Public Utility Regulatory Policies Act of 1978 to establish a Federal energy efficiency resource standard for electricity and natural gas suppliers, and for other purposes.</official-title></form><legis-body id="H044CB31C21D7473B8E1D60F6FC767AA9" style="OLC"><section section-type="section-one" id="H3E1AFE938E0F40D993E49826442F6510"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Energy Efficiency Act of 2024</short-title></quote>.</text></section><section id="H77FA349DE9CB48B990C9A1954FCCEFE3"><enum>2.</enum><header>Energy efficiency resource standard for retail electricity and natural gas suppliers</header><subsection id="H9CCC91BBB1604D55845E7CF0B3D5779E"><enum>(a)</enum><header>In general</header><text>Title VI of the Public Utility Regulatory Policies Act of 1978 is amended by adding after section 609 (<external-xref legal-doc="usc" parsable-cite="usc/7/918c">7 U.S.C. 918c</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H207E3E38D6984939B0CEE9F4FBB2DFB6"><section id="H2F7825F8F81146C48E2BC1A131A60B12"><enum>610.</enum><header>Federal energy efficiency resource standard for retail electricity and natural gas suppliers</header><subsection id="HB0B37B3FE7B34C0D97194CF6D08E9C58"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HB0EA4CE5542C42169D9D4A4DBFB942AB"><enum>(1)</enum><header>Affiliate</header><text>The term <term>affiliate</term>, when used in relation to a person (including an electric utility and a local distribution company), means another person that owns or controls, is owned or controlled by, or is under common ownership or control with, that person, as determined under regulations promulgated by the Secretary.</text></paragraph><paragraph id="H6E16C24B5E994C839A7DB763556AC1E9"><enum>(2)</enum><header>ASHRAE; <enum-in-header>ANSI</enum-in-header>; <enum-in-header>IESNA</enum-in-header></header><text>The terms <term>ASHRAE</term>, <term>ANSI</term>, and <term>IESNA</term> mean the American Society of Heating, Refrigerating and Air-Conditioning Engineers, the American National Standards Institute, and the Illuminating Engineering Society of North America, respectively.</text></paragraph><paragraph id="H9A49AC0996964B97AB736B0BC5E0D340"><enum>(3)</enum><header>Base quantity</header><subparagraph id="H101CC6D266FE4D8B954AE31D7F6CD94D"><enum>(A)</enum><header>In general</header><text>The term <term>base quantity</term>, with respect to a retail electricity supplier or retail natural gas supplier, means, for each calendar year for which a performance standard is established under subsection (c), the average annual quantity of electricity or natural gas delivered by the retail electricity supplier or retail natural gas supplier to retail customers during the 3 calendar years immediately preceding the first year that compliance is required under subsection (c)(1).</text></subparagraph><subparagraph id="HE8AD952C63BA4F509D52C68E31588D36"><enum>(B)</enum><header>Exclusion</header><text>The term <term>base quantity</term>, with respect to a retail natural gas supplier, does not include natural gas delivered for purposes of electricity generation.</text></subparagraph></paragraph><paragraph id="HB0FA7DFE10AE4A38BFC03CC8011BF7E1"><enum>(4)</enum><header>CHP Savings</header><text>The term <term>CHP savings</term> means—</text><subparagraph id="HF3880911DE44494097EE56D9F657604E"><enum>(A)</enum><text>CHP system savings from a combined heat and power system that commences operation after the date of enactment of this section; and</text></subparagraph><subparagraph id="H587E856E37BA49D2AB755E7AD94F9FBD"><enum>(B)</enum><text>the increase in CHP system savings from upgrading or replacing, after the date of enactment of this section, a combined heat and power system that commenced operation on or before the date of enactment of this section.</text></subparagraph></paragraph><paragraph id="HD13CD78311C945A1891CA84535AACDEF"><enum>(5)</enum><header>CHP system savings</header><text>The term <term>CHP system savings</term> means the electric output, and the electricity saved due to the mechanical output, of a combined heat and power system, adjusted to reflect any increase in fuel consumption by that system as compared to the fuel that would have been required to produce an equivalent useful thermal energy output in a separate thermal-only system, as determined in accordance with regulations promulgated by the Secretary.</text></paragraph><paragraph id="HBE1024C3EC094640BE3F60A30FC5ED18"><enum>(6)</enum><header>Combined heat and power system</header><text>The term <term>combined heat and power system</term> means a system that uses the same energy source for the generation of electrical or mechanical power and the production of steam or another form of useful thermal energy, if—</text><subparagraph id="H790CFD32A2964B09AAC6E8B1A368E5E8"><enum>(A)</enum><text>the system meets all applicable requirements relating to efficiency and other operating characteristics that the Secretary promulgates by regulation; and</text></subparagraph><subparagraph id="H18C33049D8824788B52F60B19186FCE2"><enum>(B)</enum><text>the net quantity of electricity sold wholesale by the facility using the system does not exceed 50 percent of the total quantity of electricity generated annually by the system.</text></subparagraph></paragraph><paragraph id="HAC280458C6CE480F93A4422C1BBE84AA"><enum>(7)</enum><header>Cost-effective</header><text>The term <term>cost-effective</term> means, with respect to an energy efficiency measure, that the measure achieves, directly to the energy consumer and to the economy, a net present value of economic benefits over the life of the measure that is greater than the net present value of the cost of the measure over the life of the measure, using a societal benefit-cost test calculated using the lower of—</text><subparagraph id="H313238351CBE402A93FC9BE9E5D0F50D"><enum>(A)</enum><text>a utility weighted average cost of capital; or</text></subparagraph><subparagraph id="H627C7855CEF74121A53C88BAAE39B3A5"><enum>(B)</enum><text>a social discount rate of 3 percent.</text></subparagraph></paragraph><paragraph id="H9FA9F29A8CDE4D4196331CFCCF6AD244"><enum>(8)</enum><header>Customer facility savings</header><text>The term <term>customer facility savings</term> means a reduction in end-use electricity or natural gas consumption (including waste heat energy savings) at a facility of an end-use consumer of electricity or natural gas served by a retail electricity supplier or retail natural gas supplier, as compared to—</text><subparagraph id="HA2256A7AA19B41BEB6AB4BD544EB162C"><enum>(A)</enum><text>in the case of a new facility, consumption at a reference facility of average efficiency;</text></subparagraph><subparagraph id="HCF908761EDA641309E6FC8D90A289A30"><enum>(B)</enum><text>in the case of an existing facility, consumption at the facility during a base period of not less than 1 year;</text></subparagraph><subparagraph id="HE38C8327626C41F88CB187A13642C193"><enum>(C)</enum><text>in the case of new equipment that replaces existing equipment at the end of the useful life of the existing equipment, consumption by new equipment of average efficiency of the same equipment type, except that customer savings under this subparagraph shall not be counted toward customer savings under subparagraph (A) or (B); and</text></subparagraph><subparagraph id="HB86231762F0C4437ACBCF7654B0E9A47"><enum>(D)</enum><text>in the case of new equipment that replaces existing equipment with remaining useful life—</text><clause id="HFE3E68E73A8E4C1E98679187D0B9870A"><enum>(i)</enum><text>consumption by the existing equipment for the remaining useful life of the equipment; and</text></clause><clause id="H31190A3B3DA94E2993AF3542F3B41497"><enum>(ii)</enum><text>thereafter, consumption by new equipment of average efficiency of the same equipment type.