which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve the provision of benefits and services to members of the Ready Reserve Corps of the Public Health Service, and for other purposes.</official-title></form><legis-body id="HF4A11273D2864C198E3251CB90876706" style="OLC"><section id="H633A14847842429CBDB1FFACAE3AA009" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity for Public Health Service Ready Reserve Act</short-title></quote>.</text></section><section id="H5E529DDB18EC41A2AC1F5E235999AD0B"><enum>2.</enum><header>Public Health Service Ready Reserve Corps (PHS RRC)</header><subsection id="H80741013D236426BBA6064AFA7B730FC"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 10141 of title 10, United States Code, is amended—</text><paragraph id="H33C8FACFFE07459CA2168AF63AEC8E33"><enum>(1)</enum><text>in subsection (a), by striking <quote>in each armed force</quote> and inserting <quote>in each uniformed service</quote>; and</text></paragraph><paragraph id="H40FA54C6125C423BADB8B9B997933F06"><enum>(2)</enum><text>in subsection (c), striking <quote>the same for all armed forces</quote> and inserting <quote>the same for all reserve components of the uniformed services</quote>.</text></paragraph></subsection><subsection id="H8397671C738C46998428464AD6AA54EC"><enum>(b)</enum><header>Organization and unit structure</header><text>Section 10143(b) of title 10, United States Code, is amended—</text><paragraph id="H892EEB491A244DC28F572C12F19DA899"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HB811A2699C5043A698E01E5D1BDC62C9"><enum>(A)</enum><text>by inserting <quote>and the Public Health Service Ready Reserve Corps</quote> after <quote>other than the Coast Guard</quote>; and</text></subparagraph><subparagraph id="HDF8A87E4BCE24B0CAE115EEA1AB7DAD9"><enum>(B)</enum><text>by striking <quote>war plans; and</quote> and inserting <quote>war plans;</quote>;</text></subparagraph></paragraph><paragraph id="HED23DCFE0D7243E09C67887D7BBACC12"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HCD71B45E82034E05ADBD519F5F71D1B7"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H78F6CC3348AC43A6BA0E8113DB84FF10" style="OLC" act-name=""><paragraph id="H9E9E7B82A0374314A49AAB60FD9290FE"><enum>(3)</enum><text>in the case of the Public Health Service Ready Reserve Corps, by the Secretary of Health and Human Services upon the recommendation of the Assistant Secretary for Health.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0B9A399C268548F2B7C649E14F6977F3"><enum>(c)</enum><header>Placement in Ready Reserves</header><text>Section 10145(a) of title 10, United States Code, is amended by striking <quote>Ready Reserve of his armed force for his prescribed term of service, unless he is transferred</quote> and inserting <quote>Ready Reserve of the reserve component of the member's uniformed service for his or her prescribed term of service, unless such member is transferred</quote>.</text></subsection><subsection id="H1EAFB94EBF0B4C3B96B7D40336D7DF23"><enum>(d)</enum><header>Standby Reserves</header><paragraph id="H9FBA55257DCE4434AACB527914DFE2D6"><enum>(1)</enum><header>Transfers to</header><text>Section 10146 of title 10, United States Code, is amended—</text><subparagraph id="H4670B135585141BAAED4818EC52B6A98"><enum>(A)</enum><text>in subsection (a), by inserting <quote>and the Secretary of Health and Human Services with respect to Public Health Service Ready Reserve Corps</quote> after <quote>operating as a service in the Navy</quote>; and</text></subparagraph><subparagraph id="H349B6240C04B47AEA06588719B0F7C6C"><enum>(B)</enum><text>in subsection (b), by inserting <quote>or the Secretary of Health and Human Services, as the case may be,</quote> after <quote>prescribed by the Secretary concerned</quote>. </text></subparagraph></paragraph><paragraph id="HBB1A6954A6CC4FBCA250607BB1E8C56D"><enum>(2)</enum><header>Transfers from</header><text>Section 10150 of title 10, United States Code, is amended by inserting <quote>and the Secretary of Health and Human Services with respect to Public Health Service Ready Reserve Corps</quote> after <quote>operating as a service in the Navy</quote>.