which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the United States Agency for Global Media to verify the authenticity of foreign academic credentials purported to be held by prospective and existing employees of the Agency, and for other purposes.</official-title></form><legis-body id="HA21E46654D9B484AB60402B73E6911A9" style="OLC"><section id="HAD75C03C2F2D431C88796C39FAD3A303" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing the Integrity of Ethics in Government Act</short-title></quote>.</text></section><section id="H0E0FDF7810084642AD6C870C1CC765E6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5A505DCE59E54922B19F6FC6DE74E8F6"><enum>(1)</enum><header>Advisory Board</header><text display-inline="yes-display-inline">The term <term>Advisory Board</term> means the International Broadcasting Advisory Board as described in section 306 of the United States International Broadcasting Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/22/6205">22 U.S.C. 6205</external-xref>).</text></paragraph><paragraph id="HB06D3D47A60A43DF8607F2FE66429836"><enum>(2)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>Agency</term> means the United States Agency for Global Media.</text></paragraph><paragraph id="H17C85722066A44A48335CC810EA2B29F"><enum>(3)</enum><header>Credential evaluation service</header><text>The term <term>credential evaluation service</term> means an organization that is—</text><subparagraph id="HC47E5A55792F48CCA0CDD7610FD89DAB"><enum>(A)</enum><text>a member organization of—</text><clause id="H58BB6095DCC54FF187EEFAE909428A6E"><enum>(i)</enum><text>the National Association of Credential Evaluation Services; or</text></clause><clause id="H96354D1F9A03426AA72F51D697A1F5FD"><enum>(ii)</enum><text>the Association of International Credentials Evaluators; and</text></clause></subparagraph><subparagraph id="H4CDAFE8D12AE437E82AA8EE55F81987B"><enum>(B)</enum><text display-inline="yes-display-inline">has as its primary purpose the evaluation and validation of academic credentials.</text></subparagraph></paragraph><paragraph id="H220D545913C84EAF945406AE2ED81F2A"><enum>(4)</enum><header>Foreign academic credential</header><text>The term <term>foreign academic credential</term> means a credential awarded for the completion of an undergraduate or a graduate-level course of study at a postsecondary educational institution located outside the United States.</text></paragraph></section><section id="HAB5C250D8A3F427197E2E50292F6A760"><enum>3.</enum><header>Documentation requirements</header><subsection id="H05251FD7508440E3ACF5B5238195248A"><enum>(a)</enum><header>In general</header><text>Beginning on the effective date of this Act, the Agency may not appoint an individual who purports to have a foreign academic credential (as described in subsection (c)) to a position in the Agency higher than GS–11 (or the equivalent), including a position for which such credential is not required, unless, prior to such appointment, the Agency obtains—</text><paragraph id="H2D5EEADEC29C49F8843CB9ACEAB817AE"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H98944820727D4FEBA2E52F7542C721B3"><enum>(A)</enum><text>a written evaluation from a credential evaluation service that includes—</text><clause id="H7FD01338C2364FD7ACADDB876F299E01"><enum>(i)</enum><text display-inline="yes-display-inline">verification that the foreign academic credential was earned by the individual at a postsecondary educational institution outside the United States;</text></clause><clause id="H58AC20E840124C36815055BEFAD16277"><enum>(ii)</enum><text>the name of the institution that awarded the credential;</text></clause><clause id="H2E36C403F4C74CDEB28C36166B6A3B75"><enum>(iii)</enum><text>the type of credential earned by the individual;</text></clause><clause id="H389E2920483049639F153E110E4E6A5D"><enum>(iv)</enum><text>the academic subject matter to which the credential pertains;</text></clause><clause id="HA78ECB93AE9D4973BD565C56F23F525A"><enum>(v)</enum><text>an analysis indicating whether the foreign academic credential is comparable to a type of academic credential awarded by postsecondary educational institutions in the United States and, if so, which type of domestically awarded credential is most comparable to the foreign academic credential;</text></clause><clause id="H97679E17F9524726B8BF256BC109C8E6"><enum>(vi)</enum><text>an explanation of the processes and standards used by the credential evaluation service to determine the validity and comparability of the foreign academic credential under clauses (i) and (v), respectively;</text></clause><clause id="HD331756C6D03451CA110C3FC0C310DC5"><enum>(vii)</enum><text>a statement confirming that the standards and processes used to evaluate the comparability of the foreign academic credential under clause (v) followed the relevant guidelines of the International Education Standards Council; and</text></clause><clause id="HC6A3DDA5B68F447CAD6997859778B663"><enum>(viii)</enum><text>an assurance confirming that the credential evaluation