which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Historic Greenwood District-Black Wall Street National Monument in the State of Oklahoma, and for other purposes.</official-title></form><legis-body id="HEAB1C21DE3D44854AF7A824AA1EB6EAD" style="OLC"><section section-type="section-one" id="H452907EA6C1F465F80AE29E59A9760C5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Historic Greenwood District—Black Wall Street National Monument Establishment Act</short-title></quote>.</text></section><section id="HB5E5B55AFD264C88A9E8C6D59F8BF3AE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC328EA92C4A544E780833E267258F14C"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Historic Greenwood District—Black Wall Street National Monument Advisory Commission established by section 5(a).</text></paragraph><paragraph id="H58068C5C05BF4769893927F7600123DC"><enum>(2)</enum><header>Descendant</header><text>The term <term>descendant</term> means an individual who can verify family lineage by blood, adoption, or marriage to a Black individual who lived in, worked in, or was present in the Greenwood District of Tulsa, Oklahoma, on May 31, 1921, or June 1, 1921, by—</text><subparagraph id="HA14EFD3D024C48468C608685121D81DD"><enum>(A)</enum><text>family records, including family Bibles, vital records, correspondence, memoirs, journals, diaries, unrecorded deeds, diplomas, certificates, or testimonials;</text></subparagraph><subparagraph id="H1D97BC9CAE2946DE89D069FC36F27030"><enum>(B)</enum><text>public records, including censuses, government records, military records, pensions, land bounty records, passport applications, passenger lists, original grants, naturalization or immigration records, records of entry, or State, province, or local records; or</text></subparagraph><subparagraph id="HFAF9A36CF5DB449F975AA7FDC6D84163"><enum>(C)</enum><text>institutional records, including church records, cemetery records and inscriptions, educational institutions, insurance records, or societies and fraternal organizations.</text></subparagraph></paragraph><paragraph id="H1FECC9767A3A4C8F9D8FB8795833E39F"><enum>(3)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Greenwood Historic District—Black Wall Street National Monument, Proposed Boundary</quote>, numbered 196/188,275, and dated July 2023.</text></paragraph><paragraph id="HE5B8C57404954F1DB847A0E8D984C2D4"><enum>(4)</enum><header>National monument</header><text>The term <term>National Monument</term> means the Historic Greenwood District—Black Wall Street National Monument established by section 3(a). </text></paragraph><paragraph id="H9249DDA41CB344628BCF8DE6FE7A7A64"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H3459088280C24DF0BB21AAA797D84C5A"><enum>3.</enum><header>Establishment of Historic Greenwood District—Black Wall Street National Monument</header><subsection commented="no" display-inline="no-display-inline" id="HF34F90B336D942B19D138B92D8488509"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established the Historic Greenwood District—Black Wall Street National Monument in the State of Oklahoma as a unit of the National Park System to preserve, protect, and interpret for the benefit of present and future generations resources associated with the Historic Greenwood District, Black Wall Street, and the Tulsa Race Massacre of 1921 and the role of each in the history of the State of Oklahoma and the United States.</text></subsection><subsection id="HE8819B3B1B3C40C1B8D924EDFB0A9D30"><enum>(b)</enum><header>Boundary</header><text>The boundary of the National Monument shall be as generally depicted on the Map.</text></subsection><subsection id="H234F5F5004F64C58927D9D229639EB53" commented="no"><enum>(c)</enum><header>Availability of map</header><text>The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service. </text></subsection><subsection id="HAF1258BA1CC24F4E848B05BC500993CB"><enum>(d)</enum><header>Acquisition authority</header><text>The Secretary may acquire any land or interest in land located within the boundary of the National Monument by—</text><paragraph id="H51B5A7A666B3481BBE1F5177891E6883"><enum>(1)</enum><text>donation;</text></paragraph><paragraph id="H306829F8C1C1475AA94FCFB0BF54FB77"><enum>(2)</enum><text>purchase from a willing seller with donated or appropriated funds; or</text></paragraph><paragraph id="H930754A569F94D139C406F1C8889FCDB"><enum>(3)</enum><text>exchange.