any established legal route with authorized motorized use in existence on the date of enactment of this Act that enters the Upper Wilderness in T. 28 N., R. 98 W., sec. 4, or the Lower Wilderness in T. 29 N., R. 97 W., sec. 33, is not included in the Upper Wilderness.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb93af25f48a04d61aa36739df4e4030d"><enum>(C)</enum><header>Lower Sweetwater Canyon Wilderness</header><clause commented="no" display-inline="no-display-inline" id="id8F4F185B56EB4910BB6B082DF0CF2F06"><enum>(i)</enum><header>Boundary</header><subclause commented="no" display-inline="no-display-inline" id="id4C9DC2F2A7D942F0A7B16AEBD9B48A03"><enum>(I)</enum><header>In general</header><text>Except as provided in subclauses (II) and (III), the boundary of the Lower Wilderness shall conform to the boundary of the Sweetwater Canyon Wilderness Study Area.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8C3DCB9753274DB6BE60682516AE1062"><enum>(II)</enum><header>Western boundary</header><text>The western boundary of the Lower Wilderness shall be 100 feet from the eastern edge of the north-south road bisecting the Upper Wilderness and the Lower Wilderness, known as <quote>Strawberry Creek Road</quote>.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEDB0EA1E1F8A4D7DB916DFFF28150FFE"><enum>(III)</enum><header>Northern boundary</header><text>The northern boundary of the Lower Wilderness shall begin where the bisecting road referred to in subclause (II) enters the Sweetwater Canyon Wilderness Study Area at the border of T. 29 N., R. 98 W., sec. 36, and T. 28 N., R. 98 W., sec. 2, and shall run east along the boundary of T. 29 N., R. 97 W., sec. 31, to the centerline of T. 29 N., R. 97 W., sec. 31, then north along that centerline to the midpoint of T. 29 N., R. 97 W., sec. 31, then east along that centerline to the boundary of T. 29 N., R. 97 W., sec. 32, then following the existing boundary of the Sweetwater Canyon Wilderness Study Area to the midpoint of T. 29 N., R. 97 W., sec. 32, then east along the centerline of T. 29 N., R. 97 W., secs. 32 and 33, to the existing boundary of the Sweetwater Canyon Wilderness Study Area.</text></subclause></clause><clause id="idA90DBBA9885B4FF0BE68A5813BC70782"><enum>(ii)</enum><header>Exclusion of existing roads</header><text>Any established legal route with authorized motorized use in existence on the date of enactment of this Act that enters the Upper Wilderness in T. 29 N., R. 98 W., sec. 4, or the Lower Wilderness in T. 29 N., R. 97 W., sec. 33, is not included in the Lower Wilderness.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id576A684CC2C54B95B99BB0D326D51D48"><enum>(2)</enum><header>Management</header><subparagraph id="idF0748F0223444FECB791C39667E9CD4F"><enum>(A)</enum><header>Administration</header><text>Subject to valid existing rights, the Upper Wilderness and the Lower Wilderness shall be administered by the Director in accordance with—</text><clause id="idC3FB121C1B8944F28170BAA068EC56AF"><enum>(i)</enum><text>this paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id860E00E8EBC547D68DDDCB5D4BA2C20B"><enum>(ii)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C119581AEA64486BDAFB515CF022616"><enum>(B)</enum><header>Grazing</header><text>Grazing of livestock in the Upper Wilderness and the Lower Wilderness, where established before the date of enactment of this Act, shall be allowed to continue in accordance with—</text><clause id="idB732618F34904771B01AEDD1241A33B2"><enum>(i)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id446252F1802148EB8B87794B104336EE"><enum>(ii)</enum><text>the guidelines set forth in the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 5487 of the 96th Congress (H. Rept. 96–617); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0E9E73E0E90B4172B6AFAF2D96D6AE15"><enum>(iii)</enum><text>the guidelines set forth in appendix A of the Report of the Committee on Interior and Insular Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84D498C8DBC447B7AE75CD7777C873AD"><enum>(C)</enum><header>Maintenance of existing roads</header><text>Necessary maintenance or repairs to any road described in subparagraph (B) or (C) of paragraph (1) shall be permitted after the date of enactment of this Act, consistent with the requirements of this subsection. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63F895B8201941ADBF14ECB621032ACE"><enum>(D)</enum><header>Range improvements</header><text>The construction, reconstruction, and maintenance of range improvements shall be allowed in the Upper Wilderness and the Lower Wilderness. </text></subparagraph><subparagraph id="id8e497b5659f341cb954f62d4dda276a0"><enum>(E)</enum><header>Buffer zones</header><clause id="id19b455cbd3424e1699d098facc1332a1"><enum>(i)</enum><header>In general</header><text>Nothing in this paragraph creates a protective perimeter or buffer zone around the Upper Wilderness or the Lower Wilderness.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7976c10cd68840cdb0de1a7b7c8b0878"><enum>(ii)</enum><header>Activities outside wilderness areas</header><text>The fact that an activity or use on land outside the Upper Wilderness or the Lower Wilderness can be seen or heard within the Upper Wilderness or the Lower Wilderness, respectively, shall not preclude the activity or use outside the boundary of the Upper Wilderness or the Lower Wilderness.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDB4EE7AB2C94FCFBC131CC14FA8D099"><enum>(3)</enum><header>Release of wilderness study area</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Sweetwater Canyon Wilderness Study Area not designated as wilderness by this subsection has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id78D15182977341CAB014FE7E27E5430F"><enum>(b)</enum><header>Designation of Sweetwater Rocks Special Management Area</header><paragraph commented="no" display-inline="no-display-inline" id="idEB4E789B00994227898AAF55364AAB89"><enum>(1)</enum><header>Designation</header><text>The land within the Lankin Dome, Split Rock, Savage Peak, and Miller Springs Wilderness Study Areas is designated as the <quote>Sweetwater Rocks Special Management Area</quote> (referred to in this subsection as the <quote>Special Management Area</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBC44BEB5E7D4CD9B027FBF9C43BD252"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Director in a manner that protects—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD0B96FEFC735485BA149BFC1666D1419"><enum>(A)</enum><text>valid existing rights;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDBCA980F60D84362B0AEC4DA927ED86D"><enum>(B)</enum><text>agricultural uses;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC853201218594D9AAFA9CAD738016228"><enum>(C)</enum><text>primitive recreational opportunities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id210B425B85CE4F5F921A7385D757DC9B"><enum>(D)</enum><text>natural, historic, and scenic resources.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id395BF529860142688CC2FBE27845720D"><enum>(3)</enum><header>Motorized vehicles</header><subparagraph commented="no" display-inline="no-display-inline" id="id020BD5C0A16647BFA036E6A40687F226"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the use of motorized vehicles in the Special Management Area shall be allowed only on established legal routes with authorized motorized use existing on the date of enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8A8C77A4A1D47DCAAE641C6247F8038"><enum>(B)</enum><header>Exceptions</header><text>Notwithstanding subparagraph (A), the use of motorized vehicles may be allowed in the Special Management Area for the construction, reconstruction, or maintenance of necessary infrastructure, as determined by the Director.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B75B202B1724CF699C649576990FC4B"><enum>(4)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C3C06023CE74B449213EEA974A96B4B"><enum>(5)</enum><header>Prohibition on certain overhead towers</header><text>No new overhead transmission or communications tower shall be constructed in the Special Management Area.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED33D7C16FF744DBB342F0D4149B2B94"><enum>(6)</enum><header>Underground rights-of-way</header><text>The Director may expand any underground right-of-way in the Special Management Area that exists as of the date of enactment of this Act.</text></paragraph><paragraph id="id569F09EA20FE426D990CDA5E5779ACDB"><enum>(7)</enum><header>Buffer zones</header><subparagraph id="idB592E4F302574E92B8C79E903FD59C09"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection creates a protective perimeter or buffer zone around the Special Management Area.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF9999E77C3F45D4BF0B117C42582D25"><enum>(B)</enum><header>Activities outside special management area</header><text>The fact that an activity or use on land outside the Special Management Area can be seen or heard within the Special Management Area shall not preclude the activity or use outside the boundary of the Special Management Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A1C2A3BC2824DE0B5A502C10B794E61"><enum>(8)</enum><header>Land exchanges and easements</header><subparagraph commented="no" display-inline="no-display-inline" id="id5B60942DA2474CAC93C0CB58DB7DC238"><enum>(A)</enum><header>Land exchanges</header><clause commented="no" display-inline="no-display-inline" id="id0B911A0C74494D9D89AB86E72C585CDE"><enum>(i)</enum><header>In general</header><text>The Director may propose to, and carry out with, an individual or entity owning land in the vicinity of the Special Management Area any land exchange that—</text><subclause commented="no" display-inline="no-display-inline" id="id654FA01318164553AEC363B21880D3FA"><enum>(I)</enum><text>increases access to the Special Management Area; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA52151F72D544434B976D2FF202D92D2"><enum>(II)</enum><text>does not result in a net loss of Federal land. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id95A8468AD0324F77A3A1AC7EC3770453"><enum>(ii)</enum><header>Process</header><text>The Director may carry out clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="idF61B5368184249B8A1CF90DC5E68ACF6"><enum>(I)</enum><text>through the use of existing processes; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id44D69010DA264B6EAC8B935C377BE072"><enum>(II)</enum><text>by establishing a process for proposing and carrying out land exchanges under that clause.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C3DBF9D1BAB4A96ADCC32DDBC231303"><enum>(B)</enum><header>Easements</header><text>Notwithstanding any other provision of law, the Director may acquire from an individual or entity owning land in the vicinity of the Special Management Area an easement for the purpose of increasing access to the Special Management Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3BFDE94756A4B8A88DD0C7293AF772D"><enum>(9)</enum><header>Withdrawals</header><subparagraph commented="no" display-inline="no-display-inline" id="id4099AB8F17604E47AC0A9D0E33F28042"><enum>(A)</enum><header>Mining, mineral, and geothermal withdrawal</header><clause commented="no" display-inline="no-display-inline" id="id49DACE15FBF048AC8606DBB41AB217A1"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from—</text><subclause commented="no" display-inline="no-display-inline" id="idC15DFC2D4DBF41EFB9F3DA24C18C8105"><enum>(I)</enum><text>location, entry, and patent under the mining laws; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id10BA6034F3E04AA9A38E4442BB7C72D7"><enum>(II)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idCA09E4DE1AE14102BD0350832FE7813E"><enum>(ii)</enum><header>Exception</header><text>The Secretary of the Interior may lease oil and gas resources within the boundaries of the Special Management Area if—</text><subclause commented="no" display-inline="no-display-inline" id="id643A52ECA3F44E299956AAF5BAB19F22"><enum>(I)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE5B066399D9742C5B90F47EEF2C37F97"><enum>(II)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9851B09569214D99A640C0D379F44BA4"><enum>(B)</enum><header>Wind and solar energy withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from right-of-way leasing and disposition under all laws relating to wind or solar energy. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF3DED157A9CA45C5B518F3F822DB3999"><enum>(10)</enum><header>Release of wilderness study areas</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Lankin Dome, Split Rock, Savage Peak, and Miller Springs Wilderness Study Areas has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEBC746D01E3344118C3BD73948CAD45E"><enum>(c)</enum><header>Release of the Dubois Badlands Wilderness Study Area</header><paragraph commented="no" display-inline="no-display-inline" id="id9F632FA24F864AFA9281F54A1E8DC053"><enum>(1)</enum><header>Division</header><text>The Director shall divide the land within the Dubois Badlands Wilderness Study Area by installing a fence, or repairing or relocating an existing fence, in T. 41 N., R. 106 W., sec. 5, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id205FF75B40EE4E7895736E514EC17C34"><enum>(A)</enum><text>follows existing infrastructure and natural barriers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB5DEFB6C79DD4EC9BC7A997DA6C01F38"><enum>(B)</enum><text>begins at an intersection with North Mountain View Road in the NE<fraction>1/4</fraction>NW<fraction>1/4</fraction> sec. 5, T. 41 N., R. 106 W.;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0112203F92EC4D2496A54914F44A66A5"><enum>(C)</enum><text>from the point described in subparagraph (B), proceeds southeast to a point near the midpoint of the NE<fraction>1/4</fraction> sec. 5, T. 41 N., R. 106 W.; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C58D38C9B02458AB6475E6570CE460A"><enum>(D)</enum><text>from the point described in subparagraph (C), proceeds southwest to a point in the SW<fraction>1/4</fraction>NE<fraction>1/4</fraction> sec. 5, T. 41 N., R. 106 W., that intersects with the boundary of the Dubois Badlands Wilderness Study Area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB1EE8B25C6BC48D1A01D830D226424CC"><enum>(2)</enum><header>Dubois Motorized Recreation Area</header><subparagraph commented="no" display-inline="no-display-inline" id="id0E629445E22D400C9E0E0BEA1947D19C"><enum>(A)</enum><header>Establishment</header><text>There is established the Dubois Motorized Recreation Area (referred to in this paragraph as the <quote>Recreation Area</quote>) in the State, to be managed by the Director.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22D0B4CC1F1749E6B6DFE79509B7BA44"><enum>(B)</enum><header>Area included</header><text>The Recreation Area shall consist of—</text><clause commented="no" display-inline="no-display-inline" id="id594BD16D24BD484EB439323BCE81F2A1"><enum>(i)</enum><text>any land within the boundaries of the Dubois Badlands Wilderness Study Area that is west of the fence described in paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5AC2A022CBD440F8A79FBCFD157874ED"><enum>(ii)</enum><text>any Federal land in T. 41 N., R. 106 W., secs. 5 and 6 that—</text><subclause commented="no" display-inline="no-display-inline" id="id72BCAE99491F446A8D4563A3614FCD95"><enum>(I)</enum><text>is managed by the Bureau; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC2D67DE6F13F4C2B96355FA44A44C069"><enum>(II)</enum><text>is west of North Mountain View Road.