subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to award grants to States to establish, increase the availability of, and improve access to, qualified health care programs to increase and strengthen the health care workforce in such States.</official-title></form><legis-body id="H6B123FDE825A427E9B778E4CF39D3640" style="OLC"><section id="H4DFCBFFA6EDF4AA09710138225C87385" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Workforce Investment Act</short-title></quote>.</text></section><section id="HC94EA5CA37D2485ABAD2666EA21A41D9"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress to address the Nation’s shortage of a broad spectrum of health care professionals, including direct support professionals, nurses, mental health professionals, nurse aides, and emergency medical services professionals by incentivizing collaboration between health care programs, health care industry partners, and States to grow and strengthen the education and training pipeline of health care professionals within the Nation to better serve patients and families by:</text><paragraph id="H2A7D229265624916AEAC14A3CE3794A7"><enum>(1)</enum><text>Improving the ability of a broad variety of health care programs to meet the workforce demands and capacity of the States, including the workforce demands of historically underserved areas.</text></paragraph><paragraph id="H7F342130569841BEA75D99001134361F"><enum>(2)</enum><text>Raising awareness of an interest in a broad variety of health care occupations and reducing the barriers of access to the health care programs necessary to pursue these occupations, including financial barriers.</text></paragraph><paragraph id="H5C4A5DBDDC65481D90BC918B97E37C84"><enum>(3)</enum><text>Improving pathways between high school career and technical programs and other health care programs.</text></paragraph><paragraph id="HD02A2C57CA5C46758ECE287A2D540FBC"><enum>(4)</enum><text>Developing strategies for health care organizations and educational and training programs to support career growth and development for their employees and for students.</text></paragraph></section><section id="H5877892B7BBB4DB9B14C7A585C4B452D"><enum>3.</enum><header>Health care workforce improvement plans</header><subsection id="H1AD6DA5F567C44BDA3A5E85F1C79CE19"><enum>(a)</enum><header>In general</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall award grants to States to establish and implement a State Health Care Workforce Improvement Plan (in this section referred to as the <quote>Workforce Plan</quote>) to increase and strengthen the health care workforce in such States.</text></subsection><subsection id="H62A9F336A6414C1ABCA2D65D44184B86" commented="no"><enum>(b)</enum><header>Workforce plans</header><paragraph id="HC2CD73655759495FA2935B147B13ABF9"><enum>(1)</enum><header>In general</header><text>A State seeking a grant under this section shall submit to the Secretary, at such time and in such manner as specified by the Secretary, a Workforce Plan containing the following information:</text><subparagraph id="HE0BAFB9EF8AF4F62BE10BBB319F30A19"><enum>(A)</enum><text>A description of the State Health Care Workforce Council (in accordance with subsection (c)(1)(A)) designated by such State to administer such Workforce Plan.</text></subparagraph><subparagraph id="HF95CD9CBDAEF44CEAB4A28B366CF9E85" commented="no"><enum>(B)</enum><text>The means by which such Council will incentivize and establish public-private partnerships with program partners (as defined in subsection (e)(3)) to provide education and training that will—</text><clause id="H5C1DDD1F4AEB41B8827965DA1F4B30FF" commented="no"><enum>(i)</enum><text>raise awareness of, and interest in, careers in health care;</text></clause><clause id="H098C71F234C44C899A12966FEF8BD14C" commented="no"><enum>(ii)</enum><text>improve pathways between high school career, technical programs, and other qualified health care programs (as defined in subsection (c)(2)(A)(i));</text></clause><clause id="H39B456341B3A470E85F60754C23FE2BA" commented="no"><enum>(iii)</enum><text>increase the availability of, and improve access to, such qualified health care programs;</text></clause><clause id="HE751C3AF1450482F87A08362E98F8167" commented="no"><enum>(iv)</enum><text>reduce barriers to accessing such qualified health care programs, including financial barriers to enrolling in such programs; and</text></clause><clause id="H11A77BC575514EC0A8BCF2FB28D617D2" commented="no"><enum>(v)</enum><text>assist employers in the health care industry in supporting career growth and development for employees.</text></clause></subparagraph><subparagraph id="HB82CEBA9A51F4D87988322A0C721FA9A"><enum>(C)</enum><text>The method by which such qualified health care programs will be evaluated, including—</text><clause id="H8B0CBADC06DB4EF2BBCB87C6BA26D243" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text>the benchmarks and improvement activities used to identify and reduce disparities in access to, and the utilization of, such programs; and</text></clause><clause id="HDD6920EE3F07431BA865A2FBD88AF6B1" commented="no"><enum>(ii)</enum><text>adequate safeguards to ensure that such programs are invested in the continuing excellence of such programs, including the education, recruitment, and training of health care program faculty and staff, and the maintenance and acquisition of medical equipment utilized by such program.