<committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require that social media platforms verify the age of their users, prohibit the use of algorithmic recommendation systems on individuals under age 18, require parental or guardian consent for social media users under age 18, and prohibit users who are under age 13 from accessing social media platforms.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Kids on Social Media Act</short-title></quote>.</text></section><section id="id369dcc53de2e40b1aeffc7368de77a42"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id99c706597f6644f58ff3fba46137182c"><enum>(1)</enum><header>Algorithmic recommendation system</header><text>The term <term>algorithmic recommendation system</term> means a fully or partially automated system that suggests, promotes, or ranks information for, or presents advertising to, an individual.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e105c0b7ce64d9cb58f1b12dfd5b27b"><enum>(2)</enum><header display-inline="yes-display-inline">Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idadf8fbd9350d4c6bb704dd8a46d2c116"><enum>(3)</enum><header display-inline="yes-display-inline">Individual</header><text>The term <term>individual</term> means a social media platform user who habitually resides in the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb16ce81c0afe44d6947543dccefba834"><enum>(4)</enum><header display-inline="yes-display-inline">Minor</header><text>The term <term>minor</term> means an individual who is at least 13 years of age but under 18 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb36e008c7604d56892f49bd41b7d2a9"><enum>(5)</enum><header display-inline="yes-display-inline">Personal data</header><text>The term <term>personal data</term> means information that identifies or is linked or reasonably linkable to an individual, household, or consumer device.</text></paragraph><paragraph id="idf96dcfaf5c494aab8aac4d2134db54cf"><enum>(6)</enum><header>Social media platform</header><text>The term <term>social media platform</term> means an online application or website that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idba3e4e62e56742c59bd82fd49bbeed9b"><enum>(A)</enum><text display-inline="yes-display-inline">offers services to users in the United States; </text></subparagraph><subparagraph id="ide4137ef9ec4b48c2ae86d3446079adb9"><enum>(B)</enum><text>allows users to create accounts to publish or distribute to the public or to other users text, images, videos, or other forms of media content; and</text></subparagraph><subparagraph id="id66acb6d77fa44bad82ddf9bbfba550f0"><enum>(C)</enum><text>provides the functions described in paragraph (B) other than in support of—</text><clause id="id144256c5bce5483cb4e8c88a2832e541"><enum>(i)</enum><text>facilitating commercial transactions;</text></clause><clause id="idc7409e83910b47838dea142763d5baec"><enum>(ii)</enum><text>facilitating teleconferencing and videoconferencing features that are limited to certain participants in the teleconference or videoconference and are not posted publicly or for broad distribution to other users;</text></clause><clause id="id4cea1ea5a8794d42b90e199da3c3cf4c"><enum>(iii)</enum><text>facilitating subscription-based content or newsletters;</text></clause><clause id="idc57d4085bd104e43a31b46edcf62d687"><enum>(iv)</enum><text>facilitating crowd-sourced content for reference guides such as encyclopedias and dictionaries;</text></clause><clause id="idb978a53c32bd4c848299e78bd0c97fe6"><enum>(v)</enum><text>providing cloud-based electronic storage, including cloud-based storage that allows collaborative editing by invited users;</text></clause><clause id="ida11b7c72212e4e0a8b631149f3a1d59d"><enum>(vi)</enum><text>making video games available for play by users;</text></clause><clause id="id844bce7b35c749c0a8d55068cf0c38ce"><enum>(vii)</enum><text>reporting or disseminating news;</text></clause><clause id="idd7da621292aa4d19bba343f8e47a6dc8"><enum>(viii)</enum><text>providing other kinds of information concerning businesses, products, or travel information, including user reviews or rankings of such businesses, products, or other travel information;</text></clause><clause id="idfad0c1b438044597a8af4de69e934eb9"><enum>(ix)</enum><text>providing educational information or instruction on behalf of or in support of an elementary school or secondary school, as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id0eaa1193f1ee430da69731a5add11f42"><enum>(x)</enum><text display-inline="yes-display-inline">facilitating electronic mail or direct messaging between users (except for message boards or applications where users can add themselves to messaging groups consisting of large numbers of users) consisting of text, photos, or videos that are not posted publicly and are visible only to the senders and recipients; or</text></clause><clause id="id3f836d8fc81443e29cc424d37538e431"><enum>(xi)</enum><text>any other function that provides content to end users but does not allow the dissemination of user-generated content. </text></clause></subparagraph></paragraph></section><section id="id55687408d213406c92b75031874ab5ec"><enum>3.