STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Secretary of Veterans Affairs to require the employees of the Department of Veterans Affairs to receive training developed by the Inspector General of the Department on reporting wrongdoing to, responding to requests from, and cooperating with the Office of Inspector General of the Department, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Office of Inspector General Training Act of 2023 </short-title></quote>.</text></section><section id="ida730f219fb5545cd9db5d66d5a4e5eac" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Department of Veterans Affairs employee training regarding Office of Inspector General</header><subsection id="idb9b56f815e0e4c77ab467fcdd5fd1360" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Training</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall require each employee of the Department of Veterans Affairs who begins employment with the Department on or after the date of the enactment of this Act to receive training that the Inspector General of the Department shall develop on the reporting of wrongdoing to, responding to requests from, and the duty of cooperating with the Office of Inspector General of the Department.</text></subsection><subsection id="ida6fb7fd850dd4f94aa275ac44e624810" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Timing of training</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary shall require each employee of the Department covered under such subsection to undergo the training required by such subsection not later than one year after the date on which the employee begins employment with the Department.</text></subsection><subsection id="ide0349ac72c484281a2c0b5f52222485b" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">Training developed and required under subsection (a) shall include the following:</text><paragraph id="ide42762e8318b437ebdc01278473edc34" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Definition of the role, responsibilities, and legal authority of the Inspector General of the Department and the duties of employees of the Department for engaging with the Office of Inspector General.</text></paragraph><paragraph id="idccbb7ca1375f40d487ea11a631892a8a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Identification of Federal whistleblower protection rights, including the right to report fraud, waste, abuse, and other wrongdoing to Congress.</text></paragraph><paragraph id="idd6540d5a267a4039b5c3781c0b042791" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Identification of the circumstances and mechanisms for reporting fraud, waste, abuse, and other wrongdoing to the Inspector General, including making confidential complaints to the Inspector General.</text></paragraph><paragraph id="id9da4537016e04173b98b1ad962948921" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Identification of the prohibitions and remedies that help to protect employees of the Department from retaliation when reporting wrongdoing to the Inspector General.</text></paragraph><paragraph id="id71a1dbbedd704655ad30d16d1ecf0e84" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Recognition of opportunities to engage with staff of the Office of Inspector General to improve programs, operations, and services of the Department.</text></paragraph><paragraph id="id662af7a76bf44e9fa4cc23c0d7d165c1" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Notification of the authority of the Inspector General to subpoena the attendance and testimony of witnesses, including former employees of the Department, as necessary to carry out the duties of the Office of Inspector General under section 312 of title 38, United States Code.</text></paragraph></subsection><subsection id="iddeee65473dad4ffa8d8943d04290adfe" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Design and update</header><text display-inline="yes-display-inline">The Inspector General of the Department shall design, and update as the Inspector General considers appropriate, the training developed and required by subsection (a).</text></subsection><subsection id="idd6cc25fd8917408091717516ac29bcc3" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">System</header><text display-inline="yes-display-inline">The Secretary shall provide, via the talent management system of the Department, or successor system, the training developed and required under subsection (a).</text></subsection><subsection id="id6c40195c02394e63abb0b681f66e1257" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Relation to certain training</header><text display-inline="yes-display-inline">The Secretary shall ensure that training developed and required under subsection (a) is separate and distinct from training provided under section 733 of title 38, United States Code.</text></subsection><subsection id="idac16835dda114589891f9e1104c7ba3a" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Notice to employees</header><text display-inline="yes-display-inline">The Secretary shall ensure that the Inspector General is afforded the opportunity, not less frequently than twice each year and more frequently if the Inspector General considers appropriate under extraordinary circumstances, to use the electronic mail system of the Department to notify all authorized users of such system of the following:</text><paragraph id="ide594593be901443c973133936592b366" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The roles and responsibilities of the employees of the Department when engaging with the Office of Inspector General.</text></paragraph><paragraph id="id3f895d135d614fb1b109f5efdc20e014" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The availability of training provided under subsection (a).</text></paragraph><paragraph id="id9881a3f8d54349b7900bde41b8b3c73b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">How to access training provided under subsection (a).</text></paragraph><paragraph id="idbb6ad7ad1d2e4b2097dfd8f631740788" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Information about how to contact the Office of Inspector General, including a link to any website-based reporting form of the Office.
