which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require modernization of information technology systems and applications of the Bureau of Industry and Security.</official-title></form><legis-body id="H30DC3758B6C647A98404FD98231FE6A2" style="OLC"><section id="H0D69C796D54348C19833428294370EE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bureau of Industry and Security Information Technology Modernization Act</short-title></quote> or the <quote><short-title>BIS IT Modernization Act</short-title></quote>.</text></section><section id="H217BCBE7C3964B51B25C4C2FA86A74BD" section-type="subsequent-section"><enum>2.</enum><header>Modernization of information technology systems and applications of the Bureau of Industry and Security</header><subsection id="H6157D9043ED04D399317E39BA46A7D4D"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the effective use of export controls requires that—</text><paragraph id="H04374495B3FA4844BB869A6C527AA6B1"><enum>(1)</enum><text display-inline="yes-display-inline">the Bureau of Industry and Security of the Department of Commerce adopt and deploy cutting-edge data fusion, analytics, and decision-making capabilities, as well as supply chain illumination tools, and additional commercial data sets to streamline and standardize the export license adjudication process, better assess global industrial relationships, and identify evasive trade patterns and shell companies being used by adversary militaries;</text></paragraph><paragraph id="HA21D25EF156E4543B29E92D1E68859DD"><enum>(2)</enum><text>the Bureau expand and scale up the adoption and use of modern data sharing interfaces and capabilities to share data safely and efficiently with industry, Federal agencies, and international partners;</text></paragraph><paragraph id="H8052357196844AC7B00C0BBF5852E85E"><enum>(3)</enum><text>Bureau information technology systems should over time enable the incorporation of artificial intelligence, machine learning, and other advanced tools as technologies evolve;</text></paragraph><paragraph id="H54AB0AED79D14742BAD8A7C3CBA40C04"><enum>(4)</enum><text>the Bureau expedite Entity List deliberations tied to countries of concern and enforcement activities related to tracking military end users and end uses in countries of concern including the People’s Republic of China (PRC), Russia, and Iran;</text></paragraph><paragraph id="H0C2C050FE885496C949FB2FA76818549"><enum>(5)</enum><text>the Bureau work with relevant agencies to comprehensively map the PRC defense industrial base and its military civil fusion strategy; and</text></paragraph><paragraph id="H3368A7BFF5B24437983BBC9F794B60FE"><enum>(6)</enum><text>the Bureau work with relevant agencies to comprehensively map the commercial linkages between the industrial bases of the PRC and Russia.</text></paragraph></subsection><subsection id="H54E43FC3F5B04E598462BEBE17A182C8"><enum>(b)</enum><header>In general</header><text>Subject to the availability of appropriations, the Under Secretary of Commerce for Industry and Security shall, on an ongoing basis through fiscal year 2029, modernize the information technology systems of the Bureau of Industry and Security of the Department of Commerce.</text></subsection><subsection id="H6937B5202A944C31BD2D2C22F892C28A"><enum>(c)</enum><header>Elements</header><text>In carrying out subsection (b), the Under Secretary should—</text><paragraph id="H86CCA67F522A423C9DCB9AC253192F2D"><enum>(1)</enum><text>replace the Bureau’s primary information technology systems with a unified environment that—</text><subparagraph id="H4BF4EC912A8344D89345C393E686D54C"><enum>(A)</enum><text>allows for deployment of a seamless case and customer relationship management information technology solution; and</text></subparagraph><subparagraph id="H86D8F818B3F844B4BB4D126B8A058222"><enum>(B)</enum><text>provides analysis of data obtained from external data providers that is collected by trade transactions and other sources as appropriate;</text></subparagraph></paragraph><paragraph id="HE5E01E1DCF214C079D92833ECFA7F057"><enum>(2)</enum><text>adopt and deploy cutting-edge data fusion, analytics, and decision-making capabilities, as well as supply chain illumination tools, and additional commercial data sets to streamline and standardize the export license adjudication process, better assess global industrial relationships, enhance Entity List deliberations, support enforcement activities, including by tracking military end users and end uses, and identify evasive trade patterns and shell companies; and</text></paragraph><paragraph id="HD03389C3FD46499DA3FF6BF5ED114125"><enum>(3)</enum><text>expand and scale up the adoption and use of modern data sharing interfaces and capabilities to share data safely and efficiently with industry, Federal agencies, and international partners.</text></paragraph></subsection><subsection id="HD4A3AD19AE89413580E8757A0A424AC8"><enum>(d)</enum><header>Objectives</header><text>Before any technology solutions are adopted with respect to the elements in subsection (c), such solutions should be analyzed based on their ability to—</text><paragraph id="H2F2C478C1F034360B309C9631273B8F9"><enum>(1)</enum><text>enhance productivity and efficiency, including by reducing the need for manual review and processing of data;</text></paragraph><paragraph id="H8898A3C97D374B24A81F959AD05BD6B7"><enum>(2)</enum><text>reduce redundancies and manage costs;</text></paragraph><paragraph id="HC44BF74C46F041D3AA9FE160B62E3142"><enum>(3)</enum><text>enhance the overall data and cyber security of Bureau systems;</text></paragraph><paragraph id="H5BD0F861D4BE4C329EAC5FE6223FD183"><enum>(4)</enum><text>facilitate seamless and safe sharing of appropriate data with relevant stakeholders and partners;</text></paragraph><paragraph id="H9197EE6BFBB84CADB65737EA3AAF08CE"><enum>(5)</enum><text>facilitate seamless data sharing with relevant agencies and the intelligence community; and</text></paragraph><paragraph id="HE519180207E74702B863D077C57649F7"><enum>(6)</enum><text>enhance the ease of access and user experience for United States exporters that are utilizing Bureau systems.</text></paragraph></subsection><subsection id="HD738AB57BE45462FA3600E6AD961206B"><enum>(e)</enum><header>Personnel assessment</header><text>The Under Secretary should—</text><paragraph id="H780946E9B85F4D91BCCE5AE76C0FA071"><enum>(1)</enum><text>reassess staffing and personnel needs across the Bureau throughout the modernization process described in this Act; and</text></paragraph><paragraph id="H5DDDA8AA5E0045F094E908CEEF23E535"><enum>(2)</enum><text>consult with Congress on whether additional or less personnel may be most effective for utilizing modern applications and systems.</text></paragraph></subsection><subsection id="H2464EA08E7BB4CFEAACADF321E4DAC53"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $25,000,000 for each of the fiscal years 2025 through 2028 to carry out this Act.</text></subsection></section></legis-body></bill>
