R. 9904</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241001">October 1, 2024</action-date><action-desc><sponsor name-id="M001216">Mr. Mills</sponsor> (for himself, <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="H001077">Mr. Higgins of Louisiana</cosponsor>, and <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit certain business concerns from receiving assistance from the Small Business Administration, and for other purposes.</official-title></form><legis-body id="H8D8D46DA986649739D87456C81F7846F" style="OLC"><section id="H419BA9A5BF6744BDA3F18C117DC68564" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing SBA Assistance from Going to China Act</short-title></quote>.</text></section><section id="HE6AD3D81ACCD48A1A96319A1BB54E833"><enum>2.</enum><header>Prohibition on affiliation with the People’s Republic of China</header><subsection id="H41F9CD4C182940C1AC38FAB410B084EB"><enum>(a)</enum><header>In general</header><text>Section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HF7CA9B118A6A4C0FBF0EFCBB987C6AB2" style="OLC"><paragraph id="H378B2A9406B94109BB823F90086B0CC3"><enum>(10)</enum><header>Prohibition on affiliation with the people’s republic of china</header><text>For purposes of this Act, a small business concern may not—</text><subparagraph id="H83C423E78CDA486F8BDF051A5E7A62AB"><enum>(A)</enum><text>be headquartered in the People’s Republic of China; or</text></subparagraph><subparagraph id="H9D62C34681FB4FABBA27639428D1D29D"><enum>(B)</enum><text>have more than 25 percent of the voting stock of the small business concern owned by affiliates that are citizens of the People’s Republic of China.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC6C4A37AAFE443388746E73B456F662C"><enum>(b)</enum><header>Regulations and guidance</header><text>The Administrator of the Small Business Administration shall amend the regulations and guidance of the Administration, including sections 120.100, 120.110, and 121.105 of title 13, Code of Federal Regulations, to carry out the amendment made by this Act.</text></subsection></section></legis-body></bill>
