R. 9741</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240920">September 20, 2024</action-date><action-desc><sponsor name-id="S001207">Ms. Sherrill</sponsor> (for herself, <cosponsor name-id="R000617">Mrs. Ramirez</cosponsor>, <cosponsor name-id="C001127">Mrs. Cherfilus-McCormick</cosponsor>, <cosponsor name-id="K000389">Mr. Khanna</cosponsor>, <cosponsor name-id="T000486">Mr. Torres of New York</cosponsor>, <cosponsor name-id="F000462">Ms. Lois Frankel of Florida</cosponsor>, <cosponsor name-id="J000305">Ms. Jacobs</cosponsor>, <cosponsor name-id="B001281">Mrs. Beatty</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="E000299">Ms. Escobar</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="D000631">Ms. Dean of Pennsylvania</cosponsor>, <cosponsor name-id="C001125">Mr. Carter of Louisiana</cosponsor>, <cosponsor name-id="B001285">Ms. Brownley</cosponsor>, <cosponsor name-id="S001208">Ms. Slotkin</cosponsor>, <cosponsor name-id="A000376">Mr. Allred</cosponsor>, <cosponsor name-id="R000305">Ms. Ross</cosponsor>, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="K000382">Ms. Kuster</cosponsor>, <cosponsor name-id="M001227">Ms. McClellan</cosponsor>, <cosponsor name-id="G000587">Ms. Garcia of Texas</cosponsor>, <cosponsor name-id="T000482">Mrs. Trahan</cosponsor>, <cosponsor name-id="G000583">Mr. Gottheimer</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="S001159">Ms. Strickland</cosponsor>, <cosponsor name-id="A000380">Mr. Amo</cosponsor>, <cosponsor name-id="T000483">Mr. Trone</cosponsor>, <cosponsor name-id="M001196">Mr. Moulton</cosponsor>, <cosponsor name-id="M000312">Mr. McGovern</cosponsor>, <cosponsor name-id="Q000023">Mr. Quigley</cosponsor>, and <cosponsor name-id="C001080">Ms. Chu</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Defense to ensure that beneficiaries and health care providers receive certain information regarding reproductive health care under the TRICARE program.</official-title></form><legis-body id="H11F223D42CE04712970FDDBB8CC39F61" style="OLC"><section id="HC3FC40F46AED42709281554A6179A08A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Knowledge on Military Reproductive Healthcare Act</short-title></quote>.</text></section><section id="H1E382CCFBB184B64A340AD3041C9433F"><enum>2.</enum><header>Provision of information regarding access to reproductive health care to a TRICARE beneficiary</header><subsection id="H1EB8FB7141C04656BE013BDEC4E8345B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense shall provide, to a beneficiary under the TRICARE program (including a member of the uniformed services), information on the following:</text><paragraph id="HF2E59A83C91946E3ACEC3DF42CBDD186"><enum>(1)</enum><text display-inline="yes-display-inline">The reproductive health care, including abortion care, that they are entitled to receive under the military health system.</text></paragraph><paragraph id="H3A655EEEEFC24008BD2EE3BB98882509"><enum>(2)</enum><text>The circumstances under which they can receive such care at a military treatment facility.</text></paragraph><paragraph id="H47BFFC2C701E499BB888105C50CCE5E0"><enum>(3)</enum><text display-inline="yes-display-inline">How to request leave and travel benefits for travel to another State to receive non-covered reproductive health care.</text></paragraph><paragraph id="H8BA2B65D8516411AA9431BA197724C5F"><enum>(4)</enum><text display-inline="yes-display-inline">How to find a non-Department provider of reproductive health care not available to the beneficiary under the military health system.</text></paragraph></subsection><subsection id="HDE1E02A118EB4917B05140C8E85B7DD7"><enum>(b)</enum><header>Schedule</header><text>The Secretary shall provide information described in subsection (a)—</text><paragraph id="H1527FF0C7A01414686B7C244E09FB76B"><enum>(1)</enum><text>at least once per year; and</text></paragraph><paragraph id="H67D2A7842D9344199CCBF107465F831F"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 14 days after a permanent change of station or a temporary change in station.</text></paragraph></subsection><subsection id="HCEBE00005E9F44B7A57E81F6FBF84F80"><enum>(c)</enum><header>Methods</header><text>The Secretary may provide information under this section through an in-person consultation or a written notice. Such a written notice may be provided electronically.</text></subsection><subsection id="H06FDDAC72A644526AAE9829D77F3C756"><enum>(d)</enum><header>Public posting</header><text>The Secretary shall ensure that a written notice under subsection (c) is posted, and copies thereof are available for collection, in publicly accessible areas of each military medical treatment facility.</text></subsection></section><section id="H47CA432E4D8D4CDD9B8CC56CF6351F6D"><enum>3.</enum><header>Training for military treatment facility providers on reproductive health care obligations</header><text display-inline="no-display-inline">Each health care provider working at a military treatment facility shall receive training, on an annual basis and in the event of any permanent change in duty station, on the following: </text><paragraph id="H77EDA523514F44388C73C8D7EB996119"><enum>(1)</enum><text display-inline="yes-display-inline">The obligation of each such provider to provide covered reproductive health care and counseling, including abortion, contraceptive, and fertility care, and such provider’s ability to provide that care and counseling at military treatment facilities notwithstanding the laws and regulations of the State in which the facility is located.</text></paragraph><paragraph id="H8A9AC2E3A11647818BA5944DA2D33D90"><enum>(2)</enum><text display-inline="yes-display-inline">The rights and the protections afforded to such providers as providers at military treatment facilities with regard to covered reproductive health care, notwithstanding laws and regulations of the State in which the treatment facility is located.</text></paragraph></section></legis-body></bill>