</text></clause></subparagraph></paragraph><paragraph id="H9286CE3ED0394932A2AA05E3E7349C3C"><enum>(9)</enum><header>Electricity savings</header><text>The term <term>electricity savings</term> means reductions in electricity consumption or losses achieved through measures implemented after the date of enactment of this section, as determined in accordance with regulations promulgated by the Secretary, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H305B587D9813453D9D59ABA0113C3E2C"><enum>(A)</enum><text display-inline="yes-display-inline">occur in the service territory of the retail electricity supplier claiming or transferring the electricity savings; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F7ADDF683FC47DF8D0EDE9C99914DD8"><enum>(B)</enum><text display-inline="yes-display-inline">are limited to—</text><clause id="H5EF7F6C4D20448A5B1489A4155A70690"><enum>(i)</enum><text>customer facility savings of electricity, adjusted to reflect any associated increase in fuel consumption at the facility;</text></clause><clause id="H72164FC03BA848EB8A45FF2F7EB9DB1D"><enum>(ii)</enum><text>reductions in distribution system losses of electricity achieved by a retail electricity supplier, as compared to losses attributable to new or replacement distribution system equipment of average efficiency, as defined in regulations promulgated by the Secretary;</text></clause><clause id="H60E4BFA84A1F40B6BB8E586B68986038"><enum>(iii)</enum><text>CHP savings;</text></clause><clause id="HE522198F069D48F9BD4AC117F879EC0B"><enum>(iv)</enum><text>State and local codes and standards savings of electricity; and</text></clause><clause id="HEC8CAC448DFD457187D82172E68CB809"><enum>(v)</enum><text>fuel-switching energy savings that result in net savings of source energy, as defined in regulations promulgated by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="HE076D8CCDC25443F806171DEB790FF06"><enum>(10)</enum><header>Fuel-switching energy savings</header><subparagraph id="HE8EF4BF137AA43F8AE67DC9CCB2D76BB"><enum>(A)</enum><header>In general</header><text>The term <term>fuel-switching energy savings</term> means net energy savings, calculated in accordance with subparagraph (B), from end-user switches from 1 energy source to another, as determined in accordance with regulations promulgated by the Secretary.</text></subparagraph><subparagraph id="H0067DD22D3BE4303A3A5CA006FCF49F6"><enum>(B)</enum><header>Calculation</header><text>For purposes of calculating fuel-switching net energy savings—</text><clause id="H4CEBFA5A6C3D48119CB1C414B34EAB02"><enum>(i)</enum><text>electricity use shall be evaluated based on the average quantity of fuel burned at a new power plant, taking into account existing and planned renewable energy generators to provide each kilowatt hour of electricity;</text></clause><clause id="HBA45D9938ABE4A1797B873E9571E05CA"><enum>(ii)</enum><text>electricity and natural gas use shall include losses in the transmission and distribution system; and</text></clause><clause id="H828A8095971F4733A8B2D35186BB5195"><enum>(iii)</enum><text>fuel-switching that is not cost-effective to the end-user shall not be counted.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FD59A3721EB49F08280469733FFEBAC"><enum>(11)</enum><header>Local distribution company</header><text>The term <term>local distribution company</term> has the meaning given the term in section 2 of the Natural Gas Policy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3301">15 U.S.C. 3301</external-xref>).</text></paragraph><paragraph id="H2837FB9D20224C2980ACB04BE68803C1"><enum>(12)</enum><header>Natural gas savings</header><text>The term <term>natural gas savings</term> means reductions in natural gas consumption, leakage, or operational losses from measures implemented after the date of enactment of this section, as determined in accordance with regulations promulgated by the Secretary, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HDF31346874184A43AC1B21163FA534D5"><enum>(A)</enum><text display-inline="yes-display-inline">occur in the service territory of the retail natural gas supplier claiming or transferring the natural gas savings; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF908CFD60BA443CEB80622C005248C7A"><enum>(B)</enum><text display-inline="yes-display-inline">are limited to—</text><clause id="H14B039F5790C4699B58DE91683757A3E"><enum>(i)</enum><text>customer facility savings of natural gas, adjusted to reflect any associated increase in electricity consumption or consumption of other fuels at the facility;</text></clause><clause id="HD870962A7D524D4AA7BB97DD41002A9E"><enum>(ii)</enum><text>reductions in leakage, operational losses, and consumption of natural gas fuel to operate a gas distribution system, achieved by a retail natural gas supplier, as compared to similar leakage, losses, and consumption during a base period of not less than 1 year;</text></clause><clause id="HD29653E8CF9847FA83D720233603FD24"><enum>(iii)</enum><text>State and local codes and standards savings of natural gas; and</text></clause><clause id="HC89A6D899BD44302AD7790B49B312B02"><enum>(iv)</enum><text>fuel-switching energy savings that result in net savings of source energy, as defined in regulations promulgated by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H988EBCF30578433DAF57EE035EBE8044"><enum>(13)</enum><header>Performance standard</header><subparagraph commented="no" display-inline="no-display-inline" id="H3FEBEE3C5F424DAAB26089055BFD736E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>performance standard</term> means a standard established for a calendar year for cumulative electricity savings or cumulative natural gas savings that is expressed as a percentage of base quantity.</text></subparagraph><subparagraph id="H2E7BF8F7899C40E6BB41A251B041BB10" commented="no"><enum>(B)</enum><header>Calendar years 2025 through 2039</header><text>For each of calendar years 2025 through 2039, the term <term>performance standard</term> means the percentage labeled as cumulative electricity savings percentage or cumulative natural gas savings percentage, as applicable, in the table in subsection (c)(2) for the applicable calendar year.</text></subparagraph></paragraph><paragraph id="H3229F39C1E084D8FB3F2D429BF7647E5"><enum>(14)</enum><header>Power pool</header><subparagraph commented="no" display-inline="no-display-inline" id="HF6F1EA7A3EED4AE9B68D107F06EB0C90"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>power pool</term> means an association of 2 or more interconnected electric systems that have entered into an agreement to coordinate operations and planning for improved reliability and efficiencies, as determined by the Secretary.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB85302125864F879ABE975BA283327C"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>power pool</term> includes a Regional Transmission Organization (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)) and an Independent System Operator (as defined in that section).</text></subparagraph></paragraph><paragraph id="H463D5D48965343DE9CA295DBB3437663"><enum>(15)</enum><header>Reporting period</header><text>The term <term>reporting period</term> means—</text><subparagraph id="H27B05C2AA11142F68A989F03F48C6621"><enum>(A)</enum><text>calendar year 2025; and</text></subparagraph><subparagraph id="H833748A325914054883A3DA0401F6170"><enum>(B)</enum><text>each successive 2-calendar-year period thereafter.</text></subparagraph></paragraph><paragraph id="H224E1791E6DF4818A061C7C8A9ED6878"><enum>(16)</enum><header>Retail electricity supplier</header><subparagraph id="HDDCC6501AA864807AAC57A16D97A53FF"><enum>(A)</enum><header>In general</header><text>The term <term>retail electricity supplier</term> means, for any given calendar year, an electric utility that delivers not less than 2,000,000 megawatt hours of electric energy to electric consumers for purposes other than resale during the preceding calendar year.