Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Research and Development, Competition, and Innovation Act to support research into the effects of extreme weather on the subsurface natural and built environment, to support engineering standards and building codes for resilient designs against multihazards, and for other purposes.</official-title></form><legis-body id="HED97DD64003744F8AE3DF9960C58BCA2" style="OLC"><section id="HE3C8FF929D5D4544B68B3C1F5CDB2184" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building and Upgrading Infrastructure for the Long Term Act</short-title></quote> or the <quote><short-title>BUILT Act</short-title></quote>.</text></section><section id="HC22DAF0D7B4A4011865C7DC00C2C9D71"><enum>2.</enum><header>Subsurface environment research and development</header><subsection id="H0D1E34B76455464B916E8504A84E29FB" commented="no"><enum>(a)</enum><header>In general</header><text>Subtitle B of title II of division B of the Research and Development, Competition, and Innovation Act (enacted as part of division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/18931">42 U.S.C. 18931 et seq.</external-xref>) is amended by adding at the end the following new sections:</text><quoted-block style="OLC" id="HAD037357FEE04D6F919A044B4EBA59AE" display-inline="no-display-inline"><section id="H50864E309F844BD99F25996889142722" commented="no"><enum>10236.</enum><header>Subsurface environment research and development</header><subsection id="H193D1A66D72E45CC8D2B3DFB525B05D4" commented="no"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Director shall support measurement research and testing to inform the development of engineering standards, practices, and building codes on the subsurface environment as such relate to the built environment.</text></subsection><subsection id="H82A01722F3AB4C28ACBE6C188AA83482" commented="no"><enum>(b)</enum><header>Research areas</header><text>Research and testing under subsection (a) may include the following:</text><paragraph id="H626F40C99A6A49B38F33A38130D4C8C6" commented="no"><enum>(1)</enum><text>Measuring, modeling, and predicting the properties of subsurface materials of soil, rock, and groundwater elevations, taking into consideration changing climate conditions.</text></paragraph><paragraph id="H12AE652CC1B043A0BAE6DEED48B24701" commented="no"><enum>(2)</enum><text>Sensing technology for monitoring subsurface infrastructure and phenomena, such as land subsidence, that may affect subsurface infrastructure.</text></paragraph><paragraph id="HE3A4A9274B1D42D0872DF9AAB744EA3D" commented="no"><enum>(3)</enum><text>Risks to subsurface infrastructure integrity, including subsurface infrastructure capacity, resulting from changes in subsurface material properties associated with climate conditions and other environmental variables.</text></paragraph><paragraph id="HB16991C5568D4150A93C91DB2EAA857D" commented="no"><enum>(4)</enum><text>Enhancing building design standards and best practices related to the following:</text><subparagraph id="H2BF397C1B9D4499CB3920AB2D799D0CD" commented="no"><enum>(A)</enum><text>Evaluation of subsurface material properties and potential geological hazards that affect below-ground infrastructure.</text></subparagraph><subparagraph id="HD924087998B6431F8CFDD39CBB7B23F3" commented="no"><enum>(B)</enum><text>Design and retrofit of below-ground infrastructure.</text></subparagraph></paragraph><paragraph id="HF456DBC1A7BF4CC088A536C160E838D8" commented="no"><enum>(5)</enum><text>Other research areas determined appropriate by the Director.</text></paragraph></subsection><subsection id="H4FB3CFA3F5934C7B8A7B3568CADCA803" commented="no"><enum>(c)</enum><header>Consultation</header><text>The Director shall carry out this section in consultation with academia, the private sector, nonprofit organizations, professional associations, and other appropriate Federal, State, Tribal, territorial, and local entities.</text></subsection></section><section id="H8C9B2203E5864613AB54C1A25E478C65" commented="no"><enum>10237.</enum><header>Climate resilience research and development</header><subsection id="H51303C68C41A4C23A6985CF77EE510FB" commented="no"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Director shall support measurement research and testing to inform the development of engineering standards, practices, and building codes for resilience of the built environment, which may include measurement research and development for the following:</text><paragraph id="H62E56454EB7E440FBAF6004B35D27152" commented="no"><enum>(1)</enum><text>Future climate conditions, loads, and effects on infrastructure.</text></paragraph><paragraph id="H212FF160F31C43F88AD99B4FAB29DBDD" commented="no"><enum>(2)</enum><text>Multihazard and cascading hazard risk and resilience modeling and prediction.</text></paragraph><paragraph id="HCF731F005198479AB0C5FAC0BF7441CB" commented="no"><enum>(3)</enum><text>Design standards and best practices for climate-resilient infrastructure, including lifeline infrastructure.