</text></clause></subparagraph><subparagraph id="HB53D99F73C86493FA2718B378B941324" commented="no"><enum>(D)</enum><text>The State’s plan (if any) to implement an income tax credit (or other tax credit) for program partners.</text></subparagraph></paragraph><paragraph id="H331577C8669346E692533CEA41F44F91" commented="no"><enum>(2)</enum><header>Publication of approved workforce plans</header><text>The Secretary shall make publicly available on an internet website of the Department of Health and Human Services each approved Workforce Plan.</text></paragraph></subsection><subsection id="H3CD34467E36C499B8E9B1601F4021D44" commented="no"><enum>(c)</enum><header>Administration of workforce plans</header><paragraph id="H9A9C4A78F66C4F2A9D343B3C38096A78"><enum>(1)</enum><header>Administration and funding</header><subparagraph id="H2BDEE3D9EE3449899FDAC57AF67A8093"><enum>(A)</enum><header>State health care workforce council</header><text>Each State shall establish (or appoint as existing body to serve as) a State Health Care Workforce Council (in this section referred to as the <quote>Council</quote>) to administer the Workforce Plan. Such Council shall—</text><clause id="H153F439609A040CCBA2C504FFD2315B2"><enum>(i)</enum><text>establish and maintain the State Health Care Workforce Investment Fund (as described in subparagraph (B));</text></clause><clause id="HA700FAF32B03477BA19ACB1B590334AC"><enum>(ii)</enum><text display-inline="yes-display-inline">provide for education and training opportunities through qualified health care programs (as described in paragraph (2)(A));</text></clause><clause id="HB40678F0B568401A8B5E863D85A92ECA"><enum>(iii)</enum><text>evaluate such programs and provide incentives to successful programs; and</text></clause><clause id="HBDC6208C36904FE48DDB008331654BB7"><enum>(iv)</enum><text>provide scholarships to eligible individuals to reduce financial barriers to accessing such programs (in accordance with the requirements under paragraph (2)(B)).</text></clause></subparagraph><subparagraph id="H7AB2E807BDEC4D83A49AA44D5717D3C6"><enum>(B)</enum><header>Health care workforce investment fund</header><text>Each Council shall establish a State Health Care Workforce Investment Fund (in this section referred to as the <quote>Fund</quote>) for the purpose of funding the activities described in the Workforce Plan, including—</text><clause id="HF1DE061A628945F7B1662B69E112E1E7"><enum>(i)</enum><text>providing funding for new or established qualified health care programs;</text></clause><clause id="H85703B2FFA2940159600775A667B6332"><enum>(ii)</enum><text>establishing and supporting scholarships for eligible individuals seeking to enroll in such qualified health care programs to reduce financial barriers for such individuals;</text></clause><clause id="H1A8F425BDF8A415DBA0647470D05478E"><enum>(iii)</enum><text>providing incentives to reward successful qualified health care programs (in accordance with paragraph (2)(A)(iii));</text></clause><clause id="H4A47BDBE4FBD4AC3BF5DAB7EF2254E6E" commented="no"><enum>(iv)</enum><text>supporting related administrative research, consulting, planning, and analysis of the health care workforce needs within such State; and</text></clause><clause id="HDE9884D7DEC543939BD4159C3E301A28"><enum>(v)</enum><text>encouraging investment in the Fund from private, financial, and philanthropic organizations to implement the work described in the Workforce Plan.</text></clause></subparagraph></paragraph><paragraph id="HCC2A2EFE7D9A4D7C89EA8744D844CD1B"><enum>(2)</enum><header>Workforce plan components</header><subparagraph id="H2FE790CD234C431099C4576EC0C1A543"><enum>(A)</enum><header>Qualified health care program</header><clause id="H4F49B85E766F4716925904FEB23DE4CB"><enum>(i)</enum><header>Qualified health care program defined</header><text>In this section, the term <quote>qualified health care program</quote> means an educational or training program, including a high school health care vocational program, that is required to obtain or maintain employment or a professional credential or license for a career in a hospital or other health care setting.</text></clause><clause id="H02DB23AA782F4F9C838793AD75F1ADFF"><enum>(ii)</enum><header>Criteria</header><text display-inline="yes-display-inline">In order to receive funding from a Council, a qualified health care program must—</text><subclause id="H97DFD7952BA0460BAF75FEFCC4FCD874"><enum>(I)</enum><text display-inline="yes-display-inline">target the specific needs of historically underserved areas (as defined in subsection (e)(2));</text></subclause><subclause id="H52235A85614F4FFFB15322267C8FB18D"><enum>(II)</enum><text>demonstrate how such program will benefit the workforce demands and capacity in underserved areas; and</text></subclause><subclause id="H77C8E102488742E8A1DBAD1726DA8DB6"><enum>(III)</enum><text>assist eligible individuals in meeting some or all of the requirements for a certificate, training, or license in health care issued by a State.