</text></paragraph></subsection><subsection id="H17A3FB0B14DE4E84ACB1FAFD8CDEA9FA"><enum>(e)</enum><header>Agreements</header><text>The Secretary may enter into cooperative agreements, as appropriate, with public or private entities to provide and facilitate, within or outside the boundary of the National Monument, interpretive and educational services, administrative support, and technical assistance relating to the National Monument.</text></subsection><subsection id="H0D51E6F51EEE4F9EA141439D9510611C"><enum>(f)</enum><header>Private property protection</header><text>Nothing in this Act—</text><paragraph id="H5D0D338E40484F2793BA341473411726"><enum>(1)</enum><text>affects the land use rights of an owner of private property (including property of a house of worship and commercial property) within or adjacent to the National Monument; or</text></paragraph><paragraph id="H939E2CDDA0A04605AEA2F92BE7F4A8A5"><enum>(2)</enum><text>requires any change in or affects the construction of, interpretation of zoning laws applicable to, or appearance of any non-Federal property (including property of a house of worship and commercial property) within or adjacent to the National Monument.</text></paragraph></subsection></section><section id="HEFB913AD92024F7A836E515757619E84"><enum>4.</enum><header>Administration</header><subsection id="H4206F6CC9AF44A79A3EC1BE3321CBBF5"><enum>(a)</enum><header>Administration by Secretary</header><paragraph commented="no" display-inline="no-display-inline" id="HF035FA785CE342F2BAB740F520ECB4AA"><enum>(1)</enum><header>Applicable law</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary shall administer the National Monument in accordance with—</text><subparagraph id="H6CCEEFB6106F4DA79E0B6AFFEAEC0F02"><enum>(A)</enum><text>this Act; and</text></subparagraph><subparagraph id="HCC8BAF7CCE1A48AB8E2D012A383D4840"><enum>(B)</enum><text>in the case of land under the direct jurisdiction of the Secretary, the laws generally applicable to units of the National Park System.</text></subparagraph></paragraph><paragraph id="H9B55A8C196B844AC94D7AF74A878DD1B"><enum>(2)</enum><header>Effect on administration of Standpipe Hill</header><text>Nothing in this Act affects the authority of Oklahoma State University or the Board of Regents for the Oklahoma Agricultural and Mechanical Colleges to own, maintain, or administer Standpipe Hill.</text></paragraph></subsection><subsection id="HD0FA86947BB9425D899AE1FC5FD8E21D"><enum>(b)</enum><header>Management plan</header><paragraph id="H4E1E6C75958D4692AE080DF6E585B77D"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation and coordination with Oklahoma State University, shall prepare a management plan for the National Monument in accordance with section 100502 of title 54, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21EAD1E0F2C345B494D32A7BF008C907"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">In preparing and implementing the management plan for the National Monument, the Secretary shall ensure that the administration of the National Monument does not interfere with the continuing use and ownership of Standpipe Hill.</text></paragraph><paragraph id="H2400832754C44D8EBE32FFACF33CB686"><enum>(3)</enum><header>Consultation</header><text>The Secretary shall consult with the Commission, current and former residents of the Historic Greenwood District, and descendants on the preparation of the management plan under paragraph (1).</text></paragraph><paragraph id="H9AC6E01730BE467696C583108B4B93C1"><enum>(4)</enum><header>Submission to congress</header><text>Not later than 3 years after the date on which funds are made available to the Secretary for the preparation of the management plan under paragraph (1), the Secretary shall submit the management plan to—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB1676116EABF459DAAF2E8A7684727AF"><enum>(A)</enum><text> the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H982143F0D39B4AB1B0DEFA1E4B08DC5D"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph></subsection></section><section id="HC1349380AE4141FFAF1E46D737CE86D6"><enum>5.</enum><header>Establishment of historic greenwood district—black wall street national monument advisory commission</header><subsection id="HE4B3BC7550444236BBB6FF0CE137E4BB"><enum>(a)</enum><header>Establishment</header><text>There is established an advisory commission, to be known as the <quote>Historic Greenwood District—Black Wall Street National Monument Advisory Commission</quote>.