</enum><header>Reasonable steps for age verification</header><subsection id="id00eb6412ef1a48ca8bb74df11e83d910"><enum>(a)</enum><header>In general</header><text>A social media platform shall take reasonable steps beyond merely requiring attestation, taking into account existing age verification technologies, to verify the age of individuals who are account holders on the platform.</text></subsection><subsection id="ida3e40e568c994626a0e0a05c55ae459f"><enum>(b)</enum><header>Restriction on use and retention of information</header><text display-inline="yes-display-inline">A social media platform shall not—</text><paragraph commented="no" display-inline="no-display-inline" id="id94dbf5788cd8410ea0ffa0e2bd7eb34b"><enum>(1)</enum><text display-inline="yes-display-inline">use any information collected as part of the platform's age verification process for any other purpose; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2102bf0ac5044eef809e06c0422999b8"><enum>(2)</enum><text display-inline="yes-display-inline">retain any information collected from a user as part of the age verification process except to the extent necessary to prove that the platform has taken reasonable steps to verify the age of the user. </text></paragraph></subsection><subsection id="id6f1d1c5235674480b5ec58e6f545193d"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require a social media platform to require users to provide government-issued identification for age verification.</text></subsection><subsection id="idc3a3c9a56d334300959513dac1cd1c92"><enum>(d)</enum><header>Existing accounts</header><text>A social media platform shall not be required to verify the age of account holders on the platform for any account that, as of the date of enactment of this Act, has existed for 90 days or more, until 2 years after the date of enactment of this Act.</text></subsection><subsection id="id3b05a6cfdefc475da48d075b59bd7e14"><enum>(e)</enum><header>Unverified accounts</header><text>A social media platform shall not permit an individual to create a user account (or continue to use an existing user account after the date that is 2 years after the date of enactment of this Act) if the individual's age has not been verified.</text></subsection><subsection id="id6df22ed75b1b4fb7867d59dec7068b0e"><enum>(f)</enum><header>Safe harbor</header><text>A social media platform that, for age verification purposes, relies in good faith on information provided by the Pilot Program described in section 7 to verify the age of a user shall be deemed to have taken reasonable steps to verify the age of that user on the platform.</text></subsection></section><section id="idf5433261e5ea494ca20ddba7ee43ced4"><enum>4.</enum><header>No children under 13</header><text display-inline="no-display-inline">A social media platform shall not permit an individual to use the platform (other than merely viewing content, as long as such viewing does not involve logging in or interacting with the content or other users) unless the individual is known or reasonably believed to be age 13 or older according to the age verification process used by the platform. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id56c5d568dc754b6eaca5cea39f263460"><enum>5.</enum><header>Parent or guardian consent for minors</header><subsection id="id64a7e969643843e8aa29b6a20b6f68e7"><enum>(a)</enum><header>In general</header><text>A social media platform shall take reasonable steps beyond merely requiring attestation, taking into account current parent or guardian relationship verification technologies and documentation, to require the affirmative consent of a parent or guardian to create an account for any individual who the social media platform knows or reasonably believes to be a minor according to the age verification process used by the platform.</text></subsection><subsection id="idffd09272a1fc49a3beb91c256643132a"><enum>(b)</enum><header>Restriction on use and retention of information</header><text display-inline="yes-display-inline">A social media platform shall not— </text><paragraph commented="no" display-inline="no-display-inline" id="id2c9e689456e143d6a4b8213133793511"><enum>(1)</enum><text display-inline="yes-display-inline">use any information collected as part of the parent or guardian consent process for any other purpose; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d8843ac6c0442079b380901ea16ace2"><enum>(2)</enum><text display-inline="yes-display-inline">retain any information collected as part of the parent or guardian verification process except to the extent necessary to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id7846937512ea4db29cfc73845ce7fab7"><enum>(A)</enum><text display-inline="yes-display-inline">provide confirmation of the affirmative consent of a parent or guardian for a minor user to create an account; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdb4be0822754bdeaf5e975f10dca9bb"><enum>(B)</enum><text display-inline="yes-display-inline">preserve the ability of the parent or guardian to revoke such consent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71cb82216ebb40eab1ca806e82cf2bc7"><enum>(C)</enum><text display-inline="yes-display-inline">prove that the platform has taken reasonable steps to obtain the affirmative consent of a parent or guardian for a minor user to create an account.