R. 9473</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240906">September 6, 2024</action-date><action-desc><sponsor name-id="I000056">Mr. Issa</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize private enforcement of immigration laws, and for other purposes.</official-title></form><legis-body id="H008A28E813EE4DE4A9B720EFF10FAFB3" style="OLC"><section id="H11744D7888044167A0442885033ECE5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sanctuary City Accountability Act</short-title></quote>.</text></section><section id="HD9EA8F2DA7E94EE98FAF04150B17FF57"><enum>2.</enum><header>Private enforcement of immigration laws</header><text display-inline="no-display-inline">Title I of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HA7F62285E77B4E91B9EC5238DBB0D4E0" display-inline="no-display-inline"><section id="H2F135A7F564C468F873050B31F5C507E"><enum>107.</enum><header>Private right of action</header><subsection id="H2167F5736557467D958E647955A4AE0D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any individual who is a national of the United States may bring a civil action in an appropriate district court of the United States against a sanctuary jurisdiction in which an alien was located if that alien commits a crime against that individual, or an immediate family member of that individual, in the sanctuary jurisdiction, or in any other jurisdiction to which the alien later relocates, for such injunctive relief or compensatory damages as may be appropriate.</text></subsection><subsection id="H19B09A974EF345169B59506BCDE8B374"><enum>(b)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">A unit of local government may not be held liable under this section for enforcing or implementing a law, ordinance, regulation, resolution, policy, or other practice imposed by the State in which the unit of local government is located. </text></subsection><subsection id="H2F50212650184E3E9162B191237B0737"><enum>(c)</enum><header>Sanctuary jurisdiction defined</header><text display-inline="yes-display-inline">In this section, the term <quote>sanctuary jurisdiction</quote> means any State or unit of local government that has laws, ordinances, regulations, resolutions, policies, or other practices that obstruct immigration enforcement and shield criminals from U.S. Immigration and Customs Enforcement, including by—</text><paragraph id="H8151E7C29AA44A32B977770707FEC208"><enum>(1)</enum><text>refusing to or prohibiting agencies from complying with U.S. Immigration and Customs Enforcement detainers;</text></paragraph><paragraph id="H2302C48C70ED487BBADEA4E10838B241"><enum>(2)</enum><text>imposing unreasonable conditions on U.S. Immigration and Customs Enforcement detainer compliance;</text></paragraph><paragraph id="H5CA8B2D8C070470F997DCD711D802F72"><enum>(3)</enum><text>denying U.S. Immigration and Customs Enforcement access to interview incarcerated aliens; or</text></paragraph><paragraph id="H8A726AB0B0164888BE205D2998773864"><enum>(4)</enum><text>otherwise impeding communication or information exchanges between the jurisdiction’s personnel and Federal immigration officers.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
