which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to establish the Substance Use Disorder Treatment and Behavioral and Mental Health Workforce Scholarship Program, and for other purposes.</official-title></form><legis-body id="HB67056207A594541B46222ACB4E54BF3" style="OLC"><section id="H1A2308C4D73648FF85D712E4629B8332" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>STAR Plus Scholarship Act</short-title></quote>. </text></section><section id="H46A9DE173B2D42F09778BBAA6AF47EA2"><enum>2.</enum><header>Substance Use Disorder Treatment and Behavioral and Mental Health Workforce Scholarship Program</header><subsection id="H6826508AD1B745C5B7976F3563EBAF82"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part F of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295h">42 U.S.C. 295h</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2D0E90F060A640D1853BF7CA4BFA2E8F" display-inline="no-display-inline"><section id="H170D188F865D4042941DBE0D3866D22C"><enum>782.</enum><header>Substance Use Disorder Treatment and Behavioral and Mental Health Workforce Scholarship Program</header><subsection id="HE69D39257168432DBDD1946EC2D8BB67"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, (in this section referred to as the <quote>Secretary</quote>) shall establish the Substance Use Disorder Treatment and Behavioral and Mental Health Workforce Scholarship Program (in this section referred to as the <quote>Scholarship Program</quote>) to award scholarships to assure an adequate supply of individuals in covered employment.</text></subsection><subsection id="ID2B5BABC5012942079035452CE8CF2064"><enum>(b)</enum><header>Eligibility; application; written contract</header><text>To be eligible to participate in the Scholarship Program, an individual must—</text><paragraph id="ID87ED735D387F4EEA83F6BECC9BA6DDA8"><enum>(1)</enum><text>be accepted for enrollment, or be enrolled, as a full-time student—</text><subparagraph id="HF029AEA4AF2F44F99E4F93C90F52D366"><enum>(A)</enum><text>in an accredited (as determined by the Secretary) educational institution in a State; and</text></subparagraph><subparagraph id="HDEA78C377C8043389D9AC499593F7391"><enum>(B)</enum><text>in a course of study or program, offered by such institution and approved by the Secretary, leading to covered employment;</text></subparagraph></paragraph><paragraph id="ID4C538D062286475284863D3005C2A7EE"><enum>(2)</enum><text>submit an application to participate in the Scholarship Program; and</text></paragraph><paragraph id="ID239D933E5448474B928B0BEE4C8E6689"><enum>(3)</enum><text>sign and submit to the Secretary, at the time of submittal of such application, a written contract (described in subsection (f)) to accept payment of a scholarship and to serve (in accordance with this section) for the applicable period of obligated service in a mental health professional shortage area.</text></paragraph></subsection><subsection id="IDACCD6C658A744C399E7685E22F387E7D"><enum>(c)</enum><header>Review and evaluation of information and forms by prospective applicant</header><paragraph display-inline="no-display-inline" id="IDB5AA8F7CB56240C387D5302B714325CD"><enum>(1)</enum><header>Contents of application and contract forms</header><text>In disseminating application forms and contract forms to individuals desiring to participate in the Scholarship Program, the Secretary shall include with such forms—</text><subparagraph id="ID168DB00A2ECA4E2CB909AF1E955A29E4" display-inline="no-display-inline"><enum>(A)</enum><text>a fair summary of the rights and liabilities of an individual whose application is approved (and whose contract is accepted) by the Secretary, including in the summary a clear explanation of the damages to which the United States is entitled under subsection (j) in the case of the individual’s breach of the contract; and</text></subparagraph><subparagraph id="ID2D24A9D755AE408B9361C81E13383785" display-inline="no-display-inline"><enum>(B)</enum><text>such other information as may be necessary for the individual to understand the individual’s prospective participation in the Scholarship Program, including a statement of all factors considered in approving applications for participation in the Scholarship Program and in approving specific positions and employers that are eligible for the Scholarship Program.