R. 9426</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240830">August 30, 2024</action-date><action-desc><sponsor name-id="B001295">Mr. Bost</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to carry out a pilot program under which the Secretary may fill vacant shifts at medical facilities of the Department of Veterans Affairs with non-Department health care providers.</official-title></form><legis-body id="HA6EB66C3D0B940938D897A057C14E88A" style="OLC"><section id="H06BB09C3E4B145AA98E38F0B11C2EA55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding VA’s Healthcare Workforce Act</short-title></quote>.</text></section><section id="HB3F482513AF24722AB44487E6E7BA1F0" section-type="subsequent-section"><enum>2.</enum><header>Pilot program to fill vacant shifts at medical facilities of the Department of Veterans Affairs with non-Department health care providers</header><subsection id="H49E020307F0F43DA981F8C8FE1F864B4"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, Secretary of Veterans Affairs shall carry out a pilot program under which the Secretary may fill a vacant shift at a medical facility of the Department of Veterans Affairs with a non-Department health care provider.</text></subsection><subsection id="H6018417685024AA8927D704701148CDF"><enum>(b)</enum><header>Agreements; payments</header><text>To carry out the pilot program, the Secretary shall seek to enter into at least one agreement with an entity that employs or contracts with health care providers. Pursuant to such an agreement, the Secretary shall pay the entity a fixed rate for each shift filled by such entity under the pilot program.</text></subsection><subsection id="H37ACF9BEBBA14BC9BD94ED9B249B3DE5"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not, under the pilot program, fill a vacant shift at a medical facility of the Department with a non-Department health care provider unless the number of vacant shifts at such facility reaches a minimum number or percentage prescribed by the Secretary.</text></subsection><subsection id="HB737371770454108A444DD20E98435EF"><enum>(d)</enum><header>Locations</header><text display-inline="yes-display-inline">The Secretary shall carry out the pilot program in medical facilities of not more than two Veterans Integrated Services Networks. In selecting a facility for the pilot program, the Secretary shall give preference to a facility—</text><paragraph id="H96E9AF104A854C2CA50C9F63DA97A974"><enum>(1)</enum><text>located in a rural area; or</text></paragraph><paragraph id="H35AFAE2993A340ADB5FD213C273BA6B1"><enum>(2)</enum><text>that historically has a high rate of vacant shifts.</text></paragraph></subsection><subsection id="H8A4C68A63ECD47B18AC918656925136D"><enum>(e)</enum><header>Privacy</header><text display-inline="yes-display-inline">To protect the privacy of a veteran who receives hospital care or medical services under the pilot program, the Secretary shall restrict the access, to medical records of the Department, of a provider who fills a vacant shift under the pilot program, to only such records of a veteran to whom such provider provides hospital care or medical services.</text></subsection><subsection id="HEB808D1510DF47E292E6F962F3E63628"><enum>(f)</enum><header>Reports</header><paragraph id="H93BFF5D68710482F82B7182745E23F03"><enum>(1)</enum><header>Requirement</header><text>The Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the pilot program not later than—</text><subparagraph id="HA2DF57FD07C447F79372EE82295D7A6E"><enum>(A)</enum><text display-inline="yes-display-inline">21 months after the date on which the Secretary begins to carry out the pilot program; and</text></subparagraph><subparagraph id="H67F3822B4F094E3DB8AF31C594A58884"><enum>(B)</enum><text>90 days after the date on which the pilot program terminates.</text></subparagraph></paragraph><paragraph id="HE7B38476216E47CEA36E401C7077D079"><enum>(2)</enum><header>Elements</header><text>Each such report shall include the following elements:</text><subparagraph id="HC8B7E65BB5F241D1B47FED66BC157824"><enum>(A)</enum><text display-inline="yes-display-inline">How frequently the Secretary filled a vacant shift under the pilot program.</text></subparagraph><subparagraph id="H501B036D8A5941B3920AC3A4D3A97496"><enum>(B)</enum><text>The medical specialties relating to vacant shifts that were most frequently filled under the pilot program.</text></subparagraph><subparagraph id="HA89F22AB75B0485C84ECBD9A57E0462E"><enum>(C)</enum><text display-inline="yes-display-inline">The number of veterans who received hospital care or medical services under the pilot program.</text></subparagraph></paragraph></subsection><subsection id="H13B3F3FCA1EB4223A57650B77F323151"><enum>(g)</enum><header>Termination</header><text>The pilot program shall terminate three years after the date on which the Secretary begins to carry out the pilot program.</text></subsection></section></legis-body></bill>