</text></subclause></clause><clause id="H88271E631D77498892EACD571CE67010" commented="no"><enum>(iii)</enum><header>Incentives for successful programs</header><text>A Council may award additional financial incentives to eligible individuals for programs that demonstrate an increase or other improvement in—</text><subclause id="H4B3FAB10DB7F49DF8F67858570498986" commented="no"><enum>(I)</enum><text>the number of such individuals completing such program;</text></subclause><subclause id="HFECBA734AFC943028C66DA59E1B83CD4" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the passage rate, particularly the first-time passage rate, on any State, health care, credential, examination by graduates of such program;</text></subclause><subclause id="H0869BF83F5D34197B12F08A5136FFA20" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">the ability of such qualified health care programs to meet the workforce demands of the communities such programs serve; and</text></subclause><subclause id="HEC99D9E16C884B14A0EF65D320F5DDEE" commented="no"><enum>(IV)</enum><text>any other objective factors as determined by such Council.</text></subclause></clause></subparagraph><subparagraph id="HE708826306F2471180F82DDD15A14A78"><enum>(B)</enum><header>Scholarships</header><clause id="H60A9BB1A02BE49458F48A8B6479C386C"><enum>(i)</enum><header>In general</header><text>The Council, in accordance with clause (ii), may award scholarships to eligible individuals for purposes of enrolling in a qualified health care program.</text></clause><clause id="HFCEA905BD4E5445697427F28D1F77A10"><enum>(ii)</enum><header>Conditions for award</header><text display-inline="yes-display-inline">In awarding scholarships under the Workforce Plan, the Council shall—</text><subclause id="H18113D4C2A9A4A2FA05EF5606E8A5500"><enum>(I)</enum><text>award not more than two 1-year scholarships to an eligible individual; and</text></subclause><subclause id="H2703319B0C24482881C9900E732138A4"><enum>(II)</enum><text>require that such eligible individual—</text><item id="H085F30BFB6754032A46F8E84DD7176A9"><enum>(aa)</enum><text>submit written proof of enrollment in a qualified health care program to the Council prior to receipt of such scholarship funds;</text></item><item id="H8E96E941F4E9469595DB7983B182BF69"><enum>(bb)</enum><text>upon completion of such program, work as a trained, licensed, or certified health care provider (in accordance with State law) in the State in which such program was conducted, for a period of not less than 1 year for each academic year for which a scholarship was provided; and</text></item><item id="HF4A9280CB6C9424986674CB4026BFA2A"><enum>(cc)</enum><text>sign a promissory note agreeing to repay the amount of the scholarship awarded upon failure to complete the requirement under item (bb).</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="H6D56C7BE638A449FA6DD0C79C486AF68"><enum>(d)</enum><header>Reporting requirements</header><paragraph id="HEC11D7A1D50F443D9551BC8EDF649C29"><enum>(1)</enum><header>Council report</header><text>Not later than December 31, 2024, and annually thereafter, each Council shall submit to the Secretary a report on the activities undertaken in accordance with the Workforce Plan, including—</text><subparagraph id="HCA6F921D6AF249A2A99DE33C4A299995"><enum>(A)</enum><text>a detailed accounting of all monies raised and expended by the Fund, including the sources and recipients of such monies;</text></subparagraph><subparagraph id="HDDA479B553FD43398492FDAE40EF50EE"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of funds spent to conduct each activity under such Workforce Plan;</text></subparagraph><subparagraph id="HA56DBF437957480E979DDDFDE8430973"><enum>(C)</enum><text display-inline="yes-display-inline">data and descriptive information related to the scholarships awarded pursuant to subsection (c)(2)(B), including—</text><clause id="H1A1C20E549694DAD8340A732CB589ED0"><enum>(i)</enum><text>the criteria used to award such scholarships;</text></clause><clause id="HB85387FCA8C3455BA6B87EA4BF0AC379"><enum>(ii)</enum><text>the number of scholarships awarded and the amount of each such scholarship; and</text></clause><clause id="HC30329D6BA2F441695A74F7ECC016A4D"><enum>(iii)</enum><text>the State and county of residence (or equivalent) of each scholarship recipient;</text></clause></subparagraph><subparagraph id="H683DC1D532274126A8F2EF906681B49C"><enum>(D)</enum><text>data and descriptive information with respect to each qualified health care program receiving funds under this section, including—</text><clause id="H8B216CB70A6643678C68DB5F413F6523"><enum>(i)</enum><text>which such programs have received incentives pursuant to subsection (c)(2)(A)(iii);</text></clause><clause id="H7649046068784B138DF5EAC8A9FCD292"><enum>(ii)</enum><text display-inline="yes-display-inline">the overall graduation, workforce participation, and retention rates for each such program; and</text></clause><clause