</text></subparagraph></paragraph></subsection><subsection id="idfcae9f214a0b42aebfbc904d19c2adf0"><enum>(c)</enum><header>Ability To revoke consent</header><text>A social media platform shall take reasonable steps to provide a parent or guardian who has consented to their child’s social media use with the ability to revoke such consent.</text></subsection><subsection id="id2302da754c02423baea8c6f1ce824718"><enum>(d)</enum><header>Effect of revocation of consent</header><text>A social media platform that receives a revocation of consent under subsection (c) shall suspend, delete, or otherwise disable the account of the minor user for whom consent was revoked.</text></subsection><subsection id="id119a832d47d64e4789792ade473fed7b"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require a social media platform to require minor users or their parents or guardians to provide government-issued identification for relationship verification or the provision of affirmative consent to create an account.</text></subsection><subsection id="id81852a611778448cb1aa681e5b04da56"><enum>(f)</enum><header>Safe harbor</header><text>A social media platform that, for parent or guardian relationship verification purposes, relies in good faith on information provided by the Pilot Program described in section 7 shall be deemed to have taken reasonable steps to verify the parent or guardian relationship of the parent or guardian granting consent for a minor user to create an account under this section. </text></subsection></section><section id="id152259f6d62b4c138f7d85d2f92ac307"><enum>6.</enum><header>Prohibition on the use of algorithmic recommendation systems on teens under 18</header><subsection id="id0221565efea8486bb30159f3eb0d0365"><enum>(a)</enum><header>In general</header><text>A social media platform shall not use the personal data of an individual in an algorithmic recommendation system unless the platform knows or reasonably believes that the individual is age 18 or older according to the age verification process used by the platform.</text></subsection><subsection id="idb910124fa129450685ccb048f975a7b7"><enum>(b)</enum><header>Rule of construction</header><text>The prohibition in subsection (a) shall not be construed to prevent the suggestion of information or provision of advertising to an individual based on context where the information or advertising is related to the content being viewed by the individual, as long as such information is suggested or advertising is provided solely based on context and is not targeted or recommended based on personal data of the individual.</text></subsection></section><section id="idafe914a530d44ea9a76455549300919f"><enum>7.</enum><header>Secure digital identification credential pilot program</header><subsection id="idee041f7e59a848d4a2e9bafc55a93d77"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Commerce (referred to in this section as the <term>Secretary</term>) shall establish a pilot program (referred to in this Act as the <term>Pilot Program</term>) for providing a secure digital identification credential to individuals who are citizens and lawful residents of the United States at no cost to the individual.</text></subsection><subsection id="idd177f8a3512444d2b2f18174ba1381fe"><enum>(b)</enum><header>Pilot program parameters</header><text>The Pilot Program shall do the following:</text><paragraph id="id4a3c82da8ddc4e6db50ee5c71e88f283"><enum>(1)</enum><text>Allow individuals to verify their age, or their parent or guardian relationship with a minor user, by uploading copies of government-issued and other forms of identification (such as records issued by an educational institution), or by validating the authenticity of identity information provided by the individual using electronic records of State departments of motor vehicles, the Internal Revenue Service, the Social Security Administration, State agencies responsible for vital records, or other governmental or professional records providers that the Secretary determines are able to reliably assist in the verification of identity information.</text></paragraph><paragraph id="id9f2af50411274e56b629c06440f80735"><enum>(2)</enum><text>Meet or exceed the highest cybersecurity standards expected of secure consumer products such as financial or healthcare records or that are required to obtain access to government systems.</text></paragraph><paragraph id="id3e697d984d49468c9c7b0bae50bc7b26"><enum>(3)</enum><text>Provide users with the ability to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id6b36814a4569455d9d26c1266107406b"><enum>(A)</enum><text display-inline="yes-display-inline">obtain a secure digital identification credential that they may use to verify their age or parent or guardian relationship with enrolled social media platforms; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74584edc05c94e568cf03ed4faf98a54"><enum>(B)</enum><text display-inline="yes-display-inline">control what data they choose to allow the pilot program to share with a social media platform, without sharing copies of the underlying verification documents or any information that the user does not affirmatively agree to share with those social media platforms.