which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that students in schools have a right to read, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Read Act of 2023</short-title></quote>.</text></section><section id="id37bc56f862c743a5b5eb7c75a9a8d2e8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) is amended—</text><paragraph id="idd5f45f183b774a33908a778c14024042"><enum>(1)</enum><text>by redesignating paragraphs (19) through (28), paragraphs (29) through (43), paragraphs (44) through (49), and paragraphs (50) through (52) as paragraphs (20) through (29), paragraphs (31) through (45), paragraphs (47) through (52), and paragraphs (54) through (56), respectively;</text></paragraph><paragraph id="iddf06cd2bfab24a13b661513d2ce7cf35"><enum>(2)</enum><text>by inserting after paragraph (18) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id479907ee41e44451be904106d99ddf2d"><paragraph id="id7919f09032cc4aaeb2ec41a8e0b4dda7"><enum>(19)</enum><header>Effective school library</header><text>The term <term>effective school library</term> means a library that—</text><subparagraph id="id7c347f6a001c4e52a433f455da4cf0d9" commented="no"><enum>(A)</enum><text>is staffed by supporting staff and at least one full-time State-certified school librarian who—</text><clause id="ide63c91897c8f41cdaa663dbdaa48955a"><enum>(i)</enum><text>is an instructional leader, information specialist, and teacher;</text></clause><clause id="id755a87f17bcb4850b29d62d7772ce282"><enum>(ii)</enum><text>supports the digital learning environment and the development of participatory learning, inquiry learning, digital literacy, and information literacy; and</text></clause><clause id="id162611e8632744718d7d10cd608a5bdb"><enum>(iii)</enum><text>supports, supplements, and elevates the literacy experience through guidance in reading for learning and motivational reading initiatives in order to enhance student achievement and foster lifelong reading and learning;</text></clause></subparagraph><subparagraph id="id2981cc3df11e4e4b9dffe211fcdf98b3"><enum>(B)</enum><text>is otherwise adequately staffed to be open to students before, during, and after the school day;</text></subparagraph><subparagraph id="idd668fe4517a64798ab82575ea2d0a9ba"><enum>(C)</enum><text>has a sufficient collection of professionally curated up-to-date digital and print materials and technology, including openly licensed educational resources;</text></subparagraph><subparagraph id="id49891234267d44e9b6a3311acc31ef18"><enum>(D)</enum><text>provides appropriate facilities for maintaining and providing equitable access to materials, technology, connectivity, and library and literacy instruction;</text></subparagraph><subparagraph id="idb258378dc74c4f7cac8e1852943be16f"><enum>(E)</enum><text>provides regular skills development or training for classroom teachers, school librarians, library paraprofessional staff, and other educators;</text></subparagraph><subparagraph id="id14de19e630164b189a47d171c0e44d51" commented="no"><enum>(F)</enum><text>provides opportunities for collaboration between classroom teachers and school librarians; and</text></subparagraph><subparagraph id="id8f315da9efd54f3691b9479fa71ecf0f"><enum>(G)</enum><text>implements nationally recognized professional standards of practice.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id966cf329d0f14c938c0c139545786068"><enum>(3)</enum><text>by inserting after paragraph (29), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id579a0743c18b4a04a830f6ba9b71299d"><paragraph id="id9b688251c2e64d97a978cf1ff8fa53da"><enum>(30)</enum><header>Information literacy</header><text>The term <term>information literacy</term> means the set of skills needed to find, retrieve, understand, evaluate, analyze, and effectively use information (which encompasses spoken and broadcast words and videos, printed materials, and digital content, data, and images).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id6b3a7c31e3504919b9aa5eede759e40e"><enum>(4)</enum><text>by inserting after paragraph (45), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfa09c22fd6fd4d308888b378ac1c502c"><paragraph id="id7d39a59142924ef2ae81331e01de42d0"><enum>(46)</enum><header>Right to read</header><text>The term <term>right to read</term> means all students have access to—</text><subparagraph id="id53942f98d24c409ebcfb0d003b6c3f71"><enum>(A)</enum><text>linguistically and developmentally appropriate, evidence-based reading instruction;</text></subparagraph><subparagraph id="id57146657ad4b4a01a9638efa570d5f2b"><enum>(B)</enum><text>effective school libraries;</text></subparagraph><subparagraph id="id467db8a60669492abbb079dcc532febe"><enum>(C)</enum><text>family literacy support;</text></subparagraph><subparagraph id="id7325be4118e34c06bcf9f4abad7f10b5"><enum>(D)</enum><text>culturally diverse and inclusive materials;</text></subparagraph><subparagraph id="idfc472e60fb5e4da9802eb6933aa9a6d3"><enum>(E)</enum><text>reading materials in the home; and</text></subparagraph><subparagraph id="id83d88e9cb44f42c1b08515167430f6de"><enum>(F)</enum><text>the freedom to choose reading materials.