which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide highly-skilled nonimmigrant visas for nationals of the Republic of Korea, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H43FC83EE790F4218A9BE45E96DA1BE21"><section section-type="section-one" id="H274CECBF533B4003B31717B33EBE0303"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Partner with Korea Act</short-title></quote>.</text></section><section id="HACA23C63EC70438A8C325B5C4BD7E9C4"><enum>2.</enum><header>Reciprocal visas for nationals of South Korea</header><subsection id="H78AE64CF29224A88BB140640282902CA"><enum>(a)</enum><header>In general</header><text>Section 101(a)(15)(E) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(E)</external-xref>) is amended—</text><paragraph id="HC878E3465A524834B7A979DFF3F97E9E"><enum>(1)</enum><text>by striking <quote>: (i) solely to carry</quote> and inserting the following: “—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC05FCF84E5B04692934C7F932890DD7A"><clause id="id4541856EDBE241299046B4B6F90A630E" indent="up1"><enum>(i)</enum><text>solely to carry</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id05A523D5987D4A8D85E45A09C7166E92"><enum>(2)</enum><text>by striking <quote>(ii) solely to develop</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03B5A8A3851E43BE8C5D29B1B9C108AA"><clause id="id4A93BAA052544A958C4D8AD9A16742D0" indent="up1"><enum>(ii)</enum><text>solely to develop</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H041B6F17864141909B58AD97C11D1701"><enum>(3)</enum><text>by striking <quote>or (iii) solely to perform</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id22235D03EE244B1BA8F0B734584BE3C1"><clause id="id0A9ED5DAAC6D4202B97954AD86D8CC1A" indent="up1"><enum>(iii)</enum><text>solely to perform</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7A058B9359674FFB8B9922C4DEBAAFE7"><enum>(4)</enum><text>by adding at the end the following: “or</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6FD8D884CA834887AF0E3ED15130ACEC"><clause id="id7AF51CD975434056A07AC25709EFC7A9" indent="up1"><enum>(iv)</enum><text>solely to perform services in a specialty occupation in the United States if the alien is a national of the Republic of Korea and with respect to whom the Secretary of Labor certifies to the Secretary of Homeland Security and the Secretary of State that the intending employer has filed an attestation with the Secretary of Labor in accordance with section 212(t)(1);</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H70FB8EC56CAA49CDAC8FBF28F4F39CDC"><enum>(b)</enum><header>Attestation</header><text>Section 212 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>), is amended—</text><paragraph id="idC00ABD498B384FAB9C6108D494DA4CC8"><enum>(1)</enum><text>in subsection (t), as added by section 402(b)(2) of the United States-Chile Free Trade Agreement Implementation Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/77">Public Law 108–77</external-xref>; 117 Stat. 941)—</text><subparagraph id="HF89252382D724A6D9639202083D75730"><enum>(A)</enum><text>by striking <quote>section 101(a)(15)(H)(i)(b1) or section 101(a)(15)(E)(iii)</quote> each place such phrase appears and inserting <quote>subparagraph (E)(iii), (E)(iv), or (H)(i)(b1) of section 101(a)(15)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE922A1C27284E5F99C2FE452A06CEFB"><enum>(B)</enum><text>in clauses (i)(II), (ii)(II), and (iii)(II) of paragraph (3)(C), by striking <quote>section 204, 214(c), 101(a)(15)(H)(i)(b1), or 101(a)(15)(E)(iii)</quote> each place it appears and inserting <quote>subparagraph (E)(iii), (E)(iv), or (H)(1)(b1) of section 101(a)(15) or section 204 or 214(c)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEC14F538B4764B48917EC56497D24D2F"><enum>(2)</enum><text>by redesignating subsection (t), as added by section 1(b)(2)(B) of <external-xref legal-doc="public-law" parsable-cite="pl/108/449">Public Law 108–449</external-xref> (118 Stat. 3470), as subsection (u).</text></paragraph></subsection><subsection id="H40933899565A43EF9D7BCFEAB9D3629A"><enum>(c)</enum><header>Numerical limitation</header><text>Section 214(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="id7A35F045F7E440F5929A6CF955101923"><paragraph id="HF52E781091B34B65967F390FFF488E21" indent="up1"><enum>(12)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H88489C3F911E4117ADB6210CD44CFB14"><enum>(A)</enum><text>The Secretary of State may not approve more than 15,000 initial applications submitted for aliens described in section 101(a)(15)(E)(iv) in any fiscal year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA8680B4949BA4A7B915726BED55D3FB8" indent="up1"><enum>(B)</enum><text>The numerical limitation under subparagraph (A) shall only apply to principal aliens and shall not apply to the spouses or children of such aliens.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD9C4AA5083CA4A5AB9D31C1CEF418C39"><enum>(d)</enum><header>Specialty occupation defined</header><text>Section 214(i)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(i)(1)</external-xref>) is amended by striking <quote>section 101(a)(15)(H)(i)(b), section 101(a)(15)(E)(iii), and paragraph (2),</quote> and inserting <quote>paragraph (2) of this subsection and subparagraphs (E)(iii), (E)(iv), and (H)(i)(b) of section 101(a)(15),</quote>.</text></subsection></section></legis-body></bill>
