<external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415</external-xref>) (commonly known as the <quote>Long-Term Leasing Act</quote>), is amended—</text><paragraph id="id1DF79A1D5569419BBB94D79519422D21"><enum>(1)</enum><text>by striking <quote>That (a)</quote> and all that follows through the end of subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF895FEF15A814BA48721C16D1C29E267" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><section id="id8C9C284DDB0E479F82C4222659256401" section-type="section-one"><enum>1.</enum><header>Leases of Restricted Land</header><subsection id="id616D6DC43AB44A7397EE967F5B0C42D8"><enum>(a)</enum><header>Authorized purposes; term; approval by Secretary</header><paragraph id="id8A879F2CC5EA4D2F900929186C2EE99A"><enum>(1)</enum><header>In general</header><text>Any restricted Indian lands, regardless of whether that land is tribally or individually owned, may be leased by the Indian owner of the land, with the approval of the Secretary, for—</text><subparagraph id="idD05734F0823E445A81B6BE250BAC97B7"><enum>(A)</enum><text>a public, religious, educational, recreational, residential, business, or grazing purposes; or</text></subparagraph><subparagraph id="id592C3C4378DB48FCA373203D693BA032"><enum>(B)</enum><text>a farming purpose that requires the making of a substantial investment in the improvement of the land for the production of 1 or more specialized crops as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="idA1D60FF9721B456FB5B1FA5AECDAF3DF"><enum>(2)</enum><header>Inclusions</header><text>A lease under paragraph (1) may include the development or use of natural resources in connection with operations under that lease.</text></paragraph><paragraph id="id4B1CE1483ECE4CB283FBF82C082F23B4"><enum>(3)</enum><header>Term</header><subparagraph id="id9D389964ABA94215B1780E10D6EA138A"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a lease under paragraph (1) shall be for a term of not more than 99 years, including any renewals. </text></subparagraph><subparagraph id="idF27F523FF5B7465AB9442ACD8B5B175F"><enum>(B)</enum><header>Exception for grazing purposes</header><text>A lease under paragraph (1) for grazing purposes may be for a term of not more than 10 years, including any renewals.</text></subparagraph></paragraph><paragraph id="id885ED6A0B8E04E999A79FE7036D65689"><enum>(4)</enum><header>Requirement</header><text>Each lease and renewal under this subsection shall be made in accordance with such terms and regulations as may be prescribed by the Secretary.</text></paragraph><paragraph id="id41A671AE77E64673A06A27BC04195CC2"><enum>(5)</enum><header>Conditions for approval</header><text>Before the approval of any lease or renewal of an existing lease pursuant to this subsection, the Secretary shall determine that adequate consideration has been given to—</text><subparagraph id="id70C32B81620F4E1F99AB0BA5368BC8E6"><enum>(A)</enum><text>relationship between the use of the leased lands and the use of neighboring land; </text></subparagraph><subparagraph id="idA4AA042253A0447D878F44205A8FC492"><enum>(B)</enum><text>the height, quality, and safety of any structures or other facilities to be constructed on the leased land; </text></subparagraph><subparagraph id="id11A5BE720B9F4962973A994E3B669DB6"><enum>(C)</enum><text>the availability of police and fire protection and other services on the leased land; </text></subparagraph><subparagraph id="id23682A10C89E4530954DB499010A3DE9"><enum>(D)</enum><text>the availability of judicial forums for all criminal and civil causes of action arising on the leased land; and </text></subparagraph><subparagraph id="id8B9408B2F4B349CEB62A8DAD4E6F8ABB"><enum>(E)</enum><text>the effects on the environment of the uses to which the leased lands will be subject.</text></subparagraph></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idCCF5C08101BA4D778659AF124F2EBF5C"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id1547BFEB48D349A8AE67F18874AF503D"><enum>(A)</enum><text>by striking <quote>(b) Any lease</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id965059D5E4964BD19F3261DCCC1E843D" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><subsection id="idA37B04D14A48433E876C2CEF9568AC86"><enum>(b)</enum><header>Exception for Secretary approval</header><text>Any lease</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB08E891C97954806B9C3486830958C71"><enum>(B)</enum><text>by striking <quote>of the Interior</quote> each place it appears; and</text></subparagraph><subparagraph id="id2CDE1037B6134ACF9A8E4D53AC4292BC"><enum>(C)</enum><text>by striking <quote>clause (3)</quote> and inserting <quote>paragraph</quote>;</text></subparagraph></paragraph><paragraph id="id092233727FD94010821B7A4144FD62E0"><enum>(3)</enum><text>by redesignating subsections (a), (b), (c), and (d) as subsections (b), (c), (d), and (a), respectively, and moving the subsections so as to appear in alphabetical order; and</text></paragraph><paragraph id="id073EEB44FBAB45C48EE78CECA41F8AA5"><enum>(4)</enum><text>by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (b)</quote>.