Russell National School Lunch Act to improve program requirements, and for other purposes.</official-title></form><legis-body id="HF1FDBA6C3CAC4D678FB75C611180C502" style="OLC"><section section-type="section-one" id="H29D704BE075744F6992ADF67A19DEC24"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Hunger Elimination Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H987BE713D5A848AAA21D6BAA9A5EB69B"><enum>2.</enum><header>Universal Medicaid direct certification</header><text display-inline="no-display-inline">Section 9(b)(15) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(15)</external-xref>) is amended—</text><paragraph id="HE8FF23B81BA6440DAB452C3D6F6DD511"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H127596A14961444A84AA809C160CBD75"><enum>(A)</enum><text>by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8A275C02BF454B2794382C68A5F41D06"><clause commented="no" display-inline="no-display-inline" id="H9423651A975C470CBD3D0DAF35917BC8"><enum>(i)</enum><header display-inline="yes-display-inline">Eligible child</header><subclause commented="no" display-inline="no-display-inline" id="H99853F49C14A447AB566D54F968291EE"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible child</term> means a child who—</text><item commented="no" display-inline="no-display-inline" id="HB3249ED8EFEC4F479B37305E685BED48"><enum>(aa)</enum><subitem commented="no" display-inline="yes-display-inline" id="H870A8C3C716D42009534DBFAA3A849E1"><enum>(AA)</enum><text>is eligible for and receiving medical assistance under the Medicaid program; and</text></subitem><subitem commented="no" id="HE417CBD1DDA24615AA8A7D49274CF499" indent="up1"><enum>(BB)</enum><text>is a member of a family with an income as measured by the Medicaid program that does not exceed, in the case of eligibility for free meals, 133 percent of the poverty line (as defined in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>), including any revision required by such section) applicable to a family of the size used for purposes of determining eligibility for the Medicaid program, or, in the case of eligibility for reduced price meals, the applicable family size income level under the income eligibility guidelines for reduced price meals; or</text></subitem></item><item commented="no" display-inline="no-display-inline" id="HB852D031491C44B8BCC0EAAFA7B908B2"><enum>(bb)</enum><text>is a member of a household (as that term is defined in section 245.2 of title 7, Code of Federal Regulations (or a successor regulation)) with a child described in item (aa).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H60F244AAA9A64338B39B2781652C42D1"><enum>(II)</enum><header>Other children</header><text>The term <term>eligible child</term> includes a child who is eligible for and receiving medical assistance under the Medicaid program under subclause (I) of section 1902(a)(10)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)</external-xref>)—</text><item commented="no" display-inline="no-display-inline" id="H6EBA31015B234D3ABC84FAA4008627B1"><enum>(aa)</enum><text>on the basis of receiving aid or assistance under the State plan approved under part E of title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>);</text></item><item commented="no" display-inline="no-display-inline" id="H26BE4271D1AA46F99036A2B432A13929"><enum>(bb)</enum><text>by reason of section 473(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(b)</external-xref>); or</text></item><item commented="no" display-inline="no-display-inline" id="HDEDED0D7379740C5BB7DA9FCACF95B14"><enum>(cc)</enum><text>under subclause (II) of section 1902(a)(10)(A)(i) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)</external-xref>).</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H64EE9AF9C39E404397AAAB86A0063D9C"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H326C32F2372047D6929C0956BCD9DE17"><clause id="H4174BD379805467C8D17C0F0FFBE0B08"><enum>(iii)</enum><header>Without further application</header><text>The term <term>without further application</term> has the meaning given the term in paragraph (4)(G).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H60EADDB217DD40C1B363CC0015EFD84B"><enum>(2)</enum><text>by striking subparagraphs (B) through (H) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D5B183936204AA5B51AEAA28926B6F4"><subparagraph id="H1F70CE5DED1A4F4BB76C2CFCA5010F8D"><enum>(B)</enum><header>Agreement</header><text>For the school year beginning on July 1, 2025, and each school year thereafter, each State shall enter into an agreement described in subparagraph (C) with the 1 or more State agencies conducting eligibility determinations for the Medicaid program.</text></subparagraph><subparagraph id="HC16318D03BFF4B9AB3F418F87E5F9D98"><enum>(C)</enum><header>Procedures</header><clause id="HCB10B49052364A95A7623D1A2AC78D84"><enum>(i)</enum><header>In general</header><text>Subject to subparagraph (D) and paragraph (6), an agreement entered into under subparagraph (B) shall establish procedures under which an eligible child shall be certified as eligible, without further application, for—</text><subclause id="H7599EAA363D2407BA8517FA62645D8E2"><enum>(I)</enum><text>free or reduced price lunch under this Act; and</text></subclause><subclause id="H7A2D8C27FEE046368A218B808F98EC59"><enum>(II)</enum><text>free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></subclause></clause><clause id="H9D8072D751404BA082780469BD5463D2"><enum>(ii)</enum><header>Free meals</header><text>Each agreement entered into under subparagraph (B) shall ensure that a child who is simultaneously eligible for reduced price meals under this paragraph or based on an income eligibility determination, and for free meals based on documentation provided under subsection (d)(2), shall be certified for free meals.</text></clause></subparagraph><subparagraph id="H6C42BA9B4CBF44E2A0CF806EB96026A6"><enum>(D)</enum><header>Certification</header><text>Subject to paragraph (6), and according to an agreement entered into under subparagraph (B), the local educational agency conducting eligibility determinations under that agreement shall certify an eligible child as eligible, without further application, for—</text><clause id="H95D72B807C9F4C7D89620468D640BD5A"><enum>(i)</enum><text>free or reduced price lunch under this Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1D4A78A833714E8CB3C156C66DD52D09"><enum>(ii)</enum><text>free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HDE2282C8F7AE43C38859E7AC16EE6974"><enum>3.</enum><header>Direct certification for children receiving Social Security income</header><subsection id="H3B2B299462474821AF67412BA1A6CD7D"><enum>(a)</enum><header>In general</header><text>Section 9(b)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(5)</external-xref>) is amended—</text><paragraph id="H8E6068C4883A42ECAF71F4850777636D"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>(2));</quote> and inserting <quote>(2)));</quote>;</text></paragraph><paragraph id="H47A0366165CA4FD6BEC204F87F7ACBBA"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H254916075AC74500A52CAE42F1FFD1EA"><enum>(3)</enum><text>in subparagraph (E)(ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HBFA5A8D3A8EC433B92B8B7B116F81B91"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5026D1A50E0B42F3A760916833707D61"><subparagraph id="H3312835846584000BF5B136D08140513"><enum>(F)</enum><text>a child who receives supplemental security income payments under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD5FE06FD3D524AEE8DB7267ECF0BDD3C"><enum>(b)</enum><header>Data from Social Security Administration</header><text>Section 9(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1149921E7E8A4E4ABD3267F040CA2FD9"><paragraph id="HD5823AF6025E4941BCF808A00C4D91ED"><enum>(16)</enum><header>Data from social security administration</header><text>In the case of direct certification under paragraph (5) or (12)(A) of a child who receives supplemental security income payments under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>), the Commissioner of Social Security shall provide a local educational agency with the data necessary to certify the child in accordance with a data-sharing agreement between the Commissioner and the State in which the local educational agency is located.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