</text></subparagraph></paragraph><paragraph id="ID4779F6737FCC49A3A39CB46DE148F242" display-inline="no-display-inline"><enum>(2)</enum><header>Clarity; availability</header><text>The application form, contract form, and all other information furnished by the Secretary under this section shall be written in a manner calculated to be understood by the average individual applying to participate in the Scholarship Program. The Secretary shall make such application forms, contract forms, and other information available to individuals desiring to participate in the Scholarship Program on a date sufficiently early to ensure that such individuals have adequate time to carefully review and evaluate such forms and information.</text></paragraph><paragraph id="IDD69B1F741F5547A090E23FC656C1995B" display-inline="no-display-inline"><enum>(3)</enum><header>Education and assistance</header><subparagraph display-inline="no-display-inline" id="ID44A72A2BAD754E689F90C1E86FDABB86"><enum>(A)</enum><header>Distribution of informational materials</header><text>The Secretary shall distribute to health professions schools materials providing information on the Scholarship Program and shall encourage the schools to disseminate the materials to the students of the schools.</text></subparagraph><subparagraph id="IDBBD942CDCE1D45B89686AAC0A193A080" display-inline="no-display-inline"><enum>(B)</enum><header>End of obligated service</header><clause display-inline="no-display-inline" id="ID5E1924E98CA8443F875A7CC23A2BF6FC"><enum>(i)</enum><header>Encouragement to continue service</header><text>In the case of any health professional whose period of obligated service under the Scholarship Program is nearing completion, the Secretary shall encourage the individual to remain in a mental health professional shortage area and to continue in covered employment.</text></clause><clause id="IDE30A92A347664D9CA6EEAFE5B98BD99D" display-inline="no-display-inline"><enum>(ii)</enum><header>Assistance in transition</header><text display-inline="yes-display-inline">During the period in which a health professional is planning and making the transition from obligated service under the Scholarship Program, the Secretary may provide assistance to the professional regarding such transition if the professional is remaining in a mental health professional shortage area and is continuing in covered employment.</text></clause></subparagraph></paragraph></subsection><subsection id="IDC7F9A0914C5B493F9C25BCA04C280307"><enum>(d)</enum><header>Factors considered in providing contracts; priorities</header><paragraph display-inline="no-display-inline" id="IDCEE4432E17024E48A7D21B6C95525117"><enum>(1)</enum><header>Factors considered in providing contracts</header><text>In providing contracts under the Scholarship Program—</text><subparagraph id="IDAA81337A8F764215B108B26AB1D6C4EE" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary shall consider the extent of the demonstrated interest of the applicants for the contracts in providing substance use disorder treatment and behavioral and mental health services; and</text></subparagraph><subparagraph id="ID5DE4CB47CD764657890882058DBBE118" display-inline="no-display-inline"><enum>(B)</enum><text>may consider such other factors regarding the applicants as the Secretary determines to be relevant to selecting qualified individuals to participate in such Program.</text></subparagraph></paragraph><paragraph id="ID6503C131166F4CB392F8DC79B7370811" display-inline="no-display-inline"><enum>(2)</enum><header>Priorities</header><text>In providing contracts under the Scholarship Program, the Secretary shall give priority—</text><subparagraph id="IDA0B1F6D359434344BC0602E916CB288E" display-inline="no-display-inline"><enum>(A)</enum><text>to any application for such a contract submitted by an individual who has characteristics that increase the probability that the individual will continue to serve in a mental health professional shortage area after the period of obligated service pursuant to subsection (f) is completed; and</text></subparagraph><subparagraph id="IDBBF1B5F56A6F430397BF75D36988A5C7" display-inline="no-display-inline"><enum>(B)</enum><text>to any application for such a contract submitted by an individual who is from a group or population that is underrepresented in the substance use disorder treatment and behavioral and mental health workforce.