</text></subsection><subsection id="HCB1789317E4249F98E85B806AD5E0FA8"><enum>(b)</enum><header>Duty</header><text>The Commission shall advise the Secretary on matters relating to the development and management of the National Monument, including the construction of visitor service facilities and infrastructure.</text></subsection><subsection id="H7542514950FE425EB2D945D91479AA55"><enum>(c)</enum><header>Membership</header><paragraph id="HF4FB48672C254F84854D613B6097AF0E"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 11 members, to be appointed by the Secretary, of whom—</text><subparagraph id="HE644402A453E470CB3FE4D23E9F37258"><enum>(A)</enum><text>7 members shall be descendants; </text></subparagraph><subparagraph id="HC73DCEEC7FEF4107A531D6A10624EC2D"><enum>(B)</enum><text>3 members shall have experience in the field of historic preservation or the purposes for which the National Monument was established; and</text></subparagraph><subparagraph id="H5B69ABB5A9A14FD3BD80C6CD19E8311B"><enum>(C)</enum><text>1 member shall be appointed after consideration of recommendations submitted by the Mayor of the city of Tulsa in the State of Oklahoma.</text></subparagraph></paragraph><paragraph id="HEA7C722483CF49A4A5DF9F212C7F88E6"><enum>(2)</enum><header>Terms</header><text>A member of the Commission shall be appointed for a term of 5 years.</text></paragraph><paragraph id="HCB78AE17380A4E81A6B9DF2E29AD9DEA"><enum>(3)</enum><header>Vacancies</header><text>Any vacancy on the Commission shall be filled in the same manner in which the original appointment was made.</text></paragraph><paragraph id="H2FB42D8AE9064BD1B73BD0C94D031A62"><enum>(4)</enum><header>Successors</header><text>Notwithstanding the expiration of a 5-year term of a member of the Commission, a member of the Commission may continue to serve on the Commission until the date on which—</text><subparagraph id="H4AD02CA9DB9E421298B6932716002EB1"><enum>(A)</enum><text>the member is reappointed by the Secretary; or</text></subparagraph><subparagraph id="HEA5AF19518BF4FFC9EF09613F323002D"><enum>(B)</enum><text>a successor is appointed by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="H0E495E2B3FAC44908BF76D33BAF20259"><enum>(d)</enum><header>Chair; bylaws</header><text>The Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="HB886339283F84138B3057282373BDFB5"><enum>(1)</enum><text display-inline="yes-display-inline">have a Chair, who shall be elected by the members of the Commission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD774F060B0C745099147627893DE1F64"><enum>(2)</enum><text display-inline="yes-display-inline">adopt such bylaws as the Commission considers necessary to carry out the functions of the Commission under this Act.</text></paragraph></subsection><subsection id="HA43A2E81537743AABBE51D1FF9B103F1"><enum>(e)</enum><header>Meetings</header><text>The Commission shall meet at the call of—</text><paragraph id="H29D097F3212744DD8699B73D732E24CC"><enum>(1)</enum><text>the Chair; or</text></paragraph><paragraph id="H0F23C876BE634CB6BE5B6CD80B36A829"><enum>(2)</enum><text>a majority of the members of the Commission.</text></paragraph></subsection><subsection id="H188E03A3A8E74B748AE7D819C753A4C0"><enum>(f)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum.</text></subsection><subsection id="H0B7A43B774F34D73AB5D42304A91E97C"><enum>(g)</enum><header>Compensation</header><paragraph id="H7BC758BC6CAD44329BCFCF0F6CD1E6C2"><enum>(1)</enum><header>In general</header><text>Members of the Commission shall serve without compensation.</text></paragraph><paragraph id="H6600AC536A684645B1BC18A9482367DC"><enum>(2)</enum><header>Travel expenses</header><text>Members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text></paragraph></subsection><subsection id="H6DD87EA43E17499F964C729A543DFC67"><enum>(h)</enum><header>FACA nonapplicability</header><text>Section 1013(b) of title 5, United States Code, shall not apply to the Commission. </text></subsection><subsection id="HC61F0E57D0BF433DB6B9E91FFDDCB1AF"><enum>(i)</enum><header>Termination</header><text>The Commission shall terminate 10 years after the date on which the National Monument is established. </text></subsection></section></legis-body></bill>