service—</text><subclause id="HF069CB6AC78846909152DDAFC2A72743"><enum>(I)</enum><text>inspected all documentation submitted to the service in connection with the service’s evaluation of the foreign academic credential; and</text></subclause><subclause id="H2AC289DA73814D7280F074CD2A14A80B"><enum>(II)</enum><text>did not find any evidence of fraud, forgery, or other material irregularities in such documentation; and</text></subclause></clause></subparagraph><subparagraph id="H8227549A7ACA444FA67D1EAA3BD04BD8" indent="up1"><enum>(B)</enum><text>documentation, such as an academic transcript or diploma, demonstrating that the individual completed all requirements necessary to obtain the foreign academic credential, which shall—</text><clause id="H891AE8F961D94CE5905FAA3A304E8D2E"><enum>(i)</enum><text>be provided directly to the Agency by the postsecondary educational institution that issued the credential; and</text></clause><clause id="HDF918B5C3BCD461997CD36650694A63D"><enum>(ii)</enum><text display-inline="yes-display-inline">be certified as authentic by an official of the institution authorized to issue such documentation; or</text></clause></subparagraph></paragraph><paragraph id="HE33D3993076641BF91D1CC9C57A9E568"><enum>(2)</enum><text display-inline="yes-display-inline">alternative documentation, obtained directly from the Government of the foreign country with jurisdiction over the institution that awarded the credential, demonstrating the validity of the credential.</text></paragraph></subsection><subsection id="H9AC0C7431A5240D0BE303C41BE266B47"><enum>(b)</enum><header>Verification of foreign academic credentials for existing employees</header><paragraph id="HE659927D0300485D9CB5ACDD4F66A497"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the effective date of this Act, the Agency shall obtain the documentation described in subsection (a)(1) or the alternative documentation described in subsection (a)(2) with respect to each foreign academic credential purported to be held (as described in subsection (c)) by an individual in a position in the Agency that is higher than GS–11.</text></paragraph><paragraph id="H87B7A37C31D54AF1B6351B9E4764C6F1"><enum>(2)</enum><header>Penalty</header><text display-inline="yes-display-inline">The Agency shall take appropriate disciplinary action with respect to an individual described in paragraph (1) in the event the Agency is unable to obtain the documentation required under such paragraph for a foreign academic credential purported to be held by such individual.</text></paragraph></subsection><subsection id="H798B011C67BF47A0AA6F70ED71E10632"><enum>(c)</enum><header>Rule of applicability</header><text>The requirements under subsections (a) and (b) shall apply with respect to foreign academic credentials that are—</text><paragraph id="H05FB168E24CA4441A66EEF963355E6E6"><enum>(1)</enum><text>disclosed in the application or other materials received by the Agency in connection with the hiring of an individual; or</text></paragraph><paragraph id="H0A91AE134EAC4BB085923E9109143739"><enum>(2)</enum><text display-inline="yes-display-inline">otherwise noted in the employment record of an individual.</text></paragraph></subsection><subsection id="H102D65D93E3747909597560F5EA488E6"><enum>(d)</enum><header>Alternative documentation procedures</header><text>The Agency shall seek to establish procedures, in consultation with appropriate officials of foreign Governments, through which the Agency may obtain the alternative documentation described in subsection (a)(2)(A).</text></subsection></section><section id="HB687501A7C8B45C3ABCF425C1D89A3DB"><enum>4.</enum><header>Overtime payments</header><subsection id="H9C351F79AB2E4A51B3EAC7B6573ADC63"><enum>(a)</enum><header>In general</header><text>The Agency shall—</text><paragraph id="HA248C15A568F4CEC8E5776BB89A6E508"><enum>(1)</enum><text>record all overtime pay paid to—</text><subparagraph id="H3C73E7B2BD3A4FA3A1D04EE572FA9AF2"><enum>(A)</enum><text>employees of the Agency; and</text></subparagraph><subparagraph id="HF3DF4AEA661648BDB19B0B4ED7E513AF"><enum>(B)</enum><text>contractors of the Agency; and</text></subparagraph></paragraph><paragraph id="HEE199F30CC46486AABAF146DEA344F5B"><enum>(2)</enum><text>establish a system to track such overtime pay as a result of expiring compensatory time off.</text></paragraph></subsection><subsection id="H75B5CFE96FD5430A89D0560BA0C5AA09"><enum>(b)</enum><header>Notice and approval</header><text display-inline="yes-display-inline">The supervisor of an employee claiming overtime work in excess of the guidelines of the Agency or overtime pay with respect to expiring compensatory time off may not approve such overtime work or overtime pay unless such supervisor submits a request for approval to, and such request is approved by, the Chief Management Officer of the Agency or such other officer designated by the Agency.</text></subsection></section><section id="H078FA835CA2E498E91A69DF7FED069EB" commented="no"><enum>5.