</text></subparagraph><subparagraph id="HEDAF92E639514D8F99A449FF59D48043"><enum>(B)</enum><header>Inclusions and limitations</header><text>For purposes of determining whether an electric utility qualifies as a retail electricity supplier under subparagraph (A)—</text><clause id="H9C2F1B8378CA40099EE044303DEFCB83"><enum>(i)</enum><text>deliveries by any affiliate of an electric utility to electric consumers for purposes other than resale shall be considered to be deliveries by the electric utility; and</text></clause><clause id="HE8BF8BB56F9E4486B5280310B91BA6BF"><enum>(ii)</enum><text>deliveries by any electric utility to a lessee, tenant, or affiliate of the electric utility shall not be considered to be deliveries to electric consumers.</text></clause></subparagraph></paragraph><paragraph id="H8BCA30B525D04684BB21D9DC642962FA"><enum>(17)</enum><header>Retail natural gas supplier</header><subparagraph id="H1D9587CD36324BA8B7065D064051FE72"><enum>(A)</enum><header>In general</header><text>The term <term>retail natural gas supplier</term> means, for any given calendar year, a local distribution company that delivered to natural gas consumers more than 5,000,000,000 cubic feet of natural gas for purposes other than resale during the preceding calendar year.</text></subparagraph><subparagraph id="HF0BF2BA43EC044F4B740A5E5C48A79D8"><enum>(B)</enum><header>Inclusions and limitations</header><text>For purposes of determining whether an entity qualifies as a retail natural gas supplier under subparagraph (A)—</text><clause id="HDDE5E78862B34BCAABC3253F0070E1E6"><enum>(i)</enum><text>deliveries of natural gas by any affiliate of a local distribution company to consumers for purposes other than resale shall be considered to be deliveries by the local distribution company; and</text></clause><clause id="H89EFBF2D85494F2BBDE6DE444B5C7B16"><enum>(ii)</enum><text>deliveries of natural gas to a lessee, tenant, or affiliate of a local distribution company shall not be considered to be deliveries to natural gas consumers.</text></clause></subparagraph></paragraph><paragraph id="H1AC711AC84E7438AA6BEF42733DDA1BE"><enum>(18)</enum><header>State and local codes and standards savings</header><subparagraph id="H222AFACDAE574C6FB6832928CDA1819A"><enum>(A)</enum><header>In general</header><text>The term <term>State and local codes and standards savings</term> means a reduction, due to the adoption and implementation, after the date of enactment of this section, of new or revised appliance and equipment efficiency standards or building energy codes, in—</text><clause id="HC4ED5CEC90B64CE4A3CBC13FBE1A19CE"><enum>(i)</enum><text>end-use electricity consumption for a retail electricity supplier; or</text></clause><clause id="H0AB0161AD8D94BF494625C5A10BDF833"><enum>(ii)</enum><text>natural gas consumption in the service territory of a retail natural gas supplier.</text></clause></subparagraph><subparagraph id="H92A4EEE5BB384D65BA8C1BE13640361A"><enum>(B)</enum><header>Baselines</header><text>In calculating State and local codes and standards savings under subparagraph (A)—</text><clause id="HD509107B30704229B432BE6C284FECFC"><enum>(i)</enum><text>the baseline for calculating savings from a new or revised building code shall be the more stringent of—</text><subclause id="H2C9E862BC20743EABF0238807CCAAA45"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="HD6C99447E10149429F40DEE8EF457EB1"><enum>(aa)</enum><text>the 2021 International Energy Conservation Code for residential buildings; or</text></item><item id="H69C61EDF6FD346F6B70311541115710E" indent="up1"><enum>(bb)</enum><text>the ASHRAE/ANSI/IESNA Standard 90.1–2019 for commercial buildings; or</text></item></subclause><subclause id="H0627B4FBF7544CEF9EB5D6BCAC679E79"><enum>(II)</enum><text>the applicable State building code in effect on the date of enactment of this section; and</text></subclause></clause><clause id="H53A54C0A1210464BBBF2A40E2FE8E7F8"><enum>(ii)</enum><text>the baseline for calculating savings from a new or revised appliance standard shall be the estimated average efficiency of new appliances in the applicable 1 or more categories during the 1-year period preceding the date on which the new or revised standard is adopted.</text></clause></subparagraph></paragraph><paragraph id="H06F4CC7847EB47FD83E3AC59AD532600"><enum>(19)</enum><header>Third-party efficiency provider</header><text>The term <term>third-party efficiency provider</term> means any retailer, building owner, energy service company, financial institution, or other commercial, industrial, or nonprofit entity that is capable of providing electricity savings or natural gas savings in accordance with any procedures, standards, and rules established by the Secretary under subsections (b)(1)(D) and (e).</text></paragraph><paragraph id="HD61B542B856F4E819A0F3EDEC21CE2C0"><enum>(20)</enum><header>Waste heat energy savings</header><text>The term <term>waste heat energy savings</term> means a reduction in the mechanical or thermal energy used at a facility or the electric output of a facility, adjusted to reflect any associated increase in fuel consumption, that results from a modification of an industrial, commercial, or institutional system that commenced operation before the date of enactment of this section, in order to recapture electrical, mechanical, or thermal energy that would otherwise be wasted, such as through exhaust or dissipation to the environment, and productively use that recaptured energy, represented as a reduction in net electricity or natural gas consumption, as determined in accordance with regulations promulgated by the Secretary.</text></paragraph></subsection><subsection id="HA673FA72B9E748B2B0C35421E6F9234C"><enum>(b)</enum><header>Establishment of program</header><paragraph id="HB8072259B5334FDB9BA40795FEC3AB89"><enum>(1)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall, by regulation, establish a program to implement and enforce the requirements of this section, including—</text><subparagraph id="H7A659D6596D94F3D8FFA3FA88F93A377"><enum>(A)</enum><text>by establishing evaluation, measurement, and verification procedures and standards under subsection (e);</text></subparagraph><subparagraph id="H65031DAF45D443FC968C6C1D4156DADA"><enum>(B)</enum><text>by establishing requirements under which retail electricity suppliers and retail natural gas suppliers shall—</text><clause id="HCD192D27CA3A4CB1A59CCD8ADE173005"><enum>(i)</enum><text>demonstrate, document, and report the compliance of the retail electricity suppliers and retail natural gas suppliers with the performance standards under subsection (c); and</text></clause><clause id="HE9357FA70A6F4735930C3BD181C0A34D"><enum>(ii)</enum><text>estimate the impact of the standards on current and future electricity and natural gas use in the service territories of the suppliers;</text></clause></subparagraph><subparagraph id="H482E7FEEE3C34AF296DDECD6173514CC"><enum>(C)</enum><text>by establishing requirements governing applications for, and implementation of, delegated State administration under subsection (g); and</text></subparagraph><subparagraph id="H563F1DEC62E04866A0D1EB97ECD83CAF"><enum>(D)</enum><text>by establishing rules to govern transfers of electricity savings and natural gas savings—</text><clause id="H01CECCDF61474112A0B1E5C065C05503"><enum>(i)</enum><text>between suppliers and third-party efficiency providers serving the same State; and</text></clause><clause id="HBFABC0AA2F47487689BEF9D689699AEC"><enum>(ii)</enum><text>between suppliers and third-party efficiency providers serving different States.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE5E1470C1136421FB7A89CE147157D80"><enum>(2)</enum><header>National academy of subsection (e)(2)(C).