</text></subparagraph></paragraph></subsection><subsection id="ID59B5BCB34EB849DFB0A07C087DCD77DA"><enum>(e)</enum><header>Commencement of participation in Scholarship Program; notice</header><paragraph display-inline="no-display-inline" id="IDEA7C3D0854484E2C9D63459307238C95"><enum>(1)</enum><header>Commencement of participation</header><text>An individual becomes a participant in the Scholarship Program only upon the Secretary’s approval of the individual’s application submitted under subsection (b)(2) and the Secretary’s acceptance of the contract submitted by the individual under subsection (b)(3).</text></paragraph><paragraph id="ID862DF1949D0347B5B577847C0B660CC0" display-inline="no-display-inline"><enum>(2)</enum><header>Notice</header><text>The Secretary shall provide written notice to an individual promptly upon the Secretary’s approving, under paragraph (1), of the individual’s participation in the Scholarship Program.</text></paragraph></subsection><subsection id="ID48774884F6604A21A72525F0061A2636"><enum>(f)</enum><header>Written contract; contents</header><text>The written contract (referred to in this section) between the Secretary and an individual shall contain—</text><paragraph id="IDA80BCFC0D5DE4B0EAB08112D817AA00A"><enum>(1)</enum><text>an agreement that—</text><subparagraph id="ID11DB78C651ED48F485ACE9240172BB0D"><enum>(A)</enum><text>subject to paragraph (2), the Secretary agrees to provide the individual with a scholarship (described in subsection (g)) for a period of one or more school years during which the individual is pursuing a course of study described in subsection (b)(1)(B); and</text></subparagraph><subparagraph id="ID55201B5038A64D40906EE8A2DB653D31"><enum>(B)</enum><text>subject to paragraph (2), the individual agrees—</text><clause id="IDADEA2549B66A4319BB11FE976F6214C4"><enum>(i)</enum><text>to accept provision of such a scholarship to the individual;</text></clause><clause id="ID60A6193A19DA45C8BA00FACE3CAB95CE"><enum>(ii)</enum><text>to maintain enrollment in a course of study described in subsection (b)(1)(B) until the individual completes the course of study;</text></clause><clause id="IDD38DFFBA568A43CEAF91633124DE1EA6"><enum>(iii)</enum><text>while enrolled in such course of study, to maintain an acceptable level of academic standing (as determined under regulations of the Secretary by the educational institution offering such course of study); and</text></clause><clause id="ID5F912E1D79724A63A3D93C35006E41AC"><enum>(iv)</enum><text display-inline="yes-display-inline">to serve for a time period (in this section referred to as the <quote>period of obligated service</quote>) equal to one year for each school year for which the individual was provided a scholarship under the Scholarship Program, in covered employment in a mental health professional shortage area (designated under section 332);</text></clause></subparagraph></paragraph><paragraph id="ID34A5294985E2438EB593052208ED98E9"><enum>(2)</enum><text>a provision that any financial obligation of the United States arising out of a contract entered into under this section and any obligation of the individual which is conditioned thereon, is contingent upon funds being appropriated for scholarships under this section;</text></paragraph><paragraph id="IDA81274C25EFB4644BC1DCE1A554957A4"><enum>(3)</enum><text>a statement of the damages to which the United States is entitled, under subsection (j), for the individual’s breach of the contract; and</text></paragraph><paragraph id="ID1AD837A2D7494599A12C25F6B5731A31"><enum>(4)</enum><text>such other statements of the rights and liabilities of the Secretary and of the individual, not inconsistent with the provisions of this section.</text></paragraph></subsection><subsection id="ID484B3CDCE55342C3B9B735ACB629C663"><enum>(g)</enum><header>Scholarship provisions; contract with educational institution; increase in monthly stipend</header><paragraph display-inline="no-display-inline" id="ID0355B7E6BBE9445596F730C28602A0CC"><enum>(1)</enum><header>Scholarship provisions</header><text>A scholarship provided to a student for a school year under a written contract under the Scholarship Program shall consist of payment to, or (in accordance with paragraph (2)) on behalf of, the student of the amount (except as provided in section 711) of—</text><subparagraph id="ID9B2A15E7E03A4EE2BAFF007450C05928" display-inline="no-display-inline"><enum>(A)</enum><text>the tuition of the student in such school year; and</text></subparagraph><subparagraph id="IDACC295AD156B440EB6C5FD557F22CA18" display-inline="no-display-inline"><enum>(B)</enum><text>all other reasonable educational expenses, including fees, books, and laboratory expenses, incurred by the student in such school year.