</text></paragraph><paragraph id="HF3B3843F15B44160B09C61E5054327EB"><enum>(3)</enum><header>Training requirements</header><text>Section 10147(a) of title 10, United States Code, is amended—</text><subparagraph id="HDD469F1C1B12453EB26F3E8D2E243D07"><enum>(A)</enum><text>by striking <quote>in an armed force</quote> and inserting <quote>in a uniformed service</quote>; and</text></subparagraph><subparagraph id="H93ACA2182359485AAC0841626D070EC5"><enum>(B)</enum><text>by inserting <quote>and the Secretary of Health and Human Services with respect to Public Health Service Ready Reserve Corps</quote> after <quote>operating as a service in the Navy</quote>.</text></subparagraph></paragraph><paragraph id="H487C8A0736844CAC9E9E4CCE500565CC"><enum>(4)</enum><header>Failure to satisfactorily perform prescribed training</header><text>Section 10148(a) of title 10, United States Code, is amended by inserting <quote>or the Secretary of Health and Human Services with respect to Public Health Service Ready Reserve Corps</quote> after <quote>Secretary of Defense</quote>.</text></paragraph></subsection><subsection id="HBED9594A2C034F2D84FE59E997D1076B"><enum>(e)</enum><header>Inactive status list</header><text>Section 10152 of title 10, United States Code, is amended by striking <quote>armed force</quote> and inserting <quote>uniformed service</quote>.</text></subsection><subsection id="H5631064611E74732ADC8F3F9CF65917E"><enum>(f)</enum><header>Technical and conforming amendments</header><paragraph id="H3399DF1E4C224EF5BB3F910E11431672"><enum>(1)</enum><header>Authorized end strength of the Ready Reserves of the Armed Forces</header><text>Section 10142 of title 10, United States Code, is amended by inserting <quote>of the armed forces</quote> after <quote>Ready Reserve</quote> both places it appears.</text></paragraph><paragraph id="HA6B140DA4C7245239B596BD21708ECD2"><enum>(2)</enum><header>Continuous screening provisions applicable to Armed Forces</header><text>Section 10149 of title 10, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7DCE07F9E072456C9A3BB1477EA929B3"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>or, in the case of the Public Health Service Ready Reserve Corps, the Secretary of Health and Human Services,</quote> after <quote>Secretary concerned</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H975F144D344D4260ABF33747F8854D64"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(A), by inserting <quote>or, in the case of a Member of Congress who also is a member of the Public Health Service Ready Reserve Corps, the Secretary of Health and Human Services</quote> after <quote>operating as a service in the Navy</quote>.</text></subparagraph></paragraph><paragraph id="HF74AD7D6B9424F41A7938032BCE99904"><enum>(3)</enum><header>Composition of Standby Reserves of Armed Forces</header><text>Section 10151 of title 10, United States Code, is amended by inserting <quote>of the armed forces</quote> after <quote>The Standby Reserve</quote>. </text></paragraph></subsection></section><section id="H5B7E37BBE4A14F81A0C2A3CE464ADF65"><enum>3.</enum><header>Dual compensation parity for Ready Reserve Corps of the Public Health Service</header><subsection id="H1EA8D4A4A61D4535939D3E732C782F70"><enum>(a)</enum><header>Dual employment</header><text display-inline="yes-display-inline">Section 5534 of title 5, United States Code, is amended— </text><paragraph id="HF78D736629164540A22CA50075ED76F7"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, a member of the Ready Reserve Corps of the Public Health Service,</quote> after <quote>armed forces</quote>; and</text></paragraph><paragraph id="HB86F1526CAF74CFE89B8ECFCF4126683"><enum>(2)</enum><text>by inserting <quote>, member of the Ready Reserve Corps,</quote> after <quote>allowances as a Reserve</quote>.</text></paragraph></subsection><subsection id="H5784D68A83DA4A1E82A0A464A4D62320"><enum>(b)</enum><header>Uniformed service leave</header><paragraph id="HAA39FB12948B4E7C984729EB60776480"><enum>(1)</enum><header>In general</header><text>Section 6323 of title 5, United States Code, is amended—</text><subparagraph id="HB8D667C9919F485DB621A51AB06997A3"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Military leave; Reserves and National Guardsmen</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Uniformed services leave</header-in-text></quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H501868B32DA246A98BAB865613D62561"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="HD33F0EBD7510457592DDC3D31F62B599"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)— </text><subclause