which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Nutrition Act of 1966 to require the provision of training and information to certain personnel relating to food allergy identification and response, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idb5d93cbe4ac84e24b2a2bd49eb67ecb5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Children with Food Allergies Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idFB53F081CBF843609168E083FAA201B0"><enum>2.</enum><header>Food allergy training completion requirement</header><text display-inline="no-display-inline">Section 7(g)(2) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(g)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5FDEF6E5E7444DA1AA51505536A124B3"><subparagraph id="idb5c67eee32304025936fefb2a270f5cd"><enum>(C)</enum><header>Food allergy training and certification for all local food service personnel</header><clause id="idf19c7efbc6374ad78b435685a2e0fbb3"><enum>(i)</enum><header>In general</header><text>The Secretary shall develop, in consultation with relevant stakeholder groups with food allergy expertise, and publish training modules and other educational materials in accordance with clause (ii).</text></clause><clause id="id6c65724b829d4852995476936de17194"><enum>(ii)</enum><header>Training modules</header><text>A training program carried out under this subparagraph shall include training modules relating to—</text><subclause id="id1068758573b641a18b8b0592fdf22d9b"><enum>(I)</enum><text>the prevention of allergic reactions to food, which may include—</text><item id="idB5F8A62BB1654DE799FDED024A7F5597"><enum>(aa)</enum><text>communicating food allergen information in school menus, food products, and recipes;</text></item><item id="idF2077A757E25432AA2DBA9D58360E3C0"><enum>(bb)</enum><text>best practices to avoid cross-contact; and</text></item><item id="id66621CA3A0364901A6D0A9D085EE4500"><enum>(cc)</enum><text>the availability of appropriate food substitutions for children with food allergies;</text></item></subclause><subclause id="idcaff436d212f4e80937ba1cfb6b95db7"><enum>(II)</enum><text>the identification of food-related allergic reaction symptoms; and</text></subclause><subclause id="id0fd05ac5a89145e1912b1f0b03caa4e3"><enum>(III)</enum><text>the appropriate responses to an allergic reaction to food.</text></subclause></clause><clause id="id18788F94893D439ABFFB93D8EEC86DAC"><enum>(iii)</enum><header>Certification of local personnel</header><subclause id="id94A9761A50D54B70AA490117D7154CCF"><enum>(I)</enum><header>In general</header><text>In accordance with criteria established by the Secretary, local food service personnel shall complete training and receive a certification to demonstrate competence with respect to the training provided under clause (ii).</text></subclause><subclause commented="no" id="id8b49c3560f684948b44e080e1f24a0d0"><enum>(II)</enum><header>Treatment</header><text>The Secretary may allow local food personnel to apply a certification received under this clause toward any other training requirements under this subsection.</text></subclause></clause><clause id="idb99b6f09db1145ce8bdb30a9e1b99636"><enum>(iv)</enum><header>Methods for inclusion</header><text>The training required under this subparagraph shall be provided, as the Secretary determines to be necessary, in—</text><subclause id="ida41cb0bf60fe486aa0b5e0a9f6313781"><enum>(I)</enum><text>relevant languages other than English, for individuals with limited English proficiency; and</text></subclause><subclause id="id129e696406244d1d824afd976d3306e6"><enum>(II)</enum><text>relevant alternative formats, for individuals with disabilities (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></subclause></clause><clause id="idca8e5e7e4c0440dbb2025d176f2b5103"><enum>(v)</enum><header>Availability to other personnel</header><text>The Secretary shall make the training provided under this subparagraph available to personnel under child nutrition programs not covered under this subsection, including personnel under—</text><subclause id="id2a02b5a6878d4d8db82d576d83cd09d5"><enum>(I)</enum><text>the special milk program under section 3;</text></subclause><subclause id="id3c56ed05ce974dbea9f487452530c844"><enum>(II)</enum><text>the summer food service program for children under section 13 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>); and</text></subclause><subclause id="id9543bca8ab684f919a09d7780a557ba7"><enum>(III)</enum><text>the child and adult care food program under section 17 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>).</text></subclause></clause><clause id="id1E9893CB0B8E4F06ADAF479098E6824B"><enum>(vi)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subparagraph $1,000,000 for each of fiscal years 2024 through 2028.