</text></subparagraph></paragraph><paragraph id="id70d391b5f8fe4805940628d7370fff22"><enum>(4)</enum><text>Not retain copies of underlying governmental records after verifying the information provided by the user.</text></paragraph><paragraph id="idf5ff291c554b45229d2c1b4587f7e2bd"><enum>(5)</enum><text>Provide users with the ability to disable or delete their secure digital identification credential and any associated records kept by the Pilot Program at any time.</text></paragraph><paragraph id="id3801b799928248d18e235e369f524988"><enum>(6)</enum><text>Keep no records of the social media platforms where users have verified their identity using a secure digital identification credential, other than aggregate data that is anonymized so that it cannot be linked to individual users.</text></paragraph></subsection><subsection id="id84a7104ea2ea4747b9ba3415452d430a"><enum>(c)</enum><header>Access</header><text>Information regarding individual users of the Pilot Program shall be confidential, and no officer or employee of the United States, or any other person who has or had access to such information due to their involvement with the Pilot Program, shall disclose any such information to any entity, including law enforcement agencies, except—</text><paragraph id="idf2f7f2ad22324fb9970c1f2582544029"><enum>(1)</enum><text>with the consent of the user;</text></paragraph><paragraph id="idb8b238b86b264ffcb301ae1919b1d325"><enum>(2)</enum><text>in connection with oversight by an Inspector General related to the proper implementation of this Act;</text></paragraph><paragraph id="id7360f6a666914284a8ab6d7c51a8b22e"><enum>(3)</enum><text>in connection with an investigation into a user for committing fraud against the Pilot Program; or</text></paragraph><paragraph id="id7ae0ec5117524d23be4b785a24e20048"><enum>(4)</enum><text>pursuant to a court order.</text></paragraph></subsection><subsection id="idc4216b63c3794614a087b3a4d3a64805"><enum>(d)</enum><header>Voluntary program</header><text>The Pilot Program described in subsection (a) shall be voluntary, and nothing in this Act shall be construed to require any individual or social media platform to use the Pilot Program.</text></subsection><subsection id="idc414a379cd044b758af930661ffac7cc"><enum>(e)</enum><header>Social media platform enrollment</header><paragraph id="iddc1247935d7949b5b833dba4d4041644"><enum>(1)</enum><text>The Secretary may establish regulations for social media platform enrollment in the Pilot Program to ensure that enrolled social media platforms employ appropriate privacy and technical protections sufficient to prevent the abuse or improper release of Pilot Program information relating to individual users.</text></paragraph><paragraph id="ida2f67104c62f40dc99bbd5d9d85f2fed"><enum>(2)</enum><text>The Secretary may revoke the enrollment of any social media platform to protect the integrity and security of the Pilot Program information.</text></paragraph></subsection><subsection id="id25e3158f10da4c9b8cb17ec59e90fefa"><enum>(f)</enum><header>Authority To enter agreements</header><text>The Secretary shall have the authority to enter into memoranda of agreement with Federal, State, tribal, or nongovernmental entities, including entering into contracts with private identity verification technology providers, to facilitate the establishment and operation of the Pilot Program.</text></subsection><subsection id="id274168f6b2d2444e8ebee456625ae249"><enum>(g)</enum><header>Design report to congress</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Commerce of the Senate, the Committee on Appropriations of the Senate, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Appropriations of the House of Representatives, a report outlining the proposed design of the Pilot Program, including estimated costs and the identification of any legal or other barriers identified as impeding the creation and functioning of the Pilot Program.</text></subsection><subsection id="id15497979465040a6a256ea7232bfdee8"><enum>(h)</enum><header>Allowable use</header><text>The Pilot Program shall be used only to establish online age verification and parental consent for purposes of social media platform participation, and may not be used to establish eligibility for any government benefit or legal status.</text></subsection><subsection id="idb7156a32e5be4334b53f17e6b03e3e07"><enum>(i)</enum><header>Sunset</header><text>The Pilot Program shall end on the later of— </text><paragraph commented="no" display-inline="no-display-inline" id="id19e98fc449f44e4f86a5278c38cdfb9c"><enum>(1)</enum><text display-inline="yes-display-inline">September 30 of the eighth year that begins after the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a961eade1ec4c3889bdd81fedd51949"><enum>(2)</enum><text>September 30 of the fifth year that begins after the date on which the Pilot Program begins providing secure digital identification credentials to individuals.