<official-title display="yes">To amend the Endangered Species Act of 1973 to further restrict the Secretary of the Interior from designating certain lands used for national defense-related purposes as critical habitats for any species under that Act and to broaden exclusions and exemptions from that Act for such defense-related purposes.</official-title>

<section id="H6C5B93294C6F49618C3E69655F7A9341" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Armed Forces Endangered Species Exemption Act</short-title></quote>.</text></section> <section id="HA9294D8AA0AE4B0B8DB7328DAFC75155"><enum>2.</enum><header>Exclusion of military institutions as critical habitat</header><text display-inline="no-display-inline">Section 4(a)(3)(B) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(a)(3)(B)</external-xref>) is amended to read as follows: </text> 
<quoted-block style="OLC" id="HA947ABE9DB9243938A2F64BA7773FE4D" display-inline="no-display-inline"> 
<clause id="H745B0A25464142968744080A45B3B83A"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall not designate as critical habitat—</text> <subclause id="H6112DCFE7A89418ABA2D7F6996910F2B"><enum>(I)</enum><text display-inline="yes-display-inline">any military installation or a State-owned National Guard installation, or any portion thereof, as such terms are defined in section 100 of the Sikes Act (<external-xref legal-doc="usc" parsable-cite="usc/16/670">16 U.S.C. 670</external-xref>); or</text></subclause> 
<subclause id="H418F92A1012841E6B1273FAC5EFB31F6"><enum>(II)</enum><text display-inline="yes-display-inline">any other lands, waters, or geographical area not described in clause (i) that is otherwise designated for use by the Secretary of Defense including by any contractor of the Department of Defense, if the Secretary of Defense determines in writing and submitted to the Secretary of the Interior that such area is necessary for military training, weapons testing, or any other reason determined appropriate by such Secretary of Defense.</text></subclause></clause> <clause id="HC9BDA846832746A69F3FA0BC21528C95" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall not be required to consult with the Secretary of the Interior, under section 7(a)(2) of this Act with respect to agency action, regardless of whether the area described in clause (i) is subject to an integrated natural resources management plan prepared under section 101 of the Sikes Act (<external-xref legal-doc="usc" parsable-cite="usc/16/670a">16 U.S.C. 670a</external-xref>). </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB9280CFC309A45B888725868E24B5C29"><enum>3.</enum><header>Additional exclusions and exemptions from the Endangered Species Act for defense-related operations</header><text display-inline="no-display-inline">Section 10 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539</external-xref>) is amended by adding at the end the following new subsection: </text> <quoted-block style="OLC" id="HA6938FFC92274591828AF81D1CB3B456" display-inline="no-display-inline"> <subsection id="H4449D8331ED54012876F16EF31430EE0"><enum>(h)</enum><header>Exclusion for national defense-Related operations</header> <paragraph id="HFFBD3219E26B4162A78577553115165C" display-inline="no-display-inline"><enum>(1)</enum><header>Exclusions</header><text>The prohibitions under section 9 shall not apply with respect to—</text> 
<subparagraph id="H2FD1CC88A27B49AB9E806D685810468A"><enum>(A)</enum><text>the taking of any endangered species or threatened species, or the importation or exportation of any such species taken as prohibited by such section, by military personnel engaged in a national defense-related operation; </text></subparagraph> <subparagraph id="H47F1C64FDA5C4331B4F70403F0B9D66A"><enum>(B)</enum><text display-inline="yes-display-inline">damaging or destroying any threatened or endangered species, or removing, cutting, digging up, damaging, or destroying any such species, by military personnel engaged in a national defense-related operation; or</text></subparagraph> 
<subparagraph id="H0D0E961B1D74461ABB91AEF4C81C3B44"><enum>(C)</enum><text display-inline="yes-display-inline">an injury to or mortality of a threatened or endangered species that results from, but is not the purpose of, a national defense-related operation,</text></subparagraph><continuation-text continuation-text-level="paragraph">regardless of whether the operation is conducted on a military installation or other area described in section 4(a)(3)(B)(i). </continuation-text></paragraph> <paragraph id="H36EF8085E9F348B6879CD44301809FD4"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this subsection—</text> 
<subparagraph id="HEB28DFFA8DFA4EF6A0CF8E2AF695B64E" commented="no"><enum>(A)</enum><text>the term <term>national defense-related operation</term> means—</text> <clause id="H2D993918A9C844E18FB77B5DA588B52C" commented="no"><enum>(i)</enum><text>research, development, testing, and evaluation of military munitions, other ordnance, and weapons systems;</text></clause> 
<clause id="H87F4BD0991D54582A3C2CA68A4E83A27" commented="no"><enum>(ii)</enum><text>the training of members of the Armed Forces in the use and handling of military munitions, other ordnance, and weapons systems;</text></clause> <clause id="H59431B1B8B7F4A6583019790C11D2732" commented="no"><enum>(iii)</enum><text>general training and military preparedness; or</text></clause> 
<clause id="H402C347730244F14B2E24D9CC23957D7" commented="no"><enum>(iv)</enum><text>any action or duty that the Secretary of Defense deems necessary to support the Department of Defense in its mission; and</text></clause></subparagraph> <subparagraph id="HE3C417C390FF4418A91C25A501A26CC5"><enum>(B)</enum><text>the term <term>military personnel</term> means—</text> 
<clause id="H8E10B20AE8A04942AF23188E7DC3B725"><enum>(i)</enum><text display-inline="yes-display-inline">a member of the Armed Forces; and</text></clause> <clause id="HA3C7C63CFDA04776B6CD10A2B13A7AEC"><enum>(ii)</enum><text display-inline="yes-display-inline">a civilian employee or contractor (including a subcontractor at any tier) of the—</text> 
<subclause id="H86DB3C652E1245CBA60650B2B102B4BA"><enum>(I)</enum><text display-inline="yes-display-inline">Department of Defense (including a nonappropriated fund instrumentality of the Department); or</text></subclause> <subclause id="HA66714EF6DA3425380BE1B76B40DAB07"><enum>(II)</enum><text display-inline="yes-display-inline">any other Federal agency, or any provisional authority, to the extent such employment relates to supporting the mission of the Department of Defense overseas.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
