<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1314</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230426">April 26, 2023</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to modify the definition of spouse and surviving spouse to include all individuals lawfully married, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idC6EF6B90C5834841AD20528DF526D62D"><enum>1.</enum><header>Modification of definition of spouse and surviving spouse for Department of Veterans Affairs to include all individuals lawfully married</header><subsection commented="no" display-inline="no-display-inline" id="idcc37eb00b42c41a19204a3921c4a7f75"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 101 of title 38, United States Code, is amended—</text><paragraph id="idAEEA1B8075334F4DAD889CA200999F61"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>of the opposite sex who was the spouse of a veteran</quote> and inserting <quote>who was lawfully married to a veteran, including a marriage between two persons of the same sex,</quote>; and</text></paragraph><paragraph id="id8D377A2809AF46E0BDC18A209A6E5101"><enum>(2)</enum><text>in paragraph (31), by striking <quote>of the opposite sex</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7cf481b244874e6488249f2a0c6e2d0e"><enum>(b)</enum><header>Modification of regulations</header><text>The Secretary of Veterans Affairs shall update all rules and regulations of the Department of Veterans Affairs to ensure compliance with—</text><paragraph commented="no" display-inline="no-display-inline" id="idaf24c3d017b14cf3814effc1ce9c3175"><enum>(1)</enum><text display-inline="yes-display-inline">the amendments made by subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id000c7424643447a3bc9b52aa259808d8"><enum>(2)</enum><text display-inline="yes-display-inline">section 7 of title 1, United States Code.</text></paragraph></subsection></section></legis-body></bill>