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE83A8F59C43D4091BBA2820C7BD766A6"><enum>(C)</enum><header>Management</header><clause commented="no" display-inline="no-display-inline" id="id2462590573C44C19926E050184739E0B"><enum>(i)</enum><header>Boundary fence</header><subclause commented="no" display-inline="no-display-inline" id="id5CB11AD7AD8F4D3E8E941619F3063D29"><enum>(I)</enum><header>In general</header><text>The Director shall construct a fence along the western boundary of the Recreation Area on any land that—</text><item commented="no" display-inline="no-display-inline" id="idB82203E30D7C4012955613A02E96B2E6"><enum>(aa)</enum><text>is managed by the Bureau; and</text></item><item commented="no" display-inline="no-display-inline" id="id3D1D734844194B0B97C0F9659BDD3DB5"><enum>(bb)</enum><text>is west of North Mountain View Road.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id070BE7BA432B45C796740DA2E8C66E6E"><enum>(II)</enum><header>Coordination</header><text>In designing, locating, and constructing the fence described in subclause (I), the Director shall coordinate with the owners of any land adjacent to the land described in that subclause.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9DE091C44901499DBF9F165EF6D7F164"><enum>(ii)</enum><header>Travel management plan</header><text>As soon as practicable after the date of completion of the fence described in clause (i), the Director shall establish a travel management plan for the Recreation Area to maximize the use of motorized off-road vehicles in the Recreation Area.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CB8BBCB8F7A4E63A97A9BD0294FF73A"><enum>(3)</enum><header>Dubois Badlands National Conservation Area</header><subparagraph commented="no" display-inline="no-display-inline" id="idB583FDC680874ACDB342F722AD693F25"><enum>(A)</enum><header>Establishment</header><text>There is established the Dubois Badlands National Conservation Area (referred to in this paragraph as the <quote>Conservation Area</quote>) in the State, to be managed by the Director.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id580EBF4594594B7FACA32812E99E5539"><enum>(B)</enum><header>Area included</header><text>The Conservation Area shall consist of any land within the boundaries of the Dubois Badlands Wilderness Study Area that is east of the fence described in paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D6C1E3EE8524B6CB431B461EDC5CA34"><enum>(C)</enum><header>Management</header><clause commented="no" display-inline="no-display-inline" id="id6D9EA25DE0764ABAB825C68211B07CA3"><enum>(i)</enum><header>In general</header><text>The Director shall manage the Conservation Area in a manner that protects—</text><subclause commented="no" display-inline="no-display-inline" id="id21CD7199384F487CA4CE3976604BFFD0"><enum>(I)</enum><text>valid existing rights;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idDBC5449E1DDF4320B855624017E3CB38"><enum>(II)</enum><text>agricultural uses;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id40043FFA950044B39DE6C2FB4E2D3B0D"><enum>(III)</enum><text>primitive recreational opportunities; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id81B9FC73A7904AD5B4A2316A5205640F"><enum>(IV)</enum><text>natural, historic, and scenic resources.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DE604EC601740E5A2F8FBEFC870E895"><enum>(D)</enum><header>Motorized vehicles</header><clause commented="no" display-inline="no-display-inline" id="id389CCEF31482472683EB996D70737656"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the use of motorized vehicles in the Conservation Area shall not be allowed.</text></clause><clause commented="no" display-inline="no-display-inline" id="id37FA02ED24A643348153A5FFD83533EE"><enum>(ii)</enum><header>Exceptions</header><text>The Director may allow the use of motorized vehicles in the Conservation Area for—</text><subclause commented="no" display-inline="no-display-inline" id="idD82750894A0F4A679290DBDF4F845C3F"><enum>(I)</enum><text>habitat improvement;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idABD545B3E28443B1B269C377060F712A"><enum>(II)</enum><text>the construction, reconstruction, or maintenance of range improvements; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE7985B7676964029BB74A126C86B3EF9"><enum>(III)</enum><text>to respond to an emergency.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9EB6ECFEC884F82BABFAEA3975AD8B2"><enum>(E)</enum><header>Grazing</header><text>Grazing of livestock in the Conservation Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id490E4FBA96F74C80B65530A3DE7BD6DF"><enum>(F)</enum><header>Rights-of-way</header><text>No major right-of-way shall be allowed within the boundaries of the Conservation Area.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2588FCA13CC4D8FB242E41FAAE1EDC0"><enum>(G)</enum><header>Withdrawal</header><clause commented="no" display-inline="no-display-inline" id="id5A1AA74862534F00BC38EBF3E1379BB1"><enum>(i)</enum><header>In general</header><text>Subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Conservation Area is withdrawn from—</text><subclause commented="no" display-inline="no-display-inline" id="idB5D4E4B24F7E40FDB49B566B2E3F8A19"><enum>(I)</enum><text>location, entry, and patent under the mining laws; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id72AF6A0B45C74676B1CE83A6C09C262F"><enum>(II)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id539E8F9882564ECF8040D539D4DADCF4"><enum>(4)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Dubois Badlands Wilderness Study Area has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id596B2A2C3F284D3B863ED796457A110C"><enum>(d)</enum><header>Release of certain wilderness study areas</header><paragraph commented="no" display-inline="no-display-inline" id="id7212E595445847D19CEEBDAE630CCEED"><enum>(1)</enum><header>Copper Mountain Wilderness Study Area</header><subparagraph commented="no" display-inline="no-display-inline" id="id052247698FDE4AB79749CAF2682329D2"><enum>(A)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Copper Mountain Wilderness Study Area—</text><clause commented="no" display-inline="no-display-inline" id="idC437687FDE0A4D7394FD51A42D92E674"><enum>(i)</enum><text>has been adequately studied for wilderness designation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id71D9DA0DC42C4905AF128FA8DFB2E5A0"><enum>(ii)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id17B4AA7D27324323B95AEE6754E5E1F0"><enum>(iii)</enum><text>shall be managed in accordance with this paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA3EA072BE34C4326B0A27675982178EA"><enum>(B)</enum><header>Management of released land</header><clause commented="no" display-inline="no-display-inline" id="id0AB9516894E542BDB130D86A41C2A294"><enum>(i)</enum><header>In general</header><text>The land described in subparagraph (A) shall be administered by the Director in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></clause><clause commented="no" display-inline="no-display-inline" id="id591DF3AEAD4747EFBA5E9B771BBF8EE5"><enum>(ii)</enum><header>Mineral leasing</header><subclause commented="no" display-inline="no-display-inline" id="idA57E63E72D264734A4FEA91641C2A6CE"><enum>(I)</enum><header>In general</header><text>Subject to surface occupancy requirements and any other provision of law, the Director may enter mineral leases for any land described in subparagraph (A) that has a slope of less than 25 percent.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF13D2632FE044129B988E59CADCFA03F"><enum>(II)</enum><header>Underground rights-of-way</header><text>The Director may grant underground rights-of-way for any mineral lease entered into under subclause (I).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idF02D0753BE0F4B299E9C5A0BCAFA36AC"><enum>(iii)</enum><header>Prohibition of certain leases</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Director shall not issue a new lease for a wind or solar project, an overhead transmission line, or a communication tower on the land described in subparagraph (A).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6154B54430A04553B59A35A017D1BE66"><enum>(C)</enum><header>Authority to exchange land</header><text>In carrying out any land exchange involving any of the land described in subparagraph (A), the Director shall ensure that the exchange does not result in a net loss of Federal land.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD0FF27FC4084330981D4BB3038D62E9"><enum>(2)</enum><header>Whiskey Mountain Wilderness Study Area</header><subparagraph commented="no" display-inline="no-display-inline" id="id5CFC95CE34F14D43A5987D6D5C8A07AE"><enum>(A)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Whiskey Mountain Wilderness Study Area—</text><clause commented="no" display-inline="no-display-inline" id="id837EC594EF724C51AA364581176D5992"><enum>(i)</enum><text>has been adequately studied for wilderness designation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idFE85F58C0DAE484F8BDE07452533D346"><enum>(ii)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id47EF9F817CC148209D60805C7BA26CB1"><enum>(iii)</enum><text>shall be managed in accordance with this paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1A0BEA8713624F5A8BDAEDA08432A3FA"><enum>(B)</enum><header>Management of released land</header><text>The land described in subparagraph (A) shall be administered by the Director in accordance with—</text><clause commented="no" display-inline="no-display-inline" id="id7A7E94B00D6D49B4B863AE3A84AB08E7"><enum>(i)</enum><text>a resource management plan that is applicable to any land adjacent to the land described in subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id144E527A20E84DDC83E31A662C38E1A4"><enum>(ii)</enum><text>the Whiskey Mountain Cooperative Agreement between the Wyoming Game and Fish Commission, the Forest Service, and the Bureau, including any amendment to that agreement relating to the management of bighorn sheep. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8162A224938148ADB1DC7F3778D3043E"><enum>(e)</enum><header>Management of land in Fremont County, Wyoming</header><paragraph commented="no" display-inline="no-display-inline" id="idD37A8B152AE5460997D74D7438C827B6"><enum>(1)</enum><header>Definition of County</header><text>In this subsection, the term <term>County</term> means Fremont County, Wyoming.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9C43C6683BB447B9656AB3175B7E1C9"><enum>(2)</enum><header>Lander slope and Red Canyon Areas of Environmental Concern</header><subparagraph commented="no" display-inline="no-display-inline" id="idA09BB14274A34B869E30A36CC7E3F83F"><enum>(A)</enum><header>Transfers</header><text>The Director shall pursue transfers in which land managed by the Bureau in the County is exchanged for land owned by the State that is within the boundaries of—</text><clause commented="no" display-inline="no-display-inline" id="id32AF37463CD9496681A89AC93CEC90F6"><enum>(i)</enum><text>the Lander Slope Area of Critical Environmental Concern; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id076D56A37B8041CA97B168062034B23D"><enum>(ii)</enum><text>the Red Canyon Area of Critical Environmental Concern.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFDA61A71456413D9C8CD9C87370E8EB"><enum>(B)</enum><header>Requirements</header><text>A transfer under subparagraph (A) shall—</text><clause commented="no" display-inline="no-display-inline" id="idBC8A41FC104E4864B156FB950EB57441"><enum>(i)</enum><text>comply with all requirements of law, including any required analysis; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id082CC95E6C194508AB0AF752B01B174E"><enum>(ii)</enum><text>be subject to appropriation.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD132889B4D7940899F58C7B106A9202C"><enum>(3)</enum><header>Study</header><subparagraph commented="no" display-inline="no-display-inline" id="idDCD3A928349B4285B5BEF5A9F578468B"><enum>(A)</enum><header>In general</header><text>The Director shall carry out a study to evaluate the potential for the development of special motorized recreation areas in the County.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDD99675911724EDA9E87EC19C12A4392"><enum>(B)</enum><header>Requirements</header><text>The study under subparagraph (A) shall evaluate—</text><clause commented="no" display-inline="no-display-inline" id="idBB46F922795A49E6961F791139A20306"><enum>(i)</enum><text>the potential for the development of special motorized recreation areas on all land managed by the Bureau in the County except—</text><subclause commented="no" display-inline="no-display-inline" id="id5E60B54559954213BD5D492CD4BFA5A6"><enum>(I)</enum><text>T. 40 N., R. 94 W., secs. 15, 17, 18, 19, 20, 21, 22, 27, 28, 29, and the N<fraction>1/2</fraction> sec. 34; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0D04FA8985EA4C82BDCCBBAE068D9086"><enum>(II)</enum><text>any land that is subject to a restriction on the use of off-road vehicles under any Federal law, including this Act;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3FAF16DF58174CBC9D06B81177BD9FE6"><enum>(ii)</enum><text>the suitability of the land for off-road vehicles, including rock crawlers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idEA44838AD2CF4A78A7CE91D58C63A005"><enum>(iii)</enum><text>the parking, staging, and camping necessary to accommodate special motorized recreation.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66EC14CAA5E3418A892CD0D9DA779D5E"><enum>(C)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the findings of the study under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id735E52BC6E39461CBCF23E4405964EC1"><enum>(4)</enum><header>Fremont County Implementation Team</header><subparagraph commented="no" display-inline="no-display-inline" id="id256F73A729F54EE3B055EAEF02E74636"><enum>(A)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of the Interior shall establish a team, to be known as the <quote>Fremont County Implementation Team</quote> (referred to in this paragraph as the <quote>Team</quote>) to advise and assist the Director with respect to the implementation of the management requirements described in this section that are applicable to land in the County.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9C850CB3A894572B34DC5207DE5EAB6"><enum>(B)</enum><header>Membership</header><text>The team shall consist of—</text><clause commented="no" display-inline="no-display-inline" id="id8629F5C633D54076AC788C35F5540D62"><enum>(i)</enum><text>the Secretary of the Interior (or a designee of the Secretary of the Interior); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1846FA69CCBD47789F3666822008C83C"><enum>(ii)</enum><text>1 or more individuals appointed by the Board of County Commissioners of the County.