</text></paragraph></subsection><subsection id="idb6aa81e07ac14654b02f81a9a691954f"><enum>(j)</enum><header>Authorization</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out the provisions of this section. </text></subsection></section><section id="ide191046f9b50484c940b65652ee526e4"><enum>8.</enum><header>Enforcement</header><subsection id="idd91463f72e5442818f24ac6d1563aa9d"><enum>(a)</enum><header>Enforcement by Commission</header><paragraph id="idc6f8cad9360b4e4f869ee9aaae1afd65"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act by a social media platform shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="idedb306ef4a184ade97d936adb91c6c22"><enum>(2)</enum><header>Powers of Commission</header><subparagraph id="id27cf99c803434308995238e6edb1ecb8"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph id="id6eec53fd7c784cf58a4afba261c16010"><enum>(B)</enum><header>Privileges and immunities</header><text>Except as provided in subparagraph (C), any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="id6872b71717b4450d9434c42012385d5c"><enum>(C)</enum><header>Nonprofit organizations and common carriers</header><text>Notwithstanding section 4 or 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2)) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act, in the same manner provided in subparagraphs (A) and (B) of this paragraph, with respect to—</text><clause commented="no" display-inline="no-display-inline" id="idd19c0055820641e29e85906599464790"><enum>(i)</enum><text display-inline="yes-display-inline">organizations not organized to carry on business for their own profit or that of their members; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id883c8abe5b8e44a98a3446451a8f2774"><enum>(ii)</enum><text display-inline="yes-display-inline">common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection id="idcb69f5c399dd42f88f41c1f4e2fe423e"><enum>(b)</enum><header>Enforcement by States</header><paragraph commented="no" display-inline="no-display-inline" id="id83332cfd03f94e24bc4e2fee7cdcc433"><enum>(1)</enum><header>Authorization</header><text>Subject to paragraph (3), in any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of a social media platform in a practice that violates this Act, the attorney general of the State may, as parens patriae, bring a civil action against the online service provider or person on behalf of the residents of the State in an appropriate district court of the United States to obtain appropriate relief, including civil penalties in the amount determined under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d91ffae9b5f451f84a5dd643cc7451f"><enum>(2)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">A social media platform that is found, in an action brought under paragraph (1), to have knowingly or repeatedly violated sections this Act shall, in addition to any other penalty otherwise applicable to a violation of this Act, be liable for a civil penalty equal to the amount calculated by multiplying—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0d4397abe6fb4cd3a16a800e6401c27a"><enum>(A)</enum><text display-inline="yes-display-inline">the greater of—</text><clause commented="no" display-inline="no-display-inline" id="idd2e528bec1fb4b238e8e1d84064f4e80"><enum>(i)</enum><text display-inline="yes-display-inline">the number of days during which the social media platform was not in compliance with that section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida970ee97069f4d03a05ae24b62950018"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of end users who were harmed as a result of the violation; by</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc67f4ca88e64e9fa1419dc1b43b8160"><enum>(B)</enum><text display-inline="yes-display-inline">an amount not to exceed the maximum civil penalty for which a person, partnership, or corporation may be liable under section 5(m)(1)(A) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(m)(1)(A)</external-xref>) (including any adjustments for inflation).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id904787a01bc54013a4ba130f8f9e240a"><enum>(3)</enum><header>Rights of Federal Trade Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id9bd175ac7f4549a0ae66564daea834c3"><enum>(A)</enum><header>Notice to Federal Trade Commission</header><clause commented="no" display-inline="no-display-inline" id="id583a8abf9c00442cbd479cc0917a6fb4"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (iii), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under paragraph (1) before initiating the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idcdf0f05d5bf2402fb9fdd9fff1d5400a"><enum>(ii)</enum><header>Contents</header><text display-inline="yes-display-inline">The notification required under clause (i) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc51c24d2056640628a17484cdf23a439"><enum>(iii)</enum><header>Exception</header><text