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id451EA95F5BCE4BB99AD9F5312D59A8B5"><enum>3.</enum><header>Activities to support WIC-eligible individuals impacted by food allergies</header><text display-inline="no-display-inline">Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text><paragraph id="id6df386fc50534ef2bab3507716e282ce"><enum>(1)</enum><text>by redesignating subsections (<italic>l</italic>) through (s) as subsections (m) through (t), respectively;</text></paragraph><paragraph id="id42FBAE62242443FBBDBBEBA561E41F52"><enum>(2)</enum><text>by inserting after subsection (k) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBCE68D0E35FB4097AFBDE516E4B26942"><subsection id="id654b535127724dcbb7eeb2e02e0facca"><enum>(l)</enum><header>Activities To support WIC-Eligible individuals impacted by food allergies</header><paragraph id="id6C1A61D16A5341D2B08E55A08C4D7875"><enum>(1)</enum><header>In general</header><text>In accordance with subsection (e), the Secretary shall—</text><subparagraph id="id86f0fff2d6c54105b0ba67d015fd4f3c"><enum>(A)</enum><text>submit to the Secretary of Health and Human Services for comment proposed nutrition education materials for use under subsection (e), which shall—</text><clause id="id860D385B5157490EA11C6E75DAEC3181"><enum>(i)</enum><text>incorporate evidence-based findings from the United States Dietary Guidelines for Americans relating to food allergies and potentially allergenic foods; and</text></clause><clause id="id1819A30707424ED0880845C088A00D0D"><enum>(ii)</enum><text>include nutrition education materials for—</text><subclause id="idF836B9BDD48C461A954FEB695333BD40"><enum>(I)</enum><text>individuals with food allergies during pregnancy and in the postpartum period;</text></subclause><subclause id="id678c7f6b23c34eceb2d49e92c98cb21c"><enum>(II)</enum><text>infants impacted by prenatal food allergy exposure; and</text></subclause><subclause id="id54273BEC85814144BA4982579F346100"><enum>(III)</enum><text>children with food allergies; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54279097DC44478BBDC87CF80868B238"><enum>(B)</enum><text>after submitting the materials in accordance with subparagraph (A), publish and disseminate the materials for use under subsection (e).</text></subparagraph></paragraph><paragraph id="id2D60127C650348EE8333FAB35DB71A3D"><enum>(2)</enum><header>Requirements for inclusion</header><subparagraph id="id41B91561628042C9B6B51449551BFA23"><enum>(A)</enum><header>In general</header><text>The nutrition education materials under paragraph (1) shall be provided, as the Secretary determines to be necessary, in—</text><clause id="id5A44A016A4944B68958E6D78D60E0555"><enum>(i)</enum><text>relevant languages other than English for individuals with limited English proficiency; and</text></clause><clause id="idE9565622F1E640DCB0684D4258880342"><enum>(ii)</enum><text>relevant alternative formats for individuals with disabilities (as defined in section 3 of the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></clause></subparagraph><subparagraph id="id50fc654c061443a79ad4c52fe51a01aa"><enum>(B)</enum><header>Outreach</header><text>In carrying out this paragraph, the Secretary shall conduct outreach to individuals who are, or may be—</text><clause id="id065C140DA5CF4AAB8662FD5E5A8167F8"><enum>(i)</enum><text>eligible to participate in—</text><subclause commented="no" id="id5F5E14341B03481AAC88AC7BB72387E1"><enum>(I)</enum><text>the program under this section; or</text></subclause><subclause commented="no" id="id3337DD0F1CFD40BEAF718C94624525F5"><enum>(II)</enum><text>a training program of a State agency under subsection (e)(2); and</text></subclause></clause><clause id="id1C08EAD3F2E24C33A074AAFEA93B97D6"><enum>(ii)</enum><text>impacted by food allergies.</text></clause></subparagraph></paragraph><paragraph id="idF6C4041DA2D24487B5B6757F9A27CF2C"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $1,000,000 for fiscal year 2024.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id9d39f2fe60744314b56b216ea9a3cc2c"><enum>(3)</enum><text>in subsection (q) (as redesignated by paragraph (1))—</text><subparagraph id="id184972498F0A485EA104611EE24EA4BD"><enum>(A)</enum><text>in paragraph (1), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73967389f0004257a39e26dbb3416e95"><enum>(B)</enum><text>in paragraph (2)(B), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>; and</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idDFDDFEA7B7A94B67B048DB20F7777415"><enum>(4)</enum><text>in paragraph (5) of subsection (t) (as redesignated by paragraph (1)), by striking <quote>subsection (r)</quote> and inserting <quote>subsection (s)</quote>.</text></paragraph></section></legis-body></bill>