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7D23F78D5E1543E2B9DA287968B480C0"><enum>(C)</enum><header>Nonapplicability of the <enum-in-header>F</enum-in-header>ederal <enum-in-header>A</enum-in-header>dvisory <enum-in-header>C</enum-in-header>ommittee <enum-in-header>A</enum-in-header>ct</header><text>The team shall not be subject to the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote><act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></quote>).</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9EFBE66BF5D44A1D8EC75D2677173756" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>5.</enum><header>Designation of land in Johnson and Campbell Counties, Wyoming</header><subsection commented="no" display-inline="no-display-inline" id="id5641E1E8F3C8404FA71982926B2128FD"><enum>(a)</enum><header>Designations</header><paragraph commented="no" display-inline="no-display-inline" id="idFD5F8BF024FD46EFA1CB507CFF1787D7"><enum>(1)</enum><header>Fortification Creek Management Area</header><text>The land within the Fortification Creek Wilderness Study Area is designated as the <quote>Fortification Creek Management Area</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5C968DDE7DB049BA86EC53758A155B6E"><enum>(2)</enum><header>Fraker Mountain Management Area</header><text>The land within the Gardner Mountain Wilderness Study Area is designated as the <quote>Fraker Mountain Management Area</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99A3C428241649ACAD9F5C7ED1E70E0E"><enum>(3)</enum><header>North Fork Management Area</header><text>The land within the North Fork Wilderness Study Area is designated as the <quote>North Fork Management Area</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id79E1147454B3467CA88830769B16E5C5"><enum>(b)</enum><header>Management</header><paragraph commented="no" display-inline="no-display-inline" id="idDEFA44452F24427EB3F404B3BFB16E9B"><enum>(1)</enum><header>Administration</header><text>The management areas designated by subsection (a) (referred to in this subsection as the <quote>Management Areas</quote>) shall be administered by the Director in a manner that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idBA90941BA7B942FAB7EF3B7035CEEA3E"><enum>(A)</enum><text>promotes nonmotorized backcountry recreation, including hunting; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7A8E9A4C20842F08FE317EA643D80DC"><enum>(B)</enum><text>supports ongoing projects to maintain and improve—</text><clause commented="no" display-inline="no-display-inline" id="idB586106D827742FA9888C9240F5F9FD6"><enum>(i)</enum><text>wildlife habitat;</text></clause><clause commented="no" display-inline="no-display-inline" id="idAF0DCF2C8312445FAD0A1D9000063251"><enum>(ii)</enum><text>forest health;</text></clause><clause commented="no" display-inline="no-display-inline" id="id11C7D221631D4AA5BAB21FE2C5648937"><enum>(iii)</enum><text>watershed protection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idA175E6DE64EB49F5A437BA3E40BC2225"><enum>(iv)</enum><text>ecological and cultural values.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD93B8FDFEA0C4424830D3F4A7F3C111B"><enum>(2)</enum><header>Roads</header><subparagraph commented="no" display-inline="no-display-inline" id="idA9855B861F8E4CB8A0EB44698F32DCE0"><enum>(A)</enum><header>Prohibition on new permanent roads</header><text>The construction of new permanent roads in the Management Areas shall not be allowed.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28DB83625DBD4175AA37B48C6AAACC41"><enum>(B)</enum><header>Temporary roads</header><text>The Secretary of the Interior may authorize the construction of new temporary roads in the Management Areas—</text><clause commented="no" display-inline="no-display-inline" id="id38F16407CB06467AB7DB773F7061DE97"><enum>(i)</enum><text>for—</text><subclause commented="no" display-inline="no-display-inline" id="id003131215E0042B49E66CECCB70254C7"><enum>(I)</enum><text>fire suppression;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6A2EA7918A3D4D27842DB0F4DFFA1540"><enum>(II)</enum><text>forest health and restoration;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id005298F5A42440339F7360B5ACACF214"><enum>(III)</enum><text>weed and pest control;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idAB3FBC50A4BC4C2D8166BC7DFAF70089"><enum>(IV)</enum><text>habitat management;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA7BC7CDE6CB24A3A96672C51D9FBCCF2"><enum>(V)</enum><text>livestock management; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9A1BAC515E694DCF9D1E177C20CD5007"><enum>(VI)</enum><text>the construction, reconstruction, or maintenance of a range improvement; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9BE3F20DEA8146EA9B57E9F8D334AD5F"><enum>(ii)</enum><text>to respond to an emergency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4EF56D7550C3401AAC148E8E5EFDFF34"><enum>(3)</enum><header>Motorized vehicles</header><subparagraph commented="no" display-inline="no-display-inline" id="id9E771E2692694F56A58F88797B8E1ED5"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the use of motorized or mechanized vehicles in the Management Areas shall not be allowed.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44FF3CDD271548A6865982D9C4F7CA7E"><enum>(B)</enum><header>Exceptions</header><text>The Director may allow the use of motorized or mechanized vehicles in the Management Areas—</text><clause commented="no" display-inline="no-display-inline" id="idF5E37FB9B6B94C3983CEAF5980E63DCA"><enum>(i)</enum><text>for—</text><subclause commented="no" display-inline="no-display-inline" id="id1FF69F3066E4444588E7DB26E4A94899"><enum>(I)</enum><text>fire suppression;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE2E291646A5C442893700BA0FA82BCCE"><enum>(II)</enum><text>forest health and restoration;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id851D6139FF814CCF8B4082A968008295"><enum>(III)</enum><text>weed and pest control;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC34E7133899C4A4688E67F5FF374E8A7"><enum>(IV)</enum><text>habitat management;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2743B2EEE8E54E0E8A126665990FA101"><enum>(V)</enum><text>livestock management; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD98329F2932D4991B4D1F470FCEFF382"><enum>(VI)</enum><text>the construction, reconstruction, or maintenance of a range improvement; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idCA0A72FC83A647958C57AD250A010398"><enum>(ii)</enum><text>to respond to an emergency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC129E8D672E7491E9955E62612C8DA2C"><enum>(4)</enum><header>Grazing</header><text>Grazing of livestock in the Management Areas shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id497C917BFDBC41399FDC4D1615CECDB5"><enum>(5)</enum><header>Prohibition on certain infrastructure</header><text>The development, construction, or installation of infrastructure for recreational use shall not be allowed in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5C7CA53C4D4E4EEE9892333E82F8F99D"><enum>(A)</enum><text>the Fraker Mountain Management Area; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB91551452FC34476A2BAC57A15578CA5"><enum>(B)</enum><text>the North Fork Management Area. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4D5D3AE68F1B40FEA25907AB61FE2E55"><enum>(6)</enum><header>Withdrawal</header><subparagraph commented="no" display-inline="no-display-inline" id="id7B39C88976AF40A79D588CF45B912FD5"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Management Areas is withdrawn from—</text><clause commented="no" display-inline="no-display-inline" id="id928EBDD68BB549CC8AA695F9370816B2"><enum>(i)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8A55C2E9C05A4E2695F408B6A5ACF0E7"><enum>(ii)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1CD878D1076E43B19680B6838E768186"><enum>(B)</enum><header>Exception</header><text>The Secretary of the Interior may lease oil and gas resources within the boundaries of a management area designated by paragraph (1) if—</text><clause commented="no" display-inline="no-display-inline" id="id22F174398A42438A86C243E40A68CDB5"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the management area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id95E6DD3F6B754F019731AC5BD55523C7"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the management area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BA345B89DFA4C86BEE45369E126EC05"><enum>(7)</enum><header>Release of wilderness study areas</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Fortification Creek Wilderness Study Area, the Gardner Mountain Wilderness Study Area, and the North Fork Wilderness Study Area has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>). </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idA194083CE2FF429EB09E898350404A95" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>6.</enum><header>Designation of land in Washakie and Hot Springs Counties, Wyoming</header><subsection commented="no" display-inline="no-display-inline" id="id79BC504B70D44C7A835A124DCD25AEBE"><enum>(a)</enum><header>Designation of Bobcat Draw Wilderness</header><paragraph id="idABA1F47D57844C5F8E170AAD833D8655"><enum>(1)</enum><header>Designation</header><subparagraph id="idD542F3A5A5A548B1A15ED10F78318CD8"><enum>(A)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the approximately 6,200 acres of land within the Bobcat Draw Wilderness Study Area described in subparagraph (B) is designated as wilderness and as a component of the National Wilderness Preservation System, to be known as the <quote>Bobcat Draw Wilderness</quote> (referred to in this subsection as the <quote>Wilderness</quote>).</text></subparagraph><subparagraph id="id2034411BA0304AA4A20480D41E083AEB"><enum>(B)</enum><header>Included land</header><text>The Wilderness shall consist of—</text><clause id="id62F50A7744B14BAC9A71490A3DE78158"><enum>(i)</enum><text>in T. 48 N., R. 97 W., secs. 2, 3, 10, 11, 15, 22, 23, 26, and 27, any land in the Bobcat Draw Wilderness Study Area that is in Washakie County, Wyoming;</text></clause><clause id="idA02A5A4C318549DD8DC95B2F49D00770"><enum>(ii)</enum><text>in T. 48 N., R. 97 W., sec. 4, the land in—</text><subclause id="id7414353658774B5BBCD3AF4F3FDD888C"><enum>(I)</enum><text>the E<fraction>1/2</fraction>SE<fraction>1/4</fraction>;</text></subclause><subclause id="idA87C86D2209D4A1BAE57F51515F37F88"><enum>(II)</enum><text>lots 5, 6, 11, 12, 13 and 14 of the NE<fraction>1/4</fraction>;</text></subclause><subclause id="id3F180D3D2C0F4D97A68A446145A4926E"><enum>(III)</enum><text>the east <fraction>1/2</fraction> of lot 10 of the NW<fraction>1/4</fraction>; and</text></subclause></clause><clause id="id9DCA33D492494F66AF4603A7C7DBD8DC"><enum>(vi)</enum><text>in T. 48 N., R. 97 W., sec. 24, the land in—</text><subclause id="idE39A55955D0B4F3A8E3FFA8F7C819AB3"><enum>(I)</enum><text>the W<fraction>1/2</fraction>NW<fraction>1/4</fraction>; and</text></subclause><subclause id="id4EEC8CDDAF71481CA639F299ACF200C7"><enum>(II)</enum><text>that part of the NW<fraction>1/4</fraction>SW<fraction>1/4</fraction> within the boundary of the Bobcat Draw Wilderness Study Area.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF957B14D7F7A40459BC375CC946EFD1D"><enum>(2)</enum><header>Management</header><subparagraph id="idB688A39797C948009CB997654D9C9EFA"><enum>(A)</enum><header>Administration</header><text>Subject to valid existing rights, the Wilderness shall be administered by the Director in accordance with—</text><clause id="idA72EB650152A409E960776449ED6A856"><enum>(i)</enum><text>this paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3F2108677643417AA6D60416ABB55C1C"><enum>(ii)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5E0C45989CE941CB961F2A6ED2CA6821"><enum>(B)</enum><header>Grazing</header><text>Grazing of livestock in the Wilderness, where established before the date of enactment of this Act, shall be allowed to continue in accordance with—</text><clause id="ida8fdcf09d798481eae2b925a8973a32f"><enum>(i)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id9eb774a7be914707b4075677208eb3fd"><enum>(ii)</enum><text>the guidelines set forth in the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 5487 of the 96th Congress (H. Rept. 96–617); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id01aae83d69d540d5a7ea5511044b0ec7"><enum>(iii)</enum><text>the guidelines set forth in appendix A of the Report of the Committee on Interior and Insular Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></clause></subparagraph><subparagraph id="id0F93A601E47445F1B56ADEE92FF69440"><enum>(C)</enum><header>Review of policies, practices, and regulations</header><clause id="id02776CC24681420E8440EEC9FDAE29DE"><enum>(i)</enum><header>In general</header><text>To ensure that the policies, practices, and regulations of the Department conform to and implement the intent of Congress regarding forest fires and the outbreak of disease or insects, not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall review all policies, practices, and regulations of the Department applicable to the Wilderness that pertain to—</text><subclause id="idDA68F132397A42B39FDD4CC1E84D2F88"><enum>(I)</enum><text>forest fires, including the use of modern methods of fire suppression (including mechanical activity, as necessary); or </text></subclause><subclause id="id4AA918A920504EF1A78DEFAC8198C58B"><enum>(II)</enum><text>the outbreak of disease or insect populations.</text></subclause></clause><clause id="id7EE01EEA90314534BFB59C0B91815189"><enum>(ii)</enum><header>Revisions</header><text>On completion of the review under clause (i), the Secretary of the Interior shall revise or develop policies, practices, and regulations for the Wilderness—</text><subclause id="id76A6FB4D095E4E30BE56248053C36264"><enum>(I)</enum><text>to ensure the timely and efficient control of fires, diseases, and insects in the Wilderness; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idACEC4B13E2244BA8B429691A56E34792"><enum>(II)</enum><text>to provide, to the maximum extent practicable, adequate protection from forest fires, disease outbreaks, and insect infestations to any Federal, State, or private land adjacent to the Wilderness. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31CCEC8C65B14AC785A049CF43085A12"><enum>(3)</enum><header>Release of wilderness study area</header><subparagraph commented="no" display-inline="no-display-inline" id="id0307A68A9AD448658E2B73662EB79A82"><enum>(A)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Bobcat Draw Wilderness Study Area not designated as wilderness by this subsection has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCFEBE16E252D4EB6B5CC66CF72DFF50E"><enum>(B)</enum><header>Classification and management of released land</header><clause commented="no" display-inline="no-display-inline" id="id8B7E334AC3F6424B8D7B27FA0651DE54"><enum>(i)</enum><header>Classification</header><text>The Director shall designate the land described in subparagraph (A) as visual resource management class II.