which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal employees and contractors from directing online platforms to censor any speech that is protected by the First Amendment to the Constitution of the United States, and for other purposes.</official-title></form><legis-body id="H817ADAB945904606B57262CAE63B029B" style="OLC"><section section-type="section-one" id="H1D323F05E6D6404BBAEC1B1BD91A4AEB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Standing to Challenge Government Censorship Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H3CE8DA228EF9491C95D77CD43FC963FC"><enum>2.</enum><header display-inline="yes-display-inline">Employee prohibitions</header><subsection commented="no" display-inline="no-display-inline" id="H19596CE3808D4343A3F006BC9D149BE0"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="H19B84C29DA9849E3AA8E377B701EAFB5"><enum>(1)</enum><header>Covered information</header><text display-inline="yes-display-inline">The term <term>covered information</term> means information relating to—</text><subparagraph id="HC89AD30EB46E4106950E3C85EA8045EF"><enum>(A)</enum><text>a phone call;</text></subparagraph><subparagraph id="H8E232B7D13EA4DEEA5032FFB8F137713"><enum>(B)</enum><text>any type of digital communication, including a post on a covered platform, an e-mail, a text, and a direct message;</text></subparagraph><subparagraph id="HB395A152EFA6402790C3DB01A78D7877"><enum>(C)</enum><text>a photo;</text></subparagraph><subparagraph id="H407342A8065C474F950291DDA22EAB57"><enum>(D)</enum><text>shopping and commerce history;</text></subparagraph><subparagraph id="H96B94318442E43B8B145E03227D9CB89"><enum>(E)</enum><text>location data, including a driving route and ride hailing information;</text></subparagraph><subparagraph id="H3D9F108CE01B4B04BDCA657B2B518A5F"><enum>(F)</enum><text>an IP address;</text></subparagraph><subparagraph id="HF60A97465F19411CA6F96AB1060800A1"><enum>(G)</enum><text>metadata;</text></subparagraph><subparagraph id="H9FBB84214A2A406AACED65DC97F43FAD"><enum>(H)</enum><text>search history; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB6EB9B7C0D594EC9B78B92FDFA690E89"><enum>(I)</enum><text display-inline="yes-display-inline">the name, age, or demographic information of a user of a covered platform; and</text></subparagraph><subparagraph id="HAFF639C755B745A99D9419AC95F99E46"><enum>(J)</enum><text>a calendar item. </text></subparagraph></paragraph><paragraph id="H853EB3A40BBF4280B34D676B963EABA1"><enum>(2)</enum><header>Covered platform</header><text>The term <term>covered platform</term> means—</text><subparagraph id="HC403D28C5C9F4C1D869D081163FD92FB"><enum>(A)</enum><text>an interactive computer service, as that term is defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>); and</text></subparagraph><subparagraph id="HEC640F9011B94A488F5925B16D3652B1"><enum>(B)</enum><text>any platform through which a media organization disseminates information, without regard to whether the organization disseminates that information—</text><clause id="H36884258846D4BAA97D49F0F9DBE5042"><enum>(i)</enum><text>through broadcast or print;</text></clause><clause id="H8A5F4C8988444C8D885525BD91A7CE5A"><enum>(ii)</enum><text>online; or</text></clause><clause id="HD3E39402E85D4916A7B67FAC0A029286"><enum>(iii)</enum><text>through any other channel.</text></clause></subparagraph></paragraph><paragraph id="H42231DD075C6459389E7B587DB02AA4F"><enum>(3)</enum><header>Employee</header><subparagraph commented="no" display-inline="no-display-inline" id="H54A33EB5D38A45DDBE9DC2D0F1FB958B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>employee</term>— </text><clause commented="no" display-inline="no-display-inline" id="HFDA77217A6B343F28A2C58DBE2A637E3"><enum>(i)</enum><text display-inline="yes-display-inline">means an employee of an Executive agency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H123ED2D9DDD24414BDBA00BEEB4B2FE7"><enum>(ii)</enum><text>includes— </text><subclause commented="no" display-inline="no-display-inline" id="H966215BC37ED4A4EBE6C155297B3ADD8"><enum>(I)</enum><text display-inline="yes-display-inline">an individual, other than an employee of an Executive agency, working under a contract with an Executive agency; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HCDC5C65951674B9BAE9098ABF9591972"><enum>(II)</enum><text display-inline="yes-display-inline">the President and the Vice President.