</text></paragraph><paragraph id="H9E55DAF945F140989D8A8A04F2DDEC08"><enum>(3)</enum><header>Coordination with state programs</header><text>In establishing and implementing the program under this section, the Secretary shall, to the maximum extent practicable, preserve the integrity and incorporate best practices of existing State energy efficiency programs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5161358BB2B847E0807A80E37D3B6A66"><enum>(4)</enum><header display-inline="yes-display-inline">Savings programs for low-income customers</header><text display-inline="yes-display-inline">In implementing this section, the Secretary shall encourage retail electricity suppliers and retail natural gas suppliers to ensure that a portion of the customer facility savings achieved for a calendar year shall result from programs that target households that are at or below 200 percent of the poverty line (as defined in section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>)).</text></paragraph></subsection><subsection id="HD91A1371BE53487C9ACF9B2F383139C0"><enum>(c)</enum><header>Performance standards</header><paragraph id="HB4CC00AA126F4D5B9756F53474BDCAA8"><enum>(1)</enum><header>Compliance obligation</header><text>Not later than May 1 of the calendar year immediately following each reporting period—</text><subparagraph id="H2AD239F1BF53413C86F7D2917E92070F"><enum>(A)</enum><text>each retail electricity supplier shall submit to the Secretary a report, in accordance with regulations promulgated by the Secretary, demonstrating that the retail electricity supplier has achieved cumulative consistent electricity savings (adjusted to account for any attrition of savings measures implemented in prior years) in each calendar year that are equal to the applicable percentage of the base quantity of the retail electricity supplier; and</text></subparagraph><subparagraph id="H1ACD4905D47E49EBA4DB2ED04286E1ED"><enum>(B)</enum><text>each retail natural gas supplier shall submit to the Secretary a report, in accordance with regulations promulgated by the Secretary, demonstrating that the retail natural gas supplier has achieved cumulative consistent natural gas savings (adjusted to account for any attrition of savings measures implemented in prior years) in each calendar year that are equal to the applicable percentage of the base quantity of the retail natural gas supplier.</text></subparagraph></paragraph><paragraph id="HBCF18CC1095047639DBB633859889F69"><enum>(2)</enum><header>Standards for 2025 through 2039</header><text>For each of calendar years 2025 through 2039, the applicable percentages are as performance standards (expressed as applicable percentages of base quantity for both cumulative electricity savings and cumulative natural gas savings) for each of calendar years 2040 through 2049.</text></subparagraph><subparagraph id="H47C34B0AE2144B02863FC689F13ACAB2"><enum>(B)</enum><header>Requirements</header><text>The Secretary shall establish standards under this paragraph at levels reflecting the maximum achievable level of cost-effective energy efficiency potential, taking into account—</text><clause id="HA4A974CA1DC744EFB57B03703FCFCF58"><enum>(i)</enum><text>cost-effective energy savings achieved by leading retail electricity suppliers and retail natural gas suppliers;</text></clause><clause id="HD1AE1717973E411496AF503F51F3D2BE"><enum>(ii)</enum><text>opportunities for new State and local codes and standards savings;</text></clause><clause id="H68C5BC7843944DA6809042FD64229AE0"><enum>(iii)</enum><text>technology improvements; and</text></clause><clause id="H8E8ABB4732494449AAB7CB333ED0025C"><enum>(iv)</enum><text>other indicators of cost-effective energy efficiency potential, including differences between States.</text></clause></subparagraph><subparagraph id="H610154F159FA4AF89678E7D6313FC363"><enum>(C)</enum><header>Minimum percentage</header><text>In no case shall the applicable percentages for any calendar year after calendar year 2039 be less than the applicable percentages for calendar year 2039.</text></subparagraph></paragraph><paragraph id="H1E13E76060114B3E8723532F2A0E0293"><enum>(4)</enum><header>Midcourse review and adjustment of performance standards</header><subparagraph id="HD95E77BE583A46899E55B52F0D7A2C49"><enum>(A)</enum><header>In general</header><text>Not later than December 31, 2033, and at 10-year intervals thereafter, the Secretary shall—</text><clause id="H23B3D298C0D54678877E9E782A3CFC66"><enum>(i)</enum><text>review the most recent performance standards established under paragraph (2) or (3), as applicable; and</text></clause><clause id="H3D8476DC20514922A939E19FAF4146B9"><enum>(ii)</enum><text>increase the performance standards by regulation if the Secretary determines that additional cost-effective energy efficiency potential is achievable, taking into account the requirement described in paragraph (3)(C).</text></clause></subparagraph><subparagraph id="HBC338811830C49508B814F8E8C1B78E4"><enum>(B)</enum><header>Lead time</header><text>If the Secretary revises performance standards under this paragraph, the applicable regulations shall provide adequate lead time to ensure that compliance with the increased performance standards is feasible. </text></subparagraph></paragraph><paragraph id="H5DBFCFE379F7435E8E203923EFDB95D6"><enum>(5)</enum><header>Delay of submission for first reporting period</header><subparagraph id="HC6A0BEF032A046AC993E0BF78AC8D53E"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraphs (1) and (2), for the first reporting period after the date of enactment of this section, the Secretary may accept a request from a retail electricity supplier or a retail natural gas supplier to delay the required submission of documentation of all or part of the required savings for up to 2 years.</text></subparagraph><subparagraph id="H87EC06B943394184B94532FDFB97634A"><enum>(B)</enum><header>Plan for compliance</header><text>The request for delay under subparagraph (A) shall include a plan for coming into full compliance by the end of the second reporting period after the date of enactment of this section.</text></subparagraph></paragraph><paragraph id="H8E418A6DE359487184569E06396FDC3C"><enum>(6)</enum><header>Applying unused savings to future years</header><text>If savings achieved in a year exceed the performance standards specified in this subsection, any savings in excess of the performance standards may be applied toward performance standards specified for the first 3 years following the year in which the excess savings are achieved.</text></paragraph></subsection><subsection id="H7F69316CCBD1411FB44EE4634EBF7A0D"><enum>(d)</enum><header>Transfers of electricity savings and natural gas savings</header><paragraph id="H4893F7A52860414EBDED83CE62F3192A"><enum>(1)</enum><header>Bilateral contracts for savings transfers</header><text>Subject to the limitations of this subsection, a retail electricity supplier or retail natural gas supplier may use electricity savings or natural gas savings purchased pursuant to a bilateral contract from another retail electricity supplier or retail natural gas supplier, a State, or a third-party efficiency provider to meet the applicable performance standard under subsection (c).</text></paragraph><paragraph id="H7252B7CFEE8B43A19968F5FDE50F2E53"><enum>(2)</enum><header>Requirements</header><text>Electricity savings or natural gas savings purchased and used for compliance under this subsection shall be—</text><subparagraph id="HC4AFFF0A7FA144D7AE91D47779F6F013"><enum>(A)</enum><text>measured and verified in accordance with subsection (e);</text></subparagraph><subparagraph id="HE3F7996789614F1DACC23F711F22EF72"><enum>(B)</enum><text>reported in accordance with subsection (c); and</text></subparagraph><subparagraph id="H2D31A608C3DD4A71998225C39EB844CF"><enum>(C)</enum><text>achieved within the same power pool as is served by the applicable retail electricity supplier or retail natural gas supplier.