</text></clause><clause commented="no" display-inline="no-display-inline" id="idAE3C08C2AA884758961151B29CC62807"><enum>(ii)</enum><header>Grazing</header><text>Grazing of livestock on the land described in subparagraph (A) shall be administered—</text><subclause commented="no" display-inline="no-display-inline" id="id031427E14E0141FD8C9BBA290573C3F2"><enum>(I)</enum><text>as a nondiscretionary use; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7A3D5A335EBC405E9459FE30E67E88F0"><enum>(II)</enum><text>in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8CE65ABDAFFE4D0FB121AC38F6537B8D"><enum>(C)</enum><header>Travel management plan</header><clause commented="no" display-inline="no-display-inline" id="idC0F37F845BF74E679760DC15AEB8724F"><enum>(i)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall develop a travel management plan for the land described in subparagraph (A).</text></clause><clause commented="no" display-inline="no-display-inline" id="id52910F71B80C4539BA7A79392C6C52F9"><enum>(ii)</enum><header>Requirements</header><text>The travel management plan under clause (i) shall—</text><subclause commented="no" display-inline="no-display-inline" id="id8441AEDA43B44DE892FC549E30C55C1D"><enum>(I)</enum><text>identify all existing roads and trails on the land described in subparagraph (A);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC434F1A4D0184BDFBCDAB2B23E2685DF"><enum>(II)</enum><text>designate each road or trail available for—</text><item commented="no" display-inline="no-display-inline" id="id169AD5D827494E14B172ADCE64846FEB"><enum>(aa)</enum><text>motorized or mechanized recreation; or</text></item><item commented="no" display-inline="no-display-inline" id="id4600F9D9F2CA4B8292EA5ACAA4060CCA"><enum>(bb)</enum><text>agriculture practices;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idDC658400122B4FF4996B104721EA276B"><enum>(III)</enum><text>prohibit the construction of any new road or trail for motorized or mechanized recreation use; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1716E0043B1B4C6BA146AA043D2E29D9"><enum>(IV)</enum><text>permit the continued use of nonmotorized trails.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA09DC1B989844678B8437B477BDD01B"><enum>(D)</enum><header>Withdrawal</header><clause commented="no" display-inline="no-display-inline" id="id50531FEAB59F4580A144F741F9A6E383"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), subject to valid rights in existence on the date of enactment of this Act, the land described in subparagraph (A) is withdrawn from—</text><subclause commented="no" display-inline="no-display-inline" id="idA1E2B26FDF66450B9A2639E0DFE80876"><enum>(I)</enum><text>location, entry, and patent under the mining laws; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id04443057A20E4CE6871252A46F1DEA84"><enum>(II)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id56292498FC6B433AADF664D5DA987BB8"><enum>(ii)</enum><header>Exception</header><text>The Secretary of the Interior may lease oil and gas resources within the land described in subparagraph (A) if—</text><subclause commented="no" display-inline="no-display-inline" id="id369A310523294C9AB8B7E1681C171751"><enum>(I)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the land described in subparagraph (A); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1E2C7AC64FE74D678AC1B48F1CA8DDA7"><enum>(II)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance on the land described in subparagraph (A) for any activities, including activities related to exploration, development, or production.</text></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id27EF548BC4144D2E983B3E8FF64EDE55"><enum>(b)</enum><header>Designation of Cedar Mountain Special Management Area</header><paragraph commented="no" display-inline="no-display-inline" id="id773AD062B6AC442C8B75AB95EE90467D"><enum>(1)</enum><header>Designation</header><subparagraph commented="no" display-inline="no-display-inline" id="idC8D468A08C26468AA1CD9A0A3A6834F7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the land within the Cedar Mountain Wilderness Study Area is designated as the <quote>Cedar Mountain Special Management Area</quote> (referred to in this subsection as the <quote>Special Management Area</quote>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1E8383B10314AAE972C8C0F1FF35DCC"><enum>(B)</enum><header>Excluded land</header><clause commented="no" display-inline="no-display-inline" id="idBFB8869E3B2D443F884CE013B52336E6"><enum>(i)</enum><header>In general</header><text>The land described in clause (ii) is not included in the Special Management Area.</text></clause><clause commented="no" display-inline="no-display-inline" id="id837C850A49C54BEF8768D57DC8A2F0AE"><enum>(ii)</enum><header>Land described</header><text>The land referred to in clause (i) is the land designated by the Bureau as not suitable for wilderness in—</text><subclause id="idf4a46620509e46d49c411682c2b2a435"><enum>(I)</enum><text>the NE<fraction>1/4</fraction>NW<fraction>1/4</fraction> sec. 5, T. 44 N., R. 94 W;</text></subclause><subclause id="id6730b62b60a14f1d9dfd31f39ee361ed"><enum>(II)</enum><text>the NE<fraction>1/4</fraction>SE<fraction>1/4</fraction> sec. 5, T. 44 N., R. 94 W;</text></subclause><subclause id="id080131af6db34bacb51e5a46bdfbb502"><enum>(III)</enum><text>the SW<fraction>1/4</fraction>NE<fraction>1/4</fraction> sec. 5, T. 44 N., R. 94 W; and</text></subclause><subclause id="id272d3a5ab75d48cfad6675732e74f8fe"><enum>(IV)</enum><text>the SW<fraction>1/4</fraction>SW<fraction>1/4</fraction> sec. 32, T. 45 N., R. 94 W. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21A54A97C96744F5B8971B83327D9BB4"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Director in a manner that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD5B02820AAFF49098D18E46EC9592490"><enum>(A)</enum><text>maintains the recreational, scenic, cultural, ecological, wildlife, and livestock production values of the Special Management Area; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98BDDF571A954C58BC47B3552D882DA6"><enum>(B)</enum><text>promotes continued use of the Special Management Area for recreational activities, including hunting and wildlife viewing.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC933F4ADABC74D9EA07CAB0664C911E8"><enum>(3)</enum><header>Travel management plan</header><subparagraph commented="no" display-inline="no-display-inline" id="idAEF1A989837049B1AF8755F09B63F4DC"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall develop a travel management plan for the Special Management Area.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB08A43DC5953452A8BD439F2F15CC6CA"><enum>(B)</enum><header>Requirements</header><text>The travel management plan under subparagraph (A) shall—</text><clause commented="no" display-inline="no-display-inline" id="id249713BF0E6549998EAF842651F473AE"><enum>(i)</enum><text>identify all existing roads and trails in the Special Management Area;</text></clause><clause commented="no" display-inline="no-display-inline" id="id75FC58E11A94478EAF8812CAC228CCE4"><enum>(ii)</enum><text>designate each road or trail available for—</text><subclause commented="no" display-inline="no-display-inline" id="id1284FCB9459142E490E1347F55E5631C"><enum>(I)</enum><text>motorized or mechanized recreation; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id578DABFCC4D54491AD212F136EE1272D"><enum>(II)</enum><text>agriculture practices;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEBD878B639E14581BFC8E14DF6C0081C"><enum>(iii)</enum><text>prohibit the construction of any new road or trail for motorized or mechanized recreation use; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id98ECC6D015764A969AB623F7DC947070"><enum>(iv)</enum><text>permit the continued use of nonmotorized trails.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B7F03206DCC45F4BB2273E4CD0864B5"><enum>(4)</enum><header>Motorized vehicles</header><subparagraph commented="no" display-inline="no-display-inline" id="id07A41A18D3484AF2A93C5FA886DEA0D6"><enum>(A)</enum><header>Use of motorized vehicles for livestock</header><text>The use of motorized vehicles shall be allowed on any road in the Special Management Area for—</text><clause commented="no" display-inline="no-display-inline" id="id8E3527CD9A4149B797BBFFE2F2866873"><enum>(i)</enum><text>the construction, reconstruction, or maintenance of range improvements; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7EED9A6596644B66B3575B63A7E68C57"><enum>(ii)</enum><text>other livestock-management purposes.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAB1EAB4CD74B48B4A47F9C2401EE200D"><enum>(B)</enum><header>Use of motorized vehicles for emergencies</header><text>The use of motorized vehicles shall be allowed in the Special Management Area—</text><clause commented="no" display-inline="no-display-inline" id="idC21846DEF6FA4A038F0E59D7287371A3"><enum>(i)</enum><text>for fire suppression;</text></clause><clause commented="no" display-inline="no-display-inline" id="idC12D14DBBEDF4F45AD5FDF3771783DF9"><enum>(ii)</enum><text>for weed and pest management; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idABDD0B3473994A149964A25B99E6EF93"><enum>(iii)</enum><text>to respond to an emergency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51773D4B5DC1483C810F2906D5A78D17"><enum>(5)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9DCE0D1452164375BB3E4FB7C45E6892"><enum>(A)</enum><text>as a nondiscretionary use; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3628D40CC2A1461482B33DA892122639"><enum>(B)</enum><text>in accordance with the laws generally applicable to land under the jurisdiction of the Bureau. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id124CE2B616EA42C98549A74BD61B6EF6"><enum>(6)</enum><header>Withdrawal</header><subparagraph commented="no" display-inline="no-display-inline" id="id3647038AD08442969B74F12F671B9847"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from—</text><clause commented="no" display-inline="no-display-inline" id="id56F16610A98849179CB65BCAD9F70943"><enum>(i)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idB3D27DD0A99448C8A9043DF8E070C713"><enum>(ii)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8272F2AFAF2648E7960B903D6113D905"><enum>(B)</enum><header>Exception</header><text>The Secretary of the Interior may lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause commented="no" display-inline="no-display-inline" id="id7C6C9B9AC0764FDBBE457DF5412E4BC9"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD380E6107A1A48DE8F5440354709F954"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCFA40A38A1C94EF1B710AB677CC09352"><enum>(7)</enum><header>Release of wilderness study area</header><subparagraph commented="no" display-inline="no-display-inline" id="id0B0C63DFC7D64DF58024F8BF134D492F"><enum>(A)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Cedar Mountain Wilderness Study Area has been adequately studied for wilderness designation and is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id702DF8434D294C078ECA8C872E900085"><enum>(B)</enum><header>Management of certain released land</header><text>The Director shall manage any land described in subparagraph (A) that is not included in the Special Management Area in a manner consistent with a resource management plan that is applicable to any land that—</text><clause commented="no" display-inline="no-display-inline" id="idC6B2B8B724CA4359A2B619A5DE9011F6"><enum>(i)</enum><text>is managed by the Bureau; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3A55E63A18424F2694B80EF26148DEB4"><enum>(ii)</enum><text>is similarly situated to the land described in subparagraph (A) that is not included in the Special Management Area.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE3CE2F93DD554321AE77DC8F8F1B846E"><enum>(c)</enum><header>Release of Honeycombs Wilderness Study Area</header><paragraph commented="no" display-inline="no-display-inline" id="idD3603824452E45DE9A521C3179E9A0D4"><enum>(1)</enum><header>Release</header><text>Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the land within the Honeycombs Wilderness Study Area—</text><subparagraph commented="no" display-inline="no-display-inline" id="id62EB0B9AEA374B69B405B2AA35150708"><enum>(A)</enum><text>has been adequately studied for wilderness designation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB633EB4AF05047529C2C17A8F156E286"><enum>(B)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEB8BAAC15EF6429F8120C8EA0192168D"><enum>(C)</enum><text>shall be managed in accordance with this subsection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE71E0D5D40F4004807C6A9A9B733062"><enum>(2)</enum><header>Management of released land</header><text>The land described in paragraph (1) shall be administered by the Director in accordance with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id94CC20EC959847EAA072164A627F5DDE"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2EA83B370B2042ACA58B0C43884D8A4B"><enum>(B)</enum><text>a resource management plan that is applicable to any land adjacent to the land described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id579359D4A98648E58FD8348C0C640157"><enum>(d)</enum><header>Study of land in Hot Springs and Washakie Counties</header><paragraph commented="no" display-inline="no-display-inline" id="id855AA809B74048229AE3B4A429B3F4F4"><enum>(1)</enum><header>Definition of Counties</header><text>In this subsection, the term <term>Counties</term> means each of the following counties in the State:</text><subparagraph commented="no" display-inline="no-display-inline" id="idEB70222A19D24C95AE618B5B7B05ECA3"><enum>(A)</enum><text>Hot Springs County.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8158FABE17194A28AF9E3D4D20C8C036"><enum>(B)</enum><text>Washakie County.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98792867F2AD43BEBDD8639CCDB0EF41"><enum>(2)</enum><header>Study</header><subparagraph commented="no" display-inline="no-display-inline" id="id9CD76BCA23774799BFB895D25473B378"><enum>(A)</enum><header>In general</header><text>The Director shall carry out a study to evaluate the potential for the development of new special motorized recreation areas in the Counties.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36F3F1808C7E431A8F53ACC0EAED388D"><enum>(B)</enum><header>Requirements</header><clause commented="no" display-inline="no-display-inline" id="idCA502A9A266D4AB098E83F94B0D8B550"><enum>(i)</enum><header>Land included</header><text>The study under subparagraph (A) shall evaluate the potential for the development of new special motorized recreation areas on all land managed by the Bureau in the Counties except any land that is subject to a restriction on the use of motorized or mechanized vehicles under any Federal law, including this Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="id443F1F3937DE45E2A70938F91F104D55"><enum>(ii)</enum><header>Public input; collaboration</header><text>In carrying out the study under subparagraph (A), the Director shall—</text><subclause commented="no" display-inline="no-display-inline" id="idC1FC5BDF6D944CB38D7A7E2556D58BB4"><enum>(I)</enum><text>offer opportunities for public input; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC91FFE377F3D43D79E0FFF39D27D1412"><enum>(II)</enum><text>collaborate with—</text><item commented="no" display-inline="no-display-inline" id="idB6C1D5802CF64B9AAA7710958CF5F34B"><enum>(aa)</enum><text>Wyoming Parks, Historic Sites, and Trails; and</text></item><item commented="no" display-inline="no-display-inline" id="idA3F945CE09E743BB862DB60C40467107"><enum>(bb)</enum><text>the Counties.