which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a Federal returnship program to strengthen the Federal workforce and to ease re-entry into the workforce for individuals who have taken time away from work, and for other purposes.</official-title></form><legis-body id="H04B7812503E14874878B6B366D70D454" style="OLC"><section id="HB72CE694B8C1492F8E5A07CBE3BF7B48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Return USA Act</short-title></quote>. </text></section><section id="HF4C6354275DF47D9A97A6E4F5E09FA20"><enum>2.</enum><header>Purpose; findings</header><subsection id="HD21CBEA5B9D446AF88762F1B94A59D10"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this Act to establish a pilot returnship program for Federal civilian employment to expand opportunities in the Federal civilian service for experienced, highly qualified mid-career professionals who are seeking to return to the workforce after a career break.</text></subsection><subsection id="H91DA3A48A8E34314A98C518C471E8611"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds as follows:</text><paragraph id="HE2DD7F625299403EAB5BD817E5841CC2"><enum>(1)</enum><text display-inline="yes-display-inline">To best represent and serve communities across the United States, it is critical that the Federal Government is able to attract and retain the best and brightest to its workforce.</text></paragraph><paragraph id="HAA6B1D974F29415292CE72B7295769AC"><enum>(2)</enum><text>According to the 2022 Federal Workforce Priorities Report, the Office of Personnel Management has identified several key areas for workforce development to ensure the highly skilled and specialized Federal workforce can meet emerging needs.</text></paragraph><paragraph id="H6CF36A66D816489A9930451B79A78507"><enum>(3)</enum><text>Returnship programs, which help highly qualified, highly skilled mid-career professionals to re-enter the workforce after a career break, are utilized at over one-third of Fortune 50 companies to help meet workforce needs, according to an analysis by iRelaunch as of 2023.</text></paragraph><paragraph id="HD52E47B3FE1B430A8717328B642A3CAE"><enum>(4)</enum><text>In April 2021, the State of Utah founded the first public returnship program in the United States (Return Utah) to meet workforce needs for mid-level State government positions.</text></paragraph><paragraph id="H9779D71EE02A45FFB56BB34B761F3171"><enum>(5)</enum><text display-inline="yes-display-inline">Returnship programs are often used to strengthen opportunities for underrepresented populations, including women who only represent 45 percent of the Federal workforce at large and 40 percent of senior executive positions, according to the Office of Personnel Management.</text></paragraph><paragraph id="H65215849ECAD4976A742D82CA9D9093B"><enum>(6)</enum><text>Many parents, primarily women, leave the workforce when they have young children or aging loved ones and struggle to re-enter.</text></paragraph><paragraph id="HBF60A5EA0B7F4888950FA95A1D18779F"><enum>(7)</enum><text>According to data from the career platform LinkedIn, approximately 43 percent more women list a career break on their profile than men, and the most commonly cited reason for taking a career break was child care.</text></paragraph><paragraph id="HCEDA9B3643BE43159EC64BF5F08A0371"><enum>(8)</enum><text>The <quote>motherhood penalty</quote>, the loss of income, difficulty re-entering the workforce, and slower career progression faced by mothers in the workforce, can have a devastating impact on women and the workforce and economy at large.</text></paragraph><paragraph id="HCCE37F8E23F343F5ACBF0B0D54BDFF57"><enum>(9)</enum><text>Following the birth of their first child, on average, nearly 25 percent of women will leave the workforce in the first year, and 17 percent will remain out of the workforce after 5 years.</text></paragraph><paragraph id="H06DBDAA66539474BBF2E2529B4068DAB"><enum>(10)</enum><text>Some experts estimate that the <quote>motherhood penalty</quote> is now the top driver of the gender pay gap, as mothers experience a 60 percent reduction in earnings in the decade following the birth of their first child compared to fathers.</text></paragraph></subsection></section><section id="H00FDB9EC42454FA79A4B166B06FEED83"><enum>3.</enum><header>Return USA Program</header><subsection id="H2910EB209D614FE6869158452503D25A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall establish a Federal returnship pilot program at one or more Federal agency. Such programs shall be known and designated as the <quote>Return USA Program</quote>. The Program shall—</text><paragraph id="HB66B7D23B40142809F5784519664BD89"><enum>(1)</enum><text>target Federal civilian workforce needs; and</text></paragraph><paragraph id="H92E007AF990140FFB70FAEE3E1EB6A50"><enum>(2)</enum><text>assist professionals with at least 3 years of prior work experience to re-enter the workforce, in civil service positions that are above entry-level and commensurate with their skills and experience, after a career break of at least 1 year that was unrelated to work performance or solely for the pursuit of additional educational degrees, including a break due to child or elder care, time after military service or while a spouse was serving in the military service, or personal health concerns.