which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, to cover, for purposes of workers’ compensation under such chapter, services by physician assistants and nurse practitioners provided to injured Federal workers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5544475F42BE4E5AA80B4D878F35CED7"><section section-type="section-one" id="HFC921456061D475AAEC2A378F83D9F3A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Workers’ Compensation for Injured Federal Workers Act of 2023</short-title></quote>.</text></section><section id="H0E79E3EFAD9A41DA890AB7A5B3A6B866"><enum>2.</enum><header>Inclusion of physician assistants and nurse practitioners in Federal Employees’ Compensation Act</header><subsection id="HAAC70E7DB21147A9AB4D9442906E8468"><enum>(a)</enum><header>Inclusion</header><text>Section 8101 of title 5, United States Code, is amended—</text><paragraph id="H4CCEFBF72D6C405F89C571D7839AD4FF"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>, other eligible providers,</quote> after <quote>osteopathic practitioners</quote>;</text></paragraph><paragraph id="H50FF16E5A20F411FA1F3D6C33882CE24"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of paragraphs (18) and (19);</text></paragraph><paragraph id="H74ABADCD6AAB48638E123526F1800B3D"><enum>(3)</enum><text>by striking the period at the end of paragraph (20) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC9FD84799C424EBA9F1852EF99081596"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H962BC7E66E124A55B4636ACD1DB7E99A"><paragraph id="H1E33C4F4E3044D67AE66B80A80D659B4"><enum>(21)</enum><text><quote>other eligible provider</quote> means a nurse practitioner or physician assistant within the scope of their practice as defined by State law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC8288710116F4865A4C6E39B4A3535C8"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">Chapter 81</external-xref> of title 5, United States Code, is amended—</text><paragraph id="HBFD533EA89BB46128B67C7D5F1881D29"><enum>(1)</enum><text>in section 8103(a)—</text><subparagraph id="HE8BACF8FF0E04A4B8E3B978AE9832A28"><enum>(A)</enum><text>by inserting <quote>or other eligible provider</quote> after <quote>physician</quote> in each instance; and</text></subparagraph><subparagraph id="H53A252866BF041C4A6E77B7505FE783A"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>or other eligible providers</quote> after <quote>physicians</quote>; </text></subparagraph></paragraph><paragraph id="H62E2882704814738978CDBDDF37A59C2"><enum>(2)</enum><text>in section 8121(6), by inserting <quote>or other eligible provider</quote> after <quote>physician</quote>; and</text></paragraph><paragraph id="HA27AD90928EF4C98B9529374363DF543"><enum>(3)</enum><text display-inline="yes-display-inline">in section 8123(a)—</text><subparagraph id="HD2AF27C3D104455090183F0367B695A7"><enum>(A)</enum><text>by inserting <quote>or other eligible provider</quote> after <quote>The employee may have a physician</quote>; and</text></subparagraph><subparagraph id="HEAB2BF6A502349F8846F1FAD81B47C0E"><enum>(B)</enum><text>by inserting <quote>or other eligible provider</quote> after <quote>United States and the physician</quote>. </text></subparagraph></paragraph></subsection><subsection id="H0059B390DD39456E9D8EF2611463B760"><enum>(c)</enum><header>Regulations</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall finalize rules to carry out the amendments made by this Act.</text></subsection></section><section id="H229844DCB5B8453794A27BD9F5A46B24"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