</text></paragraph></subsection><subsection id="id2670E12DF63648348DCEE617B1347151"><enum>(b)</enum><header>Technical correction</header><text>Section 2 of the Act of August 9, 1955 (69 Stat. 539, chapter 615; <external-xref legal-doc="usc" parsable-cite="usc/25/415a">25 U.S.C. 415a</external-xref>) (commonly known as the <quote>Long-Term Leasing Act</quote>), is amended by inserting <quote>of the Interior</quote> after <quote>Secretary</quote> each place it appears.</text></subsection><subsection id="idF0F7C66ABAA3467499A9DF4C3AE6B07F"><enum>(c)</enum><header>Modification of rights-of-Way across Indian land</header><text>The first section of the Act of February 5, 1948 (62 Stat. 17, chapter 45; <external-xref legal-doc="usc" parsable-cite="usc/25/323">25 U.S.C. 323</external-xref>), is amended—</text><paragraph id="idE6CBEC7ECDC64A37A160984AA0BC99D5"><enum>(1)</enum><text>by striking <quote>That the Secretary of the Interior be, and he is empowered to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F68296D039243EBA9B406CE504471BD" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><section id="idD9908DF24EA74022829314CCBF380F0F" section-type="section-one"><enum>1.</enum><header>Rights-of-way for All Purposes Across Indian Land</header><subsection id="id5AEBE2FFDA5143F0A298BF5E3F759083"><enum>(a)</enum><header>Rights-of-Way</header><text>Except as provided in subsection (b), the Secretary of the Interior may</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id4948C4FD54C54A0E88BA2CEE02FD1889"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idECA34CDE53BF4C7F80C5F2197B0A5AEE" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><subsection id="idD8DD4CAB8B4F4491B8D49FB5360287E9"><enum>(b)</enum><header>Exception</header><text>A right-of-way granted by an Indian tribe for the purposes authorized under this section shall not require the approval of the Secretary of the Interior, subject to the condition that—</text><paragraph id="id5565925D94B449308D0F652C5E8E7742"><enum>(1)</enum><text>the right-of-way approval process by the Indian tribe substantially complies with subsection (h) of the first section of the Act of August 9, 1955 (69 Stat. 539, chapter 615; <external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415(h)</external-xref>); or</text></paragraph><paragraph id="idF14CFE013FAD40EBA55859260FA64F59" commented="no"><enum>(2)</enum><text>the Indian tribe has tribal regulations approved by the Secretary of the Interior under that subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id81669c6a-6944-4810-98fd-86c13fe6fc9f" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SLIA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlocking Native Lands and Opportunities for Commerce and Key Economic Developments Act of 2023</short-title></quote>.</text></section><section id="id680c3996-c997-4d53-8642-666619f9e195" changed="added" reported-display-style="italic" committee-id="SLIA00"><enum>2.</enum><header>Modification of tribal leases and rights-of-way across Indian land</header><subsection id="id4b2bfcfd-155a-4b84-869c-fc2e83c34f0c"><enum>(a)</enum><header>Extension of tribal lease period</header><text>The first section of the Act of August 9, 1955 (69 Stat. 539, chapter 615; <external-xref legal-doc="usc" parsable-cite="usc/25/324">25 U.S.C. 324</external-xref>), by striking <quote>organized under the Act of June 18, 1934 (48 Stat. 984), as amended; the Act of May 1, 1936 (49 Stat. 1250); or the Act of June 26, 1936 (49 Stat. 1967),</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70e926ef88824e3bb3afa8d44f3ba91c"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF9D6B7A3B84C4AD48E17288CE3E6B072" changed="added" reported-display-style="italic" committee-id="SLIA00"><section id="idecc6e516175545a49ab229b0e6650465"><enum>8.</enum><header>Tribal grants of rights-of-way</header><subsection commented="no" display-inline="no-display-inline" id="idd4ed369a8d19479280d6608566d52025"><enum>(a)</enum><header>Rights-of-way</header><paragraph commented="no" display-inline="no-display-inline" id="id7e28f4d467be46af9c9fd4fa9dde1f2a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), an Indian tribe may grant a right-of-way over and across the Tribal land of the Indian tribe for any purpose.