</text></subparagraph></paragraph><paragraph id="H17185C5E5FFC4EDCB77C06097B447245"><enum>(3)</enum><header>Regulatory approval</header><text>Nothing in this subsection limits or affects the authority of a State regulatory authority to require a retail electricity supplier or retail natural gas supplier that is regulated by the State regulatory authority to obtain the authorization or approval of the State regulatory authority of a contract for transfer of electricity savings or natural gas savings under this subsection.</text></paragraph><paragraph id="H8DF25E83265B44B3ACE146B95A44C77B"><enum>(4)</enum><header>Limitations</header><text>To optimize the achievement of cost-effective energy efficiency potential, the Secretary may prescribe such limitations as the Secretary determines appropriate with respect to the proportion of the compliance obligation of a retail electricity supplier or retail natural gas supplier under the applicable performance standards under subsection (c) that may be met using electricity savings or natural gas savings that are purchased under this subsection. </text></paragraph></subsection><subsection id="H74F618B6577D4A9F826735666FB95A8C"><enum>(e)</enum><header>Evaluation, measurement, and verification of savings</header><paragraph id="H6FF7842B13B943E2B69E2C1644ACF581"><enum>(1)</enum><header>Regulations</header><text>The regulations promulgated pursuant to subsection (b) shall—</text><subparagraph id="H9CD8EA66422A407E949DC3FDFFD0270B"><enum>(A)</enum><text>be based on—</text><clause id="H35A16775D52C45AD9E440730073A342F"><enum>(i)</enum><text>the Uniform Methods Project of the Department of Energy;</text></clause><clause id="H45EE41567C34473696ABF5783BA1BF98"><enum>(ii)</enum><text>the National Standard Practice Manual for Assessing the Cost-Effectiveness of Energy Efficiency Resources, developed by the National Efficiency Screening Project; and</text></clause><clause id="H2D522552B87E46B2AF402E85B4131319"><enum>(iii)</enum><text>other best practices recognized in the energy efficiency industry; and</text></clause></subparagraph><subparagraph id="H5E1A5E8F2B894A34A423D005949B2329"><enum>(B)</enum><text>include—</text><clause id="HDE2C93A4DDEF4F2AB0460509130BE1E6"><enum>(i)</enum><text>procedures and standards for evaluating, measuring, and verifying electricity savings and natural gas savings that count toward the performance standards established under subsection (c) that—</text><subclause id="H6ED389DC039545208429ED03BFF97C12"><enum>(I)</enum><text>specify the types of energy efficiency and energy conservation measures that may be counted;</text></subclause><subclause id="HEF1B88AA0226413DAF940735D1513D13"><enum>(II)</enum><text>require that energy consumption estimates for customer facilities or portions of facilities in the applicable base and current years be adjusted, as appropriate, to account for changes in weather, level of production, seasonal patterns, and building area;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE5C649A8A74F41DDB430A00A759BA44D"><enum>(III)</enum><text>for new customer facilities, establish a standardized method for calculating average efficiency that accounts for factors such as weather, level of production, seasonal patterns, and building area;</text></subclause><subclause id="HD7DBE02FC08D4983A360E62EB2DA2282"><enum>(IV)</enum><text>do not prevent overall load growth due to beneficial electrification;</text></subclause><subclause id="HCD5A0286FACF44699B5EDC056787590D"><enum>(V)</enum><text>account for the useful life of energy efficiency and energy conservation measures;</text></subclause><subclause id="H33601576DC3141819AECA9C08EA3D6F5"><enum>(VI)</enum><text>allow for savings from a program to be estimated based on extrapolation from a representative sample of participating customers;</text></subclause><subclause id="H9F3C4F04E5F94FBB97E1BD88936A8B06"><enum>(VII)</enum><text>include procedures for calculating and documenting CHP savings, fuel-switching energy savings, and waste heat energy savings;</text></subclause><subclause id="H74138DF870084927AB7AFEB75E089350"><enum>(VIII)</enum><text>establish methods for calculating State and local codes and standards savings, including the use of verified compliance rates;</text></subclause><subclause id="H19B0884EC1294CDBB071698920B8676A"><enum>(IX)</enum><text>include procedures for calculating and documenting—</text><item id="HDA7499B3C6654F938E15D5455D15CBD7"><enum>(aa)</enum><text>customer facility savings and reductions in distribution system losses of electricity and natural gas that are achieved as a result of smart grid deployment, as described in section 1301 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17381">42 U.S.C. 17381</external-xref>), or the siting of new generation capacity closer to the end-use customer; and</text></item><item id="HB33C93016E9542D690385E5430703DBA"><enum>(bb)</enum><text>reductions in natural gas distribution system losses attributable to pipeline repair and replacement programs;</text></item></subclause><subclause id="H46FF8E543E8A4EDFA2BDBEF9DEA926C2"><enum>(X)</enum><text>count only measures and savings that are additional to business-as-usual customer purchase practices;</text></subclause><subclause id="HCB8C1C02B229403EBD6834E04AAA840F"><enum>(XI)</enum><text>ensure that the retail electricity supplier or retail natural gas supplier claiming the electricity savings or natural gas savings, including State and local codes and standards savings, has played a significant role in achieving the savings (including through the activities of a designated agent of the supplier or through the purchase of transferred electricity savings or natural gas savings);</text></subclause><subclause id="H4ACB7B44D2204273973571CF07AC4DA1"><enum>(XII)</enum><text>avoid double-counting of savings used for compliance with this section, including transferred savings;</text></subclause><subclause id="HE5FF99FDFF2043DE9A036F29AAAF318E"><enum>(XIII)</enum><text>include electricity savings or natural gas savings from programs administered by retail electricity suppliers or retail natural gas suppliers that are funded by Federal, State, or other sources, unless the funding source specifies otherwise;</text></subclause><subclause id="H15FEA02A186A449B90B743E672EF5617"><enum>(XIV)</enum><text>credit large customer self-directed electricity savings or natural gas savings to the retail electricity supplier or retail natural gas supplier if the large customer receives incentives or rate reductions from the retail electricity supplier or retail natural gas supplier for self-directed energy efficiency improvements;</text></subclause><subclause id="H8E7AA2FB07154790B5C5FBFC01482186"><enum>(XV)</enum><text>include guidance, as appropriate, for additional alternative approaches to evaluate electricity savings and natural gas savings for large commercial and industrial customers in energy-intensive industries that are subject to international competition;</text></subclause><subclause id="H8A538BE4B63048BEAD745A831879E735"><enum>(XVI)</enum><text>include procedures for counting electricity savings and natural gas savings achieved by solar heating and cooling technologies, solar light pipe technology, geothermal heat pumps, and other technologies utilizing renewable resources that do not produce electricity or gaseous fuel and reduce on-site energy use;</text></subclause><subclause id="H6996ADC41ACE41CCBD2EB8A89DAADBF1"><enum>(XVII)</enum><text>include procedures for counting electricity savings and natural gas savings achieved by weatherization measures, such as installing mechanical insulation, repairing or replacing heating and cooling systems, repairing or replacing windows and doors, performing air sealing, and replacing lights and appliances with more energy efficient models;</text></subclause><subclause id="H9E3049A02B2D441C845211D074109483"><enum>(XVIII)</enum><text>include procedures for