Rules of construction.</toc-entry></toc></subsection></section><section id="H093C002AC66F4575A7FF4B99E8AF49ED"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H203473637232405388759C78118FF2F0"><enum>(1)</enum><text>grasslands provide vital habitat for a multitude of species which represent the lifeblood of local and regional economies that depend on income generated by sportsmen and women and other forms of outdoor recreation;</text></paragraph><paragraph id="HA2DFFBCF94D848D99EF40EEA25B09A89"><enum>(2)</enum><text>grasslands have been managed for millennia by Indian Tribes through the use of practices referred to as <quote>Indigenous Traditional Ecological Knowledge</quote> to conserve and restore habitat for native flora and fauna, including practices such as restoration and conservation of grassland ecosystems to support continued cultural traditions, including subsistence agriculture, cultural burning, and management of culturally significant wildlife and their ecosystems;</text></paragraph><paragraph id="H52FA82A6D532468C906F0552D38F399E"><enum>(3)</enum><text>the maintenance of healthy populations of grassland species and working lands that are critical for rural economies and carbon sequestration is dependent on the conservation, restoration, and management of grassland ecosystems, which are composed of tallgrass, mixed grass, and shortgrass prairies, sagebrush shrub-steppe, and savannah grasslands (referred to in this Act as <quote>grassland ecosystems</quote>);</text></paragraph><paragraph id="HF7CA9E32790C495190F8DD70AF1E432C"><enum>(4)</enum><text>grassland and rangeland ecosystems provide—</text><subparagraph id="HF434E972F9284272A91B84B5071DACD3"><enum>(A)</enum><text>essential and significant habitat for mammals, pollinators, reptiles, and other wildlife of commercial, recreational, scientific, aesthetic, and cultural value; and</text></subparagraph><subparagraph id="H307B74DD1D94466A9AE5EA070C8189BC"><enum>(B)</enum><text>an abundance of critical ecological services, including forage and hay for grazing livestock, carbon sequestration, carbon storage, drought and flood resilience, water filtration, and water storage;</text></subparagraph></paragraph><paragraph id="HEAE4F489A6434233A328ACC0A96F5F51"><enum>(5)</enum><text>grasslands cover 358,000,000 acres of the United States, 85 percent of which are privately owned and serve as an important habitat for 29 breeding obligate grassland bird species;</text></paragraph><paragraph id="HCFFD9E2571C8498AAA3549D0119A31AE"><enum>(6)</enum><text>sagebrush occupies 161,000,000 acres of 14 Western States;</text></paragraph><paragraph id="H0968E947209645DEBC6580C8A994CA6D"><enum>(7)</enum><text>over the last decade alone, millions of acres of grassland ecosystems in North America have been converted to cropland and residential and commercial development;</text></paragraph><paragraph id="HFAEE3D0D2E2C48D19210FD66C7774143"><enum>(8)</enum><text>grassland ecosystems are threatened by fragmentation, invasive species, wildfire, degradation, and land conversion;</text></paragraph><paragraph id="H46E9509AA021411383DED6D0E793FF15"><enum>(9)</enum><text>on average, about 1,200,000 acres of sagebrush burn each year in the United States due to invasive annual grasses that fuel catastrophic wildfires;</text></paragraph><paragraph id="H4E635A322624470DA2E148DB4F355879"><enum>(10)</enum><text>in addition to wildfires, there has been a decrease in the number of working farms and ranches due to—</text><subparagraph id="H720D3CF31E8448FA9DD6D52983ABBF1D"><enum>(A)</enum><text>pressures to convert or sell land; and</text></subparagraph><subparagraph id="H9577EC6D14324B8DBD9A3D3BE809DD92"><enum>(B)</enum><text>challenges in keeping ranching profitable;</text></subparagraph></paragraph><paragraph id="H5A97020FFE89424DB81EFB0DA76674BE"><enum>(11)</enum><text>effective restoration strategies for land managers of grassland ecosystems require—</text><subparagraph id="H99CDA1DAFC8D4F2881DBE6AA82CA1484"><enum>(A)</enum><text>access to adequate quantities of high-quality, regionally appropriate, and diverse native plant seeds;</text></subparagraph><subparagraph id="HA8299A667AB24CE090E565C4CC763C7E"><enum>(B)</enum><text>science-based guidance on cultivating native plant species; and</text></subparagraph><subparagraph id="H0EFB6946D458486B8BC2AD01600EF516"><enum>(C)</enum><text>as stated in the National Seed Strategy for Rehabilitation and Restoration developed by the Plant Conservation Alliance and chaired by the Director of the Bureau of Land Management, more research on seedling establishment and species interaction in order to increase the use of native plant species;</text></subparagraph></paragraph><paragraph id="HF6002DA2EE6B4CDBAC2A5B60DF70E1B5"><enum>(12)</enum><text>many plant species most often associated with grassland and rangeland ecosystems are drought tolerant, characteristics that will help ensure the viability of critical wildlife habitat and other ecosystem services in the face of increased drought prevalence brought on by the effects of climate change;</text></paragraph><paragraph id="HDE1F3BC483BA4197B8EC6C434733FECA"><enum>(13)</enum><text>grassland and rangeland ecosystems are often comprised of disturbance-dependent communities that rely on disturbances such as fire to maintain the desired plant community composition, reduce fuel loading, and arrest ecological succession;</text></paragraph><paragraph id="HCA3E66BDDA3D4B0B82D26FEF14F8F6EB"><enum>(14)</enum><text>beneficial fire, when scientifically applied and in accordance with local fire prescriptions, is a critical tool in the maintenance of grassland and rangeland ecosystems, particularly in the face of climate change which has been linked to an increase in the frequency and intensity of wildfires in areas in which beneficial fire has been excluded and fuel loading is high;</text></paragraph><paragraph id="H02AD27B09EB1477BAEC482D726D987FD"><enum>(15)</enum><text>the migratory bird treaty obligations of the United States with Canada, Mexico, and other countries require conservation of grasslands and rangelands that are used by migratory birds for breeding, wintering, or migration and are needed to achieve and to maintain optimum population levels, distributions, and patterns of migration;</text></paragraph><paragraph id="H87F1D660671F4D6288D76B94557E2D33"><enum>(16)</enum><text>the 1988 amendments to the Fish and Wildlife Conservation Act of 1980 require the Secretary of the Interior to identify conservation measures to assure that nongame migratory bird species do not reach the point at which measures of the Endangered Species Act are necessary; and</text></paragraph><paragraph id="H478152C4BEDC4A688EC1D9030E781157"><enum>(17)</enum><text>conservation of migratory birds and their habitats requires long-term planning and the close cooperation and coordination of management activities by Canada, Mexico, and the United States within the framework of the North American Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4401">16 U.S.C. 4401 et seq.</external-xref>), the 1916, 1969, and 1986 Migratory Bird Conventions, and the Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere.</text></paragraph></section><section id="HAB2271FB8D7A4B9B82DFF51E29575003"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to take bold action to conserve and restore grasslands in North America while supporting ranchers, farmers, Indian Tribes, sportsmen and sportswomen, rural communities, and other interests by drawing from existing conservation plans, programs, and models with a proven track record of success through—</text><paragraph id="H1E33ACBA1A4D42B08804F002D58F5D78"><enum>(1)</enum><text>encouraging voluntary grassland conservation and restoration as an alternative to additional conversion and loss of native grasslands ecosystems and sustaining those ecosystems as working lands by creating a flexible, voluntary, and innovative grant program;</text></paragraph><paragraph id="HF45DCB1BB5234699B68B065AD6565A1C"><enum>(2)</enum><text>improving grassland and rangeland health and management;</text></paragraph><paragraph id="H66DC5AB515B54B71A12F2DDA2BC34575"><enum>(3)</enum><text>restoring marginal lands to native grasslands in areas that were historically grasslands;</text></paragraph><paragraph id="HBD1BE5D8710647AABBA27D514DD2DE43"><enum>(4)</enum><text>mitigating the impacts of severe drought and wildfire on grasslands;</text></paragraph><paragraph id="H4750B845E9BE4CBEBDE958AC4F695A28"><enum>(5)</enum><text>supporting farmer and rancher stewards, private landowners, and Tribal