</text></subparagraph></paragraph><paragraph id="IDC9C0875A452347A1B02C5B5B3A0B631D" display-inline="no-display-inline"><enum>(2)</enum><header>Contract with educational institution</header><text>The Secretary may contract with an educational institution, in which a participant in the Scholarship Program is enrolled, for the payment to the educational institution of the amounts of tuition and other reasonable educational expenses described in paragraph (1). Payment to such an educational institution may be made without regard to section 3324 of title 31, United States Code.</text></paragraph></subsection><subsection id="ID9697622968994A68AB3D66DA4E14BE27"><enum>(h)</enum><header>Employment ceiling of Department unaffected</header><text>Notwithstanding any other provision of law, individuals who have entered into written contracts with the Secretary under this section, while undergoing academic training, shall not be counted against any employment ceiling affecting the Department.</text></subsection><subsection id="H65F569AAF7594990AD771F362280D63F" commented="no"><enum>(i)</enum><header>Obligated service</header><text display-inline="yes-display-inline">Any individual receiving payments under the Scholarship Program as required by an agreement under this section shall agree to an annual commitment to work full-time in covered employment, with no more than 1 year passing between any 2 years of covered employment, in the United States in—</text><paragraph id="H087C5FBADA3F4DB0AEBBF4919EE28CBE" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a mental health professional shortage area, as designated under section 332;</text></paragraph><paragraph id="H5B97C82C1FB342CDAA134C174C1D2911" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">a county (or a municipality, if not contained within any county) where the mean drug overdose death rate per 100,000 people over the past 3 years for which official data is available from the State, is higher than the most recent available national average overdose death rate per 100,000 people, as reported by the Centers for Disease Control and Prevention; or</text></paragraph><paragraph id="H264B07A80A3E41A1B5DB097B034B7D39"><enum>(3)</enum><text>any facility, program, center, or clinic as determined appropriate by the Secretary for purposes of this section because of a shortage of mental health professionals, including private practices and other medical facilities designated under section 332(a) as having such a shortage.</text></paragraph></subsection><subsection id="H09F2AFA571574E5A8C261E061A767A3D" commented="no"><enum>(j)</enum><header>Breach</header><paragraph id="H1967A632EA7946A0A55FD46C18A56A37"><enum>(1)</enum><header>Liquidated damages formula</header><text display-inline="yes-display-inline">The Secretary may establish a liquidated damages formula to be used in the event of a breach of an agreement entered into under this section.</text></paragraph><paragraph id="H4A2F85A1AF0C419BBF7FA92C8D53B747"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The failure by an individual to complete the full period of service obligated pursuant to such an agreement, taken alone, shall not constitute a breach of the agreement, so long as the individual completed in good faith the years of service for which payments were made to the individual under this section.</text></paragraph></subsection><subsection id="HDFE9F40242C640DD84BB1543A9D8089D" commented="no"><enum>(k)</enum><header>Fund regarding use of amounts recovered for contract breach To replace services lost as result of breach</header><paragraph id="ID11FC03D0794546D3B2CAEE31B511522F" commented="no"><enum>(1)</enum><header>Establishment of Fund</header><text>There is established in the Treasury of the United States a fund to be known as the Substance Use Disorder Treatment and Behavioral and Mental Health Workforce Scholarship Program Replacement Fund (in this subsection referred to as the <quote>Fund</quote>). The Fund shall consist of such amounts as may be appropriated under paragraph (2) to the Fund. Amounts appropriated for the Fund shall remain available until expended.