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0cccb9fac74f4f2e9a1bf0f9e8432ca4"><enum>(2)</enum><header>Authority</header><text display-inline="yes-display-inline">A right-of-way granted under paragraph (1) shall not require the approval of the Secretary of the Interior or a grant by the Secretary of the Interior under the section 1 if the right-of-way granted under paragraph (1) is executed in accordance with a Tribal regulation approved by the Secretary of the Interior under subsection (b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id545a2289f3b640498e7f016ced6e3683"><enum>(b)</enum><header>Review of Tribal regulations</header><paragraph commented="no" display-inline="no-display-inline" id="idfe7bba3d5fcb4704a50b2574067c9567"><enum>(1)</enum><header>Tribal regulation submission and approval</header><subparagraph commented="no" display-inline="no-display-inline" id="id0764da15dc46451db1f788ed8c55e190"><enum>(A)</enum><header>Submission</header><text display-inline="yes-display-inline">An Indian tribe seeking to grant a right-of-way under subsection (a) shall submit for approval a Tribal regulation governing the granting of rights-of-way over and across the Tribal land of the Indian tribe.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6cd8541a8d64128a6c5d4706306b651"><enum>(B)</enum><header>Approval</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary of the Interior shall have the authority to approve or disapprove any Tribal regulation submitted under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5623e9bddfec46fcbe6862b4f7afa2e9"><enum>(2)</enum><header>Considerations for approval</header><subparagraph commented="no" display-inline="no-display-inline" id="id2f456d24e4684212abc101642913d302"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior shall approve a Tribal regulation submitted under paragraph (1)(A), if the Tribal regulation—</text><clause commented="no" display-inline="no-display-inline" id="id374a5c492eca42cab2be81bb020c9995"><enum>(i)</enum><text display-inline="yes-display-inline">is consistent with any regulations (or successor regulations) issued by the Secretary of the Interior under section 4;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida7bbd1a015f04f9fa1316220e8fe41a0"><enum>(ii)</enum><text display-inline="yes-display-inline">provides for an environmental review process that includes—</text><subclause commented="no" display-inline="no-display-inline" id="idd13107c87f844d5180a7635bd1bc2e98"><enum>(I)</enum><text display-inline="yes-display-inline">the identification and evaluation of any significant impacts the proposed action may have on the environment; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id56c3ada23d0d48feae07b213c938305c"><enum>(II)</enum><text display-inline="yes-display-inline">a process for ensuring—</text><item commented="no" display-inline="no-display-inline" id="id4cc9ec2ea7cd4e38a678b11fda63be55"><enum>(aa)</enum><text display-inline="yes-display-inline">that the public is informed of, and has a reasonable opportunity to comment on, any significant environmental impacts of the proposed action identified by the Indian tribe under subclause (I); and</text></item><item commented="no" display-inline="no-display-inline" id="idcd2517b6878e4c51a6add2350cc7ff10"><enum>(bb)</enum><text display-inline="yes-display-inline">the Indian tribe provides a response to each relevant and substantive public comment on the significant environmental impacts identified by the Indian tribe under subclause (I) before the Indian tribe approves the right-of-way.</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d280f87823e4e6ba1cd6263e7ce6277"><enum>(B)</enum><header>Statutory exemptions</header><text display-inline="yes-display-inline">The Secretary of the Interior, in making an approval decision under this subsection, shall not be subject to—</text><clause commented="no" display-inline="no-display-inline" id="id86620128e4ae4bb3bad68a3caaeeda3a"><enum>(i)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idc4942d6362ad40e887cf7cbb3c3e3c20"><enum>(ii)</enum><text display-inline="yes-display-inline">section 306108 of title 54, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide24b4165c17e4239bf9cc00f15d53c0e"><enum>(iii)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e2465ddeeb74ac2b74be4e7a099ab57"><enum>(3)</enum><header>Review process</header><subparagraph commented="no" display-inline="no-display-inline" id="id80a89aaaf0aa451a859a195cc98ff7ce"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Indian tribe submits a Tribal regulation to the Secretary of the Interior under paragraph (1)(A), the Secretary of the Interior shall—</text><clause commented="no" display-inline="no-display-inline" id="id48ac598f555a496699bcdfda605e30fb"><enum>(i)</enum><text display-inline="yes-display-inline">review the Tribal regulation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id06bfa187949649099a01b7d0b44007ff"><enum>(ii)</enum><text display-inline="yes-display-inline">approve or disapprove the Tribal regulation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida39a4d6f00e24ecdb14aa1ead4adbf65"><enum>(iii)</enum><text display-inline="yes-display-inline">notify the Indian tribe that submitted the Tribal regulation of the approval or disapproval.