<official-title display="yes">To require the Administrator of the Federal Aviation Administration to revise regulations for certain individuals carrying out aviation activities who disclose a mental health diagnosis, and for other purposes.</official-title>

<section id="H0FF5E75838AB42D6B557540FA4C510C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mental Health in Aviation Act of 2024</short-title></quote>.</text></section> <section id="H95F2DDB221AB46738798FC270834DBFA" section-type="subsequent-section"><enum>2.</enum><header>Regulations for individuals carrying out aviation activities</header> <subsection id="HBB54C3F5261840DD9D831DB85D90E482"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall update regulations, including in part 67 of title 14 of Code of Federal Regulations, as appropriate, and take any other actions necessary to implement the recommendations of the aviation workforce mental health task group established under section 411(d) the FAA Reauthorization Act of 2024 to encourage individuals to—</text>
<paragraph id="H18BD3DB3EBE14D878776B253061F9290"><enum>(1)</enum><text>seek help for mental health conditions or symptoms of mental health conditions; and</text></paragraph> <paragraph id="H60E28AB773F741F7BF387028133CF5F5"><enum>(2)</enum><text>to disclose conditions or symptoms described in paragraph (1).</text></paragraph></subsection>
<subsection id="H2415E7CDB27C4544B9366DFC55F6DF79"><enum>(b)</enum><header>Consultation</header><text>In carrying out this section, the task group described in subsection (a) shall consult with relevant stakeholders from the aviation and medical communities, as necessary, including—</text> <paragraph id="H12620FE586534FF4A88474FED695C55B"><enum>(1)</enum><text display-inline="yes-display-inline">the exclusive bargaining representatives of pilots and air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph>
<paragraph id="H20C7017A304A405FAC1034C08615C780"><enum>(2)</enum><text display-inline="yes-display-inline">aviation medical examiners, as described in section 183.21 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="H46829CD902D44940A738BD0DAF34A589"><enum>(3)</enum><text>organizations representing the individuals in paragraphs (1) and (2); and</text></paragraph>
<paragraph id="H08F3C2A274884D519928BDA0A7041E70"><enum>(4)</enum><text display-inline="yes-display-inline">any other stakeholder determined relevant by the task group , including any stakeholders described in section 411(d)(3)(B) of the FAA Reauthorization Act of 2024.</text></paragraph></subsection> <subsection id="H1CDD421CE45E46D9BFEDF3FACC39B05D"><enum>(c)</enum><header>Report requirements</header><text display-inline="yes-display-inline">Section 411(d)(4) of the FAA Reauthorization Act of 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/63">Public Law 118–63</external-xref>) is amended—</text>
<paragraph id="H8E64B53FDF6A4C26B14135F5028D6859"><enum>(1)</enum><text>in subparagraph (B) by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H806F99A80C5A4673B242166178DEA2FE"><enum>(2)</enum><text>in subparagraph (C) by striking the period at the end and inserting a semicolon; and</text></paragraph>
<paragraph id="HEE2C94BF8FE24CA48624206AEFF833F7"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H28C909935F3A43BFB05814EFCFFECD3B" display-inline="no-display-inline"> <subparagraph id="HA9ECCF1277EC41D0BF9D21194D875DC7"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation of any recommendations reached by the National Transportation Safety Board related to aviation workforce mental health; and</text></subparagraph>
<subparagraph id="HF465BC11E0B24E299363582510D0378A"><enum>(E)</enum><text display-inline="yes-display-inline">a description of relevant clinical studies, research, diagnostic manuals, and protocols used by the licensed professionals as of the date of enactment of this Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HEFE339CA1D7A46E4BA0057E3632DDF7F"><enum>3.</enum><header>Annual review of mental health special issuance process</header><text display-inline="no-display-inline">The Administrator of the Federal Aviation Administration shall conduct an annual review, and update, as appropriate, the applicable regulations and policies, on mental health-related special issuance for pilots and air traffic controllers to— </text>
<paragraph id="H02EB02FE78C84C4EB80EF50F7420015A"><enum>(1)</enum><text display-inline="yes-display-inline">reclassify and approve additional medications that may be safely prescribed to airmen to treat mental health conditions;</text></paragraph> <paragraph id="H85D37471A9A940528E4E310E4BF48F43"><enum>(2)</enum><text display-inline="yes-display-inline">if the administrator determines appropriate, delegate additional authority to aviation medical examiners; and</text></paragraph>
<paragraph id="HAD3D66AAD7C34E95804145CB591BA92D"><enum>(3)</enum><text>improve the special issuance process for pilots and air traffic controllers.</text></paragraph></section> <section id="H503D2B1A66F142BDA9EFC5C77E7F8B3D"><enum>4.</enum><header>Authorization of appropriation for additional aviation medical examiners</header><text display-inline="no-display-inline">There is authorized to be appropriated $13,740,000 to the Administrator for each of fiscal years 2025 through 2028 to—</text>
<paragraph id="HBFAF079F6AD74F359D756F8174440861"><enum>(1)</enum><text>recruit, select, train, and delegate the necessary authorities to additional aviation medical examiners and human intervention motivation study aviation medical examiners, including those who are psychiatrists;</text></paragraph> <paragraph id="H946645A07FAE4FCD9E76FD0E911AACC3"><enum>(2)</enum><text>review and improve mental health care training for aviation medical examiners; </text></paragraph>
<paragraph id="H85A36E6C4A8A4879BC33A8717A77E0B3"><enum>(3)</enum><text display-inline="yes-display-inline">expand capacity to provide oversight of aviation medical examiners and clear the backlog of special issuance requests at the Office of Aerospace Medicine; and</text></paragraph> <paragraph id="H2984C0AE2D8F4F91A752D446E1DA146C"><enum>(4)</enum><text display-inline="yes-display-inline">support any other related activities, as determined by the Administrator.</text></paragraph></section>
<section id="HCB4C8B74C9DB4C3DA13BE13CFEE5A3A5"><enum>5.</enum><header>Public information campaign</header>
<subsection id="H1A420F4CEA7D4F1C8ECB187C022836B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Administrator of the Federal Aviation Administration $1,500,000 for each of fiscal years 2025 through 2028 for a public information campaign or similar public education efforts to destigmatize individuals in (or interested in joining) the aviation industry who seek mental health care and to broaden awareness of available supportive services.</text></subsection> <subsection id="H0799971159BA4348AB135B782A8E2EB6"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the Administrator creates the public information campaign described in subsection (a), the Administrator shall submit to appropriate committees of Congress a report describing the actions taken to develop such campaign and the plans for implementation.</text></subsection></section>
<section id="H6D520D1DAF48452B9D49FDEE2C22C2EA"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H6860475C55E8422E9E336DC815B85056"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text>
<subparagraph id="H33F86006317E48B9ACD12FEEA48577BB"><enum>(A)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph> <subparagraph id="HDDD5C140F14E4B7AB4F9BC8A125420C3"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph>
<paragraph id="HA198633BCB9040F8950940A771313375"><enum>(2)</enum><header>Special issuance</header><text display-inline="yes-display-inline">The term <quote>special issuance</quote> has the meaning given the term in section 67.401 of title 14, Code of Federal Regulations.</text></paragraph></section> </legis-body> </bill>
