A BILL
To amend the McKinney-Vento Homeless Assistance Act to update to the
definition of chronically homeless, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Transitional Housing Protection for
the Homeless Act''.
SEC. 2. CHRONIC HOMELESSNESS.
(a) In General.--Section 401(2) of the McKinney-Vento Homeless
Assistance Act (42 U.S.C. 11360(2)) is amended--
(1) in subparagraph (A)(ii) by striking ``shelter
continuously for at least 1 year or on at least 4 separate
occasions in the last 3 years; and'' and inserting ``shelter--
``(I) continuously for at least 1
year; or
``(II) on more than one occasion
for a cumulative period of 1 year or
more in the last 3 years; and''; and
(2) in subparagraph (B)--
(A) by striking ``A person'' and inserting the
following:
``(i) In general.--A person''; and
(B) by adding at the end the following:
``(ii) Transitional housing.--A person who
currently lives or resides in a transitional
housing program and has resided there for fewer
than 90 days shall be considered chronically
homeless if such person met all of the
requirements described in subparagraph (A)
prior to entering that program.''.
(b) Rule Making.--The Secretary of Housing and Urban Development
shall not later than 180 days after the date of the enactment of this
section issue a rule to update part 578 of title 24, Code of Federal
Regulations, to reflect the amendments made by this section.