</enum><header>Review of United States international broadcasting</header><text display-inline="no-display-inline">Section 306(d) of the United States International Broadcasting Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/22/6205">22 U.S.C. 6205(d)</external-xref>) is amended—</text><paragraph id="HE367B7BAC6AD4AF0AAFEBE7FB09B4047"><enum>(1)</enum><text>in paragraph (6)(B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H6C80C4B52F9C40C780DF81F1015A6986"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC4BDA5FA3E2245A784E2191FB389FA71"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H15A9F4CA5733431FBF55657256546928" style="OLC"><paragraph id="H67AFB802EAA04B06972A6E369F4AB237" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">convene biannually to conduct a review of United States Agency for Global Media affiliate and grantee broadcasting activities and, when not less than three Advisory Board members find a violation of the broadcasting standards and principles listed under section 303 pursuant to such a review, submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report describing each such violation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H29D4B30BCF1D4DBEB7CD19CCC0F56771"><enum>6.</enum><header>Special Investigator for certain matters relating to the Agency</header><subsection id="HEBB9F63F5178461FA12E05935D2A2A50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the effective date of this Act, the Chair of the Advisory Board shall appoint a Special Investigator to submit the report required by subsection (a). The individual appointed as Special Investigator shall have expertise in human resources, labor management, credentials screening, and oversight and accountability.</text></subsection><subsection id="H2ED4F0B83E7144EC8DE7051621705CEF" commented="no"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the effective date of this Act, the Special Investigator shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report on—</text><paragraph id="H92E70C3143B34EF598A9A53B46F36FDA" commented="no"><enum>(1)</enum><text>the adequacy of the Agency’s hiring and employee vetting processes;</text></paragraph><paragraph id="H7EC5BF61E25C4A8092E626A2C6B962E5" commented="no"><enum>(2)</enum><text>the efficacy and feasibility of establishing an Office of Inspector General at the Agency;</text></paragraph><paragraph id="HA7D62E2E020D46999482F9CF4B2AF4CB" commented="no"><enum>(3)</enum><text>its recommendations with respect to the findings under paragraphs (1) and (2);</text></paragraph><paragraph id="H25529E99A65B45549EC08C42DCD482DD" commented="no"><enum>(4)</enum><text>a fiscal and administrative cost-benefit analysis of establishing an independent Office of Inspector General within the Agency;</text></paragraph><paragraph id="H4288602D045A4DD7BE0BD77E2AC0B99A" commented="no"><enum>(5)</enum><text>an evaluation of the adequacy of the Department of State’s Office of Inspector General for oversight and accountability purposes at the Agency, with particular attention to investigation of matters potentially criminal in nature;</text></paragraph><paragraph id="H7D04BE81B5F04A99A2D047AEA20D2207" commented="no"><enum>(6)</enum><text>a review of all incidents pertaining to, inter alia, fraud, misconduct, malfeasance, misstatements, misrepresentations, and security breaches at the Agency since January 1, 2019, and any disciplinary actions taken with respect to them;</text></paragraph><paragraph id="H5D1FEDD847294DD3A1E75029E1A86F13" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text>an overview of the Department of State and the Agency’s responsibilities regarding personnel and whistleblower complaints, with particular focus on areas for improvement;</text></paragraph><paragraph id="HA0F48CB25E184D4EBC3B82A1C26A5BAA" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text>a determination as to whether the Agency has adequately coordinated with the Department of State regarding personnel misconduct and whistleblower complaints;</text></paragraph><paragraph id="H329B3A3DBB6B474F8A60B351CB90A359" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text>the circumstances under which the Department of State refers whistleblower complaints to the Agency;</text></paragraph><paragraph id="H8D92109936A64F4A968A3D2F601BE8F7" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">any circumstances under which the Department of State is involved in Agency hiring decisions, including the Department’s Bureau of Diplomatic Security verifying Agency job applicants’ foreign education credentials; and</text></paragraph><paragraph id="HE712E997C35F49F1A54FC5EB333D5E57" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text>an assessment of the Department of State and the Agency’s security clearance process, including outsourcing to the Defense Counterintelligence and Security Agency.</text></paragraph></subsection></section><section id="HE017E98D816D43C380DBD87EACDC4707"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline"> This Act takes effect on January 1, 2025.</text></section></legis-body></bill>