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6adbf748352040e9a32dceaaff00adb6"><enum>(5)</enum><text>by inserting after paragraph (52), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfa2b7aef018046f1a3aa197f3826bd43"><paragraph id="id1cfb85ecc07947448f5ae5c277c30dce"><enum>(53)</enum><header>Teacher</header><text>The term <term>teacher</term> includes a school librarian.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idac614ab1874444f8ba53e4ccfbee6a98"><enum>3.</enum><header>Amendments to title I</header><subsection id="id47664bc4e7ea45f593d72ced2fa54e49"><enum>(a)</enum><header>State plans</header><text>Section 1111 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>) is amended—</text><paragraph id="id36ae3c0004ba4a528a8c8393fa2cce3a"><enum>(1)</enum><text>in subsection (a)(4)(A)(ii)(I)(aa), by inserting <quote>(including school librarians)</quote> after <quote>teachers</quote>; and</text></paragraph><paragraph id="id6c314a6bba66411f957047d877112e9f"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph id="idd4b3c97d9e42414496e337b8d9920113"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id1bf9c3a033684c5394b9745c67fdf219"><enum>(i)</enum><text>by redesignating subparagraph (G) as subparagraph (H); </text></clause><clause id="ida0bbd9a768f14d2a91c530caf7163c06"><enum>(ii)</enum><text>in subparagraph (F), by striking <quote>and</quote> after the semicolon;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2330a7a631034704ac4a740cac5b69db"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (F) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id053e56cd7e1943528026082c78724f2f"><subparagraph id="id6decea5e11474a5f869419c50ae9bbee"><enum>(G)</enum><text>how the State will work to ensure that low-income students, minority students, students with disabilities, and English learners are not disproportionally enrolled in schools that lack an effective school library, and the measures the State educational agency will use to evaluate and publicly report the progress of the State educational agency with respect to ensuring such access to an effective school library; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id4bbccd76131243e5a4681f9ff30aaf2e"><enum>(iv)</enum><text>in subparagraph (H), as redesignated by clause (i), by inserting <quote>, including the development of digital literacy and information literacy skills</quote> after <quote>academic standards</quote>; and</text></clause></subparagraph><subparagraph id="ida6f1798d8ee2451ebefd5f12e92e1cbd"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idaceec17ea8dc443e8f4a8a49f75792c7"><enum>(i)</enum><text>in subparagraph (J), by inserting <quote>(including school librarians)</quote> after <quote>teachers</quote>;</text></clause><clause id="id44f04871bb9a4f5ab7f8dfbc0991f999"><enum>(ii)</enum><text>in subparagraph (M), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="idc9c357877a29489487e12cac0c13507e"><enum>(iii)</enum><text>in subparagraph (N), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="id56171433aded4344af7c52998ff3439f"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8e71a3ced2494194a3709315bab06233"><subparagraph id="id968c52d6411044a69e5af88a04a14fbf"><enum>(O)</enum><text>the State educational agency has a policy regarding the right to read and will notify local educational agencies, Indian tribes and tribal organizations, schools, teachers, school librarians, principals, other school leaders, specialized support personnel, parents, and the public of such policy.