which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve dam and hydropower safety, and for other purposes.</official-title></form><legis-body id="H277A84006BD94950BDDBB64CBC901BE9" style="OLC"><section id="H0FBE2107184E47FFA348605EB007ACEB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Dam and Hydropower Safety Improvements Act of 2024</short-title></quote>.</text></section><section id="H76A90AD3CFB040B4AAAA0B108D2530E6" section-type="subsequent-section"><enum>2.</enum><header>Dam safety conditions</header><text display-inline="no-display-inline">Section 10 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HC77CD8F5337F49E59EAF5F4143560D6D" display-inline="no-display-inline"><subsection id="HD8681800DE874ABDAA3251424924AB27"><enum>(k)</enum><text display-inline="yes-display-inline">That the dam and other project works meet the Commission’s dam safety requirements and that the licensee shall manage, operate, and maintain the dam and other project works in a manner that ensures dam safety and public safety under the operating conditions of the license. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB18D0DC2E3134C6FB40E69CF81B6E85D" section-type="subsequent-section"><enum>3.</enum><header>Dam safety requirements</header><text display-inline="no-display-inline">Section 15 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/808">16 U.S.C. 808</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H27F77A0EDB9245B7A608DE919A3B43F7" display-inline="no-display-inline"><subsection id="H77D78BA771EF4206B4D9AE9506208D5C"><enum>(g)</enum><text display-inline="yes-display-inline">The Commission may issue a new license under this section only if—</text><paragraph id="HB17B21B70B7B4B6DB699E642680FFA8C"><enum>(1)</enum><text>the Commission determines that the dam and other project works covered by the license meet the Commission’s dam safety requirements and that the licensee can continue to manage, operate, and maintain the dam and other project works in a manner that ensures dam safety and public safety under the operating conditions of the new license; or</text></paragraph><paragraph id="HBBA42E0E8D694A4F8E0A8737C179DAB4" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the new license includes a plan to resolve the noncompliance of the dam or other project works covered by the license with the Commission’s dam safety requirements.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDA8D1F0C60354251A5AA51215F9A0F3D"><enum>4.</enum><header>Viability procedures</header><text display-inline="no-display-inline">The Federal Energy Regulatory Commission shall establish procedures to assess the financial viability of an applicant for a license under the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>) to—</text><paragraph id="H15C594307B5B497EAA9226F6CE4E83BE"><enum>(1)</enum><text>meet applicable dam safety requirements; and</text></paragraph><paragraph id="HACF1B4E9AB984225AE5C9AF73264FB7C"><enum>(2)</enum><text>operate the dam and project works under the license.</text></paragraph></section><section id="H3311C4A567B14CDFBA78E6AD40367DD5" section-type="subsequent-section"><enum>5.</enum><header>FERC dam safety technical conference with States</header><subsection id="H64A73E58F5A6484E949604B56BFA2549" commented="no"><enum>(a)</enum><header>Technical conference</header><text display-inline="yes-display-inline">Not later than October 1, 2025, the Federal Energy Regulatory Commission, acting through the Director of the Office of Energy Projects, shall hold a technical conference with the States to discuss and provide information on—</text><paragraph id="HE7B5E82D6E264E32BF7AFF7D339A69BB" commented="no"><enum>(1)</enum><text>dam maintenance and repair;</text></paragraph><paragraph id="H1670DEE40D7A46EF877DCA1AC0943C6E" commented="no"><enum>(2)</enum><text>Risk Informed Decision Making;</text></paragraph><paragraph id="HB8B71EC19D744B14BE8DB6202892893D" commented="no"><enum>(3)</enum><text>climate and hydrological regional changes that may affect the structural integrity of dams; and</text></paragraph><paragraph id="H64A8ED365EF04538BA2A2ED5752F1EC8" commented="no"><enum>(4)</enum><text>high hazard dams.</text></paragraph></subsection><subsection id="H8D8AEBF2B06E452997F7ADC6955D9E63" commented="no"><enum>(b)</enum><header>State defined</header><text display-inline="yes-display-inline">In this section, the term <term>State</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></subsection></section><section id="H960E60DE0124421089A3E1FCCB117B9F"><enum>6.</enum><header>Required dam safety communications between FERC and States</header><subsection id="HB9F016B7BD3B442D8C4270F2D80DDBC3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission, acting through the Director of the Office of Energy Projects, shall notify each State within which a project is located when—</text><paragraph id="H62A714E1EA2C4E969469B29FD936E1DC"><enum>(1)</enum><text display-inline="yes-display-inline">the Commission issues a finding, following a dam safety inspection, that requires the licensee for such project to take actions to repair the dam and other project works that are the subject of such finding;</text></paragraph><paragraph id="H9FDF5467258D4BBF8DA7A6C48D59C870"><enum>(2)</enum><text>after a period of 5 years starting on the date a finding under paragraph (1) is issued, the licensee has failed to take actions to repair the dam and other project works; and</text></paragraph><paragraph id="H3CEEA9A0161D4A4FA3B0CB1A2F047940" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the Commission initiates a non-compliance proceeding or otherwise takes steps to revoke a license due to the failure of a licensee to take actions to repair a dam and other project works.</text></paragraph></subsection><subsection id="H332E0D4E661B40FDAB99AF631B215727" display-inline="no-display-inline"><enum>(b)</enum><header>Notice upon revocation, surrender, or implied surrender of a license</header><text display-inline="yes-display-inline">If the Commission issues an order to revoke a license or approve the surrender or implied surrender of a license under the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>), the Commission shall consult with the State within which the project that relates to such license is located to provide to such State—</text><paragraph id="H3FD762348F2A408D807AC67D268F74D8"><enum>(1)</enum><text display-inline="yes-display-inline">all records pertaining to the structure and operation of the applicable dam and other project works, including, as applicable, any dam safety inspection reports by independent consultants, specifications for required repairs or maintenance of such dam and other project works that have not been completed, and estimates of the costs for such repairs or maintenance;</text></paragraph><paragraph id="H3FBCCF20470745468FE7DAEFB357322C"><enum>(2)</enum><text display-inline="yes-display-inline">all records documenting the history of maintenance or repair work for the applicable dam and other project works;</text></paragraph><paragraph id="H0AA6797FEA0741A8ADC2AA1F91439A88"><enum>(3)</enum><text>information on the age of the dam and other project works and the hazard classification of the dam and other project works;</text></paragraph><paragraph id="HCA421133BAB841249369AB7C1172A074"><enum>(4)</enum><text display-inline="yes-display-inline">the most recent assessment of the condition of the dam and other project works by the Commission;</text></paragraph><paragraph id="HC3370E3964A54DD3B2B0FD33F4BDE9CB"><enum>(5)</enum><text>as applicable, the most recent hydrologic information used to determine the potential maximum flood for the dam and other project works; and</text></paragraph><paragraph id="H1DB5056649DE4EE3BF76FFB28C31F0DA"><enum>(6)</enum><text>the results of the most recent risk assessment completed on the dam and other project works.</text></paragraph></subsection><subsection id="H79B9B44633C94DAC851614881D7859B2"><enum>(c)</enum><header>Definition</header><text>In this section:</text><paragraph id="H16F822FA105744C683F6CD2D3E64E638"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Energy Regulatory Commission. </text></paragraph><paragraph id="H5C7E714027D14AC09B92BE9129F97B75"><enum>(2)</enum><header>Licensee</header><text display-inline="yes-display-inline">The term <term>licensee</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="HC0744CB336D34B26B87FD2558032D97D" commented="no"><enum>(3)</enum><header>Project</header><text display-inline="yes-display-inline">The term <term>project</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