id="HB58CC35789F0483AA4D0931914E7FEB0"><enum>(iii)</enum><text>the graduation, workforce participation, and retention rates for eligible individuals enrolled in each such program, disaggregated by those eligible individuals who received a scholarship pursuant to subsection (c)(2)(B) and those who did not;</text></clause></subparagraph><subparagraph id="H8C1D8017EDDE4C0195383DAA691E91B2"><enum>(E)</enum><text>the number of eligible individuals practicing or employed in the health care field in a respective State, including the training, licensure, or credential of such individual; and</text></subparagraph><subparagraph id="HAC87E274D8C049CDAF3450EDBC67D578"><enum>(F)</enum><text>any other data demonstrating the need for professionals with such training, licensures, or credentials in such State.</text></subparagraph></paragraph><paragraph id="HF233DB370C794EBBAE98F1F098E1D404"><enum>(2)</enum><header>Report to Congress</header><text>Not later than June 1, 2025, and annually thereafter, the Secretary shall submit to Congress a report, including—</text><subparagraph id="H14A3F143B1184E2295F5DFB44DD40347"><enum>(A)</enum><text>the information submitted by each Council under paragraph (1); and</text></subparagraph><subparagraph id="HB8966403DDEE4DDFAE99102BCADFC622"><enum>(B)</enum><text display-inline="yes-display-inline">any other information as determined by the Secretary, including information ensuring compliance with this section and accountability with respect to any Federal funds disbursed under a Workforce Plan.</text></subparagraph></paragraph></subsection><subsection id="H5F5FE19A05704A2B9FFC175F250C4807"><enum>(e)</enum><header>Other definitions</header><text>In this Act:</text><paragraph id="H384C66347CC1451F83E209E8269C1592"><enum>(1)</enum><header>Eligible individual</header><text>The term <quote>eligible individual</quote> means an individual enrolling in a qualified health care program to pursue or advance a career in health care.</text></paragraph><paragraph id="H7AB1DA6C4FB9468AB0C876F8F73E0F42"><enum>(2)</enum><header>Historically underserved county or region</header><text>The term <quote>historically underserved county or region</quote> means a county or a region of a State in which, for the 5 years immediately preceding such State’s application under subsection (b)—</text><subparagraph id="H5C06C5E2ACB349D6BAB9ECEFDA0CCCE6"><enum>(A)</enum><text>objective data with the respect to the health care workforce in such State demonstrates the needs and demands of a State’s health care workforce that exceed the average for such State during such years; and</text></subparagraph><subparagraph id="H80616D4E32B64B9DB33F040DA610EBBF"><enum>(B)</enum><text>unemployment among health care providers as calculated by the Department of Labor of a State demonstrating a countywide or regional rate of unemployment which exceeds statewide unemployment in such State.</text></subparagraph></paragraph><paragraph id="H366C0584A15C43BBAC4AA7B3821A6177"><enum>(3)</enum><header>Program partner</header><text>The term <quote>program partner</quote> means an individual or an entity that gifts, grants, or donates monies to a State’s Fund, and that is—</text><subparagraph id="H9D3835C3920C4C3786056501AA46F11A"><enum>(A)</enum><text>a health care provider (as defined in accordance with State law);</text></subparagraph><subparagraph id="HACD4CEA2C2C44759A6095BBA41A4A55E"><enum>(B)</enum><text>a licensed health care facility operating in such State; or</text></subparagraph><subparagraph id="H3EA5E3CF2C4E43D1A7DB4464F62ADBD4"><enum>(C)</enum><text>a business, corporation, or health care association doing business in, and incorporated under, the laws of such State.</text></subparagraph></paragraph></subsection><subsection id="HABEFF84CDFA04E7AB060DE04368CF6FA"><enum>(f)</enum><header>Funding</header><paragraph id="H64F90696D4B84ADBBE7A758A32BED598"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts in the Medicare Improvement Fund established under section 1898 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395iii">42 U.S.C. 1395iii(a)</external-xref>) shall be available, as provided in advance in appropriation Acts, to carry out this section.</text></paragraph><paragraph id="HE0ECC8951C364ADBB253F147865A094D"><enum>(2)</enum><header>State limitation</header><text display-inline="yes-display-inline">A State with an approved Workforce Plan under this section shall be eligible to receive an amount not to exceed 50 percent of the amount of the State appropriated match to the State Fund established under this section.</text></paragraph><paragraph id="HEAC3E7D2A9E2431092EAD9823E88EF55"><enum>(3)</enum><header>Overall limitation</header><text display-inline="yes-display-inline">In no case shall the aggregate amount made available under paragraph (1) exceed 25 percent of the amount of the combined annual appropriations of the Nurse Corps Scholarship Program and the Nurse Corps Loan Repayment Program authorized pursuant to section 846 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/297n">42 U.S.C. 297n</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