commented="no" display-inline="no-display-inline" id="H108586FFBF064AE2865BC432531864C1"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>or the National Guard</quote> and inserting the following: <quote>the National Guard</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE8AB281072374A00824A9245A1721CEE"><enum>(II)</enum><text>by inserting <quote>, or the Ready Reserve Corps of the Public Health Service</quote> after <quote>of title 32</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8B6CEACCD81A455681FE6CD44238159C"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause commented="no" display-inline="no-display-inline" id="H11AA2B172FFB4F078F88DE0CE6697B2E"><enum>(I)</enum><text display-inline="yes-display-inline">in subparagraph (A)(ii), by striking <quote>or</quote> at the end;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB088B0139B144B7C9322BC8E90603A8B"><enum>(II)</enum><text>in subparagraph (B), by inserting <quote>or</quote> after the semicolon at the end; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H639BBD527C0543C182B6D0419EF8B0EB"><enum>(III)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block id="HA90412C7E92547E6B0F5630F790E4F8D" style="OLC" act-name=""><subparagraph id="H8C9A12DFED2C42EC935FCAE4D5DBBBD3" indent="up1"><enum>(C)</enum><text>in the case of a member of the Ready Reserve Corps of the Public Health Service, performs services as a result of a deployment to respond to an urgent or emergency public health need, as defined in section 203A(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/204a">42 U.S.C. 204a(a)</external-xref>);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="HD5296E0D20E34585A1C5E1A680D131C4"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1ED14C2AE02E4DA4BC01800346C8F749"><subsection id="H93133B00C73E443E9D7A7D7D2A1D052E"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H7C39CF44632E472DB3423D947287D807"><enum>(1)</enum><text>Subject to paragraph (2) of this subsection, an employee as defined by section 2105 of this title or an individual employed by the Government of the District of Columbia is entitled to leave without loss in pay, time, or performance or efficiency rating for active duty or inactive-duty training (as defined in section 101 of title 37) as a member of the Ready Reserve Corps of the Public Health Service. Leave under this subsection accrues for an employee or individual at the rate of 15 days per fiscal year and, to the extent that it is not used in a fiscal year, accumulates for use in the succeeding fiscal year until it totals 15 days at the beginning of a fiscal year.</text></paragraph><paragraph id="HA62BA53B25214580B4AD1947B32892A4" indent="up1"><enum>(2)</enum><text>In the case of an employee or individual employed on a part-time career employment basis (as defined in section 3401(2) of this title), the rate at which leave accrues under this subsection shall be a percentage of the rate prescribed under paragraph (1) which is determined by dividing 40 into the number of hours in the regularly scheduled workweek of that employee or individual during that fiscal year.</text></paragraph><paragraph indent="up1" id="H0AFC0AE8A61145A692FA91C2C24B3598"><enum>(3)</enum><text>The minimum charge for leave under this subsection is one hour, and additional charges are in multiples thereof.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD55A82D674B2459197BEEA297018105E"><enum>(2)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by striking the item relating to section 6323 and inserting the following:</text><quoted-block style="OLC" id="H4980E4BF323E431CA2BF2278E5BFDADA"><toc><toc-entry level="section">6323. Uniformed services leave.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HA4D8F6A2A083412E9A52CB99827B9575"><enum>4.</enum><header>Clarification of entitlement to Post-9/11 Educational Assistance for service on active duty in the uniformed services</header><subsection id="H4DAA28B725C749828437B32CD5410F0F"><enum>(a)</enum><header>Clarification</header><text>Section 3301(1) of title 38, United States Code, is amended by adding at the end the following new subparagraphs:</text><quoted-block display-inline="no-display-inline" id="HB2A2639EA0184493BB7046EA8174D22E" style="OLC"><subparagraph id="H89F26DAA12F547EBAD4BC22053FD9C62"><enum>(D)</enum><text>In the case of members of the regular components of the Commissioned Corps of the Public Health Service, the meaning given such term in section 101(21)(B).