<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1347</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230427">April 27, 2023</action-date><action-desc><sponsor name-id="S414">Mr. Ossoff</sponsor> (for himself and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to waive cost-sharing under the TRICARE program for three mental health outpatient visits per year for certain beneficiaries, and for other purposes. </official-title></form><legis-body><section id="id0fbad9f5384f4b5f9cf4140c4237d2ee" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Families Mental Health Services Act</short-title></quote>.</text></section><section id="ide94843f838c247fdba20bb5291d61692"><enum>2.</enum><header>Waiver of cost-sharing for three mental health outpatient visits for certain beneficiaries under the TRICARE program</header><subsection id="idcd6748d602a54984a6e44c02b68d2658"><enum>(a)</enum><header>TRICARE Select</header><text>Section 1075(c) of title 10, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb6147cabf0ce4ca987b608f367948dca"><paragraph id="id3fe44383bbbc4237bc51a247e6fe4312"><enum>(4)</enum><text>Consistent with other provisions of this chapter and subject to requirements to be prescribed by the Secretary, the Secretary may waive cost-sharing requirements for the first three outpatient mental health visits each year of any of the following beneficiaries:</text><subparagraph commented="no" display-inline="no-display-inline" id="id947c7ee7a40f4ec7b77f4c06252a60f5"><enum>(A)</enum><text display-inline="yes-display-inline">Beneficiaries in the active-duty family member category.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id660b9f742574440fa9b7ec9d554b9ef2"><enum>(B)</enum><text display-inline="yes-display-inline">Beneficiaries covered by section 1110b of this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id283be8ff2a254068b2f1935d01819337"><enum>(b)</enum><header>TRICARE Prime</header><text>Section 1075a(a) of such title is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35fa45c803df4e03ad6831d75385aa33"><paragraph id="id2c0387879f8c462c863df28901c25257"><enum>(4)</enum><text>Consistent with other provisions of this chapter and subject to requirements to be prescribed by the Secretary, the Secretary may waive cost-sharing requirements for the first three outpatient mental health visits each year of a beneficiary in the active-duty family member category (as described in section 1075(b)(1)(A) of this title).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