partners;</text></paragraph><paragraph id="H4E8D8FF5E88D4D0DBA6B16B57986AC9B"><enum>(6)</enum><text>improving biodiversity and habitat for grassland and sagebrush birds, pollinators, and other wildlife;</text></paragraph><paragraph id="H30DEFABC05EB410E9CEB51CD8BBD084D"><enum>(7)</enum><text>increasing carbon sequestration and carbon storage;</text></paragraph><paragraph id="HAF7C7EC2A069478DA6CF9C0FF930191A"><enum>(8)</enum><text>providing increased wildlife-dependent recreational and hunter and angler access opportunities, at the discretion of private landowners;</text></paragraph><paragraph id="HBD04F5820EFC40BDB04A0918F1AB63A8"><enum>(9)</enum><text>encouraging stronger public-private partnerships in support of landscape-level grassland conservation efforts conducted by State fish and wildlife agencies, Indian Tribes, regional and Federal entities, nongovernmental organizations, farmers and ranchers, and other stakeholders both in the United States and in Canada and Mexico, and complementing the public-private partnerships working on grassland conservation as of the date of the enactment of this Act, such as the Partners for Fish and Wildlife;</text></paragraph><paragraph id="HE7A48584E30744AF833E1B0246CCBC58"><enum>(10)</enum><text>identifying voluntary opportunities for grassland conservation, restoration, and management not currently available through existing programs; and</text></paragraph><paragraph id="HDAA0AA7866944D2AAF09B2C3215764E9" commented="no"><enum>(11)</enum><text>providing opportunities for Indian Tribes and Tribal organizations to conserve, restore, and manage grasslands, including through—</text><subparagraph id="H7373B3BB63CF4DC1839F9D37980F0B7B" commented="no"><enum>(A)</enum><text>the ethical incorporation of Indigenous Traditional Ecological Knowledge into grassland management and restoration activities; and</text></subparagraph><subparagraph id="H042635C410B54352BC40CF915CC6928A" commented="no"><enum>(B)</enum><text>identifying, encouraging, and providing funding for partnerships between Indian Tribes and Federal agencies to co-manage grassland ecosystems, including ecologically important flora and fauna.</text></subparagraph></paragraph></section><section id="HDE9655CFD2E24AC4AC252E7E5F4257A6"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HFE6F67D3CAAF4ED4B0348A387430E7C5"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Migratory Bird Conservation Commission established by section 2 of the Migratory Bird Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/715a">16 U.S.C. 715a</external-xref>).</text></paragraph><paragraph id="H7F45473C981C4212AE43DE45B7B5877D"><enum>(2)</enum><header>Conservation Strategy</header><text>The term <term>Conservation Strategy</term> means the North American Grasslands Conservation Strategy established under section 7(a).</text></paragraph><paragraph id="HC0DDD0AAB3A04A8F9DEC426213E55D18"><enum>(3)</enum><header>Council</header><text>The term <term>Council</term> means the North American Grasslands Conservation Council established by section 5(a).</text></paragraph><paragraph id="H81717608D79240C694C394E71EA2BDAD"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="H7C1B473840FB4BF4AFB7C63062F45741"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HE96E578C3A934465889A3F18CD55F935"><enum>(A)</enum><text>a grazing land coalition;</text></subparagraph><subparagraph id="H42E4B3CF31024A47AD5F1D56AF599D90"><enum>(B)</enum><text>an agricultural or livestock producer group;</text></subparagraph><subparagraph id="HD2091D16C2B347BC8131ED487B992A55"><enum>(C)</enum><text>an Indian Tribe;</text></subparagraph><subparagraph id="HDBC1E8291CEB4B69B217B5F61F113C88"><enum>(D)</enum><text>a Tribal organization;</text></subparagraph><subparagraph id="H63B4A45721144181BBE6ADD576420842"><enum>(E)</enum><text>a land trust;</text></subparagraph><subparagraph id="H0A6B57C0F6684999AD8EAEE42A4E6837"><enum>(F)</enum><text>a State or local government;</text></subparagraph><subparagraph id="H3FDFCCF8D6494B27B0FB6743E6155ED0"><enum>(G)</enum><text>a Federal agency;</text></subparagraph><subparagraph id="H41DC98B3B34842918C1FDFFE9C67DEC9"><enum>(H)</enum><text>a nongovernmental organization;</text></subparagraph><subparagraph id="HD7583447857E44559710373D22C1E0EC"><enum>(I)</enum><text>a community-based organization;</text></subparagraph><subparagraph id="H2FA0FC10206C4077A7C04F728F710846"><enum>(J)</enum><text>a group of individuals that are private landowners; and</text></subparagraph><subparagraph id="HF2950ADAFE0E425FB845BB0A09C2A8DB"><enum>(K)</enum><text>a regional fish and wildlife agency.</text></subparagraph></paragraph><paragraph id="H936744ADA7A1410486537FC9061DA0CA"><enum>(6)</enum><header>Grasslands</header><text>The term <term>grasslands</term> means tallgrass, mixed grass, shortgrass, native prairie, sagebrush shrub-steppe, savanna grasslands, glades, wet meadows, coastal grasslands, and other related grassland ecosystems, including certain rangelands.</text></paragraph><paragraph id="H162678ADA3B74B38B699888B4DDD21AE"><enum>(7)</enum><header>Grasslands conservation project</header><text>The term <term>grasslands conservation project</term> means any conservation, restoration, protection, or enhancement activity that is carried out with a grant awarded under the Program.</text></paragraph><paragraph id="HB27C91D0D2AF43E49573207D04FCEA34"><enum>(8)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HD3D4ACFF8D6D445AB94F90803A28BE25"><enum>(9)</enum><header>Indigenous Traditional Ecological Knowledge; ITEK</header><text>The terms <term>Indigenous Traditional Ecological Knowledge</term> and <term>ITEK</term> mean observations, oral and written knowledge, practices, and beliefs of Indian Tribes that promote environmental sustainability and the responsible stewardship of natural resources through relationships between humans and environmental systems and are applied to phenomena across biological, physical, cultural, and spiritual systems.</text></paragraph><paragraph id="HCB537920D2134F409FBD0DA0A2592604"><enum>(10)</enum><header>Program</header><text>The term <term>Program</term> means the grant program established under section 8(a).</text></paragraph><paragraph id="HA4DF3E16DBE645C88CE7A1EA425F4F88"><enum>(11)</enum><header>Regional Grasslands Conservation Council</header><text>The term <term>Regional Grasslands Conservation Council</term> means a Regional Grasslands Conservation Council established by section 6(a).</text></paragraph><paragraph id="H7B8B27939137466592AE08589395F36D"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H9D1561082D5140F5BDD3BE0BE94608F9"><enum>(13)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section><section id="H7F497B4F25774BA28357ACDF1E20A66E"><enum>5.</enum><header>North American Grasslands Conservation Council</header><subsection id="HEA65D7C73B3540D3A41AFFA8F4347988"><enum>(a)</enum><header>Establishment</header><text>There is established the North American Grasslands Conservation Council.</text></subsection><subsection id="HCB0DFA8D37DD41DDA217DFA3C3FEF743"><enum>(b)</enum><header>Membership</header><paragraph id="H562AF88FED9E4820839CC1A44382B2F8"><enum>(1)</enum><header>In general</header><text>The Council shall be composed of the following 13 members: </text><subparagraph id="HD844CE2C4FB643D7BB62A4865FE8B5C4"><enum>(A)</enum><text>The Director, who shall be the responsible Federal official for ensuring Council compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph><subparagraph id="HA12A28AFBF114A53918CF8DB47F777FC"><enum>(B)</enum><text>The Chief of the Natural Resources Conservation Service of the Department of Agriculture, who shall coordinate interdepartmental efforts with the Director.</text></subparagraph><subparagraph id="H1A24928B96E946699961E847D8B6E81F"><enum>(C)</enum><text>1 representative of the National Fish and Wildlife Foundation, appointed by the Secretary. </text></subparagraph><subparagraph id="HC4998360FF1E4DA58947A79AB315B506"><enum>(D)</enum><text>4 members who shall each—</text><clause id="H01C495B5786649589418316C5F649B65"><enum>(i)</enum><text>be appointed by the Secretary;</text></clause><clause id="HB9CFCA8B8E074D558CA46E2E35CEDEB5"><enum>(ii)</enum><text>be a director of a State fish and wildlife agency; and</text></clause><clause id="H96A76EEA5F41454694150D08D9FF60FB"><enum>(iii)</enum><text>represent a different regional association.