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="id054e76fa18514cda932e73884b99448c"><enum>(b)</enum><header>Local educational agency plans</header><text>Section 1112 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6312">20 U.S.C. 6312</external-xref>) is amended—</text><paragraph id="id46e78f711e484d61828737b27eba687e"><enum>(1)</enum><text>in subsection (a)(1)(A), by inserting <quote>(including school librarians)</quote> after <quote>teachers</quote>; and</text></paragraph><paragraph id="id0ec3e11feb4e44abab0c09d966a82c77"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id3ffbfb6265c246ad849fac28076ad84b"><enum>(A)</enum><text>in paragraph (12)(B), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="id8f62e1bcc8c441cdbcedcfe12464788c"><enum>(B)</enum><text>by striking paragraph (13); and</text></subparagraph><subparagraph id="id3a7a3d1c66084bd7bb1f47d5f43cf55f"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc138d598c3c845f1b8fcd503bfc2c14c"><paragraph id="id7ab5375b454047639b1df8d192c5265c"><enum>(13)</enum><text>how the local educational agency will—</text><subparagraph id="id73cffd7ae2be4b80a9a81ca45a2e514e"><enum>(A)</enum><text>support and improve effective school libraries by supporting the work of State-certified school librarians to ensure that students have equitable access to such libraries; and</text></subparagraph><subparagraph id="id353ea8460ea3462fa1050d0681916d76"><enum>(B)</enum><text>assist schools in developing effective school libraries to provide students an opportunity to develop digital literacy and information literacy skills and improve academic achievement;</text></subparagraph></paragraph><paragraph id="id54aa177f57424c599d60f9296d6abb5a"><enum>(14)</enum><text>the policies the local educational agency has in place to protect the right to read; and</text></paragraph><paragraph id="iddccf5b7ff0554a7384be087293ca7562"><enum>(15)</enum><text>any other information on how the local educational agency proposes to use funds to meet the purposes of this part, and that the local educational agency determines appropriate to provide, which may include a description of how the local educational agency will assist schools in identifying and serving gifted and talented students.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="idf209602a987c44708515810ba2621cbf"><enum>4.</enum><header>Amendments to title II</header><subsection commented="no" display-inline="no-display-inline" id="ide7b7d920cf694752b548e413f4f4353b"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>Section 2003 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6603">20 U.S.C. 6603</external-xref>) is amended—</text><paragraph id="idb7e1ff5f45e447db83d7b33e456554b2"><enum>(1)</enum><text>in subsection (b), by inserting <quote>except for subpart 2,</quote> after <quote>part B,</quote>; and</text></paragraph><paragraph id="ida69d4000421a48148401cb32c30f8605"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf92924144ac042d98f259c836f22f39d"><subsection id="id66bdf01108104d9283f1ec10537af653"><enum>(c)</enum><header>Literacy education for all, results for the nation</header><text>There are authorized to be appropriated—</text><paragraph id="id194b37b91d494f50a80dbfe6c74151cb"><enum>(1)</enum><text>for grants authorized under section 2222, $500,000,000 for fiscal year 2024 and each of the succeeding 4 fiscal years; and</text></paragraph><paragraph id="id23ce45e8a98c439e803db7eecf9f469a"><enum>(2)</enum><text>for grants authorized under section 2226, $100,000,000 for fiscal year 2024 and each of the succeeding 4 fiscal years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1d699e5209644cc2a14ed7f8f96cabe7"><enum>(b)</enum><header>Formula grants to states</header><text>Section 2101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611</external-xref>) is amended—</text><paragraph id="idc785052755ab4ceb8922a8dc677d23f0"><enum>(1)</enum><text>in subsection (c)(4)(B)—</text><subparagraph id="id41b73be92a2c4404b46fc0b4c71a36bb"><enum>(A)</enum><text>by redesignating clauses (xiv) through (xxi) as clauses (xvii) through (xxiv), respectively;</text></subparagraph><subparagraph id="id0ee241be7fdb4c648d16406a478f41ab"><enum>(B)</enum><text>by striking clause (xiii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idca5f5f8f4f9b40378e0aa1350967238d"><clause id="id15ed089a1fca4af4a5f375901f1c43fb"><enum>(xiii)</enum><text>Supporting and improving effective school libraries that involve collaboration with State-certified school librarians.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id02bc5671d10b49bc8554f212351d45a6"><enum>(C)</enum><text>by inserting after clause (xiii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9632ed8869224d89bd9a6580a3b37b75"><clause id="id2617548ea2cc4a2e9c8783b756ca999d"><enum>(xiv)</enum><text>Developing, improving, and implementing mechanisms to assist local educational agencies and schools in effectively recruiting, hiring, and retaining State-certified school librarians.</text></clause><clause id="id0815e2df30a046348f184aa5ed05b68a"><enum>(xv)</enum><text>Providing training to school librarians, teachers, and school leaders on how to leverage effective school libraries for academic achievement, digital literacy, information literacy, and student and family engagement.