</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D4F3619166F4D57B260F9F03388DCF7"><enum>(C)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the findings of the study under subparagraph (A).</text></subparagraph></paragraph></subsection></section><section id="id51f7043026d74873842b5a8f20772976" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>7.</enum><header>Application of BLM rule</header><text display-inline="no-display-inline">The proposed rule of the Bureau entitled <quote>Conservation and Landscape Health</quote> (88 Fed. Reg. 19583 (April 3, 2023)) or any substantially similar rule shall not apply to the land covered by this Act.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id66b296165d1043a58b496f3b422afe52" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wyoming Public Lands Initiative Act of 2023</short-title></quote>.</text></section><section id="id5ecc123aa23e4ca4abe6661057bc7179" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb6049341f51f4562896ab83fa8bc5678"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="idf09b16d32e39402ebc6945598dca60f9"><enum>(2)</enum><header>Range improvement</header><text>The term <term>range improvement</term> has the meaning given the term in section 3 of the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1902">43 U.S.C. 1902</external-xref>). </text></paragraph><paragraph id="idaf85179b0cf34229b7c5edb62660d08a"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id6c5b36edcc02406b8b8acca4b7bc046a"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means the State of Wyoming.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1438476f0614369a8e31e3289f66276"><enum>(5)</enum><header>Wilderness area</header><text>The term <quote>wilderness area</quote> means a wilderness area designated by section 3.</text></paragraph></section><section id="id84655e756954452cbdd14bd8848e22df" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Designation of wilderness areas</header><text display-inline="no-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following areas in the State are designated as wilderness and as components of the National Wilderness Preservation System:</text><paragraph id="id7dda9d4d86d24345a0c6f0238daac9a8"><enum>(1)</enum><header>Encampment River Canyon Wilderness</header><subparagraph commented="no" display-inline="no-display-inline" id="ida454198de9984568b19fd25fb9d244c1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Certain Federal land administered by the Bureau in the State, comprising approximately 4,523.84 acres, as generally depicted on the map entitled <quote>Proposed Encampment River Wilderness</quote> and dated December 5, 2023, which shall be known as the <quote>Encampment River Canyon Wilderness</quote>. </text></subparagraph><subparagraph id="id7decb07f76c9441ab97ecf9ebb3e7176"><enum>(B)</enum><header>Excluded land</header><text>The following land is not included in the Encampment River Canyon Wilderness:</text><clause id="idf9f684b76bd149eca10d70799fe80166" commented="no"><enum>(i)</enum><text>Any land in the NW<fraction>1⁄4</fraction>NW<fraction>1⁄4</fraction>NW<fraction>1⁄4</fraction> sec. 24, T. 14 N., R. 84 W.</text></clause><clause id="id7b46427a94904d0a80f121f6706bd1f2" commented="no"><enum>(ii)</enum><text>Any land within 100 feet of the centerline of—</text><subclause id="id83484ddcbc6a40cba6dac7708683e428" commented="no"><enum>(I)</enum><text>County Road 353; or</text></subclause><subclause id="id6d113227dfea4984a76a0af1b429db78" commented="no"><enum>(II)</enum><text>Water Valley Road.</text></subclause></clause></subparagraph></paragraph><paragraph id="id1500233cc9c1467a9c2d58008a546e96"><enum>(2)</enum><header>Prospect Mountain Wilderness</header><subparagraph commented="no" display-inline="no-display-inline" id="id13e88c52c4f64b11bdc31808f358b7e8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Certain Federal land administered by the Bureau in the State, comprising approximately 1,099.76 acres, as generally depicted on the map entitled <quote>Proposed Prospect Mountain Wilderness</quote> and dated December 8, 2023, which shall be known as the <quote>Prospect Mountain Wilderness</quote>. </text></subparagraph><subparagraph id="id3e4480bdaef54967803b3c3ed6dc0e91" commented="no"><enum>(B)</enum><header>Excluded land</header><text>Any land within 100 feet of the centerline of Prospect Road is not included in the Prospect Mountain Wilderness.</text></subparagraph></paragraph><paragraph id="id6683250883c34ab6bb2e72d6ab7e6c7a"><enum>(3)</enum><header>Upper Sweetwater Canyon Wilderness</header><subparagraph commented="no" display-inline="no-display-inline" id="idb3266cd81d064f0480723d3c17b5c5fa"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Certain Federal land administered by the Bureau in the State, comprising approximately 2,877.35 acres, as generally depicted on the map entitled <quote>Proposed Upper Sweetwater Canyon Wilderness</quote> and dated December 6, 2023, which shall be known as the <quote>Upper Sweetwater Canyon Wilderness</quote>. </text></subparagraph><subparagraph id="idecb8d331dd5949f8bcc53e25bafe084c" commented="no"><enum>(B)</enum><header>Boundary</header><clause id="id7452aa2890464a0d9e1402791980ffde" commented="no"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the boundary of the Upper Sweetwater Canyon Wilderness shall conform to the boundary of the Sweetwater Canyon Wilderness Study Area.</text></clause><clause id="id26dda7c1fa0f4c2f8cd5c8d6f24ce80f" commented="no"><enum>(ii)</enum><header>Eastern boundary</header><text>The eastern boundary of the Upper Sweetwater Canyon Wilderness shall be 100 feet from the western edge of the north-south road bisecting the Upper Sweetwater Canyon Wilderness and the Lower Sweetwater Canyon Wilderness, known as <quote>Strawberry Creek Road</quote>.</text></clause><clause id="id3a49373ea882427789ea189defc87dca" commented="no"><enum>(iii)</enum><header>Exclusion of existing roads</header><text>Any established legal route with authorized motorized use in existence on the date of enactment of this Act that enters the Upper Sweetwater Canyon Wilderness in T. 28 N., R. 98 W., sec. 4, or the Lower Sweetwater Canyon Wilderness in T. 29 N., R. 97 W., sec. 33, is not included in the Upper Sweetwater Canyon Wilderness.</text></clause></subparagraph></paragraph><paragraph id="id132b05b3f0a24dd3b64ed6d6814c9bbb"><enum>(4)</enum><header>Lower Sweetwater Canyon Wilderness</header><subparagraph commented="no" display-inline="no-display-inline" id="iddf27d8123d664e328e4125898e387418"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Certain Federal land administered by the Bureau in the State, comprising approximately 5,665.19 acres, as generally depicted on the map entitled <quote>Lower Sweetwater Canyon Wilderness</quote> and dated December 5, 2023, which shall be known as the <quote>Lower Sweetwater Canyon Wilderness</quote>.</text></subparagraph><subparagraph id="ida068499773d94a5cbb826633db655258" commented="no"><enum>(B)</enum><header>Boundary</header><clause id="id822c85a9aff44640911e406c161676c1" commented="no"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the boundary of the Lower Sweetwater Canyon Wilderness shall conform to the boundary of the Sweetwater Canyon Wilderness Study Area.</text></clause><clause id="id7968469ef0e8420490275a62e4582d7e" commented="no"><enum>(ii)</enum><header>Western boundary</header><text>The western boundary of the Lower Sweetwater Canyon Wilderness shall be 100 feet from the eastern edge of the north-south road bisecting the Upper Sweetwater Canyon Wilderness and the Lower Sweetwater Canyon Wilderness, known as <quote>Strawberry Creek Road</quote>.</text></clause><clause id="id7b74e6d45cdb4c9f874a8fc978f844b8" commented="no"><enum>(iii)</enum><header>Exclusion of existing roads</header><text>Any established legal route with authorized motorized use in existence on the date of enactment of this Act that enters the Upper Sweetwater Canyon Wilderness in T. 29 N., R. 98 W., sec. 4, or the Lower Sweetwater Canyon Wilderness in T. 29 N., R. 97 W., sec. 33, is not included in the Lower Sweetwater Canyon Wilderness.</text></clause></subparagraph></paragraph><paragraph id="id4cd27f4dd13e4478a633c8d6632903e8"><enum>(5)</enum><header>Bobcat Draw Wilderness</header><text>Certain Federal land administered by the Bureau in the State, comprising approximately 6,246.84 acres, as generally depicted on the map entitled <quote>Proposed Bobcat Draw Wilderness</quote> and dated December 8, 2023, which shall be known as the <quote>Bobcat Draw Wilderness</quote>.</text></paragraph></section><section id="id8a6409a0403140c1ba1c32bba7abf021" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>4.</enum><header>Administration of wilderness areas</header><subsection id="id2690b445a4a14195a1e6bfeb416a28b8"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, the Secretary shall administer the wilderness areas in accordance with this section and the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text><paragraph id="idc54b70844e6e4498ba524aa2c8415ade"><enum>(1)</enum><text>any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text></paragraph><paragraph id="id023b490bd8fb49619b1e8815297615cc"><enum>(2)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary. </text></paragraph></subsection><subsection id="ide79d4f3bdca54571b586dd6d51acfc0d"><enum>(b)</enum><header>Fire management and related activities</header><paragraph id="id7e02b34d15e84f149dd18cbb12720be5"><enum>(1)</enum><header>In general</header><text>The Secretary may carry out any activities in a wilderness area as are necessary for the control of fire, insects, or disease in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>).</text></paragraph><paragraph id="id1b8f90b4befb4fddbc5addd18629ba3d"><enum>(2)</enum><header>Coordination</header><text>In carrying out paragraph (1), the Secretary shall coordinate with—</text><subparagraph id="id778222c7187b406a9c43fa3ecda2ec05"><enum>(A)</enum><text>the Wyoming Forestry Division; and</text></subparagraph><subparagraph id="ida5022883c6ee4137841209ecf9d6541e"><enum>(B)</enum><text>the applicable county in the State in which the wilderness area is located.</text></subparagraph></paragraph><paragraph id="id14529bde2ca944fba19a90fe03b16f52"><enum>(3)</enum><header>Fire management plan</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a fire management plan for the wilderness areas—</text><subparagraph id="id0c0d00ac1a354dd7917881c22ea302a3"><enum>(A)</enum><text>to ensure the timely and efficient control of fires, diseases, and insects in the wilderness areas, in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>); and</text></subparagraph><subparagraph id="id95da5f461dd54fc183e26937b60316b8"><enum>(B)</enum><text>to provide, to the maximum extent practicable, adequate protection from forest fires, disease outbreaks, and insect infestations to any Federal, State, or private land adjacent to the wilderness areas.</text></subparagraph></paragraph></subsection><subsection id="id323625476d0c411386fdc81af118e638"><enum>(c)</enum><header>Grazing</header><text>The grazing of livestock in a wilderness area, if established before the date of enactment of this Act, shall be administered in accordance with—</text><paragraph id="id76f12d9681034dc992486bb70db85ea9"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph><paragraph id="idf80b193c24394309adcabf37f496e2a6"><enum>(2)</enum><text>the guidelines set forth in Appendix A of House Report 101–405, accompanying H.R. 2570 of the 101st Congress, for land under the jurisdiction of the Secretary of the Interior. </text></paragraph></subsection><subsection id="idf0752d3bfdc4442cb8bea3e408a49a8c"><enum>(d)</enum><header>Buffer zones</header><paragraph id="id397e72246ecd470da5e486d200d58ce1"><enum>(1)</enum><header>In general</header><text>Nothing in this section establishes a protective perimeter or buffer zone around a wilderness area.</text></paragraph><paragraph id="ided4cee9480a844c284638fe6aac5bb24"><enum>(2)</enum><header>Outside activities or uses</header><text>The fact that a nonwilderness activity or use can be seen or heard from within a wilderness area shall not preclude the activity or use outside the boundary of the wilderness area.</text></paragraph></subsection></section><section id="idb8d65a70b81a417591256a6a2f452238" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>5.</enum><header>Release of Wilderness Study Areas</header><subsection id="id89098021ed3d4848acff1869ad5bc19a"><enum>(a)</enum><header>Finding</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), any portion of a wilderness study area described in subsection (b) that is not designated as a wilderness area by section 3 has been adequately studied for wilderness designation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id979514d39e5d4d5c82bff13fc77eee0d"><enum>(b)</enum><header>Description of land</header><text>The wilderness study areas referred to in subsections (a) and (c) are the following:</text><paragraph id="id1275e020ae7d4767bef9a22aac195f4a"><enum>(1)</enum><text>The Encampment River Canyon Wilderness Study Area.</text></paragraph><paragraph id="idd423a363a7d84bb89b54249590a704f2"><enum>(2)</enum><text>The Prospect Mountain Wilderness Study Area.</text></paragraph><paragraph id="id4a7cfd395d054fdebed929cf51a97caa"><enum>(3)</enum><text>The Bennett Mountains Wilderness Study Area.</text></paragraph><paragraph id="id39d833703ceb48adb03998e6e713ac6d"><enum>(4)</enum><text>The Sweetwater Canyon Wilderness Study Area.</text></paragraph><paragraph id="idd076353d5818499d93d8a50958e570f9"><enum>(5)</enum><text>The Lankin Dome Wilderness Study Area.</text></paragraph><paragraph id="ida8f1a3fd25b044aeaa72b1e2287a8168"><enum>(6)</enum><text>The Wilderness Study Area.</text></paragraph><paragraph id="idcd1061e3918544bca145caa29d6a1b39"><enum>(17)</enum><text>The Honeycombs Wilderness Study Area.</text></paragraph></subsection><subsection id="id78c3d03deacf4593bd4c90547f7c5334"><enum>(c)</enum><header>Release</header><text>Any portion of a wilderness study area described in subsection (b) that is not designated as a wilderness area by section 3 is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text></subsection><subsection id="id146e854d524943e59b6f3c2922a87936"><enum>(d)</enum><header>Management of released land</header><paragraph commented="no" display-inline="no-display-inline" id="idfbfb5e91214a474f9a095b8d8c2e201e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall manage the portions of the wilderness study areas released under subsection (c) in accordance with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1cca359c8e98486fa3469a2e0905e0d3"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2239a919dfc5424daf88a2ae58d0aa07"><enum>(B)</enum><text display-inline="yes-display-inline">applicable land management plans; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd74161134036464e8c00eec5e2364492"><enum>(C)</enum><text display-inline="yes-display-inline">applicable management provisions under paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44e343ea40164636afcdf98ac374b35c"><enum>(D)</enum><text display-inline="yes-display-inline">any other applicable law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97f90cc0be6f4731b491b7652cd41ada"><enum>(2)</enum><header>Specific management provisions</header><subparagraph id="id95b3a65e74544753ae4953a9ee4bdae3"><enum>(A)</enum><header>Bennett mountains wilderness study area</header><text>The Secretary shall manage the portion of the Bennett Mountains Wilderness Study Area released under subsection (c) in accordance with section 8(a).