</text></clause></subparagraph><subparagraph id="H29D137AD2BF548D884B5268EA9B4FE16" commented="no"><enum>(E)</enum><text>2 members who shall each—</text><clause id="H236B02BBF5C746F3B652A6971E12E78A" commented="no"><enum>(i)</enum><text>be appointed by the Secretary;</text></clause><clause id="H36D6936DA29E41BE84883BD7DBE59F83" commented="no"><enum>(ii)</enum><text>be a director, or an equivalent role, of a natural resources agency of an Indian Tribe; and</text></clause><clause id="H1A118092A6F34FE88CA3E18FA33AB1E6" commented="no"><enum>(iii)</enum><text>represent a different intertribal organization dedicated to natural resources and the environment.</text></clause></subparagraph><subparagraph id="HE5BCA406D50E4F049E27565737EB512C"><enum>(F)</enum><text>2 members who shall each—</text><clause id="H778A14EBA5B84A4CB80E08DD7FACBAA7"><enum>(i)</enum><text>be appointed by the Secretary of Agriculture; and</text></clause><clause id="H2846D100DD68455484390FC2DB2AFA76"><enum>(ii)</enum><text>represent a separate working lands organization that represents landowners, farmers, or ranchers actively participating in carrying out voluntary grasslands conservation projects. </text></clause></subparagraph><subparagraph id="HF1AAE4749C924C80AEA351469CD88220"><enum>(G)</enum><text>2 members, of whom—</text><clause id="H8F0BBEAE1CCA4BCDB8A4130224BC5452"><enum>(i)</enum><text>both shall be appointed by the Secretary; vacancies</header><subparagraph id="HEB89B4233D1941AEB9BB69C8BA2DB2D7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a member of the Council shall serve for a term of 3 years.</text></subparagraph><subparagraph id="HDE964756554740DC8C53FB8B28A33EF5"><enum>(B)</enum><header>Initial appointments</header><clause id="H50B76570F0D54EBCAF16728D70AF6E4E"><enum>(i)</enum><header>Directors of State fish and wildlife agencies</header><text>Of the members first appointed under paragraph (1)(D)—</text><subclause id="HC97977E193C5453AABCBAEED0E04555D"><enum>(I)</enum><text>1 shall be appointed for a term of 1 year;</text></subclause><subclause id="H929FB153E85D4D198F05D8A5FEFFF102"><enum>(II)</enum><text>2 shall be appointed for a term of 2 years; and</text></subclause><subclause id="H111D98609B754AD2A782C9CBEC6CA563"><enum>(III)</enum><text>2 shall be appointed for a term of 3 years.</text></subclause></clause></subparagraph><subparagraph id="H2C48DD9E739C4C3CAFA4D8D106D6D880"><enum>(C)</enum><header>Vacancies</header><clause id="H59E52C4D228E4AF28A3DB5DB391CFC1B"><enum>(i)</enum><header>In general</header><text>With respect to a member appointed to the Council under subparagraphs (C) through (G) of paragraph (1), a vacancy in the Council shall be filled in accordance with that subparagraph for the remainder of the applicable term of that member.</text></clause><clause id="H7B59479A901C4659BDAB722ED4E2A495"><enum>(ii)</enum><header>Alternate members</header><text>Until a vacancy referred to in clause (i) is filled, or in the event of an anticipated absence of a member described in that clause from any meeting of the Council, the Secretary shall appoint an alternate member to the Council who shall—</text><subclause id="H0D3F6766F6F343CBBDF5FAC22A14E0FF"><enum>(I)</enum><text>be knowledgeable and experienced in matters relating to grasslands conservation and restoration; and</text></subclause><subclause id="HD9C9F00E150641EAAF6BA7956409473D"><enum>(II)</enum><text>perform the duties of a member appointed to the Council under subparagraphs (C) through (G) of paragraph (1).</text></subclause></clause></subparagraph></paragraph><paragraph id="H7F342C44E02A48098A52B33B54338652"><enum>(3)</enum><header>Ex officio members</header><text>The Secretary may include as ex officio, nonvoting members of the Council—</text><subparagraph id="H1741847433EF4A7FAE5BF4C89E2A4BE9"><enum>(A)</enum><text>the Under Secretary for Farm Production and Conservation of the Department of Agriculture;</text></subparagraph><subparagraph id="HCE5CA2FA390543CC9CF1BFF0FE584A8D"><enum>(B)</enum><text>the Under Secretary for Natural Resources and Environment of the Department of Agriculture; and</text></subparagraph><subparagraph id="HC5C8BDB02B484A9990490CC9059C5C14"><enum>(C)</enum><text>representatives of—</text><clause id="HB4A755A2CAD444B59CD094955D0A7628"><enum>(i)</enum><text>other appropriate Federal, State, or Tribal Government agencies that are actively participating in grasslands conservation projects or have technical expertise in grasslands conservation;</text></clause><clause id="H17C83A8204FA47BC83C0BC39255D44F5"><enum>(ii)</enum><text>the Federal, provincial, territorial, Indigenous, or State government agencies of Canada and Mexico that are actively participating in carrying out grasslands conservation projects;</text></clause><clause id="H9E969607FAE9439F9B5D30A72CC0E018"><enum>(iii)</enum><text>nonprofit charitable organizations that are actively participating in grasslands conservation projects; and</text></clause><clause id="H23B57D2456AF405791383DD98C697100"><enum>(iv)</enum><text display-inline="yes-display-inline">Tribal organizations that are actively participating in grasslands conservation projects.</text></clause></subparagraph></paragraph><paragraph id="H0D6565442EDC49B1BEF90DD1789EB70C"><enum>(4)</enum><header>Chairperson</header><subparagraph id="H034469F05E464B518B00098C5CFDE554"><enum>(A)</enum><header>In general</header><text>The Council shall select a Chairperson from among the members of the Council.</text></subparagraph><subparagraph id="HFFD246EBF62A4BC7BBACDBF3E62A10B7"><enum>(B)</enum><header>Term</header><text>A Chairperson shall serve for a 3-year term, except that the first selected Chairperson may serve for an initial term of less than 3 years.</text></subparagraph></paragraph><paragraph id="HC123A7127A294B11A06C5A0D39DDFF2B"><enum>(5)</enum><header>Vice chair</header><subparagraph id="H6D028AD00FE64937B59FAF4F0DA438DC"><enum>(A)</enum><header>In general</header><text>The Chairperson shall select a Vice Chair from among the members of the Council.</text></subparagraph><subparagraph id="H781BCAA600394C39B63F736D86936B45"><enum>(B)</enum><header>Term</header><text>A Vice Chair shall serve for a 2-year term, except that the first selected Vice Chair may serve for an initial term of less than 2 years.</text></subparagraph></paragraph></subsection><subsection id="H29BFD6C398754BFFA4363F006DDCA570"><enum>(c)</enum><header>Meetings</header><paragraph id="HB122707ABCA249E19C521B0E69314188"><enum>(1)</enum><header>In general</header><text>The Council shall meet at the call of the Chairperson.</text></paragraph><paragraph id="H811B0AE1C45041E39A48D445C802911A"><enum>(2)</enum><header>Frequency</header><text>The Council shall meet not less frequently than once per year.</text></paragraph><paragraph id="HE7DE2EEB0779445B850F49E3C5D2C300"><enum>(3)</enum><header>Format</header><text>A meeting of the Council may be conducted in person, virtually, or in a hybrid format.</text></paragraph><paragraph id="HC878D01A03C84C94ADA519625D468F26"><enum>(4)</enum><header>Availability</header><text>Meetings of the Council shall be open to the public, and the Council shall give public notice of the time and place of such meetings.</text></paragraph><paragraph id="H99CA1F21812B42D9835C1FF85DDBAA9B"><enum>(5)</enum><header>Quorum</header><text>A majority of the members of the Council shall constitute a quorum for the transaction of business. </text></paragraph></subsection><subsection id="H6F81C831FF9E44EBA21F21A0268EAACC"><enum>(d)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="H92A0F036004445869B31C7B8B3588B4D"><enum>(1)</enum><text>provide input to the Director in the development of the Conservation Strategy;</text></paragraph><paragraph id="HC2E76ED59F8D4494A02FAA3F863C1062"><enum>(2)</enum><text>establish publicly available project evaluation criteria for applications submitted under the Program;</text></paragraph><paragraph id="HB168FE15954341DD92CB0E6BAA430906"><enum>(3)</enum><text>recommend grasslands conservation projects to the Commission in accordance with section 9;</text></paragraph><paragraph id="H26BCCB634EBC483C87B84A580F0AC45E"><enum>(4)</enum><text>receive input from regional conservation entities who have a vested interest in developing multi-State and Tribal conservation plans; and</text></paragraph><paragraph id="HCC9F6EEB44C94D48A412FC935A2D4A93"><enum>(5)</enum><text>provide annual updates on the status of the objectives and goals identified in the Conservation Strategy to the Commission.</text></paragraph></subsection><subsection id="H14B3BC795C0B4105A4C1EDD2FC41804F"><enum>(e)</enum><header>Compensation</header><text>A member of the Council shall receive no compensation as a result of serving on the Council.