counting electricity savings and natural gas savings achieved from increased utilization of mechanical insulation for new, retrofit, and maintenance construction for commercial, industrial, public, and nonprofit buildings and facilities;</text></subclause><subclause id="HA29CE484887D4C38BA26FC6936D69580"><enum>(XIX)</enum><text>in any State in which the State regulatory authority has designated 1 or more entities to administer electric ratepayer-funded efficiency programs approved by the State regulatory authority, provide that electricity savings and natural gas savings achieved through those programs shall be distributed proportionally among retail electricity suppliers and retail natural gas suppliers;</text></subclause><subclause id="H4F88EBA6C513462CA376B9BC9723DEDA"><enum>(XX)</enum><text>include guidance for retail electricity suppliers and retail natural gas suppliers to calculate and document business-as-usual consumption projections;</text></subclause><subclause id="H81D136C47A414C0B93AE4594CBC050A5"><enum>(XXI)</enum><text>include guidance for estimating savings using information from the database established under paragraph (3) based on similar measures and programs in other settings with appropriate adjustments, as necessary; and</text></subclause><subclause id="H972F17DDE4694235B1C05B9D28C2EC2A"><enum>(XXII)</enum><text>incorporate advances in the science of policy evaluation, such as the use of—</text><item id="HEBD0FF2F34F84352BA7AB777AF8721C8"><enum>(aa)</enum><text>randomized control trials;</text></item><item id="H310D9EB06FCB481FB282594367131D88"><enum>(bb)</enum><text>other experimental and quasi-experimental approaches; and</text></item><item id="HE2028A9231844DDD8B0A2E11CD4B2511"><enum>(cc)</enum><text>large data sets and machine learning techniques; and</text></item></subclause></clause><clause id="H2E74B06B8E2D4C3B8F0380445123034F"><enum>(ii)</enum><text>procedures and standards for third-party verification of reported electricity savings or natural gas savings.</text></clause></subparagraph></paragraph><paragraph id="H1FCF8A341A5845D895EFDF8FA7E5A02A"><enum>(2)</enum><header>National <enum-in-header>A</enum-in-header>cademy of <enum-in-header>S</enum-in-header>ciences study</header><text>Not later than 180 days after the date of enactment of this section, the Secretary shall seek to enter into an agreement with the National Academy of Sciences, under which the Academy shall—</text><subparagraph id="H55EC33F76FD9413A8B1DA3B8DF571713"><enum>(A)</enum><text>evaluate existing state-of-the-art methods for evaluating energy efficiency policies and measures;</text></subparagraph><subparagraph id="HF5BFF5A8D2C344068ED5BE1EAB014DDA"><enum>(B)</enum><text>identify approaches in program evaluation literature that may be brought into the energy efficiency domain, including—</text><clause id="HBF528C9BEECC466AB200DF8C4150CFF2"><enum>(i)</enum><text>randomized control trials and other experimental or quasi-experimental approaches;</text></clause><clause id="H5AA68C633B304946A998B791D58FF5B5"><enum>(ii)</enum><text>control of confounding factors;</text></clause><clause id="HEFC6CF0EA1344C30A86C5C00AEE61276"><enum>(iii)</enum><text>longitudinal studies;</text></clause><clause id="H0049394EF004471C9C10BB58C3834DD0"><enum>(iv)</enum><text>assessments by neutral arbiters; and</text></clause><clause id="HB472234E0E58445B84429AD15EDB215D"><enum>(v)</enum><text>disclosure of data for replication; and</text></clause></subparagraph><subparagraph id="HC139F803E20B4112806D96B1662E3525"><enum>(C)</enum><text>not later than 18 months after the date of enactment of this section, publish a report that includes—</text><clause id="H36DBCB3033284E85861D0B9172A57EA2"><enum>(i)</enum><text>a description of the evaluation under subparagraph (A);</text></clause><clause id="H0DFF1608631A46D2B4B320E156A96772"><enum>(ii)</enum><text>a description of the approaches identified under subparagraph (B); and</text></clause><clause id="H182D418F40C2471685E530658369F828"><enum>(iii)</enum><text>recommendations for advancing and adopting rigorous state-of-the-art methods for evaluating energy efficiency policies and measures.</text></clause></subparagraph></paragraph><paragraph id="HAB90B11C7ECA4E12BD310F1E6B1C5C87"><enum>(3)</enum><header>Energy efficiency program evaluation database</header><subparagraph id="HBD3162412B0D432F98392BAAF25EE6AE"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish and maintain a searchable public database, accessible on the website of the Department of Energy, that contains a list of randomized control trials and other experimental or quasi-experimental evaluations of energy efficiency programs.</text></subparagraph><subparagraph id="H8CA0968EA5E3491491DAB1E420131759"><enum>(B)</enum><header>Requirements</header><text>Each trial or evaluation on the list described in subparagraph (A) shall include, at a minimum—</text><clause id="HFF36A673EB994083A3289F0E779B2C4A"><enum>(i)</enum><text>the State in which the trial or evaluation was conducted;</text></clause><clause id="HD6D3F2B3C4EC4BAB9A0BC33D9B68E458"><enum>(ii)</enum><text>the type of trial or evaluation conducted;</text></clause><clause id="H81567BC5886E473AA182F26C6B8DA4F0"><enum>(iii)</enum><text>the type of program evaluated;</text></clause><clause id="HC9C9AF538E404C19A302B0FD570F3E65"><enum>(iv)</enum><text>an abstract or summary of the program evaluated;</text></clause><clause id="H716EE5FC49454A8AB10668780837910B"><enum>(v)</enum><text>a summary of the trial or evaluation methodology;</text></clause><clause id="H2312D916A0EB4958A87A6056D70D069E"><enum>(vi)</enum><text>the revealed energy savings from the trial or evaluation; and</text></clause><clause id="H6A22F2DE6BD748EFAE118F237C87E7E7"><enum>(vii)</enum><text>to the extent practicable, the underlying data used to conduct the trial or evaluation.</text></clause></subparagraph></paragraph></subsection><subsection id="H3CF32616E59948B9B1DAC1160B8AF204"><enum>(f)</enum><header>Enforcement and judicial review</header><paragraph id="H0BB34D1964F547A88ED77A21B7689A69"><enum>(1)</enum><header>Review of retail supplier reports</header><subparagraph id="H0D995B23A58949C791C46F373DABC3F2"><enum>(A)</enum><header>In general</header><text>The Secretary shall review each report submitted to the Secretary by a retail electricity supplier or retail natural gas supplier under subsection (c) to verify that the applicable performance standards under subsection (c) have been met.</text></subparagraph><subparagraph id="H1B3231243AC44ECF84AA22B51B320FA8"><enum>(B)</enum><header>Exclusion</header><text>In determining compliance with the applicable performance standards under subsection (c), the Secretary shall exclude reported electricity savings or natural gas savings that are not adequately demonstrated and documented, in accordance with the regulations promulgated under subsections (b) and (c).</text></subparagraph></paragraph><paragraph id="HDC529F0F1BCD40AB9636A1E311E16B0A"><enum>(2)</enum><header>Penalty for failure to document adequate savings</header><text>If a retail electricity supplier or a retail natural gas supplier fails to demonstrate compliance with an applicable performance standard under subsection (c), or to pay to the State an applicable alternative compliance payment under subsection (g)(4), the Secretary shall assess against the retail electricity supplier or retail natural gas supplier a civil penalty for each failure in an amount equal to, as adjusted for inflation in accordance with such regulations as the Secretary may promulgate—</text><subparagraph id="H8A87932ECFAE4DC38B05C711D160E1CB"><enum>(A)</enum><text>$100 per megawatt hour of electricity savings or alternative compliance payment that the retail electricity supplier failed to achieve or make, respectively; or</text></subparagraph><subparagraph id="HAB61B91FD13245BEB4856716784DCFAC"><enum>(B)</enum><text>$10 per million Btu of natural gas savings or alternative compliance payment that the retail natural gas supplier failed to achieve or make, respectively.