</text></subparagraph><subparagraph id="id94b88017f88445a591583cd222e93ac5"><enum>(B)</enum><header>Dubois badlands wilderness study area</header><clause id="id2c17dc84fa7749b19e712005fdd82760"><enum>(i)</enum><header>Division</header><text>The Secretary shall divide the land within the Dubois Badlands Wilderness Study Area by authorizing the installation of a fence or the repair or relocation of an existing fence in T. 41 N., R. 106 W., sec. 5, that—</text><subclause id="idf0f94f18fb764f46b44fdc738b706b2f"><enum>(I)</enum><text>follows existing infrastructure and natural barriers;</text></subclause><subclause id="idb01f0d308b97425a92def499612289bf"><enum>(II)</enum><text>begins at an intersection with North Mountain View Road in the NE<fraction>1⁄4</fraction>NW<fraction>1⁄4</fraction> sec. 5, T. 41 N., R. 106 W.;</text></subclause><subclause id="id7c8f448c9bdc4765a0edd779c4cc7454"><enum>(III)</enum><text>from the point described in subclause (II), proceeds southeast to a point near the midpoint of the NE<fraction>1⁄4</fraction> sec. 5, T. 41 N., R. 106 W.; and</text></subclause><subclause id="idb90b550ac29d4ea9996f35ea3d10548f"><enum>(IV)</enum><text>from the point described in subclause (III), proceeds southwest to a point in the SW<fraction>1⁄4</fraction>NE<fraction>1⁄4</fraction> sec. 5, T. 41 N., R. 106 W., that intersects with the boundary of the Dubois Badlands Wilderness Study Area.</text></subclause></clause><clause id="id9127642c04064f4ebf1cf7175a2805ea"><enum>(ii)</enum><header>Management</header><text>The Secretary shall manage the portion of the Dubois Badlands Wilderness Study Area released under subsection (c) in accordance with—</text><subclause id="id4fb3eed36e144fadb9ef006166e76f8d"><enum>(I)</enum><text>paragraph (1); and</text></subclause><subclause id="idfecbcb4ca24940cb996c849e3057d48e"><enum>(II)</enum><text>sections 6 and 7. </text></subclause></clause></subparagraph><subparagraph id="id4ba36abccba64901a06a8ed7e0cf0367"><enum>(C)</enum><header>Copper mountain wilderness study area</header><clause commented="no" display-inline="no-display-inline" id="id62E1FCD3015C4C74B03317CA6F40D2B4"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall manage the portion of the Copper Mountain Wilderness Study Area released under subsection (c) in accordance with paragraph (1).</text></clause><clause commented="no" display-inline="no-display-inline" id="ida7053d1db7d147ae8b71cb40f59fe9bc"><enum>(ii)</enum><header>Mineral leasing</header><subclause id="id1d01e968fe0a43fa939cc2a5dff0166a"><enum>(I)</enum><header>In general</header><text>The Secretary may lease oil and gas resources within the land released from the Copper Mountain Wilderness Study Area under subsection (c) if—</text><item id="idc137c449d86446d695036b513273a284"><enum>(aa)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the land released from the Copper Mountain Wilderness Study Area; and</text></item><item id="idc057d5f431dc4982bdcf246c18ed5f1a"><enum>(bb)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance on the land released from the Copper Mountain Wilderness Study Area for any activities, including activities relating to exploration, development, or production. </text></item></subclause><subclause id="id9ac4fd0bb71e44f8a41344f332278f2a"><enum>(II)</enum><header>Underground rights-of-way</header><text>The Secretary may grant underground rights-of-way for any mineral lease entered into under subclause (I).</text></subclause><subclause id="id688c945ad0194242a9407dad8a036742"><enum>(III)</enum><header>Prohibition of certain leases</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Secretary shall not issue a new lease for a wind or solar project, an overhead transmission line, or a communication tower on the land released from the Copper Mountain Wilderness Study Area under subsection (c).</text></subclause><subclause id="ide4a9d9c0555449a7b728e0850c531d10"><enum>(IV)</enum><header>Authority to exchange land</header><text>In carrying out any land exchange involving any of the land released from the Copper Mountain Wilderness Study Area under subsection (c), the Secretary shall ensure that the exchange does not result in a net loss of Federal land.</text></subclause></clause></subparagraph><subparagraph id="id02c3ff40e7e846f5ba3fb7633900e786"><enum>(D)</enum><header>Whiskey mountain wilderness study area</header><text>The Secretary shall manage the portion of the Whiskey Mountain Wilderness Study Area released under subsection (c) in accordance with—</text><clause id="id8d6dd3bf23ab45eeab8cbd0be63e29d1"><enum>(i)</enum><text>paragraph (1); and</text></clause><clause id="id31233763223741b99821a47d53480301"><enum>(ii)</enum><text>the Whiskey Mountain Cooperative Agreement between the Wyoming Game and Fish Commission, the Forest Service, and the Bureau, including any amendment to that agreement relating to the management of bighorn sheep.</text></clause></subparagraph><subparagraph id="ide1ce4555b4e1435c9e925b57fe62cdc4"><enum>(E)</enum><header>Bobcat draw wilderness study area</header><clause id="id725dcbbab57b4ac882306f015e4667ab"><enum>(i)</enum><header>Travel management plan</header><subclause id="id60889aac7f364572a5719aea06093f6c"><enum>(I)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall develop a travel management plan for the land released from the Bobcat Draw Wilderness Study Area under subsection (c).</text></subclause><subclause id="id285685b1da814a88a7007a5c6133ea1b"><enum>(II)</enum><header>Requirements</header><text>The travel management plan under subclause (I) shall—</text><item id="id6b1709d07a624d95ba7f399cc3078e5c"><enum>(aa)</enum><text>identify all existing roads and trails on the land released from the Bobcat Draw Wilderness Study Area under subsection (c);</text></item><item id="idd3ff8b4539c74f8ca80427201de59baf"><enum>(bb)</enum><text>designate each road or trail available for—</text><subitem id="id23aaffc426974c14b00317f5b3bdc8b7"><enum>(AA)</enum><text>motorized or mechanized recreation; or</text></subitem><subitem id="id210e10225e3343148738c114191411b6"><enum>(BB)</enum><text>agriculture practices;</text></subitem></item><item id="id3f3fe2e5dcf848f5b1d576182d07a0a5"><enum>(cc)</enum><text>prohibit the construction of any new road or trail for motorized or mechanized recreation use; and</text></item><item id="id3c791f7b7eb04e5daba4c21e7e658bab"><enum>(dd)</enum><text>permit the continued use of nonmotorized trails.</text></item></subclause></clause><clause id="id947160d597ce4381bf1cc63c1bcd297a"><enum>(ii)</enum><header>Withdrawal</header><subclause id="id0d408d3fce2649259f984a082de36d5e"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), subject to valid rights in existence on the date of enactment of this Act, the land released from the Bobcat Draw Wilderness Study Area under subsection (c) is withdrawn from—</text><item id="id7c44bbb87efe4a5fab3f06bb769aad16"><enum>(aa)</enum><text>all forms of appropriation or disposal under the public land laws;</text></item><item id="idda03d550d3eb4609aa2ba8676e701069"><enum>(bb)</enum><text>location, entry, and patent under the mining laws; and</text></item><item id="id39c427d479fc43a29c75e5de540f671f"><enum>(cc)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></item></subclause><subclause id="idb9e62e72c1ec46a28e429dbe63880073"><enum>(II)</enum><header>Exception</header><text>The Secretary may lease oil and gas resources within the land released from the Bobcat Draw Wilderness Study Area under subsection (c) if—</text><item id="id47b8330d8e0d42438db6399c9b4c0f45"><enum>(aa)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the land released from the Bobcat Draw Wilderness Study Area; and</text></item><item id="id88c3ef0d991b41869d9bbcbbdfbe1f83"><enum>(bb)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance on the land released from the Bobcat Draw Wilderness Study Area for any activities, including activities related to exploration, development, or production.</text></item></subclause></clause></subparagraph></paragraph></subsection></section><section id="idd4ebcc925d1b45d3b048c2fb2a69f1ca" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>6.</enum><header>Establishment of Dubois Badlands National Conservation Area</header><subsection id="id281665d3194e4deabc6372090b71fa25"><enum>(a)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Dubois Badlands National Conservation Area (referred to in this section as the <quote>Conservation Area</quote>), comprising approximately 4,446.46 acres of Federal land administered by the Bureau in the State, as generally depicted on the map entitled <quote>Proposed Badlands National Conservation Area</quote> and dated November 15, 2023. </text></subsection><subsection id="idf4cd9ba766084227922e51d88c888d80"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Conservation Area is to conserve, protect, and enhance for the benefit and enjoyment of present and future generations the ecological, wildlife, recreational, scenic, cultural, historical, and natural resources of the Area.</text></subsection><subsection id="ide7ce75a55084420b943e3fa6e9895714"><enum>(c)</enum><header>Management</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Secretary shall manage the Conservation Area—</text><paragraph id="idab2b8f56594648228d88c4fba26bf1cd"><enum>(1)</enum><text>in a manner that only allows uses of the Conservation Area that the Secretary determines would further the purpose of the Conservation Area described in subsection (b); and</text></paragraph><paragraph id="idccbf7250591a43abb16ceeab1c741913"><enum>(2)</enum><text>in accordance with—</text><subparagraph id="iddf75574484f743f0b7c68f2fedd2e3ff"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph><subparagraph id="id0f1019ca002d430185f84d2e8b7951fe"><enum>(B)</enum><text>this section; and</text></subparagraph><subparagraph id="idc3911dd1a4884f52ae8f2fe10e4459f5"><enum>(C)</enum><text>any other applicable law.</text></subparagraph></paragraph></subsection><subsection id="id3d812a7d0b7848708f33ab4082ba5575"><enum>(d)</enum><header>Motorized vehicles</header><paragraph id="idc0c75c61b994423badd684688b132625"><enum>(1)</enum><header>In general</header><text>The use of motorized vehicles in the Conservation Area shall be permitted only on existing roads, trails, and areas designated by the Secretary for use by such vehicles as of the date of enactment of this Act.</text></paragraph><paragraph id="id3d112be76a374b4e81a270de15d683fb"><enum>(2)</enum><header>Exceptions</header><text>The Secretary may allow the use of motorized vehicles in the Conservation Area as needed for administrative purposes and emergency response.</text></paragraph></subsection><subsection id="id9f0a3f0d72f74b3f81e14d13aedf1d56"><enum>(e)</enum><header>Grazing</header><text>Grazing of livestock in the Conservation Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subsection><subsection id="id2cdbb9a816cd421ba60654cc3deac1a6"><enum>(f)</enum><header>Withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Conservation Area is withdrawn from—</text><paragraph id="id90292425445d4b11b0508425bb6dd829"><enum>(1)</enum><text>all forms of appropriation or disposal under the public land laws;</text></paragraph><paragraph id="idaee468cb67e04c9190acc272fe6164a3"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="id867f9afff57e4688b2842d1dd0742665"><enum>(3)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></paragraph></subsection></section><section id="id628eec6b60a545578f062cbdcf648296" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>7.</enum><header>Establishment of Dubois Motorized Recreation Area</header><subsection id="ide25a24168c124b41a588534f317524f2"><enum>(a)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Dubois Motorized Recreation Area (referred to in this section as the <quote>Recreation Area</quote>), comprising approximately 367.72 acres of Federal land administered by the Bureau in the State, as generally depicted on the map entitled <quote>Proposed Dubois Motorized Recreation Area</quote> and dated November 15, 2023. </text></subsection><subsection id="id380561c28a7d4be5befcc619a6be7f6b"><enum>(b)</enum><header>Management</header><paragraph id="id8f7f992fa8654f8b98e6a44e9aa83324"><enum>(1)</enum><header>Boundary fence</header><text>The Secretary shall authorize the construction of a fence along the western boundary of the Recreation Area on any Federal land that—</text><subparagraph id="id7a09f90c7a264c00bc57abc9d7e86507"><enum>(A)</enum><text>is managed by the Bureau; and</text></subparagraph><subparagraph id="idae8a8c3d90084d74aa3a1c5908067673"><enum>(B)</enum><text>is west of North Mountain View Road.</text></subparagraph></paragraph><paragraph id="idb53e34b50cbd4473ab9b60ad0b0e7ed6"><enum>(2)</enum><header>Travel management plan</header><text>As soon as practicable after the date of completion of the fence described in paragraph (1), the Secretary shall establish a travel management plan for the Recreation Area that efficiently coordinates the use of motorized off-road vehicles in the Recreation Area. </text></paragraph></subsection></section><section id="idf06772608fec49d9953460d39536cf1c" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>8.</enum><header>Establishment of Special Management Areas</header><subsection id="idbfc18b2a03b94fb1bfcc741ed644f36b"><enum>(a)</enum><header>Bennet mountains special management area</header><paragraph id="idc60317650e794f4b8ba371f2a093cf0f"><enum>(1)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Bennett Mountains Special Management Area (referred to in this subsection as the <quote>Special Management Area</quote>), comprising approximately 6,165.05 acres of Federal land in the State administered by the Bureau, as generally depicted on the map entitled <quote>Proposed Bennet Mountains Special Management Area</quote> and dated November 15, 2023. </text></paragraph><paragraph id="id1af0f6c9b6e3433ab4f7f1013ca221ce"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Secretary.</text></paragraph><paragraph id="idd8159cc446c34eaf94302f4dcef9f728"><enum>(3)</enum><header>Purpose</header><text>The purpose of the Special Management Area is to enhance the natural, historic, scenic, and recreational, values of the area.