which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Treasury to establish a pilot program to provide grants to eligible grantees to use for the purpose of providing low-interest construction loans to eligible entities.</official-title></form><legis-body id="HA6385DABA51C4C95898562A14864DF7E" style="OLC"><section id="HE703B591FDD8428E8857D61A6C946CF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lasting Home Affordability Act of 2024</short-title></quote>.</text></section><section id="HF79D3B85666A4F5CB6572B2FA8E7C536"><enum>2.</enum><header>Lasting Home Affordability Fund</header><subsection id="HCDEDF9D5845546E282B521B950E6D023"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall, not later than 90 days year after the date of the enactment of this section, establish a program to provide grants to eligible grantees to use for the purpose of providing low-interest construction loans to eligible entities.</text></subsection><subsection id="H31C43CEFB87B4889AB7F1A6393AEE2CE"><enum>(b)</enum><header>Application by eligible grantees</header><text display-inline="yes-display-inline">To be eligible to receive amounts under this section, an eligible grantee shall submit an application at such time and in such manner as the Secretary may reasonably require, including a detailed description of—</text><paragraph id="HC84B920340814C209A3C146B88CE3D37"><enum>(1)</enum><text>how the eligible grantee intends to use any amounts provided under this section; and</text></paragraph><paragraph id="H85780E5FDD98488685B4D4B784B7D14B"><enum>(2)</enum><text>the qualifications such eligible grantee has that will allow such eligible grantee to successfully administer a grant under this section.</text></paragraph></subsection><subsection id="H405FDA3DCC0E4713BF13F9148C1597F6"><enum>(c)</enum><header>Use of amounts by eligible grantees</header><paragraph id="H4FFC310AF55240819747A1D1912D09C8"><enum>(1)</enum><header>In general</header><text>Any eligible grantee that receives amounts under this section shall use such amounts to establish a revolving fund and provide low-interest construction loans to 1 or more eligible entities. </text></paragraph><paragraph id="HB6CEAF23F7C74B8BBEF3332296C8518F"><enum>(2)</enum><header>Loan requirements</header><subparagraph id="H997ABDD0DD8C4432B2BB5FA8A6B47821"><enum>(A)</enum><header>In general</header><text>Loans provided by an eligible grantee to an eligible entity using amounts provided under this section shall—</text><clause id="H05425D6F128F458D9C061B6FB8C880A7"><enum>(i)</enum><text>have an interest rate of not more than 3 percent; and</text></clause><clause id="H2E21EE465FFB49DBA4EED44904B54063"><enum>(ii)</enum><text>have an origination fee of not more than 1 percent of the amount of the loan.</text></clause></subparagraph><subparagraph id="H51D5418F67ED4F22821B0B30FE155909"><enum>(B)</enum><header>Liquidity requirements</header><text display-inline="yes-display-inline">An eligible grantee may not require an eligible entity to have more than 10 percent of any amount to be loaned as a prerequiste for providing such loan.</text></subparagraph></paragraph></subsection><subsection id="HD9AF5C55C79B494D9CDC9E5D20307A9B"><enum>(d)</enum><header>Use of eligible amounts by eligible entities</header><text display-inline="yes-display-inline">An eligible entity may use amounts loaned by an eligible grantee for costs associated with the construction or rehabilitation of housing intended to be purchased and used as a primary residence, including materials, labor (including contractor fees), land development (including demolition and grading), permit and developer fees, on-site infrastructure costs (including the installation of roads, water, electrical, sewer, storm drainage, and sidewalks); and predevelopment (including architectural costs and engineering costs).</text></subsection><subsection id="HF161A65FA2414C73B99B52D2530410CC"><enum>(e)</enum><header>Affordability requirement</header><text display-inline="yes-display-inline">An eligible entity that uses amounts loaned under this section to construct or rehabilitate a property may only sell such property to a household who’s income is less than or equal to 120 percent of the area median income and shall ensure that if the property is subsequently sold during the 30-year period after the date on which the eligible entity sold the property that the property is only sold to households who’s income is less than or equal to 120 percent of the area median income. </text></subsection><subsection id="H02FAAEE0912346A8BFD3D7B287341244"><enum>(f)</enum><header>Rulemaking</header><text>The Secretary may issues rules to carry out this section.</text></subsection><subsection id="H21A5A8A3D5DE470FB0B4BE5B9A9D1F26"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary, $100,000,000 for fiscal year 2025 to carry out this section.</text></subsection><subsection id="HC0AD442E1BC34139B70AB9A1D144970C"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H2D55C7891FA1447093976F48CE330670"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means a State, a unit of local government, an instrumentality of a State or unit of local government, or a nonprofit organization, including a community land trust, that uses ground leases, deed restrictions, and other similar mechanisms when selling a property owned by the eligible entity to—</text><subparagraph id="HBB33A35CD91F422681368D13FE6002A4"><enum>(A)</enum><text>maintain the property as affordable for households who’s income does not exceed 120 percent of area median income; </text></subparagraph><subparagraph id="HB82B5A120626412B96DACA190BDDD7ED"><enum>(B)</enum><text display-inline="yes-display-inline">apply a resale formula that limits the buyers proceeds upon resale to allow for a fair and equitable return while ensuring the home is affordable for subsequent qualified homebuyers; and</text></subparagraph><subparagraph id="H7392E81C48314A8DB7187097B049B7F3"><enum>(C)</enum><text display-inline="yes-display-inline">provides the State, unit of local government, instrumentality of such State or unit of local government, or nonprofit organization a preemptive option to purchase the property from the buyer if the buyer chooses to sell the property in the future.</text></subparagraph></paragraph><paragraph id="H90189B58521B43BBAD2CD54FF683A505"><enum>(2)</enum><header>Eligible grantee</header><text display-inline="yes-display-inline">The term <quote>eligible grantee</quote> means—</text><subparagraph id="H51ED5C1A02BE463A9653BE1D9A53CA8D"><enum>(A)</enum><text>any agency of a State; or</text></subparagraph><subparagraph id="H2E51F253A5164E5D9D92F827CEE823E6"><enum>(B)</enum><text>any authority chartered by a State to help meet affordable housing needs of the residents of the State.</text></subparagraph></paragraph><paragraph id="H18747ED1F6FD4C3D8F3B67835EC796B5"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Treasury. </text></paragraph></subsection></section></legis-body></bill>