</text></subsection><subsection id="H4CEA5EB13F4741A186E18BF3FF01CDF9"><enum>(f)</enum><header>FACA applicability</header><text>Chapter 10 of part I of title 5, United States Code, shall not apply to the Council.</text></subsection></section><section id="H832CD41450884D0B912ECA2C6E8BC360"><enum>6.</enum><header>Regional Grasslands Conservation Councils</header><subsection id="H62C28CA06CBE47B7B13E654194295D43"><enum>(a)</enum><header>In general</header><text>There is established a Regional Grasslands Conservation Council for each region of the United States Fish and Wildlife Service.</text></subsection><subsection id="HBA83A2E450F74781BDD5975C008A71DA"><enum>(b)</enum><header>Membership</header><text>Each Regional Grasslands Conservation Council shall be composed of not more than 10 members, which shall include—</text><paragraph id="HCD2D9C08DAF741CCA5E9EAF49D64F946"><enum>(1)</enum><text>representatives of nongovernmental and Tribal organizations representing the conservation community;</text></paragraph><paragraph id="HB4A4982E0F1B42599D1C54E7B582F4F1"><enum>(2)</enum><text>representatives from Tribal Governments;</text></paragraph><paragraph id="HF3ECE887CBC24F25A34D8E0EBB431D86"><enum>(3)</enum><text>representatives of rancher and farming interests;</text></paragraph><paragraph id="H1C11F9C9190A48F686F0C78DA70DB46F"><enum>(4)</enum><text>representatives from State fish and wildlife agencies; and</text></paragraph><paragraph id="H9B6E4551A3E74AB4A871688BEED77EE8"><enum>(5)</enum><text>any other representatives, as determined necessary by the Secretary in coordination with the Council.</text></paragraph></subsection><subsection id="H8AF956A72882407C8E814C91DC1357A8"><enum>(c)</enum><header>Recommendations</header><text>Each Regional Grasslands Conservation Council shall provide recommendations to the Council regarding—</text><paragraph id="HC490B35187F94BBC97A802C7E3F65465"><enum>(1)</enum><text>the selection of grasslands conservation projects; and</text></paragraph><paragraph id="HCC2D0730E31C46D0AE9ED3B6B68B9FAA"><enum>(2)</enum><text>key grasslands conservation strategies with respect to the region served by such Regional Grasslands Conservation Council that draw from established regional grasslands conservation plans.</text></paragraph></subsection><subsection id="H8AF2420FCCCF48EC91C2A969EFE9C03F"><enum>(d)</enum><header>FACA applicability</header><text>Chapter 10 of part I of title 5, United States Code, does not apply to a Regional Grasslands Conservation Council.</text></subsection></section><section id="H1867DB071F2741A294B502E5F04AA75C"><enum>7.</enum><header>North American Grasslands Conservation Strategy</header><subsection id="H695111796E244F8A9656F16A0C45391D"><enum>(a)</enum><header>In general</header><text>After the appointment of the first 7 of the initial members of the Council under section 5(b), the Director shall, in consultation with the Council—</text><paragraph id="HAB15F892B2DB443F939E1C6AC1EDA24B"><enum>(1)</enum><text>develop a coordinated strategy, to be known as the <quote>North American Grasslands Conservation Strategy</quote>, for the conservation, restoration, and management of grasslands ecosystems across North America; and</text></paragraph><paragraph id="H3E74EE0C8C914582B868C42413D8C535"><enum>(2)</enum><text>support implementation, monitoring, and communication efforts relating to the Conservation Strategy.</text></paragraph></subsection><subsection id="HA531035981AA42C7BB6EC9BADA31AB22"><enum>(b)</enum><header>Existing conservation plans and frameworks</header><text>The Conservation Strategy shall draw from existing local, State, regional, and international conservation plans and frameworks, conservation plans of Indian Tribes, and State wildlife action plans, with an emphasis on supporting existing science- and ITEK-based frameworks.</text></subsection><subsection id="HE92196ED84F64116AD2B8395B5C54B18"><enum>(c)</enum><header>Inclusion</header><text>The Conservation Strategy shall—</text><paragraph id="H1173BAD99FE6492A9A16B023DBD2A8E3"><enum>(1)</enum><text>identify key areas with—</text><subparagraph id="HB5421312F0BB437CAE251F936F0CACC8"><enum>(A)</enum><text>grasslands at high risk of—</text><clause id="HE893B4D38E4948F9BC3866E182C457C2"><enum>(i)</enum><text>conversion to cropland or residential or commercial development;</text></clause><clause id="HED14673230404E168C10A34A2C58A8A4"><enum>(ii)</enum><text>shrub or woody encroachment; or</text></clause><clause id="HE88EF6FD0D5B4EF6978DA79C8727E14D"><enum>(iii)</enum><text>invasion of annual grasses or other undesired vegetation;</text></clause></subparagraph><subparagraph id="H776A3B0ED14F4BBD86DADFE1E73B36DF"><enum>(B)</enum><text>the highest potential of conserving native grasslands, restoring grasslands, and reducing fragmentation;</text></subparagraph><subparagraph id="H6F965C821A4B4B96A40FC681FDF6288C"><enum>(C)</enum><text>ecologically and culturally significant grasslands remnants;</text></subparagraph><subparagraph id="H0B63C8F0507142CA9DAA3D4A49DFC27C"><enum>(D)</enum><text>populations of grasslands-dependent species of greatest conservation need, as identified in—</text><clause id="H906483F6A9904641954EEBB1DF550764"><enum>(i)</enum><text>State wildlife action plans;</text></clause><clause id="H47B3520F82BD4A0481623F61882BBC02"><enum>(ii)</enum><text>Tribal conservation plans;</text></clause><clause id="H2E01318972604215B536C5AC5C511BBF"><enum>(iii)</enum><text>the report of the United States Fish and Wildlife Service titled <quote>Birds of Conservation Concern 2021 Migratory Bird Program</quote> (published April 2021), or a successor document; or</text></clause><clause id="H4C04B6BC4E2A4EC9A69C29F6453077A3"><enum>(iv)</enum><text>other appropriate science-based grasslands conservation plans; and</text></clause></subparagraph><subparagraph id="H0F8C3D753D0B472CBC735310EAF67D7B"><enum>(E)</enum><text>grasslands habitats important to the recovery of species listed as a threatened species or an endangered species under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>) or identified by a State or Tribal fish and wildlife agency as a species of greatest conservation need;</text></subparagraph></paragraph><paragraph id="HA2825F35294449988EB4DBAB029415D0"><enum>(2)</enum><text>identify specific goals for North American grasslands conservation, including goals for—</text><subparagraph id="H7DD9F99CF15F4468BCDA215AFA5B920F"><enum>(A)</enum><text>conserving grasslands identified under paragraph (1)(A);</text></subparagraph><subparagraph id="HF127465AE54743B2B70FAA2336F9122B"><enum>(B)</enum><text>increasing grasslands acreage through the restoration of marginal cropland and pastureland to native grasslands in areas that were historically grasslands; and</text></subparagraph><subparagraph id="H848AC99D2DA442CD920067A5BD89F420"><enum>(C)</enum><text>enhancing existing grasslands, primarily through incentivizing the voluntary restoration of degraded grasslands and the management of native prairie or sagebrush shrublands through conservation practices including—</text><clause id="H8AB0803527AA4FC189023BC4ED590C5B"><enum>(i)</enum><text>advanced grazing management or other prescribed grazing management that meets the objectives of the Conservation Strategy;</text></clause><clause id="H3B36CAF59DB74BBE87B13D97FC9C799E"><enum>(ii)</enum><text>beneficial fire, including prescribed fires and cultural burning practices;</text></clause><clause id="HD7EFD2EB84674D5EAEA5DDBF31944B2F"><enum>(iii)</enum><text>invasive species management; and</text></clause><clause id="HCB249FEEECA0436DA3442179C3DA4497"><enum>(iv)</enum><text>removal of encroaching woody vegetation;</text></clause></subparagraph></paragraph><paragraph id="H87F2D7D3550F43C79408A6E72D635C00"><enum>(3)</enum><text>identify key grasslands conservation, restoration, and management strategies for each of the grasslands regions identified by the Director;</text></paragraph><paragraph id="H4084ECD7D1A0471A8BCD76060717CDAA"><enum>(4)</enum><text>examine existing funding sources and identify gaps from current Federal, State, Tribal, or local conservation programs as such programs relate to grasslands conservation, restoration, and management needs, including—</text><subparagraph id="HBC1B034C3B0C40CA8D7AB8B84A75446A"><enum>(A)</enum><text>conservation programs under the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>) and amendments made by that Act;</text></subparagraph><subparagraph id="H8B87BA67124E4CF7A16EB07D6CC46875"><enum>(B)</enum><text>conservation programs under the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H2257B14568784D7282264114136496B4"><enum>(C)</enum><text>any