which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XXI of the Social Security Act to prohibit lifetime or annual limits on dental coverage under the Children's Health Insurance Program, and to require wraparound coverage of dental services for certain children under such program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Kids Have Access to Medically Necessary Dental Care Act</short-title></quote>.</text></section><section id="id9E5460205F1B4FEE9E20947ACFCFF2E1"><enum>2.</enum><header>Prohibition of lifetime or annual limits on dental benefits under the Children's Health Insurance Program</header><subsection id="idBF6459BBE2BA45E7BB55BF7A0FEFCF7A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2103(c)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)(6)</external-xref>) is amended—</text><paragraph id="id7C792E55AEDE4CA98C5AEA65CB1770FA"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, subject to subparagraph (D),</quote> after <quote>shall include</quote>;</text></paragraph><paragraph id="idB7D67AB06552477F82BFC005FA2D07DF"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>A State</quote> and inserting <quote>Subject to subparagraph (D), a State</quote>; and</text></paragraph><paragraph id="id47DCC7764749499EB0C17F79F52802F0"><enum>(3)</enum><text>by adding at the end the following new subparagraph: </text><quoted-block style="OLC" id="id79D6E3BF38104E25A762DF62ECDECA55" act-name=""><subparagraph id="idD53DC3BBD41142809CFAECE1E46A63CF"><enum>(D)</enum><header>No lifetime or annual limits on dental benefits</header><text>A State shall not establish lifetime or annual limits on the dollar value of benefits for dental services provided under the State child health plan to a targeted low-income child, and, in the case that the State elects to provide pregnancy-related assistance pursuant to section 2112, to a targeted low-income pregnant woman (as defined in section 2112(d)), including benefits for such services that are provided through dental coverage that is otherwise equivalent to a benchmark dental package described in subparagraph (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idad21a8e9b8a34f37b22061691301702d"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date of enactment of this Act.</text></subsection></section><section id="id1FF29807A8814BE7A915720CEB2E70F5"><enum>3.</enum><header>Requiring wraparound coverage of dental services for certain children under CHIP</header><subsection id="id7F087FE549094E8CA2E19E744D548EDD"><enum>(a)</enum><header>In general</header><text>Section 2110(b)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(b)(5)</external-xref>) is amended—</text><paragraph id="idE4D4A33A63FD4584B33D325151D1FCBA"><enum>(1)</enum><text>in the paragraph header, by striking <quote><header-in-text level="paragraph" style="OLC">Option</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Requirement</header-in-text></quote>;</text></paragraph><paragraph id="idF596447631814E6A8BCA8A8781526FA3"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>may waive</quote> and inserting <quote>shall waive</quote>; and</text></paragraph><paragraph id="id23DA0C98A08A4E23921D61A3C8C13A7B"><enum>(3)</enum><text>in subparagraph (C)—</text><subparagraph id="id59A4F491F1E346D29A158B3758A52888"><enum>(A)</enum><text>in the subparagraph header, by striking <quote><header-in-text level="subparagraph" style="OLC">Conditions</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Requirements</header-in-text></quote>; and</text></subparagraph><subparagraph id="id3CCFC0F9F2FA4B68BCA8749114B687C5"><enum>(B)</enum><text>by striking <quote>may not offer dental-only supplemental coverage under this paragraph unless the State satisfies the following conditions</quote> and inserting <quote>shall offer dental-only supplemental coverage under this paragraph in accordance with the following requirements</quote>.</text></subparagraph></paragraph></subsection><subsection id="idAC7AFE8C0958410C9B1968C5FB1E596A"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