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f14766e595a4f99a1f12230ef4d9b43"><enum>(B)</enum><header>Written documentation</header><text display-inline="yes-display-inline">If the Secretary of the Interior disapproves a Tribal regulation submitted under paragraph (1)(A), the Secretary of the Interior shall include with the disapproval notification under subparagraph (A)(iii) written documentation describing the basis for the disapproval.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8641b658e9b4116a33fd33a806ee065"><enum>(C)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary of the Interior may, after consultation with the Indian tribe that submitted a Tribal regulation under paragraph (1)(A), extend the 180-day period described in subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id739cf821399a4a46bcbbdece695d9221"><enum>(4)</enum><header>Federal environmental review</header><text>Notwithstanding paragraphs (2) and (3), if an Indian tribe carries out a project or activity funded by a Federal agency, the Indian tribe may rely on the environmental review process of the applicable Federal agency rather than any Tribal environmental review process required under this subsection.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfac3ac6fce234ba38bf37951913e9814"><enum>(c)</enum><header>Documentation</header><text display-inline="yes-display-inline">An Indian tribe granting a right-of-way under subsection (a) shall provide to the Secretary of the Interior—</text><paragraph commented="no" display-inline="no-display-inline" id="id4667d7abef12409da655de7cd10bd7d3"><enum>(1)</enum><text display-inline="yes-display-inline">a copy of the right-of-way, including any amendments or renewals; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52beeddbae34408ab4d80151d621924b"><enum>(2)</enum><text display-inline="yes-display-inline">if the right-of-way allows for compensation to be made directly to the Indian tribe, documentation of payments that are sufficient, as determined by the Secretary of the Interior, as to enable the Secretary of the Interior to discharge the trust responsibility of the United States under subsection (d).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf9d25e2814ba4553ac877c99deece801"><enum>(d)</enum><header>Trust responsibility</header><paragraph commented="no" display-inline="no-display-inline" id="id5716d832fb0e42ad80b47ee01105e8b8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The United States shall not be liable for losses sustained by any party to a right-of-way granted under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91490d40c9604f9a862bb27d6f8e75a4"><enum>(2)</enum><header>Authority of the Secretary</header><subparagraph commented="no" display-inline="no-display-inline" id="idf3020da750c94208827b083c2d097034"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to the authority of the Secretary of the Interior to fulfill the trust obligation of the United States to the applicable Indian tribe under Federal law (including regulations), the Secretary of the Interior may, on reasonable notice from the applicable Indian tribe and at the discretion of the Secretary of the Interior, enforce the provisions of, or cancel, any right-of-way granted by the Indian tribe under subsection (a). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a09279ff04f49cfae0369d886610de0"><enum>(B)</enum><header>Authority</header><text display-inline="yes-display-inline">The enforcement or cancellation of a right-of-way under subparagraph (A) shall be conducted using regulatory procedures issued under section 6.