Federal, State, Tribal, or local plans, programs, or initiatives that support grasslands conservation, restoration, and management; and</text></subparagraph></paragraph><paragraph id="H3374FE944244408AB4FEEA462475626E"><enum>(5)</enum><text>develop—</text><subparagraph id="HEE210F0935A84BAEBA1525624988B48E"><enum>(A)</enum><text>baseline inventories and population estimates of key indicator birds, pollinators, and other wildlife species at risk;</text></subparagraph><subparagraph id="H174C64229BD74D73B53DDEF0CC953BA8"><enum>(B)</enum><text>goals to increase the population size and resiliency of such species, including through ensuring grasslands habitat connectivity; and</text></subparagraph><subparagraph id="H5EE0F66DF574469C94762D2CBF096CD0"><enum>(C)</enum><text>a tool to track county-level aggregated conversion of native grasslands to cropland, residential and commercial development, and other uses that shall—</text><clause id="HA2090F94495F463983EB988479FF18CA"><enum>(i)</enum><text>protect the personally identifiable information of producers and landowners;</text></clause><clause id="H16B475FF4D56431A982E50968DB2FC91"><enum>(ii)</enum><text>be made publicly available; and</text></clause><clause id="HB6ACCE262286481C8AA994D0F166036B"><enum>(iii)</enum><text>be updated on an annual basis.</text></clause></subparagraph></paragraph></subsection><subsection id="HF0AC3AFB5A1E48498F24F9A9A7B83233"><enum>(d)</enum><header>Availability</header><text>Not later than 120 days before the date on which the Program is established, the Conservation Strategy shall be finalized and made publicly available on the website of the United States Fish and Wildlife Service to help target investments in grasslands conservation projects.</text></subsection></section><section id="H2EA59CAF419444078733AD2F10C98403"><enum>8.</enum><header>Grasslands conservation grant program</header><subsection id="H414DA1FC8B6F45F69BF3165C6AE717FD"><enum>(a)</enum><header>Establishment</header><text>Not later than 2 years after the date of the enactment of this section, the Director, in consultation with the Secretary of Agriculture and other heads of relevant Federal agencies, shall establish a competitive grant program through which the Commission shall award amounts to eligible entities to carry out eligible projects to support voluntary grasslands conservation projects, including projects—</text><paragraph id="HBCF635DF11CB4828B17E3C5BB75BB8E1"><enum>(1)</enum><text>to conserve intact grasslands at risk of conversion to cropland or residential or commercial development;</text></paragraph><paragraph id="H7A5A91472F7149B7810615B8BD36B227"><enum>(2)</enum><text>to restore degraded grasslands and improve grasslands health;</text></paragraph><paragraph id="H9AED6892AE4D404C9342D3B7164AF588"><enum>(3)</enum><text>to restore marginal cropland or idle land back to grasslands;</text></paragraph><paragraph id="H52756269546549FD99C5017DF73DB6B0"><enum>(4)</enum><text>to increase carbon sequestration and ecological function in soils and improve the resilience of grasslands;</text></paragraph><paragraph id="H063359D55D1D4DD8AD52ED830F5C6402"><enum>(5)</enum><text>to support habitat and habitat connectivity for native grasslands and sagebrush birds, pollinators, plants, and other wildlife, including big game species;</text></paragraph><paragraph id="H0CB8BEAED605445C908806EF13F418F3"><enum>(6)</enum><text>to restore and enhance watersheds through grasslands restoration, management, and conservation;</text></paragraph><paragraph id="HCAD6B900433E4D8F8DD5989613695B79"><enum>(7)</enum><text>to increase adoption of grasslands conservation, restoration, and management practices; and</text></paragraph><paragraph id="H5AE08F1107DA456192E7D8222D85120B"><enum>(8)</enum><text>carried out by Indian Tribes to protect culturally significant flora and fauna through the use of Indigenous Traditional Ecological Knowledge related to grasslands ecosystems.</text></paragraph></subsection><subsection id="HAC3E3C28A20B4E088116757D8C6106A7"><enum>(b)</enum><header>Applications</header><text>To be eligible for a grant under the Program, an eligible entity shall submit to the Council an application at such time, in such manner, and containing such information as the Director determines appropriate, which shall include a description of the project the eligible entity intends to carry out with such a grant.</text></subsection><subsection id="HBD74108A9B544BDD9133C1B70F6D8C62"><enum>(c)</enum><header>Priority</header><text>In awarding grants under the Program, the Commission shall prioritize grants to eligible entities the intended projects of which advance the goals of the Conservation Strategy.</text></subsection><subsection id="HB8ED0E3620484BEEBBBB4E3D577B974F"><enum>(d)</enum><header>Considerations</header><text>In awarding grants under the Program, the Commission shall consider the recommendations made to the Commission by the Council under section 9.</text></subsection><subsection id="H27AA8AB3A64C4361807D215EDC4ED936"><enum>(e)</enum><header>Use of funds</header><paragraph id="H4EE211E8EF7B4A4699CDAE6F094952B8"><enum>(1)</enum><header>In general</header><text>An eligible entity may use a grant awarded under the Program to carry out grasslands conservation projects, including—</text><subparagraph id="H8A80DB265E9C48638B0EAC40BCBE2C0A"><enum>(A)</enum><text>voluntary conservation easements;</text></subparagraph><subparagraph id="H96BFFD65EFCA46959E52F5F54DE5D8D0"><enum>(B)</enum><text>grasslands restoration;</text></subparagraph><subparagraph id="HD12DE6C8141C43C8B871FA1074735A91"><enum>(C)</enum><text>management activities, including—</text><clause id="H9296EFDCB71749A4BB193ACA5E77478A"><enum>(i)</enum><text>voluntary incentives to producers for prescribed burns;</text></clause><clause id="H06B7A3F22A744FBFA67CC754AD0997B8"><enum>(ii)</enum><text>removal of pinyon juniper, eastern red cedar, salt cedar, or any other encroaching woody species;</text></clause><clause id="H0879C887453E45FA8A8B7B5CDFDA0403"><enum>(iii)</enum><text>management of invasive species;</text></clause><clause id="H3390C06D78394D5FBB5C62F93CDC7114"><enum>(iv)</enum><text>maintenance and monitoring of new or ongoing grasslands conservation projects;</text></clause><clause id="HAEF0D3F38A964222BDAB5569BAFFB9B9"><enum>(v)</enum><text>advanced grazing management activities;</text></clause><clause id="HD45956C777844879AFD18519B76CE619"><enum>(vi)</enum><text>drought monitoring and preparedness activities;</text></clause><clause id="H145829FAA89446E7876F540C025D0B31"><enum>(vii)</enum><text>management activities informed by Indigenous Traditional Ecological Knowledge, including through cultural burns to manage ecosystems to manage, conserve, or restore native flora and fauna; and</text></clause><clause id="H24238B5486294CC3A85F8214C06E4D40"><enum>(viii)</enum><text>such other restoration and management activities identified in the Conservation Strategy or otherwise determined appropriate by the Director;</text></clause></subparagraph><subparagraph id="H04FF125BDCDE4BD9946F782065786148"><enum>(D)</enum><text>grasslands ecosystem education, outreach, and conservation stewardship assistance, which may include—</text><clause id="HE1BD2BC659C74A0B9056923DE376BC01"><enum>(i)</enum><text>field days;</text></clause><clause id="HBE433D4924094A8A9DE3EF1A72F1E7B7"><enum>(ii)</enum><text>grazing management training programs;</text></clause><clause id="H586BD36F874C4B98836E7DC1B3DAC266"><enum>(iii)</enum><text>conservation planning; and</text></clause><clause id="H8EAF19C357D0492981823DEE410F7CFF"><enum>(iv)</enum><text>education and outreach relating to—</text><subclause id="H76E82E5AFDCE4137846CB98892D03052"><enum>(I)</enum><text>grazing management;</text></subclause><subclause id="H7829BD7C1ABF4BEEAB74A00B6ECD3471"><enum>(II)</enum><text>control of invasive species;</text></subclause><subclause id="H45D855D47AF04DCEB164F1C7DF96F812"><enum>(III)</enum><text>beneficial fire;</text></subclause><subclause id="H7E9E5A7A585E49F4B11AF8B0A8639772"><enum>(IV)</enum><text>native seed crop systems research, in accordance with the research carried out by the Secretary of Agriculture under section 10;</text></subclause><subclause id="H3A11DE93BCC746ABB10A4ADD498F6AA3"><enum>(V)</enum><text>land access, generational land transfers, and ensuring ranchland viability;</text></subclause><subclause id="H22AB0522307E4239806CE1B27692AD6D"><enum>(VI)</enum><text>best management practices relating to grasslands ecosystems;</text></subclause><subclause id="H9CD0165A076348D88A156A4648C32810"><enum>(VII)</enum><text>participation in carbon and ecosystem markets; </text></subclause><subclause id="H7B66D38C4841464EACFEEB413D92DA25"><enum>(VIII)</enum><text>payment for ecosystem or conservation services; and</text></subclause><subclause id="H76066DB10B5E442BADF0432E876502D8"><enum>(IX)</enum><text>safeguarding and ensuring the perpetuation of Indigenous Traditional Ecological Knowledge related to grasslands ecosystems; and</text></subclause></clause></subparagraph><subparagraph id="HA707F622838C48C7B09C2BB1DC06DA36"><enum>(E)</enum><text>such other activities that—</text><clause id="H798D87060AB642018C6F7E6C40804293"><enum>(i)</enum><text>benefit grasslands and associated wildlife and enable increased adoption of grasslands conservation, restoration, and management practices; and</text></clause><clause id="HA855355ABC9C4D42A8CC3A5664EA9C49"><enum>(ii)</enum><text>are consistent with the Conservation Strategy.