</text></paragraph><paragraph id="ida8ced26f1b294c26ab5f77bbe4d46ff6"><enum>(4)</enum><header>Management</header><subparagraph id="idc5a1f1d62497499a98dceab16817ac3a"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage the Special Management Area—</text><clause id="id393f2a40a97b4b2fbc5f996861d4d15d"><enum>(i)</enum><text>in furtherance of the purpose described in paragraph (3); and</text></clause><clause id="id6bd9568cb15b4e5c9009e0ab5ae9e56c"><enum>(ii)</enum><text>in accordance with—</text><subclause id="idf0f8c5dfc9224eb5a6d05dda7206fd9e"><enum>(I)</enum><text>the laws (including regulations) generally applicable to the Bureau;</text></subclause><subclause id="id594505a5fdcd4a22abd2359f41ff2c3c"><enum>(II)</enum><text>this subsection; and</text></subclause><subclause id="idf2e328b40eca4b7986133b6380b7fe67"><enum>(III)</enum><text>any other applicable law (including regulations).</text></subclause></clause></subparagraph><subparagraph id="id641051d52f9f4af2b369e70db3df0a58"><enum>(B)</enum><header>Roads; motorized vehicles</header><clause id="id9af91fcb09514914ba21d3ea7d76d11d"><enum>(i)</enum><header>Roads</header><text>The construction of new permanent roads in the Special Management Area shall not be allowed.</text></clause><clause id="ide5eb37cf5c8949fdaaad5b1a6a4f58ec"><enum>(ii)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, emergency response, fire management, forest health and restoration, weed and pest control, habitat management, livestock management, and range improvement, the use of motorized and mechanized vehicles in the Special Management Area shall be allowed only on existing roads and trails designated for the use of motorized or mechanized vehicles. </text></clause><clause id="ide25a0a38b3c9474fad474357f14b6f92"><enum>(iii)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish a travel management plan for the Special Management Area.</text></clause></subparagraph><subparagraph id="id9132819cf5644921b1deed7ba22789b0"><enum>(C)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subparagraph><subparagraph id="idd59762a4f6fc4037a4d050ea8d4a68f8"><enum>(D)</enum><header>Timber harvesting</header><text>Commercial timber harvesting shall not be allowed in the Special Management Area.</text></subparagraph></paragraph><paragraph id="idc5fd70e4ff7e40e988ce529b4f2f0974"><enum>(5)</enum><header>Withdrawal</header><subparagraph id="id2726e815176a4636b334f5b59b42c84a"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights and subparagraph (B), the Special Management Area is withdrawn from—</text><clause id="id9072255e87d843418a64f4cc307c138d"><enum>(i)</enum><text>all forms of appropriation or disposal under the public land laws;</text></clause><clause id="idf7dbbe4ac167416895db80796c55dfc6"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="id8d446b1984fc42efa1e96e87f6f24e7e"><enum>(iii)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph id="id85d8751683e841bdac50d3bfb1c2bcef"><enum>(B)</enum><header>Exception</header><text>The Secretary may lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause id="idd6925410cc67492f83cac61d5b4dabff"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause id="idb845a68f53c3414496cf943536bb495e"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3d89c255f00f4deb8a1f0fad70ef8685"><enum>(b)</enum><header>Black Cat Special Management Area</header><paragraph id="id5ffcef37cc1a45b6a5f16f608c4e4c54"><enum>(1)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Black Cat Special Management Area (referred to in this subsection as the <quote>Special Management Area</quote>), comprising approximately 1,178 acres of Federal land in Carbon County, Wyoming, as generally depicted on the map entitled <quote>Black Cat Special Management Area</quote> and dated November 13, 2023.</text></paragraph><paragraph id="id2ca45951210242d590d6b115fa89b3ae"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Secretary of Agriculture.</text></paragraph><paragraph id="id41b75df195c049d19d85a23884b2882d"><enum>(3)</enum><header>Purpose</header><text>The purpose of the Special Management Area is to enhance the natural, historic, scenic, and recreational values of the area.</text></paragraph><paragraph id="idb424f56608014b1aaea96e95447fffa7"><enum>(4)</enum><header>Management</header><subparagraph id="id6c7f2d979c9d4b118344d7ccb0aad17e"><enum>(A)</enum><header>In general</header><text>The Secretary of Agriculture shall manage the Special Management Area—</text><clause id="id53fc265b822e4b649c6365479c2583b2"><enum>(i)</enum><text>in furtherance of the purpose described in paragraph (3); and</text></clause><clause id="ida076df4a88414066bd47e10bd361882d"><enum>(ii)</enum><text>in accordance with—</text><subclause id="idf79de03317354125aa0008cde1fa0bf5"><enum>(I)</enum><text>the laws (including regulations) generally applicable to National Forest System land;</text></subclause><subclause id="idd568ce49921942038dc772b0de3190c7"><enum>(II)</enum><text>this subsection; and</text></subclause><subclause id="ide290c965194f42509f402ff71b462418"><enum>(III)</enum><text>any other applicable law (including regulations).</text></subclause></clause></subparagraph><subparagraph id="ida8e302a491704802bdd8877595df5ce1"><enum>(B)</enum><header>Roads; motorized vehicles</header><clause id="id910a9c277fcd4c9fa86aa434a7000c16"><enum>(i)</enum><header>Roads</header><text>The construction of new permanent roads in the Special Management Area shall not be allowed.</text></clause><clause id="id6673726f5daf446ba188c26a79c7e1af"><enum>(ii)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, emergency response, fire management, forest health and restoration, weed and pest control, habitat management, livestock management, and range improvement, the use of motorized and mechanized vehicles in the Special Management Area shall be allowed only on existing roads and trails designated for the use of motorized or mechanized vehicles. </text></clause><clause id="ide6807ec365a141c5b34432be2deb2cd8"><enum>(iii)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Agriculture shall establish a travel management plan for the Special Management Area.</text></clause></subparagraph><subparagraph id="id21a41105aeb34aab9fafc07d9c0256f2"><enum>(C)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered in accordance with the laws generally applicable to grazing on National Forest System land.</text></subparagraph><subparagraph id="idd30832a6230e4ee68589c08939aec92d"><enum>(D)</enum><header>Timber harvesting</header><text>Commercial timber harvesting shall not be allowed in the Special Management Area.</text></subparagraph></paragraph><paragraph id="ide2bb8febbc404840b8b1629699aaab2e"><enum>(5)</enum><header>Withdrawal</header><subparagraph id="idaa56b12a5dd545869989e897e4f74738"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights and subparagraph (B), the Special Management Area is withdrawn from—</text><clause id="id3be2ae897e5d4d3a970a5c5c299877ef"><enum>(i)</enum><text>all forms of appropriation or disposal under the public land laws;</text></clause><clause id="id24e2c4aaada04992857dd205a7a1ce7c"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="idfc6fe0914da241a88cf212fc0f8e9d26"><enum>(iii)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph id="idd9904e72ee24468cbb69bc6971e8fda3"><enum>(B)</enum><header>Exception</header><text>The Secretary may, with the approval of the Secretary of Agriculture, lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause id="idaf61d2bc64b5463fb467a14367696604"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause id="ide3a41cc6da8d43b49f801fd90b8dcc20"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph></subsection><subsection id="id33602591847143caab2052ff2e78d920"><enum>(c)</enum><header>Sweetwater rocks special management area</header><paragraph id="idb3b229eee24946ad9c56dcadded256ed"><enum>(1)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Sweetwater Rocks Special Management Area (referred to in this subsection as the <quote>Special Management Area</quote>), comprising approximately 34,347.79 acres of Federal land in Fremont and Natrona Counties, Wyoming, as generally depicted on the map entitled <quote>Proposed Sweetwater Rocks Special Management Area</quote> and dated November 15, 2023. </text></paragraph><paragraph id="ida0dbca43723949aba1f74552f8761f64"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Secretary.</text></paragraph><paragraph id="id24d0b2076e654a4e8e0aaf443e888788"><enum>(3)</enum><header>Purpose</header><text>The purpose of the Special Management Area is to enhance the natural, historic, scenic, and recreational, values of the area.</text></paragraph><paragraph id="id6d5181cbfafe4268a0d23a50aa839add"><enum>(4)</enum><header>Management</header><subparagraph id="id3da57bbb8f664a798a989635895af3b0"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage the Special Management Area—</text><clause commented="no" display-inline="no-display-inline" id="id1213e088378747bfa44df823a911d054"><enum>(i)</enum><text display-inline="yes-display-inline">in furtherance of the purpose described in paragraph (3); and</text></clause><clause id="id38a202bd75bd4a2ba2b56b2194ed9a97"><enum>(ii)</enum><text>in accordance with—</text><subclause id="id1639995548b44c91bc2439eaef314fb7"><enum>(I)</enum><text>the laws (including regulations) generally applicable to the Bureau;</text></subclause><subclause id="id9c67d8d3672c4b3999bed57c3dfd3834"><enum>(II)</enum><text>this subsection; and</text></subclause><subclause id="idee614b6693674b9ca0fbfe7411109361"><enum>(III)</enum><text>any other applicable law (including regulations).</text></subclause></clause></subparagraph><subparagraph id="id043d6bd1f2e642a09df4c0c7e9620ddd"><enum>(B)</enum><header>Roads; motorized vehicles</header><clause id="id58a2d6d874464182bad5a2775f651d25"><enum>(i)</enum><header>Roads</header><text>The construction of new permanent roads in the Special Management Area shall not be allowed.</text></clause><clause id="id595524fae17b47f982ecb042c9ccbf73"><enum>(ii)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, emergency response, fire management, forest health and restoration, weed and pest control, habitat management, livestock management, and range improvement, the use of motorized and mechanized vehicles in the Special Management Area shall be allowed only on existing roads and trails designated for the use of motorized or mechanized vehicles. </text></clause><clause id="idbb4e77378d804234bff04a1239eb42ff"><enum>(iii)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish a travel management plan for the Special Management Area.</text></clause></subparagraph><subparagraph id="idfc35ad38b9b240f3887280c057a991e3"><enum>(C)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered in accordance with the laws generally applicable to the Bureau.</text></subparagraph><subparagraph id="id898ac69383d24ad3bf74c63423ab9556"><enum>(D)</enum><header>Prohibition of certain overhead towers</header><text>No new overhead transmission or communications tower shall be constructed in the Special Management Area.</text></subparagraph><subparagraph id="idc5f3de039e0f4caa8fe4c7560fa21231"><enum>(E)</enum><header>Land exchanges</header><text>The Secretary may propose to, and carry out with, an individual or entity owning land in the vicinity of the Special Management Area any land exchange that—</text><clause id="id4536265fd5f44ce1aa8b54e9b5af5fd0"><enum>(i)</enum><text>increases access to the Special Management Area; and</text></clause><clause id="id64b8f1e1f3f3490ea5fbe44fab409a5d"><enum>(ii)</enum><text>does not result in a net loss of Federal land.</text></clause></subparagraph><subparagraph id="idbc4511e52dca432b8d12e317a990299f"><enum>(F)</enum><header>Underground rights-of-way</header><text>Notwithstanding paragraph (5), the Secretary may expand any underground right-of-way in the Special Management Area that exists as of the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id521b3182862047b8a9534dcaf24b7744"><enum>(5)</enum><header>Withdrawal</header><subparagraph id="id750713b236bc4d71b30c30128a3fae16"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights and subparagraph (B), the Special Management Area is withdrawn from—</text><clause id="idc485b78095f94338bfca65bfea318ff3"><enum>(i)</enum><text>all forms of appropriation or disposal under the public land laws;</text></clause><clause id="idcfe548f3dd834bb8900a281a6a26d0c0"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="id0f7f3f9fd35c4a019b9aa8db9d85fa08"><enum>(iii)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph id="id71f15f2485f6425386245867f6fa77d4"><enum>(B)</enum><header>Exception</header><text>The Secretary may lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause id="idd2b59e9888cf49589d034d3b2b8a53d7"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause id="id59ae427ea33f496babc319f45de6e4ce"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph><subparagraph id="id8c36223b390948ef898a4c6b31faf176"><enum>(C)</enum><header>Wind and solar energy withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the land within the boundaries of the Special Management Area is withdrawn from right-of-way leasing and disposition under laws relating to wind or solar energy.</text></subparagraph></paragraph></subsection><subsection id="id8d4aa88867fc416ab768d52882b45adb"><enum>(d)</enum><header>Fortification creek special management area; fraker mountain special management area; north fork special management area</header><paragraph commented="no" display-inline="no-display-inline" id="ida74e98177be64537b9c60201623a44c7"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of special management area</header><text>In this subsection, the term <quote>Special Management Area</quote> means a special management area established by paragraph (2).</text></paragraph><paragraph id="id041f5f982eaa45bbb0e5ff6eda002a39"><enum>(2)</enum><header>Establishment of special management areas</header><text>Subject to valid existing rights there are established the following:</text><subparagraph id="id4a6f1a7fd5de49689e2c59edf24a95ac"><enum>(A)</enum><text>The Fortification Creek Special Management Area, comprising approximately 12,520.69 acres of Federal land administered in the State by the Bureau, as generally depicted on the map entitled <quote>Proposed Fortification Creek Management Area</quote> and dated November 15, 2023. </text></subparagraph><subparagraph id="id91815bf3c89e4cb7b4006d4154b9adf0"><enum>(B)</enum><text>The Fraker Mountain Special Management Area, comprising approximately 6,248.28 acres of Federal land administered in the State by the Bureau, as generally depicted on the map entitled <quote>Proposed Fraker Mountain Management Area</quote> and dated November 15, 2023. </text></subparagraph><subparagraph id="id81bb1cc50f5d48d9b28451e3ce1c4949"><enum>(C)</enum><text>The North Fork Special Management Area, comprising approximately 10,026.15 acres of Federal land administered in the State by the Bureau, as generally depicted on the map entitled <quote>Proposed North Fork Management Area</quote> and dated November 15, 2023. </text></subparagraph></paragraph><paragraph id="id0739c74b09874ab59f7970e96137e74e"><enum>(3)</enum><header>Administration</header><text>The Special Management Areas shall be administered by the Secretary.