which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to provide for transparency and oversight of third-party beneficiaries in civil actions.</official-title></form><legis-body id="H5A2BE8BBD426466FA0999E1851BEC1B3" style="OLC"><section id="HF75E081E78DE4FBC86B89B85AA9912BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Litigation Transparency Act of 2024</short-title></quote>.</text></section><section id="HE226E6EB738647CA94C39AF60E69B4E9"><enum>2.</enum><header>Transparency and oversight of third-party beneficiaries in civil cases</header><subsection id="H8B8824813F054A8C94E0E544522C582F"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/111">Chapter 111</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block id="HD865AAD56FC84C2DB651F30E2F71DC7A" style="USC"><section id="H2F42E9BE57384FA49D4BAA6D3575C1D2"><enum>1660.</enum><header>Third-party beneficiary disclosure</header><subsection id="H506DD6A761EB49D0A55BC2C01C27F3FB"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), in any civil action, a party or any counsel of record for a party shall—</text><paragraph id="H883B089C180240C89B0453690DEFD1AA"><enum>(1)</enum><text>disclose in writing to the court and all other named parties to the civil action the identity of any person (other than counsel of record) that has a right to receive any payment or thing of value that is contingent on the outcome of the civil action or a group of actions of which the civil action is a part; and</text></paragraph><paragraph id="H5A141A382C3244368C7887F807595287"><enum>(2)</enum><text display-inline="yes-display-inline">produce to the court and to each other named party to the civil action, for inspection and copying, any agreement creating a contingent right referred to in paragraph (1), including any ancillary agreement or document, except as otherwise stipulated or ordered by the court.</text></paragraph></subsection><subsection id="HDA94043D0A1949B581788B2472D5C0A1"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The requirements under subsection (a) shall not apply with respect to a person that has a right to receive payment described in subsection (a)(1) if the right to receive payment is solely—</text><paragraph id="H35197EB3A221429E8CB85CF391DCA778"><enum>(1)</enum><text>the repayment of the principal of a loan;</text></paragraph><paragraph id="HAB921162E8BA43A3A51327165B849313"><enum>(2)</enum><text display-inline="yes-display-inline">the repayment of the principal of a loan plus interest that does not exceed the higher of 7 percent or a rate two times the annual average 30-year constant maturity Treasury yield, as published by the Board of Governors of the Federal Reserve System, for the year preceding the date on which the relevant agreement was executed; or</text></paragraph><paragraph id="HFE467415A8E8452F8528DAD195C4D0A7"><enum>(3)</enum><text>the reimbursement of attorney’s fees.</text></paragraph></subsection><subsection id="HF27244EF41D342D4B03879B72F7A6376"><enum>(c)</enum><header>Timing</header><text>The disclosures required by subsection (a) shall be made not later than the later of—</text><paragraph id="H32FC0C60E5AE40F59BD38FCF9AA3645D"><enum>(1)</enum><text>10 days after the execution of any agreement described in subsection (a)(2); or</text></paragraph><paragraph id="H1E9705543533466287BCF75C8A47F338"><enum>(2)</enum><text>the time of the filing of the action before the court.</text></paragraph></subsection><subsection id="HA09554181CC2489894531875C61C5843"><enum>(d)</enum><header>Duty To correct</header><text display-inline="yes-display-inline">A party or counsel of record that made a disclosure required by this section shall supplement or correct each such disclosure in a timely manner—</text><paragraph id="H47A98485DFD949718DA430E65C7D177E"><enum>(1)</enum><text>if such party or counsel of record learns that the disclosure is or has become incomplete or incorrect in some material respect, if the additional or corrective information has not otherwise been made known to the other parties during the discovery process or in writing; or</text></paragraph><paragraph id="H35CBE2D030594A60BC2E8935DE94B0FF"><enum>(2)</enum><text>as ordered by the court.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H984683CF09B94C36BCE38D14FB49C805"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/111">chapter 111</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block id="HE0DF14CA1E8E4EEDA0354EBB42F4AD8D" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1660. Third-party beneficiary disclosure.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H829D0CA88F51441CADD8A0B5B7BD1D9B"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any civil action pending on or commenced after the date of enactment of this Act.</text></section></legis-body></bill>