</text></clause></subparagraph></paragraph><paragraph id="H6B64797802E9400A84C1EEA3C52104C6"><enum>(2)</enum><header>Restoration activities</header><text>For purposes of paragraph (1)(B), any restoration activity shall prioritize a diverse mix of appropriately sourced native grasses and forbs, with such exceptions as the Director determines to be appropriate for ecologically appropriate noninvasive and nonnative species.</text></paragraph><paragraph id="H09EAED9396C54356AAEF9EB88963CB2B"><enum>(3)</enum><header>Safe harbor</header><text>An eligible entity that carries out a project pursuant to a grant awarded under the Program shall be eligible with respect to such project for a safe harbor agreement with the United States Fish and Wildlife Service.</text></paragraph></subsection><subsection id="HEA6A03B39E7C4CF390C7EA626252EF5A"><enum>(f)</enum><header>Grasslands conservation projects in Mexico and Canada</header><text>The Director shall grant or otherwise provide up to 10 percent of the amounts appropriated pursuant to the authorization under section 13(a)(1) to Federal agencies, eligible entities, and other individuals and entities, including foreign land management agencies, for the purpose of assisting such agencies, entities, and individuals in carrying out grasslands conservation projects in Mexico and Canada that—</text><paragraph id="HFA27E82EA32543909F3F9697C8C6BFA7"><enum>(1)</enum><text>have been recommended by the Council; and</text></paragraph><paragraph id="HBBD5744B07E943159CA440A9CF2E08CB"><enum>(2)</enum><text>meet the goals of the Conservation Strategy.</text></paragraph></subsection><subsection id="H77E04F93B61E4650978AC47A181C05B4"><enum>(g)</enum><header>Tribal set-Aside</header><text>For each fiscal year, of the amounts made available to carry out the Program, the Director shall set aside not less than 10 percent of such amounts to provide grants to Indian Tribes and Tribal organizations working with 1 or more Indian Tribes.</text></subsection><subsection id="H1EAE5F80C9BE4C9D80544C0AF0C6AC18"><enum>(h)</enum><header>Cost-Sharing requirement</header><paragraph id="H4DD06A8B56D3447F991632ABEBDAB33C"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the non-Federal share of the cost of carrying out an eligible project using amounts from a grant awarded under the Program—</text><subparagraph id="H3B60286CF7124E3CA8B678FC16D4B824"><enum>(A)</enum><text>shall be not less than 25 percent, including in-kind contributions; and</text></subparagraph><subparagraph id="HB5B436E861AF4FBDB3C17309DABDA2FF"><enum>(B)</enum><text>may not be derived from a Federal grant program.</text></subparagraph></paragraph><paragraph id="H8B9FCB1241A545B29DE45BA69A39115A"><enum>(2)</enum><header>Waivers</header><subparagraph id="H415F92F05E0B487E8BE06DE62A929DC6"><enum>(A)</enum><header>Indian Tribes</header><text>The Director shall waive the cost-share requirement under paragraph (1) for grants awarded under the Program to Indian Tribes and Tribal organizations.</text></subparagraph><subparagraph id="H27A3388D6731477DBBC7F29B969FC051"><enum>(B)</enum><header>Other eligible entities</header><text>The Council shall establish waiver criteria under which the Commission may waive the cost-share requirement under paragraph (1), in whole or in part, for grants awarded under the Program to eligible entities other than Indian Tribes.</text></subparagraph></paragraph></subsection><subsection id="HBC0476B9E9B34B4B81DE310E3840920E"><enum>(i)</enum><header>Administrative costs</header><text>An eligible entity that is awarded a grant under this section may use such grant award for reasonable administrative costs relating to that grant.</text></subsection></section><section id="HAE2858F1C4C64AE881E0C63FFD8FCA8A"><enum>9.</enum><header>Approval of grasslands conservation projects</header><subsection id="HFAAD2D131AFD4152B3D15221DEBB0850"><enum>(a)</enum><header>Recommendations to the Commission</header><paragraph id="H2CDB75ED711841508D87269C6D57DCBF"><enum>(1)</enum><header>In general</header><text>Each calendar year, the Council shall submit to the Commission a report that includes a list of the grasslands conservation projects (including the costs of those projects), in order of priority, that the Council, in consultation with each Regional Grasslands Conservation Council, recommends to the Commission for funding under the Program.</text></paragraph><paragraph id="H68BA748DA7A0412EBDB3C63B922C90A5"><enum>(2)</enum><header>Considerations</header><text>In making the list of recommended grasslands conservation projects under paragraph (1), the Council shall consider—</text><subparagraph id="H7E289BB288DF4193AD03BFA884995069"><enum>(A)</enum><text>the extent to which the grasslands conservation project fulfills the purpose of this Act and the strategies and objectives of the Conservation Strategy;</text></subparagraph><subparagraph id="H2892563B60B04E7E98E24CE758C2E4F7"><enum>(B)</enum><text>the availability of sufficient non-Federal funds to carry out the grasslands conservation project and to match Federal contributions in accordance with section 8(h)(1), notwithstanding the waivers described in paragraph (2) of that section;</text></subparagraph><subparagraph id="H70E39706898843B9B41073268A9BD6BA"><enum>(C)</enum><text>the extent to which the grasslands conservation project represents a partnership between public entities, including Indian Tribes, and private entities, including landowners; and</text></subparagraph><subparagraph id="H2F3106FA6D0F431C82DD75FC860F614F"><enum>(D)</enum><text>the substantiality of the character and design of the grasslands conservation project.</text></subparagraph></paragraph></subsection><subsection id="H6991453118B0430EBB85DDE9F3A4741C"><enum>(b)</enum><header>Council best practices and procedures</header><paragraph id="HEB73DA02607C4FD5A7BC3B34C2090BEC"><enum>(1)</enum><header>In general</header><text>The Council shall establish best practices and procedures for carrying out the requirements of subsection (a).</text></paragraph><paragraph id="H0F65F98355EC4250A6D8AB0D47DB5F14"><enum>(2)</enum><header>Requirements</header><text>The best practices and procedures established under paragraph (1) shall require that—</text><subparagraph id="HC3386B704D5544C78537AC108149BFBC"><enum>(A)</enum><text>a quorum of the Council be present before any business may be conducted; and</text></subparagraph><subparagraph id="HC6FF42501AE244B7B866B08FC0369A5C" commented="no"><enum>(B)</enum><text>the Council may not refer a grasslands conservation project to the Commission under subsection (a)(1) unless the grasslands conservation project is approved by a vote of <fraction>2/3 </fraction>of the members of the Council present and voting.</text></subparagraph></paragraph></subsection><subsection id="H3F56D0CEB32F41CC8444042908641A0B"><enum>(c)</enum><header>Council representation on Commission</header><paragraph id="H1674B6E7A72A40D19E1E04184F36236D"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary and the Secretary of Agriculture shall each select 1 member of the Council to serve as an ex officio member of the Commission for the purposes of considering and voting on grasslands conservation projects recommended to the Commission by the Council under subsection (a)(1).</text></paragraph><paragraph id="H0B8D5CCE4D67472E96584B554613EE5D"><enum>(2)</enum><header>Requirement</header><text>A member of the Council selected under paragraph (1) shall be a citizen of the United States.