display-inline="yes-display-inline">If it is not feasible for the attorney general of a State to provide the notification required under clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida138e44004644ca78cf98b081de32d41"><enum>(B)</enum><header>Intervention by Federal Trade Commission</header><text display-inline="yes-display-inline">The Commission may—</text><clause commented="no" display-inline="no-display-inline" id="id036e9ccbb7cf4b46982e1f9307346d89"><enum>(i)</enum><text display-inline="yes-display-inline">intervene in any civil action brought by the attorney general of a State under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id754ca0663f48489492ebcc0fc3327424"><enum>(ii)</enum><text display-inline="yes-display-inline">upon intervening—</text><subclause commented="no" display-inline="no-display-inline" id="idbfffb80e98524e5a9b6f960effbbaf32"><enum>(I)</enum><text display-inline="yes-display-inline">be heard on all matters arising in the civil action; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf2c8eb26a47f4cb0a6d1c932f1f8d663"><enum>(II)</enum><text display-inline="yes-display-inline">file petitions for appeal of a decision in the civil action. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44d023ba1e13401cb0432d4e53e03ac1"><enum>(4)</enum><header>Investigatory powers</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id0806644872f54c83bdcf335bf2c4d64e"><enum>(A)</enum><text display-inline="yes-display-inline">conduct investigations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2c63c1b62904d15b823f4deefe89291"><enum>(B)</enum><text display-inline="yes-display-inline">administer oaths or affirmations; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25ca150a9fc545c5908bc9ba5307bccb"><enum>(C)</enum><text display-inline="yes-display-inline">compel the attendance of witnesses or the production of documentary or other evidence.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc7ae5abaa8b4943ad591470c53789da"><enum>(5)</enum><header>Preemptive action by Federal trade commission</header><text display-inline="yes-display-inline">If the Commission institutes a civil action or an administrative action with respect to a violation of this Act, the attorney general of a State may not, during the pendency of the action, bring a civil action under paragraph (1) against any defendant named in the complaint of the Commission based on the same set of facts giving rise to the alleged violation with respect to which the Commission instituted the action.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide85f796e47aa4d6eb0d68b8e3fe9b597"><enum>(6)</enum><header>Venue; service of process</header><subparagraph commented="no" display-inline="no-display-inline" id="ide611c600959d488ea99a1aef123f0b13"><enum>(A)</enum><header>Venue</header><text display-inline="yes-display-inline">Any action brought under paragraph (1) may be brought in—</text><clause commented="no" display-inline="no-display-inline" id="id51e00c6b08a04506ac3a8dcd16920d0c"><enum>(i)</enum><text display-inline="yes-display-inline">the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idc0459b60b7984f32b2982c749389108c"><enum>(ii)</enum><text display-inline="yes-display-inline">another court of competent jurisdiction.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idce3fdcea748a46ccaecb668024586643"><enum>(B)</enum><header>Service of process</header><text display-inline="yes-display-inline">In an action brought under paragraph (1), process may be served in any district in which the defendant— </text><clause commented="no" display-inline="no-display-inline" id="id7591db8fbca44f9b90453c40d4ef9e5c"><enum>(i)</enum><text display-inline="yes-display-inline">is an inhabitant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id90b0bb225b4f43aea67e34ef979bdfe9"><enum>(ii)</enum><text display-inline="yes-display-inline">may be found.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ce140e14bea4479a3633769b5e148a6"><enum>(7)</enum><header>Actions by other State officials</header><subparagraph commented="no" display-inline="no-display-inline" id="id27602940722b4d18b13611fe5cdd945b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to civil actions brought by attorneys general under paragraph (1), any other consumer protection officer of a State who is authorized by the State to do so may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id262b624556434b6a8211a1061b4b9633"><enum>(B)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id19dd583e643041ce92c84d0a22c09d5a"><enum>(c)</enum><header>Extraterritorial jurisdiction</header><text>There is extraterritorial jurisdiction over any violation of this Act if such violation involves an individual in the United States or if any act in furtherance of the violation was committed in the United States.</text></subsection></section><section id="id418ae119602b435b87690fe8cf77da7f" commented="no" display-inline="no-display-inline"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline"> This Act shall take effect 1 year after the date of enactment of this Act. </text></section></legis-body></bill>