</text></clause><clause id="id9676f1fdcab14195a2b9ca82d893d5ac"><enum>(xvi)</enum><text>Providing training to library paraprofessional and other library staff to improve the effectiveness of school library programs.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id63e43d09e514426898cdf208f7226ebf"><enum>(2)</enum><text>in subsection (d)(3)(A), by inserting <quote>(including school librarians)</quote> after <quote>teachers</quote>.</text></paragraph></subsection><subsection id="id33214b84813145f6bc34b9420eca93a3"><enum>(c)</enum><header>Local uses of funds</header><text>Section 2103(b)(3) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613(b)(3)</external-xref>) is amended by striking subparagraph (K) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0637890c70e94941b7d4887be730a4bb"><subparagraph id="ida902daa36001460a87f9605c7ffbfd1c"><enum>(K)</enum><text>programs and activities to support and improve effective school libraries that involve collaboration with State-certified school librarians, such as efforts to promote and support digital literacy, information literacy, extended student inquiry, and capstone projects;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idc5f0b103d76c4ec988e14f53198c90d6"><enum>(d)</enum><header>Reservations</header><text>Section 2201 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6621">20 U.S.C. 6621</external-xref>) is amended—</text><paragraph id="idb0bbd693fe284d4a9c5b25ebb4e95dcb"><enum>(1)</enum><text>by striking paragraph (2); and</text></paragraph><paragraph id="id97932c3811524bdfa38d9c132d275ada"><enum>(2)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively.</text></paragraph></subsection><subsection id="idd0edceba970549d8adad3c40ff14d886"><enum>(e)</enum><header>Learn purposes and definitions</header><text>Section 2221(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6641">20 U.S.C. 6641(b)</external-xref>) is amended—</text><paragraph id="idf6de02c39a98416e946453ded0393ed2"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id42a6e67c421b41e3b7b16fac35fdf8a8"><enum>(A)</enum><text>in subparagraph (K), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="idbebef5a21c5b4ff2b06e10d17c9257c3"><enum>(B)</enum><text>in subparagraph (L), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id0ae24160c2c649039c607f00d7be8578"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id76212570bfee47ebb63d43e561d79877"><subparagraph id="id007a3c9141334125b1fb9dc40aa148fa"><enum>(M)</enum><text>provides opportunities for students to develop digital literacy and information literacy skills.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idaab4c781c4ca4d54b11bd3c7e7138a4a"><enum>(2)</enum><text>in paragraph (2)(C), by inserting <quote>public libraries, or pediatric literacy programs</quote> after <quote>which may include early childhood education programs</quote>. </text></paragraph></subsection><subsection id="id14d09a8ac9e44b9e9eb2ac194e4ea997"><enum>(f)</enum><header>Comprehensive literacy state development grants</header><text>Section 2222 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6642">20 U.S.C. 6642</external-xref>) is amended—</text><paragraph id="id2f4dee100a8548cabce9312ed64fca12"><enum>(1)</enum><text>in subsection (a), by striking <quote>From the amounts reserved by the Secretary under section 2201(2) and not reserved under subsection (b),</quote> and inserting <quote>From amounts appropriated to carry out this section</quote>; and</text></paragraph><paragraph id="id7206325a1f784e91b32f90877edf5ac0"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id1248eca940eb4c8fb76e3e6c6ea4e3cd"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>reserved to carry out this subpart</quote> and inserting <quote>appropriated to carry out this section</quote>; and</text></subparagraph><subparagraph id="id08b0ef1a82a24d979fad336350b3c8c4"><enum>(B)</enum><text>in paragraphs (2) and (3), by striking <quote>subpart</quote> and inserting <quote>section</quote> each place the term appears;</text></subparagraph></paragraph><paragraph id="id573abaf539894b728adcc7d818754c6b"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="id29d475cdcc434dc4baf00b5e8fc9cd40"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and the State agency responsible for administering child care programs</quote> and inserting <quote>the State agency responsible for administering child care programs in the State, and the State library administrative agency</quote>; and</text></subparagraph><subparagraph id="id91ae6f0a5da8497e9ac906222892c942"><enum>(B)</enum><text>in