</text></subparagraph><subparagraph id="H03919A8AE7CD4C7C85D1E8EDA38BB531"><enum>(E)</enum><text>In the case of members of the reserve component of the Commissioned Corps of the Public Health Service, service on active duty under a call or order to active duty under subparagraph (B), (C), or (D) of section 203(c)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/204">42 U.S.C. 204(c)(2)</external-xref>) or section 216 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/217">42 U.S.C. 217</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA6981BB511B446DA82A6E5D1B18A3542"><enum>(b)</enum><header>Additional clarification</header><text display-inline="yes-display-inline">Section 3311 of such title is amended—</text><paragraph id="H0E0D27317C754B07879A5C81FB6CB5A6"><enum>(1)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="USC">in the Armed Forces</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">in the uniformed services</header-in-text></quote>;</text></paragraph><paragraph id="H86C553644A81488CA6EB3A4BEB7E8585"><enum>(2)</enum><text>in subsection (b), in paragraphs (1) through (11), by striking <quote>Armed Forces</quote> each place it appears and inserting <quote>uniformed services</quote>;</text></paragraph><paragraph id="H0C9D2EDD00924E3488F64B72E7B10F63"><enum>(3)</enum><text>in subsection (c), by striking <quote>Armed Forces</quote> each place it appears and inserting <quote>uniformed services</quote>;</text></paragraph><paragraph id="HAF630DB36F25483490A3179BC441AF04"><enum>(4)</enum><text>in subsection (d)(3)(A), by striking <quote>Armed Forces</quote> and inserting <quote>uniformed services</quote>; and</text></paragraph><paragraph id="HD498DA32D0164D61BB5A2BC5A2DD8446"><enum>(5)</enum><text>in subsection (f)(4)(B)(ii), by striking <quote>Armed Forces</quote> and inserting <quote>uniformed services</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE019FCEB55EA42FBB2D8F3218CEE73E9"><enum>(c)</enum><header>Applicability</header><text>The amendments made by subsections (a) and (b) shall apply with respect to service occurring on or after March 27, 2020.</text></subsection><subsection id="H0E1C149AEA3B4F9A97A811B8C57B16E9"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 33 of such title is amended by striking the item relating to section 3311 and inserting the following new item:</text><quoted-block display-inline="no-display-inline" id="H01465513F9204D3A8648153B1EE2891B" style="OLC"><toc><toc-entry bold="off" level="section">3311. Educational assistance for service in the uniformed services commencing on or after September 11, 2001: entitlement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H82AE509F591E4A8595917233FE2A049B" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Technical correction</header><text>Section 101 of such title is amended, in paragraphs (21) through (23), by striking <quote>Reserve Corps of the Public Health Service</quote> each place it appears and inserting <quote>Ready Reserve Corps of the Public Health Service</quote>.</text></subsection></section><section id="HC56DBDF6EC014A6292A1797F43248CE1"><enum>5.</enum><header>Extension of certain educational benefits to members of the Public Health Service Ready Reserve Corps</header><subsection id="H691C9119AF924ACEA8DCFB71D9D2656C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 16131 of title 10, United States Code, is amended—</text><paragraph id="H479063443EEA42E49D1407CF6E7F5B1C"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HB0B1BE1E28974C8D9139116ADF82F4BE"><enum>(A)</enum><text>by striking <quote>each military department</quote> and inserting <quote>the reserve component of that Secretary's uniformed service</quote>;</text></subparagraph><subparagraph id="H3E6FD135DB1847C59728052300945866"><enum>(B)</enum><text>by striking <quote>and</quote> after <quote>Secretary of Defense,</quote>;</text></subparagraph><subparagraph id="HD80CBBE7BE474C53ABB2E59D39AB5C56"><enum>(C)</enum><text>by inserting <quote>, and the Secretary of Health and Human Services with respect to the Public Health Service Ready Reserve Corps,</quote> after <quote>Navy</quote>;
