which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize a pilot program for the making of 90-year, zero interest loans for the purchase of real estate to be used for agricultural production for 90 years.</official-title></form><legis-body id="HE22A7CBE7B58415CA6C55A72CCC4795B" style="OLC"><section id="HA7092EC9B8D94091BE5FFACB6D7BDC83" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Optimize Markets and Encourage Generational Resilience through Ownership, Workmanship, and Nurturing Soil Health Act</short-title></quote> or the <quote><short-title>HOMEGROWN Soil Health Act</short-title></quote> .</text></section><section id="H1F4C86C576114F5A8AEB435B7E2FD2F5"><enum>2.</enum><header>Pilot program of <enum-in-header>90</enum-in-header>-year, zero interest loans for the purchase of real estate to be used for agricultural production for <enum-in-header>90</enum-in-header> years</header><subsection id="HCE2496F53D614D339C7C8D8B8F6A10B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture (in this section referred to as the <quote>Secretary</quote>) shall—</text><paragraph id="HC60712E235B647DC9D7C79BCCCF62D3F"><enum>(1)</enum><text>conduct a pilot program under which loans are made by the Secretary to eligible farmers for the purchase of eligible cropland; and</text></paragraph><paragraph id="HA94B1DCA4E6940B3A4CD01004B770E14"><enum>(2)</enum><text>monitor the productivity of eligible cropland purchased pursuant to the pilot program.</text></paragraph></subsection><subsection id="HD2136090503B46E191525976D313DB74"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H207FB5CE2EEB44C8A884F4935B5520A4"><enum>(1)</enum><header>Eligible farmer</header><text>The term <quote>eligible farmer</quote> means a farmer who—</text><subparagraph id="H05E4F199E3B34D619CC75A4E90AA85A9"><enum>(A)</enum><text display-inline="yes-display-inline">has participated in the business operations of a farm or ranch for not less than 10 years; or</text></subparagraph><subparagraph id="H6B551A796A554A17A1D2AAEFFE2CF4F0"><enum>(B)</enum><text>has other acceptable experience, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HB3B16698A3D8453DB4AB3E8D3FBCACEA"><enum>(2)</enum><header>Eligible land</header><text display-inline="yes-display-inline">The term <term>eligible cropland</term>—</text><subparagraph id="HE381A8507CFC4326B879B10A2A7C469F"><enum>(A)</enum><text display-inline="yes-display-inline">means private or tribal land on which fruits or vegetables, tree nuts, dried fruits, horticulture, or nursery crops (including floriculture) are grown;</text></subparagraph><subparagraph id="H0C545A4915AA4112A5E1A59B08689DDA"><enum>(B)</enum><text>includes other land incidental to land described in paragraph (1), if the Secretary determines that including the other land is necessary for the efficient administration of a loan to be made under this section;</text></subparagraph><subparagraph id="H9F9D7ED087504B138C52D4CD788FB6ED"><enum>(C)</enum><text>not more than 2 percent of the surface of which is impervious; and</text></subparagraph><subparagraph id="H5CA7386765DA44E59FCA7A42841909A5"><enum>(D)</enum><text>the total area of which does not exceed 160 acres.</text></subparagraph></paragraph></subsection><subsection id="HDDD2750F39D44B43A04C0198DBB61680"><enum>(c)</enum><header>Location of loan recipients</header><text>The Secretary shall make loans under this section to recipients in 5 regions of the United States selected by the Secretary, and the loan recipients in each region shall all be located within a single radius of 100 miles.</text></subsection><subsection id="HC64F6D64ED2F4F3899E6C75C09E50266"><enum>(d)</enum><header>Zero-Interest loan</header><text>A loan under this section shall not bear interest.</text></subsection><subsection id="HDCFAA1D6E76C4DD58A91AB523329E01D"><enum>(e)</enum><header>Loan term</header><text>A loan under this section shall be repayable during a term of 90 years.</text></subsection><subsection id="H219898FAAFC443658510F02EE142A779"><enum>(f)</enum><header>Loan condition</header><text>As a condition of making a loan under this section, the Secretary shall require the borrower to use the cropland in a manner described in subsection (b)(2)(A) throughout the 90-year period that begins with the date the loan is made, and if that condition is violated, to repay the Secretary an amount equal to 101 percent of the fair market value of the cropland at the time of the violation.</text></subsection><subsection id="HF70AADC7424E49EC9DA2DB7742DD1C61"><enum>(g)</enum><header>Regulations</header><text>The Secretary may prescribe such regulations as are necessary to carry out this section.</text></subsection><subsection id="H1FA0B5BCE39A4CEC9386CC72DCA0194C"><enum>(h)</enum><header>Effective date</header><text>This Act shall take effect 90 days after the date of the enactment of this section.</text></subsection><subsection id="H552734CD89614EFC856B1997FD2141E7"><enum>(i)</enum><header>Termination</header><text>The authority provided by this section shall expire on the date that is 5 years after the effective date of this Act.</text></subsection></section></legis-body></bill>