</text></paragraph></subsection><subsection id="H6E687C49CD6F42ED870532E8A00FF712"><enum>(d)</enum><header>Approval of Council recommendations by the Commission</header><paragraph id="HA2E293CA727B4E08AA2C7246A9C7C54F"><enum>(1)</enum><header>In general</header><text>The Commission, including the 2 members of the Council selected to serve as ex officio members on the Commission under subsection (c)(1), shall approve, reject, or reorder the priority of any grasslands conservation projects recommended by the Council under subsection (a)(1) based on, to the greatest extent practicable, the considerations described in paragraph (2) of that subsection.</text></paragraph><paragraph id="HBB7E8435B4A04976934A9C0DE9FA9DD2"><enum>(2)</enum><header>Approval of projects</header><text>If the Commission approves a grasslands conservation project under paragraph (1), the Commission shall award a grant under the Program to the eligible entity that applied to carry out the grasslands conservation project.</text></paragraph><paragraph id="HDDFB529657034C54A5F804E60841F8D3"><enum>(3)</enum><header>Rejection of projects</header><text>If the Commission rejects or reorders the priority of any grasslands conservation project under paragraph (1), the Commission shall provide the Council and the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate a written statement explaining the rationale of the Commission in rejecting or reordering the priority of, as applicable, the grasslands conservation project.</text></paragraph></subsection><subsection id="H12D14C36A6CB41C4873264333F1DF4D3"><enum>(e)</enum><header>Notification of appropriate committees</header><text display-inline="yes-display-inline">Not less frequently than annually, the Commission shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate, and make publicly available, a report that includes—</text><paragraph id="H23C7424D719F453D891BE60FEFA90A86"><enum>(1)</enum><text>a list and description of the grasslands conservation projects approved by the Commission under subsection (d)(2), in order of priority;</text></paragraph><paragraph id="HFA2F0C6564D043DE8BD23287D58DCE4F"><enum>(2)</enum><text>the amounts and sources of Federal and non-Federal funding for those grasslands conservation projects;</text></paragraph><paragraph id="HC9EC2112F67149FC8A9BD12D2EF9A7E3"><enum>(3)</enum><text>a justification for the approval of those grasslands conservation projects and the order of priority for funding those grasslands conservation projects;</text></paragraph><paragraph id="H60CBB522D18243E38342CAB45AC89BD2"><enum>(4)</enum><text>a list and description of the grasslands conservation projects that the Council recommended, in order of priority, that the Commission approved for funding under the Program; and</text></paragraph><paragraph id="H0A4680D566244FF49FFF1F74D05DA2AF"><enum>(5)</enum><text>a justification for any rejection or reordering of the priority of grasslands conservation projects recommended by the Council that was based on factors other than the considerations described in subsection (a)(2).</text></paragraph></subsection></section><section id="H127C0BF2A0AC4C48BCBDE1E64A284C6E"><enum>10.</enum><header>Native seed crop systems research</header><text display-inline="no-display-inline">The Secretary and the Secretary of Agriculture shall jointly coordinate and implement the National Seed Strategy for Rehabilitation and Restoration developed by the Plant Conservation Alliance and chaired by the Director of the Bureau of Land Management, with an emphasis on—</text><paragraph id="H3E02F3370A4E49879A8DED0A2F7753C9"><enum>(1)</enum><text>research relating to native seed crop systems, including—</text><subparagraph id="H2B1022589280438EAFEF9EC532CCF1D6"><enum>(A)</enum><text>agronomic research to improve the understanding of native plants as seed crops for native rangeland revegetation, with an emphasis on enhancing natural plant establishment in the environment;</text></subparagraph><subparagraph id="HE5A3E72DE588448FA6EFD45EAFF88C45"><enum>(B)</enum><text>research on plant seed physiology to improve seed quality, storage, and seeding success in the landscape;</text></subparagraph><subparagraph id="H5EA15E44F5DA4698A86401B9607574AC"><enum>(C)</enum><text>the development and technology transfer of best management practices and technologies for seed production, seed collection, seed storage, and reseeding success in the environment;</text></subparagraph><subparagraph id="H552CF514424842569445FB4B8CB31059"><enum>(D)</enum><text>research on soil chemistry and biome composition and how soil chemistry and biome composition affect native seed establishment; and</text></subparagraph><subparagraph id="HC2F9DB993A7C404799C09A788B9BDBB2"><enum>(E)</enum><text>identification of scenarios and preferred species for the incorporation of nonnative seed, with the goal of the overall successful restoration of functional groups of species;</text></subparagraph></paragraph><paragraph id="HDE5BFCC7AE6E427E9CCB7808C813295E"><enum>(2)</enum><text>the extension of research described in paragraph (1) to seed producers and land managers responsible for restoration efforts; and</text></paragraph><paragraph id="H00E5656BC4FC43AFBADCFD1F81A21102"><enum>(3)</enum><text>the production, storage, distribution, and planting of native seed crops in grasslands areas for restoration.</text></paragraph></section><section id="HCA7AE33B2F48476EA361390E285BC90A"><enum>11.</enum><header>Regenerative grazing data collection</header><subsection id="H38AE9A4F7A6B41288074F8E8071D93E6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H8B34E4069BBB4CC0A025A5883118CB40"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="H2B8B4165DFDF464E8A53B2463E1CAFF5"><enum>(A)</enum><text>public lands; and</text></subparagraph><subparagraph id="HA0DA9677032044BD9129726E70C37241"><enum>(B)</enum><text>land of the National Forest System.</text></subparagraph></paragraph><paragraph id="H7292316CFE04445FA7DF5D0EA5CFEA80"><enum>(2)</enum><header>National Forest System</header><text display-inline="yes-display-inline">The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H6EA63181F3704533BD91E4FC394A6A89"><enum>(3)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b)(1).</text></paragraph><paragraph id="H91D13EF26C6C429D93C8E0A077EE5A0D"><enum>(4)</enum><header>Public lands</header><text display-inline="yes-display-inline">The term <term>public lands</term> has the meaning given the term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="HC8D908AFE1D84CD09261549000FEB8DE"><enum>(5)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the—</text><subparagraph id="H5F8579E1D87A49A9B7AAC1E7A77BEED4"><enum>(A)</enum><text>Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph><subparagraph id="HC406CC157D5942CBA86A08211D0A0029"><enum>(B)</enum><text>Secretary of the Interior, acting through the Director of the Bureau of Land Management;</text></subparagraph><continuation-text continuation-text-level="paragraph">acting jointly.</continuation-text></paragraph></subsection><subsection id="HD52D57DB9623455884B6CA708834DF30"><enum>(b)</enum><header>Pilot program for use of regenerative grazing on Federal land To mitigate effects of climate change</header><paragraph id="H008414F110B944DB9DB70F144EA180D8"><enum>(1)</enum><header>Establishment</header><text>Not later than 1 year after the date of the enactment of this section, the Secretaries shall establish a pilot program to study the effectiveness of using grazing on Federal land to mitigate the effects of climate change.