which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to preclude a President from controlling the conduct of an investigation into the President by the Department of Justice.</official-title></form><legis-body id="H5BFF236EB33A4ABFB675EB46BE5A59DC" style="OLC"><section id="HB1AD0AA87FA54D589CE3283BF4871EC9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investigative Integrity Protection Act of 2024</short-title></quote>.</text></section><section id="H15237ED814BB4C9E90836966C76A2760"><enum>2.</enum><header>Presidential oversight of Attorney General</header><subsection id="H860FF00466F3465E8E225B39B44F6521"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/31">Chapter 31</external-xref> of title 28, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H45A953693EB749C5BC65C75C2AEEC568" display-inline="no-display-inline"><section id="H4293D9146E5540FC9C4BF41718670398"><enum>530E.</enum><header>Presidential oversight of Attorney General</header><subsection id="H8C8B92A0DE2041078953BC85CD0030D3"><enum>(a)</enum><header>Certification</header><text display-inline="yes-display-inline">In the case of any criminal prosecution against the President, irrespective of when the prosecution was initiated, if the government seeks dismissal of such prosecution, the court shall require the Attorney General to submit a sworn statement under penalty of perjury attesting as to whether the dismissal was ordered by the President or anyone acting pursuant to the direction of the President.</text></subsection><subsection id="H207CA02D327B4D0CB2308926544E4020"><enum>(b)</enum><header>Considerations</header><paragraph id="H95A3ABFA7EB0418C8F36C93C7468C0CF"><enum>(1)</enum><header>In general</header><text>The court shall only grant the dismissal if deemed appropriate and in the interest of justice after having duly considered the circumstances of the case and—</text><subparagraph id="HED96854BBA77487E830FB77C9219055D"><enum>(A)</enum><text display-inline="yes-display-inline">the sworn statement required by subsection (a);</text></subparagraph><subparagraph id="HAACF3C66AEAC435A85990C61F228C2CD"><enum>(B)</enum><text display-inline="yes-display-inline">any evidence in the record or ex curia, which shall be reflected in the order of the court, to support an inference that the decision to seek dismissal of the prosecution is motivated by bad faith or is a pretext to enable the President to act outside of the legal and constitutional authority of the Presidency; and</text></subparagraph><subparagraph id="HADE848C17D624BF7836869B643088F0A"><enum>(C)</enum><text>any other factors the court deems appropriate.</text></subparagraph></paragraph><paragraph id="H065B1E2A8D2F4AAB84E08EF8E3512046"><enum>(2)</enum><header>Evidentiary considerations</header><text>Evidence considered under subsection (b)(1)(B) may include—</text><subparagraph id="H5F905FC47453451D8F4A664001A63A22"><enum>(A)</enum><text display-inline="yes-display-inline">whether the dismissal was suggested, encouraged, requested, or ordered by the President; or</text></subparagraph><subparagraph id="H757E2BEA134C4FC49AC323319FFF642B"><enum>(B)</enum><text display-inline="yes-display-inline">whether the Attorney General was, in the opinion of the court, appointed in whole or in part for his willingness to dismiss the prosecution at bar or any criminal prosecution against the President.</text></subparagraph></paragraph></subsection><subsection id="H9DAC7D2231284A6F8E705C42D59AC012"><enum>(c)</enum><header>Three-Judge court</header><text display-inline="yes-display-inline">Any action seeking dismissal shall be heard by a three-judge court convened pursuant to section 2284.</text></subsection><subsection id="H4756A6CB4BB04F83A57444796209452A"><enum>(d)</enum><header>Sanctions</header><text display-inline="yes-display-inline">If the court, in making a determination under subsection (b), additionally determines that the motion to dismiss was made without good cause, the court may impose sanctions as appropriate.</text></subsection><subsection id="HE305B933F5B24B7A97871EC9172C5BD5"><enum>(e)</enum><header>Inspector General responsibilities</header><text display-inline="yes-display-inline">The Inspector General of the Department of Justice, upon having a good faith basis to conclude that a motion to dismiss a prosecution against the President was brought at the direction of the President, or anyone acting pursuant to the direction of the President, shall immediately report such findings to Congress.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF49ED4CE7D264DF69E86F106423F4267"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by adding at the end the following: </text><quoted-block style="USC" id="HC362BE959F2240C880ADB8047A012520" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">530E. Presidential oversight of Attorney General.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