</text></paragraph></subsection><subsection id="H6308865429394CDDA434D3709D2DCB99"><enum>(b)</enum><header>Requirements</header><text>The Program shall—</text><paragraph id="H1A609A3664DF44A183501AA475FF59D4"><enum>(1)</enum><text display-inline="yes-display-inline">draw upon best practices from existing State and private sector returnship programs to inform the structure, supports, and implementation of the Program; </text></paragraph><paragraph id="H89EDD424B7B44BD0AB5299B92B5D8E0A"><enum>(2)</enum><text>provide onboarding, training, mentorship, and professional and leadership development opportunities to support and foster a Federal leadership trajectory for participants;</text></paragraph><paragraph id="HF3B21A0B64DD409496953885383806E9"><enum>(3)</enum><text>create cohorts of current and former Program participants to foster community and support systems; </text></paragraph><paragraph id="H353C479A4B2949D1BC72D0E13017F61A"><enum>(4)</enum><text>last no less than one year in duration for each participant; and</text></paragraph><paragraph id="H984E089C5F7D42EF9E27FD9DAD896CD9"><enum>(5)</enum><text>prioritize providing opportunities for underrepresented populations and, to the extent available, provide wraparound supports, including child care.</text></paragraph></subsection><subsection id="H047A06E1CB2445449C0B9F67D55C1F8D"><enum>(c)</enum><header>Recruitment</header><text>The Director shall work with relevant public and private partners to recruit prospective applicants, including creating a unique Program hiring path on the website USAjobs.gov.</text></subsection><subsection id="HE7D1B9CD9AC5482A96408545A1341050"><enum>(d)</enum><header>Conversion</header><text display-inline="yes-display-inline">The Director may convert any participant who successfully completes the Program, as determined by the Director, to a permanent appointment in the competitive service without further competition.</text></subsection><subsection id="H71AD801940C34F45AA33648A822028E6"><enum>(e)</enum><header>Reports to Congress</header><text>At the end of each of fiscal years 2025 through 2029, the Director shall submit a report on the Program to the Committee on Oversight and Accountability of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate. Each such report shall include an overall description of the status of the Program and key success metrics, including—</text><paragraph id="H9A90315D700646569AB091C31828B812"><enum>(1)</enum><text display-inline="yes-display-inline">the number of Program participants and the aggregate demographic representation of Program participants;</text></paragraph><paragraph id="HA338994A604A47388465273AA1EEBE98"><enum>(2)</enum><text>the number of Program participants retained in permanent, full-time positions following completion of the Program, participant’s GS–level following completion, and agency assignment, and the aggregate demographic representation of Program participants retained and not retained in permanent, full-time positions;</text></paragraph><paragraph id="HA37F52404F484F4B94733C98A9BAE2BE"><enum>(3)</enum><text>opportunities to expand the returnship Programs into additional Federal agencies or departments; and</text></paragraph><paragraph id="HF0C16924FD49440A90FE1480053CA7C3"><enum>(4)</enum><text>impact of the Program on the strength and diversity of the Federal workforce.</text></paragraph></subsection><subsection id="H50991FBA9B554D3EBBF662DA7CA84E91"><enum>(f)</enum><header>Duration</header><paragraph id="H6DE820111A3345DF93DB35978E7E4B28"><enum>(1)</enum><header>In general</header><text>The Program shall operate for a period of three years beginning on the date the Director established the Program under subsection (a). At the end of such period, the Director shall—</text><subparagraph id="HFE9C08DD293B4696A72674128A9C3ACE"><enum>(A)</enum><text>determine whether the Program was successful in hiring and retaining qualified candidates; and</text></subparagraph><subparagraph id="HF88C965532E34D23B20FBC84B207CD02"><enum>(B)</enum><text>submit a report on such determination to the Committee on Oversight and Accountability of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="H266FEF5F04854022ADA015FD1B9BE9F1"><enum>(2)</enum><header>Application</header><text>If the Director determines under paragraph (1)(A) that the Program was successful, the Director shall continue to carry out the Program. The Program shall be terminated on the date of such determination if the Director determines that the Program was not successful.</text></paragraph></subsection><subsection id="H609CD76BF8514CC9869B570A74C953E9"><enum>(g)</enum><header>Definitions</header><text>In this Act—</text><paragraph id="H995E935C43BE4CACBFA52D89E910D1AC"><enum>(1)</enum><text>the term <quote>civil service</quote> has the meaning given that term in section 2101 of title 5, United States Code;</text></paragraph><paragraph id="H53129DD66C7441B5A232497319293E4D"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>competitive service</quote> has the meaning given that term in section 2102 of such title 5;</text></paragraph><paragraph id="HF935D88F4F554E858E0841828BA03FCB"><enum>(3)</enum><text>the term <quote>Director</quote> means the Director of the Office of Personnel Management; </text></paragraph><paragraph id="H5C99FDA1731B45DCB4607698ECCB23DC"><enum>(4)</enum><text>the term <quote>Program</quote> means the Return USA Program established under this Act; and</text></paragraph><paragraph id="H6BC2D6B015934BA98D2AE3206A2D6DF5"><enum>(5)</enum><text display-inline="yes-display-inline">the term <quote>underrepresented populations</quote> means groups who have traditionally not had equal access to economic opportunities because of discrimination or other societal barriers and could include gender, race, ethnicity, disability, or low-income status. </text></paragraph></subsection><subsection id="H96B7752AE83A420C8C5AA7BB1C96C0B9"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $5,000,000 for each fiscal year, beginning with fiscal year 2025, the Program is carried out consistent with the determination under subsection (f)(1). </text></subsection></section></legis-body></bill>
