id="H61B6F96F0BFA4AF6A407844440A415C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Human Trafficking Fingerprint Background Check Protection Act of 2024</short-title></quote>.</text></section><section id="H5C4A4B63C97A4CF7BA5F658214DCAE6A"><enum>2.</enum><header>Purpose; findings</header><subsection id="HAD57E699E72548D8812B8F50DF6C0792"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to require owners and employees of massage wellness spas to undergo fingerprint-based background checks to mitigate the risk of human trafficking and enhance public safety.</text></subsection><subsection id="HAA997746059940C6854999D4B74FEAFF"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H5EBBFE8CD9E4414CA150D5E673AEAC12"><enum>(1)</enum><text display-inline="yes-display-inline">Human trafficking remains a grave concern, with massage wellness spas being identified as venues frequently associated with such criminal activities.</text></paragraph><paragraph id="HC6FD11A8F75C4E65B4E0B1CBEF5578A7"><enum>(2)</enum><text>The protection of vulnerable individuals and the prevention of human trafficking are paramount.</text></paragraph><paragraph id="H6FA88A9AD46C412D9ADE20C60845746F"><enum>(3)</enum><text>Comprehensive background checks, particularly fingerprint-based ones, have proven to be effective in identifying potential risks and preventing exploitation.</text></paragraph></subsection></section><section id="H355F5DE78D5E4732BE2277A17A378DF4"><enum>3.</enum><header>Fingerprint Background Checks</header><subsection id="HB314867A8BBC4EE487872C952FC35BD5" display-inline="no-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">All owners and employees of massage wellness spas, including independent contractors, shall be subject to a fingerprint-based background check.</text></subsection><subsection id="H0ED5BE4137BB4B92B6EB9A2AE1EA0B32"><enum>(b)</enum><text>The background check shall be conducted by a law enforcement agency, or an entity authorized by the relevant jurisdiction to perform such checks.</text></subsection><subsection id="HA2035D15049548D8B2461F1E919B34BA"><enum>(c)</enum><text>The results of the background check shall be reviewed to determine the presence of any criminal history, particularly related to offenses such as human trafficking, sexual exploitation, or violence.</text></subsection><subsection id="HB68A2B7C6F3F4043B768171A6F326D15"><enum>(d)</enum><text>Owners and employees must pass the background check prior to being able to own, be employed, or allowed to continue their employment in a massage parlor.</text></subsection></section><section id="HFB59722A45E6487B8522182626D2C650"><enum>4.</enum><header>Compliance and Enforcement</header><subsection id="H73F74C7D82F049EB8F240D9B919D469C"><enum>(a)</enum><text display-inline="yes-display-inline">Owners of massage wellness spas shall be responsible for ensuring that all employees undergo the required background checks.</text></subsection><subsection id="H7896CD0FFE81452AB22E1DE028A236FA"><enum>(b)</enum><text display-inline="yes-display-inline">Failure to comply with the provisions of this Act shall result in penalties as determined by the relevant jurisdiction, which may include fines, suspension, or revocation of licenses.</text></subsection></section><section id="H06F0F5BD113C4D779D42E1EEADB6BCA6"><enum>5.</enum><header>Reporting</header><text display-inline="no-display-inline">Law enforcement agencies shall report any findings of criminal activity uncovered during the background check process to appropriate authorities for further investigation and action.</text></section><section id="HE1E5773FFFCE4AFE80F011A21D96D37A"><enum>6.</enum><header>Training and Enforcement</header><subsection id="H3FC682FE5434496AA9A8708AF2DC11E8"><enum>(a)</enum><text display-inline="yes-display-inline">Owners and employees of massage wellness spas shall undergo training on recognizing and reporting signs of human trafficking.</text></subsection><subsection id="H1ECE95AC64D34631B965068986790A38"><enum>(b)</enum><text display-inline="yes-display-inline">Educational materials and resources shall be made available to massage parlor owners and employees to raise awareness about human trafficking and related issues.</text></subsection></section><section id="H948DA42600114D3D84A3F325F21F00FB"><enum>7.</enum><header>Enactment</header><text display-inline="no-display-inline">This Act shall take effect 120 days after the date of enactment.</text></section><section id="HB25D9AEC4249451EB9D3D20E00789B1A"><enum>8.</enum><header>Reliability of Fingerprint Background Checks</header><subsection id="H5BFC203ADFD343BE95BFDE65F88AD3EB" display-inline="no-display-inline"><enum>(a)</enum><text>Fingerprint-based background checks are widely recognized as one of the most reliable methods for identifying individuals and assessing their criminal history.</text></subsection><subsection id="HCD6A873B7FBF4C94B47A9B6D3D13F0C7"><enum>(b)</enum><text>Fingerprinting offers a unique identifier for each individual, significantly reducing the likelihood of false positives or identity confusion.</text></subsection><subsection id="H34504D9429EA446C9BFACA7EFF4DAA7E"><enum>(c)</enum><text>The use of fingerprints in background checks enhances accuracy and completeness by accessing criminal records databases at local, State, and Federal levels.</text></subsection><subsection id="HEE902EC6C2DE4E59B43F60D777F653A7"><enum>(d)</enum><text>Studies have shown that fingerprint-based background checks have a high degree of accuracy and are effective in identifying individuals with criminal histories.</text></subsection><subsection id="H44E3E3CF87354D14AD2F7126F7A4FAEF"><enum>(e)</enum><text>Law enforcement agencies, government entities, and employers across various sectors rely on fingerprint-based background checks as a standard practice for vetting individuals’ criminal history.</text></subsection><subsection id="H2825533F123A476B8BFA3C049804C6FD"><enum>(f)</enum><text>By mandating fingerprint-based background checks for owners and employees of massage wellness spas, this Act ensures a robust and reliable screening process to identify potential risks and protect against human trafficking and related crimes.</text></subsection></section><section id="HBEA584A5FEC747959F84CE5EB171A659"><enum>9.</enum><header>Definition</header><text display-inline="no-display-inline">The term <term>massage wellness spa</term> is defined as a business establishment where various forms of massage therapy are offered. A facility where licensed massage therapists provide therapeutic treatments designed to promote relaxation, relieve stress, alleviate pain, and improve overall health and well-being. This definition includes massage parlors, massage facility, massage spa, and any other facility where the core service is to provide massage services of any kind.</text></section></legis-body></bill>
