which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to require the Secretary of Energy to stipulate, as a condition on the sale at auction of any petroleum products from the Strategic Petroleum Reserve, that the petroleum products not be exported to certain countries, to prohibit such sales to certain state-owned entities, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idC3A65004AD0C43979FF01AB843F6DCF1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Auction For Energy Reserves Act of 2023</short-title></quote> or the <quote><short-title>SAFER Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5FBFF5EC03EE44F9B04A426F8823E888"><enum>2.</enum><header>Prohibition on export of Strategic Petroleum Reserve petroleum products to certain countries and sales to certain state-owned entities</header><text display-inline="no-display-inline">Section 161(i) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6241">42 U.S.C. 6241(i)</external-xref>) is amended—</text><paragraph id="id3C3FE39EDFF14365BCFC4D3F5AC22109"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(i) Notwithstanding any other law</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA79E17EF78E471786390A6B42C829C3"><subsection id="idE6CCE29F143543B7ABFB35F5490575D5"><enum>(i)</enum><header>Refine or exchange outside the United States</header><paragraph id="idCAD9F9BA537F4060AA696402E1839994"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and subject to paragraphs (2) and (3)</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idAC79DDC5B213443B84562E2EED5642E4"><enum>(2) </enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0BE9DAD15B0342BCAEBB827107EF426D"><paragraph id="id2D75D7A720EE42F1B30F58F802E9F80F"><enum>(2)</enum><header>Prohibition on export of Strategic Petroleum Reserve petroleum products to certain countries</header><text>Notwithstanding any other provision of law, with respect to the drawdown and sale at auction of any petroleum products from the Reserve under this section after the date of enactment of this paragraph, the Secretary shall require, as a condition of the sale, that the petroleum products not be exported to a country that is designated as a country of particular concern for religious freedom under clause (ii) of section 402(b)(1)(A) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6442">22 U.S.C. 6442(b)(1)(A)</external-xref>).</text></paragraph><paragraph id="idFA165170F9134873A74884A113BE2801"><enum>(3)</enum><header>Requirements applicable to certain state-owned entities</header><text>Notwithstanding any other provision of law, with respect to the drawdown and sale at auction of any petroleum products from the Reserve under this section after the date of enactment of this paragraph, if the Secretary determines that, as of the date of the auction, there is in effect a United States ban on, or the imposition of sanctions by the United States with respect to, the purchase of crude oil from 1 or more countries—</text><subparagraph id="id3ED2A4CF077646AF8F413652ADE1F3E8"><enum>(A)</enum><text>to be eligible to bid in the auction, a state-owned entity shall submit to the Secretary a certification that the state-owned entity has not purchased petroleum products from any country subject to such a ban or sanctions later than 15 days after the date on which the ban or sanctions went into effect; and</text></subparagraph><subparagraph id="id640E33C4E7CF403E88DDD67CD1B8BC59"><enum>(B)</enum><text>if the Secretary determines that a state-owned entity participating in the auction has purchased crude oil from a country subject to such a ban or sanctions later than 15 days after the date on which the ban or sanctions went into effect, the Secretary shall not sell petroleum products from the Reserve to the state-owned entity under the auction.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