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd3f88217c764dc39f943265e986d7f6"><enum>(e)</enum><header>Compliance</header><paragraph commented="no" display-inline="no-display-inline" id="id8ab192ec780045aea2d2b6a08208b233"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An interested party, after exhaustion of any applicable Tribal remedies, may submit a petition to the Secretary of the Interior, at such time and in such form as determined by the Secretary of the Interior, to review the compliance of an applicable Indian tribe with a Tribal regulation approved by the Secretary of the Interior under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide503c0a551704a45a4f7a1b3808c7180"><enum>(2)</enum><header>Violations</header><text display-inline="yes-display-inline">If the Secretary of the Interior determines that a Tribal regulation was violated after conducting a review under paragraph (1), the Secretary of the Interior may take any action the Secretary of the Interior determines to be necessary to remedy the violation, including rescinding the approval of the Tribal regulation and reassuming responsibility for approving rights-of-way through the trust land of the applicable Indian tribe.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17c87ae182874af2b79a0c87f0b2d521"><enum>(3)</enum><header>Documentation</header><text display-inline="yes-display-inline">If the Secretary of the Interior determines that a Tribal regulation was violated after conducting a review under paragraph (1), the Secretary of the Interior shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id36cff235c9ba42278870a0a7108130ed"><enum>(A)</enum><text display-inline="yes-display-inline">provide written documentation, with respect to the Tribal regulation that has been violated, to the appropriate interested party and Indian tribe;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf98dd52a790d47d08bd0b7cee463ab5f"><enum>(B)</enum><text display-inline="yes-display-inline">provide the applicable Indian tribe with a written notice of the alleged violation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e079411f07a4728896646ed308f2dc4"><enum>(C)</enum><text display-inline="yes-display-inline">prior to the exercise of any remedy, including rescinding the approval for the applicable Tribal regulation or reassuming responsibility for approving rights-of-way through the trust land of the applicable Indian tribe, provide the applicable Indian tribe with—</text><clause commented="no" display-inline="no-display-inline" id="id4711ae9d5e0c41fcabdb13038b4ddf48"><enum>(i)</enum><text display-inline="yes-display-inline">a hearing that is on the record; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida9b918cec6df437ca33c00830dd89c9d"><enum>(ii)</enum><text display-inline="yes-display-inline">a reasonable opportunity to cure the alleged violation.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide868369928644240a4159e492dd98046"><enum>(f)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section affects the application of any Tribal regulations issued under Federal environmental law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd7b668a02d7246b7983517d60044bc02"><enum>(g)</enum><header>Effect of Tribal regulations</header><text display-inline="yes-display-inline">An approved Tribal regulation under subsection (b) shall not preclude an Indian tribe from, in the discretion of the Indian tribe, consenting to the grant of a right-of-way by the Secretary of the Interior under the section 1.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id17f65539080c4bf7ad1b8f1744d7be80"><enum>(h)</enum><header>Terms of right-of-way</header><text display-inline="yes-display-inline">The compensation for, and terms of, a right-of-way granted under subsection (a) will be determined by—</text><paragraph commented="no" display-inline="no-display-inline" id="idfdb743b132304f18bed4bf91eb9b7351"><enum>(1)</enum><text display-inline="yes-display-inline">negotiations by the Indian tribe; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf42fb2d9079b4694a8166db7a86f2747"><enum>(2)</enum><text display-inline="yes-display-inline">the regulations of the Indian tribe.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4cbfa1abd653444aba454b1b6c9973dd"><enum>(i)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">The grant of a right-of-way under subsection (a) does not waive the sovereign immunity of the Indian tribe or diminish the jurisdiction of that Indian tribe over the Tribal land subject to the right-of-way, unless otherwise provided in—</text><paragraph commented="no" display-inline="no-display-inline" id="id3442174b6c3040359bd45f68323da9dc"><enum>(1)</enum><text display-inline="yes-display-inline">the grant of the right-of-way; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id261fb066027a4b5bba071bf40c1be70b"><enum>(2)</enum><text display-inline="yes-display-inline">the regulations of the Indian tribe.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><endorsement><action-date date="20240312">March 12, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