</text></paragraph><paragraph id="H8EEE21A889FE4A8EB2DEADFB26AA0ACE"><enum>(2)</enum><header>Requirements</header><text>In carrying out the pilot program, the Secretaries shall—</text><subparagraph id="HD882D7D41B8441B0A61143D1AB61FF55"><enum>(A)</enum><text>identify—</text><clause id="H15783C70160843618963C56CEE1E79BB"><enum>(i)</enum><text>a standard set of practices to study, such as carbon beneficial practices, that support conservation and grazing goals, including—</text><subclause id="H2AAE05981394445CAFB883E4826B3E8D"><enum>(I)</enum><text>ecologically appropriate silvopasture;</text></subclause><subclause id="HA395ED1E5AE3447A93FA2FD63CCF2D0C"><enum>(II)</enum><text>practices that provide wildlife habitat benefits;</text></subclause><subclause id="HAA59EA5DE1A04CDAB52042F979B5B7AD"><enum>(III)</enum><text>practices that consider flexibility in season of use;</text></subclause><subclause id="H70A8578C22F84A9DAAA77D01A2AFCCA7"><enum>(IV)</enum><text>forage and biomass management;</text></subclause><subclause id="H08EC464BE0994B4592F618A2D5B6546A"><enum>(V)</enum><text>planned grazing; and</text></subclause><subclause id="H180F1FCA29594649A5364C0C411E421F"><enum>(VI)</enum><text>range monitoring; and</text></subclause></clause><clause id="H9AA86CB13CAB48A7A81DB325A22C32AF"><enum>(ii)</enum><text>sufficient grazing allotments on a diverse mixture of ecosystems to identify whether, and the extent to which, grazing is an effective tool to mitigate the effects of climate change, including the ability—</text><subclause id="H8762A6D6591C4621902960F27BFA1F57"><enum>(I)</enum><text>to improve soil health;</text></subclause><subclause id="HBCBCDDC09B43439CBB26E5FA553E4693"><enum>(II)</enum><text>to increase carbon sequestration;</text></subclause><subclause id="H01616CCE2C174401B5A0FB9479BAE5A8"><enum>(III)</enum><text>to reduce wildfire risk; and</text></subclause><subclause id="H71AEDD1912614F70860B784AB83DC0D6"><enum>(IV)</enum><text>to improve watershed resilience and biodiversity; and</text></subclause></clause></subparagraph><subparagraph id="H168A37C1E03E4C40A2F38BE438AB78A7"><enum>(B)</enum><text>in developing, implementing, and monitoring the pilot program, consult with—</text><clause id="H4B11F3EE2AA64092B46CD6FCCBA50B7D"><enum>(i)</enum><text>the Chief of the Forest Service;</text></clause><clause id="H77AB5ED111E54667BECB8D1D9F384AFB"><enum>(ii)</enum><text>the Director of the Bureau of Land Management;</text></clause><clause id="H6218F34992134428B5699A01411D8EE8"><enum>(iii)</enum><text>the Administrator of the Agricultural Research Service;</text></clause><clause id="H139E791880C04B818E022428791D0C93"><enum>(iv)</enum><text>the Chief of the Natural Resources Conservation Service;</text></clause><clause id="HE3ED7A20E4E14DD0B1771B1C8550C519"><enum>(v)</enum><text>the Director of the United States Geological Survey;</text></clause><clause id="HA84A47A1C961407B9D9D6314C2E8002C"><enum>(vi)</enum><text>representatives designated by Indian Tribes;</text></clause><clause id="H0815EB3E281D48CCA97FDC92E7E77DA3"><enum>(vii)</enum><text>ranchers and representatives of the ranching industry;</text></clause><clause id="HE496E27C04624B4495DB66689F10CB41"><enum>(viii)</enum><text>representatives from grazing districts, associations, boards, or councils;</text></clause><clause id="H532C0966E31D406D873C0EF05001F770"><enum>(ix)</enum><text>environmental and conservation nongovernmental organizations;</text></clause><clause id="H9301403066CF437FA8F6F61ED0DF03B5"><enum>(x)</enum><text>institutions of higher education; and</text></clause><clause id="HA8DE15F3D0DD4765B853606B5FBD038E"><enum>(xi)</enum><text>any other Federal or State agency, academic institution, or organization that the Secretaries determine to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="H69D8370331474783A960E151B62A3AD1"><enum>(3)</enum><header>Use of funds</header><text>Funds made available to carry out the pilot program may be used—</text><subparagraph id="HCEA5FC8CC43E400C9EFACF047920C6E1"><enum>(A)</enum><text>to conduct research activities;</text></subparagraph><subparagraph id="H661DF2B64F464178BEFC225A9A56CE7C"><enum>(B)</enum><text>to provide technical assistance to permittees; or</text></subparagraph><subparagraph id="H12E2B5A4104F40C8BC1DC898A20516E6"><enum>(C)</enum><text>to construct the infrastructure necessary to implement and analyze regenerative grazing.</text></subparagraph></paragraph><paragraph id="H17B3B657EE5745F896D44372F1AE0B58"><enum>(4)</enum><header>Report to Congress</header><text>Not later than 180 days after the date on which the Secretaries determine that a sufficient quantity of data has been collected under the pilot program, the Secretaries shall submit to the Committee on Energy and Natural Resources and the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Natural Resources and the Committee on Agriculture of the House of Representatives, and make publicly available on the websites of the Department of Agriculture and the Department of the Interior, a report regarding the findings and data derived from the pilot program, including whether and the extent to which the use of regenerative grazing improved the ability to mitigate the impacts of climate change.</text></paragraph></subsection></section><section id="H980D6FDBCB1148E38C39997F813C5857"><enum>12.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Director shall biennially submit to Congress, and make publicly available, a report regarding the implementation of this Act, which shall include an assessment of the status of grasslands conservation projects during the preceding 2 years, including an accounting of expenditures by Federal, State, and other entities.</text></section><section id="H1DBF7A48FB994CC28BB83DCD37FC4927"><enum>13.</enum><header>Authorization of appropriations</header><subsection id="HC03D5D5C85CC41AAAB08C09ADDCA4C66"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated, to remain available until expended—</text><paragraph id="H90578A312F4E4A4ABD6D2B0E26567898"><enum>(1)</enum><text>to carry out section 7, $5,000,000;</text></paragraph><paragraph id="HFC1A11BADF67496E9A70743884F6BDC9"><enum>(2)</enum><text>beginning on the date the Conservation Strategy is first publicly posted under section 7(d), to carry out the Program—</text><subparagraph id="HE7AC85D5CD0146E49DA70B895C6F6E02"><enum>(A)</enum><text>$60,000,000 for fiscal year 2025;</text></subparagraph><subparagraph id="H1CB1B604DA83401894595948FFF4CC13"><enum>(B)</enum><text>$67,500,000 for fiscal year 2026;</text></subparagraph><subparagraph id="H52ECDEE501EC408890ADDB0E44A42FD4"><enum>(C)</enum><text>$75,000,000 for fiscal year 2027;</text></subparagraph><subparagraph id="H2FB8EECAED744A7C852637083E2ACEE4"><enum>(D)</enum><text>$82,500,000 for fiscal year 2028; and</text></subparagraph><subparagraph id="H0F7FF8C2AA2340129C322054055275A6"><enum>(E)</enum><text>$90,000,000 for fiscal year 2029;</text></subparagraph></paragraph><paragraph id="HBF6638A3D2474DDA8DE02E608EEFA8BA"><enum>(3)</enum><text>to Partners for Fish and Wildlife to work with ranchers, landowners, Tribes, and eligible entities to carry out activities under the Program, $1,500,000 for each of fiscal years 2025 through 2029;</text></paragraph><paragraph id="H9E6EB318572F4497940C3A1B0953566D"><enum>(4)</enum><text>to the Secretary of Agriculture to carry out section 10, $1,000,000 for each of fiscal years 2024 through 2027; and</text></paragraph><paragraph id="H18DEACF0C7BC4431AE1D3F0B8B204C4C"><enum>(5)</enum><text>to carry out section 11, $10,000,000 for each of fiscal years 2024 through 2026.</text></paragraph></subsection><subsection id="HD8E081224FA949418C734594D92C2026"><enum>(b)</enum><header>Administrative costs for the Program</header><text>Of the amounts made available under subsection (a)(3), not more than 10 percent may be used for administrative costs relating to the Council, Regional Grasslands Conservation Councils, and the Program.</text></subsection><subsection id="HFF6C3F3DD84B46269658FF3BDC57655F"><enum>(c)</enum><header>Limitation</header><text>None of the funds made available under this section may be—</text><paragraph id="H4C7520399DF24853943AA5F1C7475C95"><enum>(1)</enum><text>used for species or habitat mitigation under any Federal law; or</text></paragraph><paragraph id="HBBD31A9B2D564025A92ABDC4FE2708B0"><enum>(2)</enum><text>applied in a manner that requires nonvoluntary changes in agricultural or domestic livestock production, permitted forestry practices, access to valid existing rights, or compatible energy development and mining.</text></paragraph></subsection></section><section id="HB22296BF55284814AA1CB95A7BEC2879"><enum>14.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed—</text><paragraph id="HB7E3C6029C8A476DA0F77C84E4E400DF"><enum>(1)</enum><text>to enlarge or diminish the authority, jurisdiction, or responsibility of a State to manage, control, or regulate fish and wildlife under the law and regulations of the State on lands and waters within the State, including on Federal lands and waters;</text></paragraph><paragraph id="HA63CE977067D4ED0814040B7BC3AFA5F"><enum>(2)</enum><text>as modifying or abrogating a treaty with any Indian Tribe, or as enlarging or diminishing the authority, jurisdiction, or responsibility of an Indian Tribe to manage, control, or regulate wildlife on Tribal land;</text></paragraph><paragraph id="HE49D25E0A3CD4EDE98C05ECA657D0D26"><enum>(3)</enum><text>to impact the private property or privacy rights of landowners without the express written consent of such landowners; or</text></paragraph><paragraph id="HB864F26E2C18427D888354FD44241C3E"><enum>(4)</enum><text>to authorize restrictions or reductions to public access for hunting, angling, recreational shooting, or other compatible types of outdoor recreation.</text></paragraph></section></legis-body></bill>