paragraph (2)(A), by inserting <quote>, diverse high quality print materials, and effective school libraries,</quote> after <quote>teachers of literacy</quote>; and</text></subparagraph></paragraph><paragraph id="id2c0ac27a5d164a7193eaa3c9cf2f6da0"><enum>(4)</enum><text>in subsection (f)(2)—</text><subparagraph id="id11822028724a431a8f0264b8a84a03be"><enum>(A)</enum><text>by redesignating subparagraphs (B) through (E) as subparagraphs (C) through (F), respectively; and</text></subparagraph><subparagraph id="ideb408b73bbf541aaa2db8ce9e3cbf468"><enum>(B)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd5cc17c198e74c95874bc9d1a5ecafaf"><subparagraph id="id66c532e672c54212abd667ccde821333"><enum>(B)</enum><text>Providing technical assistance to eligible entities in the development of effective school libraries, which may include establishing a statewide office to coordinate technical assistance for such libraries.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idc9fe023717014e13818a7109c08dc92d"><enum>(g)</enum><header>Subgrants to eligible entities in support of birth through kindergarten entry literacy</header><text>Section 2223(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6643">20 U.S.C. 6643(a)(1)</external-xref>) is amended by inserting <quote>the State library administrative agency,</quote> before <quote>and, if applicable,</quote>. </text></subsection><subsection id="id496905404c31493c96212db572fb45b8"><enum>(h)</enum><header>Innovative approaches to literacy</header><text display-inline="yes-display-inline">Section 2226(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6646">20 U.S.C. 6646(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbe4fd4a9805a4735abbe7e7c67b6650b"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>From amounts reserved under section 2201(2)</quote> and inserting <quote>From amounts appropriated to carry out this section</quote>;</text></paragraph><paragraph id="idd5c7bd68c472491d9e80078e04c9e9f7"><enum>(2)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></paragraph><paragraph id="idd42bb131c3f84d199e120673add63e17"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddca1b0fc15d7454b9ff4c5aa74fa27da"><paragraph id="idd5ae0c1a1c004e7baae2acbcffac73a4"><enum>(2)</enum><text>increasing the number of State-certified school librarians supporting students in high need schools;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id848cdf945aa6491ea7c2a6a203c5eeb1"><enum>(i)</enum><header>Technical amendments</header><paragraph id="id2c072e85aabd4365b9bfb02e99edc434"><enum>(1)</enum><text>Section 2231(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6661">20 U.S.C. 6661(a)</external-xref>) is amended, in the matter preceding paragraph (1) by striking <quote>section 2201(3)</quote> and inserting <quote>section 2201(2)</quote>.</text></paragraph><paragraph id="id064c609107b147ca83e861177deb49ca"><enum>(2)</enum><text>Section 2241 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6671">20 U.S.C. 6671</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>section 2201(4)</quote> and inserting <quote>section 2201(3)</quote>.</text></paragraph></subsection></section><section id="id94dd162c8670484699de4a769bcb6aa1"><enum>5.</enum><header>Amendments to title iv</header><subsection id="id8c529ecda1c54bf3a281dc8508c257d3"><enum>(a)</enum><header>State use of funds</header><text>Section 4104(b)(3)(A)(i) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(A)(i)</external-xref>) is amended—</text><paragraph id="id7560b6fec3554b679047d9ef75242a2f"><enum>(1)</enum><text>by redesignating subclauses (VI) and (VII) as subclauses (VII) and (VIII), respectively; and</text></paragraph><paragraph id="idd4ce48fcd3f3462ba657292cc65cc1aa"><enum>(2)</enum><text>by inserting after subclause (V) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc4efaef3bc2b400e87cdd8bb77c6457c"><subclause id="ida04376500ca94ecab27caf7fdda58d05"><enum>(VI)</enum><text>digital literacy and information literacy activities and programs, including those provided through effective school libraries;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id93036cf88d7e417c9a39ce27102c2541"><enum>(b)</enum><header>Activities To support well-Rounded educational opportunities</header><text>Section 4107(a)(3) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7117">20 U.S.C. 7117(a)(3)</external-xref>) is amended—</text><paragraph id="id9d1bcccfb1d74056abb71df1f6d45aa9"><enum>(1)</enum><text>by redesignating subparagraphs (I) and (J) as subparagraphs (J) and (K), respectively; and</text></paragraph><paragraph id="id049fab2df08244ad97d80da326edbfa8"><enum>(2)</enum><text>by inserting after subparagraph (H) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f0ebfec6ac2468faa9a1a139b821be6"><subparagraph id="id0db483f993bf4c9492490c448077ec75"><enum>(I)</enum><text>programs and activities the promote the development of digital literacy and information literacy skills, including those provided through an effective school library;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="ida5be0b02875e4cbf9f37e0ad49aebae1"><enum>6.