</text></subparagraph></paragraph><paragraph id="H9B24FCC36E5642F8AF350F23F945969F"><enum>(3)</enum><header>Offsetting state penalties</header><text>The Secretary shall reduce the amount of any penalty under paragraph (2) by the amount paid by the relevant retail electricity supplier or retail natural gas supplier to a State for failure to comply with the requirements of a State energy efficiency resource standard during the same compliance period.</text></paragraph><paragraph id="HA66BEB6E914440459B6687361A9FD1BB"><enum>(4)</enum><header>Use of payments</header><subparagraph commented="no" id="H13939883830C409CB5F761CADC2B633F"><enum>(A)</enum><header>Definition of covered rate</header><text>In this paragraph, the term <term>covered rate</term> means the proportion that—</text><clause commented="no" id="H6F2101EB99104DFE8192FE1174462486"><enum>(i)</enum><text>the amount of penalty payments made by retail electricity suppliers and retail natural gas suppliers in a State under paragraph (2); bears to</text></clause><clause commented="no" id="H48874231B2BA4FCBB24D57458B64C54F"><enum>(ii)</enum><text>the total amount of penalty payments collected by the Secretary under that paragraph.</text></clause></subparagraph><subparagraph id="H980CF45C96774DB8AA06B9D76FEC31BF"><enum>(B)</enum><header>Use of payments</header><text>Penalty payments collected under paragraph (2) by the Secretary shall be—</text><clause id="H94680742C9674003B757EB037B8FED82"><enum>(i)</enum><text>provided to each State at the covered rate for the State; and</text></clause><clause id="H0F835A6D72844149AB2FA450937B8512"><enum>(ii)</enum><text>used by the State to implement cost-effective energy efficiency programs that—</text><subclause id="H02FC121B7390437D9B0007C189FC1930"><enum>(I)</enum><text>to the maximum extent practicable, achieve electricity savings and natural gas savings in the State sufficient to make up the deficit associated with the penalty payments; and</text></subclause><subclause id="HA25CF0A564BC47559E58EB5EEB124094"><enum>(II)</enum><text>can be measured and verified in accordance with the applicable procedures and standards established under subsection (e).</text></subclause></clause></subparagraph></paragraph><paragraph id="HE79A1A71917C4DB9B3A1BD031DF9E9AA"><enum>(5)</enum><header>Enforcement procedures</header><text>The Secretary shall assess a civil penalty, as provided under paragraph (2), in accordance with the procedures described in section 333(d) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6303">42 U.S.C. 6303(d)</external-xref>).</text></paragraph><paragraph id="H58AD0E99A36A49A8B9CD12C580621721"><enum>(6)</enum><header>Judicial review</header><subparagraph id="H3027D293E93748CE9F5F38BE5737BD89"><enum>(A)</enum><header>In general</header><text>Any person adversely affected by a final action taken by the Secretary under this section, other than the assessment of a civil penalty, may use the procedures for review described in section 336(b) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6306">42 U.S.C. 6306(b)</external-xref>).</text></subparagraph><subparagraph id="H7C790542A4F6435A9EF62B080EF10855"><enum>(B)</enum><header>References</header><text>For purposes of subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="H98ADBFE6D9FA4881A9B201CE811498DC"><enum>(i)</enum><text display-inline="yes-display-inline">any reference in section 336(b) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6306">42 U.S.C. 6306(b)</external-xref>) to a rule shall be considered to be a reference to a final action taken by the Secretary under this section (including the promulgation of a regulation, if applicable), other than the assessment of a civil penalty; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H221B87505EEA4BCE80B551ECB5A8108D"><enum>(ii)</enum><text display-inline="yes-display-inline">any reference in that section to the date on which a rule is prescribed shall be considered to be a reference to the date on which the applicable final action was taken.</text></clause></subparagraph></paragraph></subsection><subsection id="H842BF832B2C844B3A93CC5E66AB3FCA2"><enum>(g)</enum><header>State administration</header><paragraph id="H8BFEB43757564AAC9F26241BCC86C64D"><enum>(1)</enum><header>In general</header><text>On receipt of an application from the Governor of a State (including the Mayor of the District of Columbia), the Secretary may delegate to the State responsibility for administering this section within the territory of the State if the Secretary determines that the State will implement an energy efficiency program that meets or exceeds the requirements of this section.</text></paragraph><paragraph id="HBF5BC23658BA4EA4B51DF30E98EC4BEC"><enum>(2)</enum><header>Secretarial determination</header><text>Not later than 180 days after the date on which a complete application described in paragraph (1) is received by the Secretary, the Secretary shall make a substantive determination approving or disapproving the application, after public notice and comment.</text></paragraph><paragraph id="H2E15C7336D0B4E62A29267B79F2BE16F"><enum>(3)</enum><header>Alternative measurement and verification procedures and standards</header><text>As part of an application submitted under paragraph (1), a State may request to use alternative measurement and verification procedures and standards to the procedures and standards described in subsection (e), if the State demonstrates that the alternative procedures and standards provide a level of accuracy of measurement and verification that are at least equivalent to the Federal procedures and standards under that subsection. </text></paragraph><paragraph id="HF5790DE7D24B454E93F72D0E39020E36"><enum>(4)</enum><header>Alternative compliance payments</header><subparagraph id="H9BCFB1BD068D447B8C860B66F7FB51AD"><enum>(A)</enum><header>In general</header><text>As part of an application submitted under paragraph (1), a State may permit retail electricity suppliers or retail natural gas suppliers to pay to the State, by not later than May 1 of the calendar year immediately following the applicable reporting period, an alternative compliance payment in an amount equal to, as adjusted for inflation in accordance with such regulations as the Secretary may promulgate, not less than—</text><clause id="H2FB6C8A14CCE4E1FAE4B1FF6BB0A5FE7"><enum>(i)</enum><text>$50 per megawatt hour of electricity savings needed to make up any deficit with regard to a compliance obligation under the applicable performance standard; or</text></clause><clause id="H871423E2412A4EA1A063643FBAEEF313"><enum>(ii)</enum><text>$5 per million Btu of natural gas savings needed to make up any deficit with regard to a compliance obligation under the applicable performance standard.</text></clause></subparagraph><subparagraph id="H46981ED8C9254426A20D24C918E3A8D8"><enum>(B)</enum><header>Use of payments</header><text>Alternative compliance payments collected by a State under subparagraph (A) shall be used by the State to administer the delegated authority of the State under this subsection and to implement cost-effective energy efficiency programs that—</text><clause id="H403FC812B76F4202B4FB4A29B58359E2"><enum>(i)</enum><text>to the maximum extent practicable, achieve electricity savings and natural gas savings in the State sufficient to make up the deficit associated with the alternative compliance payments; and</text></clause><clause commented="no" id="HF18DC97175244142B11993FBF322D103"><enum>(ii)</enum><text>can be measured and verified in accordance with the applicable procedures and standards established under subsection (e).