</text></paragraph><paragraph id="H1CB44558C0AC444F8DBA1C283AEE5009" commented="no"><enum>(4)</enum><text>Sensing technology for monitoring infrastructure integrity.</text></paragraph><paragraph id="H32243126343F4FA186DCD9C4A47A4079" commented="no"><enum>(5)</enum><text>Future climate effects on infrastructure capacity over its life cycle.</text></paragraph></subsection><subsection id="H292017369F994A75BDA4E7AFAF1C331E" commented="no"><enum>(b)</enum><header>Workshop on multihazard resilient design framework</header><text>Not later than two years after the date of the enactment of this section, the Director shall convene, or enter into a cooperative agreement with an appropriate nongovernmental organization to convene, a workshop composed of subject matter experts, stakeholders, and partners from Federal, State, Tribal, territorial, and local entities, nongovernmental organizations, private sector entities, disaster management professional associations, engineering professional associations, professional construction and homebuilding industry associations, and building code setting organizations to discuss a framework for designing multihazard resilient buildings and infrastructure, including identifying research and measurement needs for the following:</text><paragraph id="HED2EAED1CE7642FFA3D7485D44D87A5E" commented="no"><enum>(1)</enum><text>Risk and resilience assessments and modeling, including cascading hazards and interactions between multiple hazards.</text></paragraph><paragraph id="H22FCBBB16FF542EA8E2022AF5735F7C3" commented="no"><enum>(2)</enum><text>Functional recovery design.</text></paragraph><paragraph id="H050BD2D436124B7AAC8B8C4B9510E4CB" commented="no"><enum>(3)</enum><text>Climate resilient design.</text></paragraph><paragraph id="H67ACF52D386D4A00A62CE49098CD8F27" commented="no"><enum>(4)</enum><text>Analysis and retrofit of existing building and infrastructure stock.</text></paragraph><paragraph id="HF54F8B3C16A646A9997F7BE71D26D72F" commented="no"><enum>(5)</enum><text>Financial tools for decision-support.</text></paragraph><paragraph id="H1C3DC5E9C853413FB399B255CC712F04" commented="no"><enum>(6)</enum><text>Other areas determined appropriate by the Director.</text></paragraph></subsection><subsection id="H831926C9526D4ED7A63F287F215A7367" commented="no"><enum>(c)</enum><header>Report</header><text>Not later than one year after the date on which the workshop described in subsection (b) is completed, the Director shall submit to Congress and make available to the public a report on the findings of the workshop, including any recommendations for legislative action that could strengthen the multihazard resilience of the United States.</text></subsection><subsection id="H6C364511E1F64CECA08719AF79291633" commented="no"><enum>(d)</enum><header>Consultation</header><text>The Director shall carry out this section in consultation with academia, the private sector, nonprofit organizations, professional associations, and other appropriate Federal agencies.</text></subsection><subsection id="H70A8C1A1C9C941B6A0B2EA50CA856D54" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H493CEBAE79BD4150926C64452129ACE7" commented="no"><enum>(1)</enum><header>Climate resilience</header><text>The term <quote>climate resilience</quote> has the meaning given the term in section 101(a) of title 10, United States Code.</text></paragraph><paragraph id="H10F4F566EB1444F18CC00643288A6F27" commented="no"><enum>(2)</enum><header>Lifeline infrastructure</header><text display-inline="yes-display-inline">The term <quote>lifeline infrastructure</quote> has the meaning given the term in section 4 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7703">42 U.S.C. 7703</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4CFF10B2DA0F4795AA8E856F0F367804" commented="no"><enum>(b)</enum><header>Risk and resilience research</header><text>Section 10351 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19060">42 U.S.C. 19060</external-xref>) is amended—</text><paragraph id="HF26B9EA6387A4F118744740AC2D8B48E" commented="no"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="HB5DD52E9B5464AE9A800DF3B8A6AC02D" commented="no"><enum>(2)</enum><text>in paragraph (5), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC4ECF3AE985E4444A815D8B7ADBC5C70" commented="no"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H759102FE41E44587BABD36CE92E52DC4" style="OLC"><paragraph id="HF1F36A5A7D40495492F7D39F171C8169" commented="no"><enum>(6)</enum><text>multidisciplinary research to understand, model, and predict subsurface geological phenomena related to climate variations and the impact of such on infrastructure design and operations, to manage risk and improve resiliency of the built environment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0734C9DD427B46888EA02B45F3EE434D"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> is amended by inserting after the item relating to section 10235 the following new items:</text><quoted-block style="OLC" id="H413E0F1BCCDA4ACFA2F842BA4917FDE6" display-inline="no-display-inline"><toc