</text></paragraph><paragraph id="IDF20DE047FA054F6BB0383A7AD1151317" commented="no"><enum>(2)</enum><header>Authorization of Appropriations to Fund</header><text>For each fiscal year, there is authorized to be appropriated to the Fund an amount equal to the sum of—</text><subparagraph id="ID40B26CB6D39845A5AA0D35678B075CCD" commented="no"><enum>(A)</enum><text>the amount collected during the preceding fiscal year by the Federal Government pursuant to the liability of individuals under subsection (j) for the breach of contracts entered into under this section; and</text></subparagraph><subparagraph id="ID30A4028851E34040A535E6E4B70FD7FA" commented="no"><enum>(B)</enum><text>the aggregate of the amount of interest accruing during the preceding fiscal year on obligations held in the Fund pursuant to paragraph (4) and the amount of proceeds from the sale or redemption of such obligations during such fiscal year.</text></subparagraph></paragraph><paragraph id="ID4218B37BDDF144DC81F2FEDDECCF613A" commented="no"><enum>(3)</enum><header>Use of Fund</header><subparagraph id="ID971F01D22A9145B090B29E0DFC854C8D" commented="no"><enum>(A)</enum><header>Payments to certain health facilities</header><text display-inline="yes-display-inline">Amounts in the Fund and available pursuant to appropriations Acts may, subject to subparagraph (B), be expended by the Secretary to make payments to any entity that has a need for a health professional to provide substance use disorder treatment and behavioral and mental health services as a result of the breach by an individual of a contract entered into under this section.</text></subparagraph><subparagraph id="ID9814BD2E85C343DDB71FF7D9DDB741D2" commented="no"><enum>(B)</enum><header>Purpose of payments</header><text display-inline="yes-display-inline">An entity receiving payments pursuant to subparagraph (A) may expend the payments to recruit and employ a health professional to provide substance use disorder treatment and behavioral and mental health services to patients of the entity, or to enter into a contract with such a professional to provide the services to the patients.</text></subparagraph></paragraph><paragraph id="ID6162C7A05D094152A7F956E469EB881A" commented="no"><enum>(4)</enum><header>Investment</header><subparagraph id="ID69A29F48A68F433489A18A05E6B18AD5" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such amounts of the Fund as such Secretary determines are not required to meet current withdrawals from the Fund. Such investments may be made only in interest-bearing obligations of the United States. For such purpose, such obligations may be acquired on original issue at the issue price, or by purchase of outstanding obligations at the market price.</text></subparagraph><subparagraph id="IDE726CC846D4C4503AF80F7A38D901E7A" commented="no"><enum>(B)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at the market price.</text></subparagraph></paragraph></subsection><subsection id="H79DC61EAAF3A45538C22B1FF858046A2"><enum>(l)</enum><header>Covered employment defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered employment</term> means—</text><paragraph id="H1ED966957BCE4D92907BFD3AF75C4BEB"><enum>(1)</enum><text>full-time employment (including a fellowship) where the primary intent and function of the position is the direct treatment or recovery support of patients with or in recovery from a substance use, behavioral health, or mental health disorder; and</text></paragraph><paragraph id="HBDD0BD2601594CA9B8B7949E7ADD8A52"><enum>(2)</enum><text>may include employment as a physician (with a degree of doctor of medicine or doctor of osteopathy), a psychiatric nurse, a social worker, a marriage and family therapist, a mental health counselor, an addiction counselor, an occupational therapist, a psychologist, a psychiatrist, a child and adolescent psychiatrist, or a neurologist.</text></paragraph></subsection><subsection id="H30074E70536944CDAE5B5A4C6AE85984"><enum>(m)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $75,000,000 for each of fiscal years 2025 through 2029.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEA8E7256280C49FBA83BFE1B6546D35A"><enum>(b)</enum><header>Exclusion of scholarship from gross income of the recipient</header><paragraph id="HCDB93C0CBF2542D0BF6769F5F743DF8C"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/117">Section 117(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of subparagraph (B), by striking the period at the end of subparagraph (C) and inserting <quote>, or</quote>, and by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H3F791AAEE5794CADA982E2FDBF477AF0" display-inline="no-display-inline"><subparagraph id="H331C8A9455934C53AEBCC2BBA0825816"><enum>(D)</enum><text display-inline="yes-display-inline">section 782 of the Public Health Service Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H39DE5842DBAF4131BD41BB9D6EAB3CC9"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
