which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act to establish a designation of state sponsor of wrongful or unlawful, and for other purposes.</official-title></form><legis-body id="H02A5CB1B20D04D66A539B7C7024AE566" style="OLC"><section id="HB8A5C4D53288413D8FD6BF2BC5B8560A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Sponsor of Wrongful or Unlawful Detention Act</short-title></quote>.</text></section><section id="H50D779206E684CEABF6CC8929D94FB28"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress as follows:</text><paragraph id="HE49639D1D7BA4B1594C482EB2C38A93E"><enum>(1)</enum><text display-inline="yes-display-inline">There has been a significant rise in the wrongful detention of United States nationals and lawful permanent residents by both state and non-state actors in foreign countries, often used as a tactic for diplomatic leverage to threaten the United States and the American people.</text></paragraph><paragraph id="H09AC29C92EB3404690FABEC501D644F2"><enum>(2)</enum><text>Existing mechanisms to hold foreign actors accountable for wrongful detentions and the practice of hostage diplomacy are insufficient.</text></paragraph><paragraph id="H9CEC9A27EA38424CA3B8902176461CD6"><enum>(3)</enum><text>Wrongful detentions and hostage taking pose a threat to United States national security, violate fundamental human rights, and undermine international law and norms.</text></paragraph><paragraph id="H4160C22E884A4CBB84DC55C1C85CAF1B"><enum>(4)</enum><text>It is the responsibility of the United States Government to protect its nationals and lawful permanent residents from wrongful detention and to provide recourse, justice, and a pathway to compensation for victims.</text></paragraph></section><section id="HE22C825EBA3844C39BF886D51E97AA3B"><enum>3.</enum><header>Designation of state sponsor of wrongful or unlawful detention</header><text display-inline="no-display-inline">The Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1741">22 U.S.C. 1741 et seq.</external-xref>) is amended—</text><paragraph id="H49EACB36A22847B899C68CBDAE5456A5"><enum>(1)</enum><text>by redesignating sections 307 and 308 as sections 308 and 309, respectively; and</text></paragraph><paragraph id="H7750C185886248AE97CD1F3D46339F93"><enum>(2)</enum><text>by inserting after section 306 the following:</text><quoted-block style="OLC" id="HE894502752E5454096F2EFFD04ABB1C3" display-inline="no-display-inline"><section id="H59644F5512414F57B245BF0473D22D8F"><enum>307.</enum><header>Designation of state sponsor of wrongful or unlawful detention</header><subsection id="H694B7C96BDDA486A941315F5210FEC60"><enum>(a)</enum><header>Penalties for designation</header><paragraph id="H9F55B0CAE0FC4749A5627FC82BCD4893"><enum>(1)</enum><header>In general</header><text>Any country the government of which the Secretary of State designates as a state sponsor of wrongful or unlawful detention under this section shall—</text><subparagraph id="H11E4CB4192F54704BB709006A2B1A782"><enum>(A)</enum><text display-inline="yes-display-inline">be subject to sanctions under relevant provisions of law, including visa sanctions with respect to government officials of such country; and</text></subparagraph><subparagraph id="H80359D2834134E59A5503C20CBD13E47"><enum>(B)</enum><text>be prohibited from receiving foreign assistance under relevant provisions of law.</text></subparagraph></paragraph><paragraph id="HCF2CD52FC66F45849365334F359765C9"><enum>(2)</enum><header>Public notice</header><text display-inline="yes-display-inline">The Secretary of State shall—</text><subparagraph id="H23A655F1E6354D0DA808D2F98ED90F75"><enum>(A)</enum><text>update travel advisories to reflect the designation of countries as state sponsors of arbitrary detention under this section; and</text></subparagraph><subparagraph id="HC2CB27E04007436ABEA00E3E229CF977"><enum>(B)</enum><text>work with airlines to provide a warning to potential travelers to such designated countries.</text></subparagraph></paragraph></subsection><subsection id="HA17EAA733FDF4ED18E0FA8AE82127CB1"><enum>(b)</enum><header>Criteria for designation</header><text display-inline="yes-display-inline">A country may be designated as a state sponsor of wrongful or unlawful detention under this section if the Secretary of State determines that the government of such country has provided support for or directly engaged in the wrongful detention of United States nationals based on one or more of the following:</text><paragraph id="HB399B116FCD84E1599B669A0844F3330"><enum>(1)</enum><text display-inline="yes-display-inline">The repeated wrongful detention or hostage taking of United States nationals as provided for in this Act.