</enum><header>Data collection and reporting on school libraries</header><subsection id="idbe32e2905aa7479a8e1a310e9b8e5aad"><enum>(a)</enum><header>Data collection</header><text>The Secretary of Education shall direct the National Center for Education Statistics to biennially collect data on elementary school and secondary school libraries.</text></subsection><subsection id="id03ef9f3f540e4569a4ee825e5533ae42"><enum>(b)</enum><header>Elements</header><text>The data collected biennially under subsection (a) shall include—</text><paragraph id="id846ed1aabe8c42988a5a889d8466b396"><enum>(1)</enum><text>the number and percentage of elementary schools and secondary schools in each State that have dedicated school library facilities located on the grounds of the school and the square footage of each such library facility;</text></paragraph><paragraph id="id662d44f55b6744538dd7e44d6e16042c"><enum>(2)</enum><text>the number and percentage of schools counted under paragraph (1) that employ at least one full-time State-certified school librarian; and</text></paragraph><paragraph id="idc758ccb1c8ba423b88d753e64484402c"><enum>(3)</enum><text>with respect to each elementary and secondary school library—</text><subparagraph id="id970422ffcef947b2a08893c7548b2dcd"><enum>(A)</enum><text>the number of State-certified school librarians;</text></subparagraph><subparagraph id="id5b2c4e9bba1c4582a7fef5036db1aa97"><enum>(B)</enum><text>the number of additional school library staff;</text></subparagraph><subparagraph id="id70c3d0061e21417d9c57de7d8b6ab681"><enum>(C)</enum><text>the number and types of physical collections or assets;</text></subparagraph><subparagraph id="id0cc536cb25d14d238b0ca208d91e3e6c"><enum>(D)</enum><text>the number and types of virtual collections or databases the school library has access to;</text></subparagraph><subparagraph id="ide165e596f2bd48c1a327b7ea94a11bf0"><enum>(E)</enum><text>the number and types of student use devices managed by school library staff;</text></subparagraph><subparagraph id="id965e12bc5c734b23b788e205ffe01f52"><enum>(F)</enum><text>the amount of time State-certified school librarians spend planning with teachers and instructing students;</text></subparagraph><subparagraph id="id54e3c577cc104ee59c58ff1c5095abeb"><enum>(G)</enum><text>the amount of time State-certified school librarians spend planning with and providing professional development for teachers; and</text></subparagraph><subparagraph id="iddf65b35065fd47cdaedc733cea137607"><enum>(H)</enum><text>other pertinent information that the Secretary of Education determines is important in order to support effective school libraries.</text></subparagraph></paragraph></subsection><subsection id="idb5df7028587f43688de7b77b3a55fa72"><enum>(c)</enum><header>Report to congress</header><text>Not later than one year after the date of enactment of this Act and every two years thereafter, the Secretary of Education shall submit to Congress a report that includes the data collected under this section.</text></subsection><subsection id="id44208d498f2147d4bd40246dd6469019"><enum>(d)</enum><header>ESEA terms</header><text>In this section, the terms <term>elementary school</term> and <term>secondary school</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></subsection><subsection id="id3f07383de4084037978674b56cf2e2f8"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each fiscal year.</text></subsection></section><section id="id32633db62ddd4b2b9e216da7a6e59bfd"><enum>7.</enum><header>Liability protections related to the right to read</header><subsection id="id3d418928b5c54066bc8f297d08bd7170"><enum>(a)</enum><header>In general</header><text>Section 8556 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7946">20 U.S.C. 7946</external-xref>) is amended—</text><paragraph id="id770061790c10452db9a7f8cbf370f053"><enum>(1)</enum><text>by redesignating subsections (b) through (e) as subsections (c) through (f), respectively;</text></paragraph><paragraph id="id67560a5cab0640be9a47d3564556d303"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7d86beec828849e0b1de2d245c91798d"><subsection id="id81626e40db514e329b70e2ebceeccf0b"><enum>(b)</enum><header>Liability protections related to the right To read</header><text>No teacher, school librarian, school leader, paraprofessional, or other staff shall be liable for harm caused by an act or omission of such person if the actions were carried out in conformity with State or local policies regarding the right to read.