</text></clause></subparagraph></paragraph><paragraph id="H15142D6322D04FF8A1A4A7605843A6E1"><enum>(5)</enum><header>Review of state administration</header><subparagraph id="H8D75BF8709C94E1BB0C6D2B7A1BD750E"><enum>(A)</enum><header>Periodic review</header><text>Every 2 years, the Secretary shall review State administration of this section for conformance with the requirements of this section in approximately <fraction>1/2</fraction> of the States that have received approval under this subsection to administer this section, so that each State shall be reviewed not less frequently than once every 4 years.</text></subparagraph><subparagraph id="H2E5D7463EA32494881F8C1775E6FD7FA"><enum>(B)</enum><header>Report</header><text>To facilitate the review under subparagraph (A), the Secretary may require the State to submit a report demonstrating the conformance of the State with the requirements of this section, including—</text><clause id="HEAE040AF4E944A7BB07B654555EC336A"><enum>(i)</enum><text>reports submitted by retail electricity suppliers and retail natural gas suppliers to the State demonstrating compliance with applicable requirements;</text></clause><clause id="H4F7D42197731477E88CFFB7F9FC5A0A9"><enum>(ii)</enum><text>the impact of applicable requirements on projected electricity and natural gas demand in the State;</text></clause><clause id="H53E26B70F35D4550B5B12758452329F5"><enum>(iii)</enum><text>an accounting of the use of alternative compliance payments by the State and the resulting electricity savings and natural gas savings achieved; and</text></clause><clause id="HF80F4C7BB7CB44F5AA305ABB35DCE9BE"><enum>(iv)</enum><text>any other information that the Secretary determines appropriate.</text></clause></subparagraph><subparagraph id="H53F6604189744E8E801430DC2CAD2080"><enum>(C)</enum><header>Review on petition</header><text>Notwithstanding subparagraph (A), on receipt of a public petition containing a credible allegation of a substantial deficiency of a State energy efficiency program authorized under this subsection, the Secretary shall promptly re-review the State energy efficiency program. </text></subparagraph><subparagraph id="H377AF4D1DAB9401982E36F481E32F308"><enum>(D)</enum><header>Deficiencies</header><clause id="HF74BFA0A0F3C4F678E8B6B440DED8272"><enum>(i)</enum><header>In general</header><text>In completing a review under this paragraph, if the Secretary finds deficiencies, the Secretary shall—</text><subclause id="H13A735B03A784B73A3AC48309BFC0CBD"><enum>(I)</enum><text>notify the State of the deficiencies;</text></subclause><subclause id="H0208E942CED74246A229A7AFABB57879"><enum>(II)</enum><text>direct the State to correct the deficiencies; and</text></subclause><subclause id="HBCF8F5170FA643BD94E36BEF333936C3"><enum>(III)</enum><text>require the State to report to the Secretary on progress made by not later than 180 days after the date on which the State receives notice under subclause (I).</text></subclause></clause><clause id="H22250E8FCFD348859F02959D8A00EEC7"><enum>(ii)</enum><header>Substantial deficiencies</header><text>If the deficiencies are substantial, the Secretary shall—</text><subclause id="HC123E3F269694177955899304AE2359A"><enum>(I)</enum><text>disallow the reported electricity savings or natural gas savings that the Secretary determines are not credible due to deficiencies;</text></subclause><subclause id="HBFCFA4D84F724CE39C13F370047B9C91"><enum>(II)</enum><text>re-review the State not later than 2 years after the date on which the original review was completed; and</text></subclause><subclause id="HA60D4FDCA8D24DE6BEB33303FBC776DB"><enum>(III)</enum><text>if substantial deficiencies remain uncorrected after the review provided for under subclause (II), revoke the authority of the State to administer this section.</text></subclause></clause></subparagraph></paragraph><paragraph id="HC925E3C3EC4B49C4960A7ADADB46EB76"><enum>(6)</enum><header>Calls for revision of state applications</header><text>As a condition of maintaining the delegated authority to administer this section, the Secretary may require a State to submit a revised application under paragraph (1) if the Secretary has—</text><subparagraph id="HBAD4C5330C5B4D0F9C1FA49F11F081E2"><enum>(A)</enum><text>established new or revised performance standards under subsection (c);</text></subparagraph><subparagraph id="HFBC73921BE984BCEBF82856323F42734"><enum>(B)</enum><text>promulgated new or substantially revised measurement and verification procedures and standards under subsection (e); or</text></subparagraph><subparagraph id="H2FB16E29F5BF4ED2BF6E7CE727AAA787"><enum>(C)</enum><text>otherwise substantially revised the Federal program established under this section.</text></subparagraph></paragraph><paragraph id="H88471351453A49C4B3CB0D0BA718B95E"><enum>(7)</enum><header>Cost recovery, fixed cost recovery, and shareholder incentives</header><text>The Secretary shall encourage State utility regulatory commissions to review the rules and regulations of the Commission to ensure that utilities under the jurisdiction of the Commission may—</text><subparagraph id="HD70FC1B7F06B40D287B4599154AE1FCC"><enum>(A)</enum><text>recover the direct costs of energy efficiency programs;</text></subparagraph><subparagraph id="HE4AB26A788A842F881FC2F7CB6BF144E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H1DA918E2F3BC436D9DDD682B18471DDE"><enum>(i)</enum><text>fully recover authorized fixed costs from customers, including recovery of revenue associated with fixed costs that was lost due to annual sales that were lower than forecasted; but</text></clause><clause id="HB3DC2B1EC6F84317963D9DCCD580CCAD" indent="up1"><enum>(ii)</enum><text>return to customers the revenue associated with fixed costs collected in excess of the authorized amount under clause (i); and</text></clause></subparagraph><subparagraph id="HD2849811CB2A4592A7F4F2FC9719BB88"><enum>(C)</enum><text>earn a performance-based incentive for shareholders for the achievement of energy efficiency standards.</text></subparagraph></paragraph><paragraph id="H879C2FFE9C30440CAEACBB7F69CBEA2D"><enum>(8)</enum><header>Evaluation, measurement, and verification incentives</header><text>The Secretary shall encourage States that have delegated authority to administer this section to provide incentives to retail electricity suppliers, retail natural gas suppliers, and third-party efficiency providers to use randomized control trials and other experimental or quasi-experimental approaches to evaluate energy efficiency measures and programs within the State.</text></paragraph></subsection><subsection id="H79C5EE5AF6C44000AF11F6E610C8A5C4"><enum>(h)</enum><header>Information and reports</header><text>In accordance with section 13 of the Federal Energy Administration Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/772">15 U.S.C. 772</external-xref>), the Secretary may require any retail electricity supplier, retail natural gas supplier, third-party efficiency provider, or any other entity that the Secretary determines appropriate, to provide any information the Secretary determines appropriate to carry out this section.</text></subsection><subsection id="H7210EF44D4F94E518A08CCABE1EB5B0E"><enum>(i)</enum><header>State law</header><text display-inline="yes-display-inline">Nothing in this section diminishes or qualifies any authority of a State or political subdivision of a State to adopt or enforce any law or regulation respecting electricity savings or natural gas savings, including any law or regulation establishing energy efficiency requirements that are more stringent than those under this section, except that no State law or regulation shall relieve any person of any requirement otherwise applicable under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAA3409B3D75F47D4820A36DFBF9D7C3C"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/617">Public Law 95–617</external-xref>; 92 Stat. 3118) is amended by adding at the end of the items relating
