R. 9626</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240917">September 17, 2024</action-date><action-desc><sponsor name-id="K000389">Mr. Khanna</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Department of Defense to develop a plan for the establishment of a secure computing and data storage environment for the testing of artificial intelligence trained on biological data, and for other purposes.</official-title></form><legis-body id="H99C3C4F82A984BB2956111076266F6EC" style="OLC"><section id="H47A40C67030348FEB79D7175CA4C4505" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AIxBio Defense Sandbox Act</short-title></quote>.</text></section><section id="H750E9AE247C9423FBF8089076605E266"><enum>2.</enum><header>Plan for establishment of secure computing and data storage environment for testing of artificial intelligence trained on biological data</header><subsection id="H5A5334F48D5D4379B02A6996C57E952E"><enum>(a)</enum><header>Plan required</header><text>The Under Secretary of Defense for Research and Engineering, in coordination with the Chief Digital and Artificial Intelligence Officer, shall develop a plan for the establishment of a secure computing and data storage environment to facilitate—</text><paragraph id="H54150EAD969D4B728D368494A26E4B47"><enum>(1)</enum><text>the testing of artificial intelligence models trained on biological data; and</text></paragraph><paragraph id="H5664B1F3BBD54E3D807D4DA6070E25DB"><enum>(2)</enum><text>the development and testing of products generated by such models.</text></paragraph></subsection><subsection id="H9C77231A23E54FA8B5CC05A10B1DBA53"><enum>(b)</enum><header>Elements</header><text>The plan under subsection (a) shall provide as follows:</text><paragraph id="H9B8D843E8597423AACEB25D6788ADC2D"><enum>(1)</enum><header>Designation</header><text>The secure computing and data storage environment described in subsection (a) shall be known as the <quote>AIxBio sandbox</quote>.</text></paragraph><paragraph id="HEA0E520F211043B3B35B3374FC796E1B"><enum>(2)</enum><header>Computing and data storage infrastructure</header><text>The AIxBio sandbox shall consist of a secure computing and data storage infrastructure to be used for the testing and development activities described in subsection (a). To the extent feasible, such infrastructure shall be assembled from the existing computing and data storage infrastructure organizations and elements of the Department of Defense with relevant capabilities, such as the Test Resource Management Center and the AI Accelerator of the Department of the Air Force.</text></paragraph><paragraph id="HB3C65A45A8F34550BB046D9B6950D5C6"><enum>(3)</enum><header>Responsible official</header><text>The Under Secretary of Defense for Research and Engineering shall be responsible for—</text><subparagraph id="H197E248D90A64888A8706037F2D15965"><enum>(A)</enum><text>managing and overseeing the activities of the sandbox;</text></subparagraph><subparagraph id="H3889A4FDC96E4F76820193A82B843076"><enum>(B)</enum><text>coordinating the efforts of the organizations of the Department involved in the activities of the sandbox;</text></subparagraph><subparagraph id="HFA338CC593DC4DFB8B13A75A2EDA177B"><enum>(C)</enum><text>selecting projects for development and testing using the sandbox in accordance with paragraph (4); and</text></subparagraph><subparagraph id="H3BB145FBEBF946A78E6323A0CD1852AB"><enum>(D)</enum><text>arranging partnerships in accordance with paragraph (5).</text></subparagraph></paragraph><paragraph id="H393BA8AB7B064E7AA04BC09C308694AF"><enum>(4)</enum><header>Selection of projects</header><text>The Under Secretary of Defense for Research and Engineering shall—</text><subparagraph id="H00366BD4C331423486B1ED5C320D20D4"><enum>(A)</enum><text>identify projects funded, in whole or in part, by the Department of Defense that—</text><clause id="HF64D8577449740888B78B1F9B113C5A5"><enum>(i)</enum><text>have demonstrated a proof-of-concept or another similar indicator of early success or feasibility; and</text></clause><clause id="HC6E259030F114D37A820F98DDF153A91"><enum>(ii)</enum><text>involve the development of a model, technology, or product at the intersection