</text></paragraph><paragraph id="idf86eb9084e7645fabea53fa7e9523618"><enum>(4)</enum><header>Purpose</header><text>The purpose of a Special Management Area is to enhance the natural, historic, scenic, recreational, wildlife habitat, forest health, watershed protection, and ecological and cultural values of the area.</text></paragraph><paragraph id="idc2249e5c88344e65b3c08d7fe2552958"><enum>(5)</enum><header>Management</header><subparagraph id="id22b0142b0869465aacbbe567f69688bf"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage each Special Management Area—</text><clause id="id057310a6ce894de6bf3aa3e7e0b87ecd"><enum>(i)</enum><text>in furtherance of the purpose described in paragraph (4); and</text></clause><clause id="id1daa4a82c21e4cac93a5f70d4cf1987c"><enum>(ii)</enum><text>in accordance with—</text><subclause id="idb0540c4439c24ddc938f19ba3a9dba8a"><enum>(I)</enum><text>the laws (including regulations) generally applicable to the Bureau;</text></subclause><subclause id="id1761fb37c68840c5846be000b3e06068"><enum>(II)</enum><text>this subsection; and</text></subclause><subclause id="id084e1aa716d34d7eb3a282c9abeaf277"><enum>(III)</enum><text>any other applicable law (including regulations).</text></subclause></clause></subparagraph><subparagraph id="idad545a4fdeb44d979eb65b19253234bc"><enum>(B)</enum><header>Roads; motorized vehicles</header><clause id="idfef934bfa4d44d3295780c944598f13c"><enum>(i)</enum><header>Roads</header><text>The construction of new permanent roads in a Special Management Area shall not be allowed.</text></clause><clause id="id2de915ab5f2540e48979bcd6eb6a5e32"><enum>(ii)</enum><header>Motorized vehicles</header><text>Except as needed for administrative purposes, emergency response, fire management, forest health and restoration, weed and pest control, habitat management, livestock management, and range improvement, the use of motorized and mechanized vehicles in a Special Management Area shall be allowed only on existing roads and trails designated for the use of motorized or mechanized vehicles. </text></clause><clause id="id8b07d38720e748d7b784a56395110749"><enum>(iii)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish a travel management plan for each Special Management Area.</text></clause></subparagraph><subparagraph id="id7ea977d6129f4054ba3c8a70c16417d2"><enum>(C)</enum><header>Grazing</header><text>Grazing of livestock in a Special Management Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subparagraph><subparagraph id="idc2c4a3701aca4ee394beddf8e3aa882d"><enum>(D)</enum><header>Prohibition of certain infrastructure</header><text>The development, construction, or installation of infrastructure for recreational use shall not be allowed in—</text><clause id="idcbb8a9f5d4c64f56b9c52c82a1e6e747"><enum>(i)</enum><text>the Fraker Mountain Special Management Area; or</text></clause><clause id="id5867fcbc86a6481791b53423333e1e9e"><enum>(ii)</enum><text>the North Fork Special Management Area.</text></clause></subparagraph></paragraph><paragraph id="id0907ab8d0053460388a8977924974569"><enum>(6)</enum><header>Withdrawal</header><subparagraph id="id61f687147b294586a32241052ee9c56a"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights and subparagraph (B), the Special Management Areas are withdrawn from—</text><clause id="id77afe7e67a2b47e4b3bf67a1a309c053"><enum>(i)</enum><text>all forms of appropriation or disposal under the public land laws;</text></clause><clause id="idb3f92882f7c44871b89827c2cfb34917"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="idb01c58580c2043929fa59a683d1c4b12"><enum>(iii)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph id="idab2ef809719c44b099fa107c32e80a29"><enum>(B)</enum><header>Exception</header><text>The Secretary may lease oil and gas resources within the boundaries of a Special Management Area if—</text><clause id="id8bc0495647734fbba37b894eb979ecec"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause id="idc5dea4fc68ea41509b6075eec71d4e46"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph></subsection><subsection id="id59dd0780a41e4aeeb5c43feb0af6f287"><enum>(e)</enum><header>Cedar mountain special management area</header><paragraph id="idaf5f0c4f42ab4b06ade8457bdcf6e35b"><enum>(1)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established the Cedar Mountain Special Management Area (referred to in this subsection as the <quote>Special Management Area</quote>), comprising approximately 20,745.73 acres of Federal land in the State administered by the Bureau, as generally depicted on the map entitled <quote>Proposed Cedar Mountain Special Management Area</quote> and dated November 15, 2023. </text></paragraph><paragraph id="id4ac4fea08941422fac9014adc0fd0789"><enum>(2)</enum><header>Administration</header><text>The Special Management Area shall be administered by the Secretary.</text></paragraph><paragraph id="id6971a281bee4456ab6de2bd9abb763d1"><enum>(3)</enum><header>Purpose</header><text>The purpose of the Special Management Area is to enhance the natural, historic, scenic, recreational, ecological, wildlife, and livestock production values of the area.</text></paragraph><paragraph id="id444192de5f4b4fb58041da6d9a7a4d34"><enum>(4)</enum><header>Management</header><subparagraph id="id0f7b50eb9aff4f9381b44c3de2696144"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage the Special Management Area—</text><clause id="ida3413501a52f4f558ea44a1a1f55fd1a"><enum>(i)</enum><text>in furtherance of the purpose described in paragraph (3); and</text></clause><clause id="id27bc26cd661040fb8e12de5112c0868d"><enum>(ii)</enum><text>in accordance with—</text><subclause id="id769bef89a303488db4096a9780ca62c7"><enum>(I)</enum><text>the laws (including regulations) generally applicable to the Bureau;</text></subclause><subclause id="idbdefd29327b943ae8d8a2d66e8ded74c"><enum>(II)</enum><text>this subsection; and</text></subclause><subclause id="idcb5e422cd6ca4565a98080ee50c05ed4"><enum>(III)</enum><text>any other applicable law (including regulations).</text></subclause></clause></subparagraph><subparagraph id="idb2da3366812847698a862689fadbcb6d"><enum>(B)</enum><header>Roads; motorized vehicles</header><clause id="id521e1ccd22f34ad4a37467880303a4fe"><enum>(i)</enum><header>Roads</header><text>The mechanized vehicles. </text></clause><clause id="ide653fe1176ac4919bfcec016c99e610f"><enum>(iii)</enum><header>Travel management plan</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish a travel management plan for the Special Management Area.</text></clause></subparagraph><subparagraph id="ide3f3b2cbe88f4537991d0e6d8b9be0f3"><enum>(C)</enum><header>Grazing</header><text>Grazing of livestock in the Special Management Area shall be administered in accordance with the laws generally applicable to land under the jurisdiction of the Bureau.</text></subparagraph></paragraph><paragraph id="idc21dbf22716e4fb8837bdadcbe488df7"><enum>(5)</enum><header>Withdrawal</header><subparagraph id="id240059bf24974952b83dbf42eea34f26"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights, the Special Management Area is withdrawn from—</text><clause id="id49ca9d94d16f470ca8598fee67ff2b2f"><enum>(i)</enum><text>all forms of appropriation or disposal under the public land laws;</text></clause><clause id="id4c6add49b1934b1c90ed50e603d84a47"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="id3723bcdbeb704118a9dd0489f85dd004"><enum>(iii)</enum><text>disposition under laws relating to mineral and geothermal leasing.</text></clause></subparagraph><subparagraph id="id69b698a5d868471b940513e2b308ac2b"><enum>(B)</enum><header>Exception</header><text>The Secretary may lease oil and gas resources within the boundaries of the Special Management Area if—</text><clause id="id4eb25c346f604e49a620bb23c30d5389"><enum>(i)</enum><text>the lease may only be accessed by directional drilling from a lease that is outside of the Special Management Area; and</text></clause><clause id="idac6233a2a563414e8270f441f588af26"><enum>(ii)</enum><text>the lease prohibits, without exception or waiver, surface occupancy and surface disturbance within the Special Management Area for any activities, including activities related to exploration, development, or production.</text></clause></subparagraph></paragraph></subsection></section><section id="idb1ae906382934a7b8a72a770718fe602" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>9.</enum><header>Lander Slope Area of Critical Environmental Concern and Red Canyon Area of Critical Environmental Concern</header><subsection id="idd2cee308f056415b8bcfb8d4734cd72f"><enum>(a)</enum><header>Definition of county</header><text>In this section, the term <term>County</term> means Fremont County, Wyoming.</text></subsection><subsection id="idebc76468c4394d7e9ec21b6a82cd443a"><enum>(b)</enum><header>Lander slope area of critical environmental concern and red canyon area of critical environmental concern</header><paragraph id="ida095e02e85b44db692fe491c1617ef06"><enum>(1)</enum><header>Transfers</header><text>The Secretary shall pursue transfers in which land managed by the Bureau in the County is exchanged for land owned by the State that is within the boundaries of—</text><subparagraph id="id0f1d8ae448414c12adee2aa5a3aba948"><enum>(A)</enum><text>the Lander Slope Area of Critical Environmental Concern; or</text></subparagraph><subparagraph id="id273fae75239f4a27beca228111a5e1e1"><enum>(B)</enum><text>the Red Canyon Area of Critical Environmental Concern.</text></subparagraph></paragraph><paragraph id="id61f29d4a425e41219c97474a407f2aef"><enum>(2)</enum><header>Requirements</header><text>A transfer under paragraph (1) shall—</text><subparagraph id="id6225c277affa453bbe9e751c70e35dc9"><enum>(A)</enum><text>comply with all requirements of law, including any required analysis; and</text></subparagraph><subparagraph id="id931bd6315e0c46178a628ed645e51aae"><enum>(B)</enum><text>be subject to appropriation.</text></subparagraph></paragraph></subsection><subsection id="id3adbd4be9d1d4988bbcb3ab906dbfb16"><enum>(c)</enum><header>Study</header><paragraph id="idc5dd7a9d82724bfb8406d04d8971de3d"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a study to evaluate the potential for the development of special motorized recreation areas in the County.</text></paragraph><paragraph id="idf1bab3e9498548dc821bf29954143c99"><enum>(2)</enum><header>Requirements</header><text>The study under paragraph (1) shall evaluate—</text><subparagraph id="idb6487744cc044e0abf6b50a46f8190ef"><enum>(A)</enum><text>the potential for the development of special motorized recreation areas on all land managed by the Bureau in the County except—</text><clause id="id74434f73717f4cf0a67b0e3c8da9da2c"><enum>(i)</enum><text>any land in T. 40 N., R. 94 W., secs. 15, 17, 18, 19, 20, 21, 22, 27, 28, 29, and the N<fraction>1⁄2</fraction> sec. 34; and</text></clause><clause id="id3e448fc54d034fec92240f344954a1ad"><enum>(ii)</enum><text>any land that is subject to a restriction on the use of off-road vehicles under any Federal law, including this Act;</text></clause></subparagraph><subparagraph id="id771b503251904f7384f49543473f8857"><enum>(B)</enum><text>the suitability of the land evaluated under subparagraph (A) for off-road vehicles, including rock crawlers; and</text></subparagraph><subparagraph id="id674531054d144af396956f8d3934ddad"><enum>(C)</enum><text>the parking, staging, and camping necessary to accommodate special motorized recreation.</text></subparagraph></paragraph><paragraph id="id44284d2eba9943fd8466d6c2efe874d5"><enum>(3)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the findings of the study under paragraph (1).</text></paragraph></subsection><subsection id="idc904fdb0ee2644088eaedd59d551fff7"><enum>(d)</enum><header>Fremont county implementation team</header><paragraph id="iddb2155cd3d9648b1b607d8ba976a9769"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a team, to be known as the <quote>Fremont County Implementation Team</quote> (referred to in this subsection as the <quote>Team</quote>) to advise and assist the Secretary with respect to the implementation of the management requirements described in this section that are applicable to land in the County.</text></paragraph><paragraph id="idbb23b28ac6be4e238663d512ea5f7d84"><enum>(2)</enum><header>Membership</header><text>The Team shall consist of—</text><subparagraph id="id788661941b5342508993c31e84d47d3e"><enum>(A)</enum><text>the Secretary (or a designee of the Secretary); and</text></subparagraph><subparagraph id="id16a4da47f36e4554ae5b220046b921a3"><enum>(B)</enum><text>1 or more individuals appointed by the Board of County Commissioners of the County.</text></subparagraph></paragraph><paragraph id="id2a2181eb040c4e63a9db8c853d71d942"><enum>(3)</enum><header>Nonapplicability of the federal advisory committee act</header><text>The Team shall not be subject to the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>).</text></paragraph></subsection></section><section id="id652e3525698247b19f4ad602e97b8301" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>10.</enum><header>Study of land in Hot Springs and Washakie Counties</header><subsection id="idd2c0e694fb804751837756d32a55a4e7"><enum>(a)</enum><header>Definition of counties</header><text>In this section, the term <term>Counties</term> means each of the following counties in the State:</text><paragraph id="id2aa07d0415bc444da1790df2975f100f"><enum>(1)</enum><text>Hot Springs County.</text></paragraph><paragraph id="id158c4e08575643028f0ffa5d1977baa3"><enum>(2)</enum><text>Washakie County.</text></paragraph></subsection><subsection id="id02abd33b77aa4c93989be4a5ba0ea8e4"><enum>(b)</enum><header>Study</header><paragraph id="id5e24137c51e24e189b79ce05671d1228"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a study to evaluate the potential for the development of new special motorized recreation areas in the Counties.</text></paragraph><paragraph id="id91e18927838a49caa49b2bdbdc8af921"><enum>(2)</enum><header>Requirements</header><subparagraph id="id2b87ef94e1314837bbe6b7b175c7860b"><enum>(A)</enum><header>Land included</header><text>The study under paragraph (1) shall evaluate the potential for the development of new special motorized recreation areas on Federal land managed by the Bureau in the Counties except any land that is subject to a restriction on the use of motorized or mechanized vehicles under any Federal law, including this Act.</text></subparagraph><subparagraph id="id4362ed2db62244af82877bc861ab7a2c"><enum>(B)</enum><header>Public input; collaboration</header><text>In carrying out the study under paragraph (1), the Secretary shall—</text><clause id="ideb1ddd0789424689b37f79f60ea92958"><enum>(i)</enum><text>offer opportunities for public input; and</text></clause><clause id="id4b258f6cbf8340edb5e22b390ff3cb89"><enum>(ii)</enum><text>collaborate with—</text><subclause id="idb5ac76636e4846e0b6f29f95144a7022"><enum>(I)</enum><text>State parks, historic sites, and trails; and</text></subclause><subclause id="id42d1eee4ebc1413d9986cae85d12acf1"><enum>(II)</enum><text>the Counties.</text></subclause></clause></subparagraph></paragraph><paragraph id="id1df7110f54104855818191c0f04909ea"><enum>(3)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the findings of the study under paragraph
