which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to establish in the Department of Homeland Security the Early Migration Alert Program, and for other purposes.</official-title></form><legis-body id="HE25459514F46475E9D0E634147A6543B" style="OLC"><section id="HCA49BCC9563C489B93C14C04E861AB14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Migration Alert Program Act</short-title></quote> or the <quote><short-title>EMAP Act</short-title></quote>.</text></section><section id="H1CD9C86C5699497A8DC878306DF03B65"><enum>2.</enum><header>Early Migration Alert Program</header><subsection id="H7682D7262E8749FA9486175CE0C0EE77"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/251">6 U.S.C. 251 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HDFB2BFE6DE944B4FB1ECC52B29E604EE" style="OLC"><section id="HAFF00996B4F642E58FC8E6692890DFEF"><enum>447.</enum><header>Early Migration Alert Program</header><subsection id="H64249D30B69A488EA1CF0E4E95E8FCF0"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department a program to be known as the <quote>Early Migration Alert Program</quote> (referred to in this section as <quote>EMAP</quote>).</text></subsection><subsection id="H3634D718243944348AD4ACD09FF3404A"><enum>(b)</enum><header>Purpose</header><text>The purpose of EMAP is to—</text><paragraph id="H02045C3E687846038005CC4972040796"><enum>(1)</enum><text>lead the Department’s dissemination of information pertaining to the movement and release of aliens into the United States; and</text></paragraph><paragraph id="H66B99ED1C82E4EBF837AF03E121BE20A"><enum>(2)</enum><text>formalize partnerships with regional stakeholders to integrate, analyze, and disseminate information pertaining to the movement and release of aliens into the United States.</text></paragraph></subsection><subsection id="H64EF1EA53B324DC0A12D4DC6A62600A3"><enum>(c)</enum><header>Information sharing</header><paragraph id="H97F4236B08B244C98B3806FBFB35F3CF"><enum>(1)</enum><header>Provision of information</header><subparagraph id="H2AFE02828DAF4FF2823E03F6EC8735AF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 24 hours before releasing an alien into the United States, the Secretary, in consultation with the Secretary of Health and Human Services, acting through the Commissioner of U.S. Customs and Border Protection and the Director of U.S. Immigration and Customs Enforcement, shall provide to State, local, Tribal, and territorial government personnel in the relevant jurisdiction information relating to the number of such aliens to be released, the number of such aliens with known criminal histories, the initial destinations of such aliens, and the final destinations where such aliens intend to settle.</text></subparagraph><subparagraph id="H32969040619E416D8B49239C4555A942"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) may be construed as requiring U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement to detain an alien any longer than required by law.</text></subparagraph></paragraph><paragraph id="HD8A23546418641F499ED1AFAA3C42A1F"><enum>(2)</enum><header>Electronic mail notification service</header><subparagraph id="H00D729EFB7C8478599FE2E657339C054"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Commissioner of U.S. Customs and Border Protection and the Director of U.S. Immigration and Customs Enforcement, shall take such actions as are necessary to develop an electronic mail notification system and a list of State, local, Tribal, and territorial government personnel who may receive information under paragraph (1).</text></subparagraph><subparagraph id="HA8C1FBFF985A417D89E396A1A2094E70"><enum>(B)</enum><header>Delivery</header><text>Information under paragraph (1) may be provided via the electronic mail notification system under subparagraph (A) only if a verified official government email address of the receiving jurisdiction is on file with EMAP.</text></subparagraph></paragraph></subsection><subsection id="H31DF6DD6486A470B82AF63EE3317426D"><enum>(e)</enum><header>Effective date</header><text>This section shall take effect and apply with respect to any alien who is apprehended or released on or after the date of the enactment of this section.</text></subsection><subsection id="H868029F96F55469E878DF23F012FED82"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $400,000 for each of fiscal years 2024 and 2025 to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCE405C07BFBC4240B610756A82CECD8F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 446 the following new item:</text><quoted-block style="OLC" id="H891A8386951745139F113EA6A93736C2" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 447.