of artificial intelligence and biotechnology that has potential defense applications, such as a project using artificial intelligence and biological data—</text><subclause id="H94473A644CDA4FB1A87F35943AD7D1C6"><enum>(I)</enum><text>to direct and produce medical countermeasures;</text></subclause><subclause id="HAAB71DBEA7AE41AF9D61F1628C8E9472"><enum>(II)</enum><text>to predict and produce new or enhanced biological materials for military purposes; or</text></subclause><subclause id="HAE079980F45645A38AF95A2142BB1829"><enum>(III)</enum><text>to analyze how biology could fulfill different components of the supply chain, including by improving the domestic supply chain through the use of biomanufacturing; and</text></subclause></clause></subparagraph><subparagraph id="H88884112997C418C97FDDEC790C9DA6C"><enum>(B)</enum><text>from projects identified under subparagraph (A), select projects for further development and testing using the AIxBio sandbox.</text></subparagraph></paragraph><paragraph id="H0C482916FD06405BBF930D3074D3CA41"><enum>(5)</enum><header>Partnerships</header><subparagraph id="H7DC5E31665F34FBA8AD95B55F53A5731"><enum>(A)</enum><header>In general</header><text>The Under Secretary of Defense for Research and Engineering shall establish mechanisms through which organizations and entities involved in projects of the AIxBio sandbox may work with Department of Defense laboratories and Department-funded laboratories of academic institutions to carry out activities in support of such projects, including biological testing and experimentation and testing and experimentation to validate artificial intelligence models in development.</text></subparagraph><subparagraph id="H04E9059032FB4A5AA99D67CB047FD23B"><enum>(B)</enum><header>Streamlined processes</header><text>In carrying out subparagraph (A), the Under Secretary shall establish a streamlined processes to facilitate efficient collaboration between laboratories, organizations of the Department of Defense, and private entities for purposes of developing products for national security purposes and carrying out activities in support of projects under AIxBio sandbox, including testing and experimentation.</text></subparagraph></paragraph><paragraph id="H8E02685E0EB0408D87CCF70C078BF1F3"><enum>(6)</enum><header>Other elements</header><text>The plan shall address—</text><subparagraph id="H97D7EC4155A54E2D980B933F64597BFC"><enum>(A)</enum><text>the manner in which existing computing and data storage infrastructure of the Department of Defense shall be made available for the AIxBio sandbox in accordance with paragraph (2);</text></subparagraph><subparagraph id="H835F4F5DFCF14E1FA663970D42AA9F66"><enum>(B)</enum><text>the development of any mechanisms needed to facilitate collaboration among individuals and organizations involved in projects under the AIxBio sandbox, including any necessary agreements concerning intellectual property, funding, and the transfer of materials or other resources;</text></subparagraph><subparagraph id="HB578523454C04EB99FE2E21FA7E75DB1"><enum>(C)</enum><text>the process for selecting projects for development and testing using the sandbox in accordance with paragraph (4); and</text></subparagraph><subparagraph id="H546F3EC39BA94465889F59ECDAB230DC"><enum>(D)</enum><text>the process for determining the amount of funding needed for projects under the sandbox, including the length of time each project is expected to receive such funding.</text></subparagraph></paragraph></subsection><subsection id="H790DE1E42CE1458E9DCC726BD6A17844"><enum>(c)</enum><header>Report and briefing</header><text>Not later than one year after the date of the enactment of this Act, the Under Secretary of Defense for Research and Engineering shall—</text><paragraph id="H910CFC5DFE1E403D96D9252D7D4B89D9"><enum>(1)</enum><text>submit to the Committees on Armed Services of the Senate and the House of Representatives a report that includes the plan developed under subsection (a); and</text></paragraph><paragraph id="H8A1E8F68CF2E4F81BF18B640556AAABA"><enum>(2)</enum><text>provide to the Committees a briefing on the plan.</text></paragraph></subsection></section></legis-body></bill>