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ideeefb03777834f0aaa387f9ceee74b83"><enum>(3)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (c)</quote>;</text></paragraph><paragraph id="id5a312397a624430c853e11230cf88902"><enum>(4)</enum><text>in subsection (c)(3), as redesignated by paragraph (1), by striking <quote>A State law that</quote> and inserting <quote>Except with respect to subsection (b), a State law that</quote>; and</text></paragraph><paragraph id="idecf8a53a91a54adf8bbb30d1dce89fc3"><enum>(5)</enum><text>in subsection (f), as redesignated by paragraph (1)—</text><subparagraph id="id0dbe5383c12f42109c7c98560c272c16"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Nothing in this section</quote> and inserting <quote>Except with respect to subsection (b), nothing in this section</quote>; and</text></subparagraph><subparagraph id="idf5bccbdb2f024baabab97b2294e5dbc8"><enum>(B)</enum><text>in paragraph (2), by striking <quote>Nothing in this subpart</quote> and inserting <quote>Except with respect to subsection (b), nothing in this subpart</quote>.</text></subparagraph></paragraph></subsection><subsection id="id5ad4f884609f433da4d03ff17b850f56"><enum>(b)</enum><header>Preemption and election of state nonapplicability</header><text>Section 8555(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7945">20 U.S.C. 7945(b)</external-xref>) is amended by striking <quote>This subpart shall not apply</quote> and inserting <quote>Except for section 8556(b), this subpart shall not apply</quote>.</text></subsection></section><section id="idbae61a7abd424a6db8e735947320a8f4"><enum>8.</enum><header>Protecting constitutional rights in school libraries</header><text display-inline="no-display-inline">Subpart 2 of part F of title VIII of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id78a3d4a94e4b42a885d8ab31b12a083d"><section id="id969d92429dab47738be54944d188d77c"><enum>8549D.</enum><header>Protecting constitutional rights in school libraries</header><text display-inline="no-display-inline">The Secretary shall require an assurance from each State and local educational agency receiving funds under this Act confirming that the State or local educational agency—</text><paragraph id="id098787a5f0cc4a8c898cbc8948861bff"><enum>(1)</enum><text>will protect the First Amendment rights of students in school libraries and will affirmatively further the right to receive information by—</text><subparagraph id="id0efb43ed767740ff946aa4f0a08d838e"><enum>(A)</enum><text>providing access to a variety of reading materials;</text></subparagraph><subparagraph id="id238e55637def49c78878063ba83a037a"><enum>(B)</enum><text>recognizing that public schools prepare individuals for participation as citizens;</text></subparagraph><subparagraph id="id06bd289bc2f04a1db7af7f756ba1c7e7"><enum>(C)</enum><text>recognizing that school boards have important and discretionary functions;</text></subparagraph><subparagraph id="iddef8f8f4bd034764bd306fe3b724782d"><enum>(D)</enum><text>acknowledging that among a school board’s functions is a role to play in determining the holdings of a school library;</text></subparagraph><subparagraph id="idddca3c5313b3494eb3ef240818295f0e"><enum>(E)</enum><text>understanding the importance of First Amendment protections in school libraries as centers for voluntary inquiry and the dissemination of information and ideas;</text></subparagraph><subparagraph id="idba2d2f91e5a84f6db9bb308cfecacd0c"><enum>(F)</enum><text>understanding that school boards must exercise their discretionary authority in a manner that comports with First Amendment protections and imperatives; and</text></subparagraph><subparagraph id="id947affd899304cb4beaf9cb32faf9e87"><enum>(G)</enum><text>understanding that the exercise of a school board’s role in determining the holdings of a school library may not be done in a manner that is partisan, political, or otherwise aimed at prescribing particular schools of thought or opinion; and</text></subparagraph></paragraph><paragraph id="ida6215b8544b245fbb01c16b18d750afa"><enum>(2)</enum><text>will provide equal protection in the conduct of school libraries in compliance with the requirements of the Fourteenth Amendment and nondiscrimination laws.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
