which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Defense to collaborate with a federally funded research and development center to assess the biotechnology capabilities of adversaries of the United States, and for other purposes.</official-title></form><legis-body id="HA7D8606E557B409BA759E3F903DA51F4" style="OLC"><section id="H36A5609922024F7B92DE29BDF266C14E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assessment of Critical Technologies in Adversarial Ventures and Emerging Threats Act</short-title></quote> or the <quote><short-title>ACTIVATE Act</short-title></quote>. </text></section><section id="H91B833A3C78E44AB8922D9760EBE35BF"><enum>2.</enum><header>Authority for Secretary of Defense to enter into an agreement for an assessment of biotechnology capabilities of adversaries of the United States</header><subsection id="HCB88277FCCCB4DB0926A73DCF0225E95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense shall seek to enter into an agreement with a federally funded research and development center to conduct an assessment related to biotechnology and provide recommendations to the Secretary.</text></subsection><subsection id="HA4CF1B52D3C7424B9A82A0F5C7791D72"><enum>(b)</enum><header>Agreement elements</header><text display-inline="yes-display-inline">Under an agreement between the Secretary and a federally funded research and development center under this section, the center shall agree to—</text><paragraph id="H540502BFA7FC41539AF4D35B1E1B1772"><enum>(1)</enum><text>conduct an assessment of—</text><subparagraph id="HDCCA4A96B76D4AD085F49EBA8E3237F3"><enum>(A)</enum><text>scientific topics related to biotechnology;</text></subparagraph><subparagraph id="H1FC2BB0F8F214C75A58F7329183734A5"><enum>(B)</enum><text>scientific capabilities of potential adversaries of the United States, such as China, Iran, and the Russian Federation, related to biotechnology; and</text></subparagraph><subparagraph id="H74A2C51BBE54442AB31271E0D07E8EC6"><enum>(C)</enum><text>the current gaps and future scientific and technological needs for adversaries of the United States to be successful with respect to biotechnology capabilities; and</text></subparagraph></paragraph><paragraph id="H3105B748D89E4EBFAD7CA11C6EF009FE"><enum>(2)</enum><text>develop recommendations with respect to useful indications of any advancement of such adversaries regarding such capabilities.</text></paragraph></subsection><subsection id="H9DD538A7E3A04499B8ADB7A6F80CBA0E"><enum>(c)</enum><header>Responsibilities of Secretary</header><text display-inline="yes-display-inline">Under an agreement between the Secretary and a federally funded research and development center under this section, the Secretary shall agree to—</text><paragraph id="H475C03B1AD6242FAADFF06E02B40E6EE"><enum>(1)</enum><text>appoint appropriate Department of Defense employees as liaisons to the center to support the timely conduct of the assessment described in subsection (b)(1);</text></paragraph><paragraph id="H570262886E074725B12217FFBA034904"><enum>(2)</enum><text>provide the center with access to materials relevant to the conduct of such assessment, consistent with the protection of sources and methods and other critically sensitive information; and</text></paragraph><paragraph id="H8B7D55607E0D49A1B561544252AB8627"><enum>(3)</enum><text>ensure that appropriate members and staff of the center have the necessary clearances, obtained in an expedited manner, to conduct such assessment.</text></paragraph></subsection><subsection id="HCE9D9813EE944DEB862CF2F45ADE0EEE"><enum>(d)</enum><header>Report</header><paragraph id="HF7C5BC465D2048B8BDC43FD62564C179"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary enters into an agreement with a federally funded research and development center under this section, not later than October 1, 2025, the Secretary shall submit to the congressional defense committees and the National Security Commission on Emerging Biotechnology a report that includes the findings and recommendations of the center developed pursuant to the assessment described in subsection (b)(1).</text></paragraph><paragraph id="HA0D2A6D7FEC24395B508CA41D028AD61"><enum>(2)</enum><header>Form of report</header><text>The report under paragraph (1) shall be submitted in unclassified form, but may contain a classified annex.</text></paragraph><paragraph id="H36CC32775DCE4939BAED68DA8356B839"><enum>(3)</enum><header>Transmittal to other Department entities</header><text>The Secretary shall transmit to relevant offices of the Department of Defense, including the offices of the Under Secretary of Defense for Acquisition and Sustainment, the Under Secretary of Defense for Research and Engineering, the Under Secretary of Defense for Policy, the Under Secretary of Defense for Intelligence and Security, and the Office of Net Assessment, a copy of the report under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