</text></paragraph><paragraph id="HE06BBBEAA17842FA83F39459BF25EAC9"><enum>(2)</enum><text display-inline="yes-display-inline">The repeated failure of the foreign government to resolve a wrongful detention once notified by the Department of State as provided for in this Act.</text></paragraph><paragraph id="H4A0D6AA06DE941F9B2D587E37905A38A"><enum>(3)</enum><text>Actions that indicate the complicity or active support of the government of such country for engaging in wrongful detentions or hostage taking.</text></paragraph><paragraph id="H7B48060AD61A4DD0AB0588CC0BFFE798"><enum>(4)</enum><text>Actions that pose, in the judgment of the Secretary, a sufficient risk of wrongful detention or hostage taking of United States nationals in such country.</text></paragraph></subsection><subsection id="H63C27F39E46A47298BFA100EEFF2F964"><enum>(c)</enum><header>Congressional notification</header><text>The Secretary of State shall notify the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate not later than 30 days after each determination to designate a country as a state sponsor of wrongful or unlawful detention under this section.</text></subsection><subsection id="HF8A4075C4E034AB7A574DDE867872D66"><enum>(d)</enum><header>Withdrawal of designation</header><text display-inline="yes-display-inline">A designation as a state sponsor of wrongful or unlawful detention may be removed or withdrawn with respect to a country if the Secretary of State certifies to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate that—</text><paragraph id="HBCF55CDD530F4835B6BC86FA547D7733"><enum>(1)</enum><text display-inline="yes-display-inline">the government of such country is no longer supporting acts of wrongful detention or hostage taking; and</text></paragraph><paragraph id="H559C51CE3DDF4BE88DD786D776DF47B2"><enum>(2)</enum><text>such government has provided evidence-based assurances to the Secretary that it will not support and actively oppose acts of wrongful detention or hostage taking in the future.</text></paragraph></subsection><subsection id="H25B26CBB98534810B9E9E8DEFB71A8A8"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to alter or affect the authorities of the Secretary of State with respect to determining that the detention in a foreign country of a United States person is wrongful pursuant to this Act or any other provision of law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H777B605A075D492B8CE70D7A70F974A3"><enum>4.</enum><header>Other modifications to the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act</header><text display-inline="no-display-inline">The Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act is amended—</text><paragraph id="H55C0457EC1D24FD68989ECB1EFB9ACF8"><enum>(1)</enum><text>in section 303(c) (<external-xref legal-doc="usc" parsable-cite="usc/22/1741a">22 U.S.C. 1741a(c)</external-xref>)—</text><subparagraph id="H1FC425CB9378434AAB0FC888A4411B8A"><enum>(A)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively;</text></subparagraph><subparagraph id="H668DAA6EDEB643F79DBBB3AB250D05B2"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="HF81B55C33747433E9F874CB0FFE7CFB9" display-inline="no-display-inline"><paragraph id="HAC77AA544A8D47ADAF39C653592A9F54"><enum>(3)</enum><text display-inline="yes-display-inline">chair the Hostage Response Group and regularly convene the group in accordance with section 305;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H0B1602BF92514CCBB3155D9B12C55902"><enum>(C)</enum><text>in paragraph (6) (as so redesignated), by inserting <quote>or held hostage</quote> after <quote>unlawfully or wrongly detained</quote>; and </text></subparagraph></paragraph><paragraph id="H976F87E97FCF43089B726397B701CEA3"><enum>(2)</enum><text display-inline="yes-display-inline">in section 305 (<external-xref legal-doc="usc" parsable-cite="usc/22/1741c">22 U.S.C. 1741c</external-xref>)—</text><subparagraph id="H19E3C52DD0DA45A8B938DE0B5F46DD07"><enum>(A)</enum><text>in subsection (a), by striking <quote>a designated member of the National Security Council or the Deputies Committee of the National Security Council</quote> and inserting <quote>the Special Envoy appointed pursuant to section 303</quote>; and</text></subparagraph><subparagraph id="H55D338A34DEC43F6B8A717252F27AAA2"><enum>(B)</enum><text>in subsection (b), by striking <quote>the Special Envoy appointed pursuant to section 303,</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