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F7E7441C7234BC2BCA76AC5A04D2769"><enum>(B)</enum><header>Rule of construction</header><text>With respect to an individual described in subparagraph (A)(ii)(I), solely for the purposes of this Act, the Executive agency that has entered into the contract under which the employee is working shall be construed to be the Executive agency employing the employee. </text></subparagraph></paragraph><paragraph id="H1988562952574FC4B759DE20082EE621"><enum>(4)</enum><header>Executive agency</header><text>The term <term>Executive agency</term>— </text><subparagraph commented="no" display-inline="no-display-inline" id="H5DAF1C0031B64E569657AE7EE7749E5B"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H007B93732F37413BBE020D4C773D2E06"><enum>(B)</enum><text>includes the Executive Office of the President.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H10F2A97554A944BC983B1D41DA5BA3A2"><enum>(5)</enum><header>Provider</header><text>The term <term>provider</term> means a provider of a covered platform. </text></paragraph></subsection><subsection id="H7F096C0CFCCC41EFAA8ADC81448A2EDD"><enum>(b)</enum><header>Prohibitions</header><paragraph id="H3022FD2BDC914FC896A22E1FBF6B1E7C"><enum>(1)</enum><header>In general</header><text>An employee acting under official authority or influence may not—</text><subparagraph id="HB76F4037517346D98CA72FAD5DDCE012"><enum>(A)</enum><text>use any form of communication (without regard to whether the communication is visible to members of the public) to direct, coerce, compel, or encourage a provider to take, suggest or imply that a provider should take, or request that a provider take any action to censor speech that is protected by the Constitution of the United States, including by—</text><clause id="HF2A4A4893E05453CB156FA0793F67A73"><enum>(i)</enum><text>removing that speech from the applicable covered platform;</text></clause><clause id="H852A436C471E48F2AB13064AEA64A2FF"><enum>(ii)</enum><text>suppressing that speech on the applicable covered platform;</text></clause><clause id="H5A8E3416CD094A95990664DFA27075F9"><enum>(iii)</enum><text>removing or suspending a particular user (or a class of users) from the applicable covered platform or otherwise limiting the access of a particular user (or a class of users) to the covered platform;</text></clause><clause id="HA943F5BD07E240FDBB4D84CDC415CEF7"><enum>(iv)</enum><text>labeling that speech as disinformation, misinformation, or false, or by making any similar characterization with respect to the speech; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H1C45881774A949299033655A4FA5F6C5"><enum>(v)</enum><text>otherwise blocking, banning, deleting, deprioritizing, demonetizing, deboosting, limiting the reach of, or restricting access to the speech;</text></clause></subparagraph><subparagraph id="HDF6FA55AC4D94965AB6BD2233D73AD6E"><enum>(B)</enum><text>direct or encourage a provider to share with an Executive agency covered information containing data or information regarding a particular topic, or a user or group of users on the applicable covered platform, including any covered information shared or stored by users on the covered platform;</text></subparagraph><subparagraph id="H541D03AED1DA482093435CE91150E7E6"><enum>(C)</enum><text>work, directly or indirectly, with any private or public entity or person to take an action that is prohibited under subparagraph (A) or (B); or</text></subparagraph><subparagraph id="H45C564FE58F94AA79DA62D210431A8EC"><enum>(D)</enum><text>on behalf of the Executive agency employing the employee— </text><clause id="H00D9AA72D6264777BA9D1A732066B00C"><enum>(i)</enum><text>enter into a partnership with a provider to monitor any content disseminated on the applicable covered platform; or</text></clause><clause id="HCAF1E62ABF124C5EB3CF058048D77FBE"><enum>(ii)</enum><text>solicit, accept, or enter into a contract or other agreement (including a no-cost agreement) for free advertising or another promotion on a covered platform.</text></clause></subparagraph></paragraph><paragraph id="H074F1B8C5B0B436C97CB0453AA6DD11E"><enum>(2)</enum><header>Exception</header><text>Notwithstanding subparagraph (B) of paragraph (1), the prohibition under that subparagraph shall not apply with respect to an action by an Executive agency or employee pursuant to a warrant that is issued by any court of competent jurisdiction, including a court of the United States of competent jurisdiction in accordance with the procedures described in rule 41 of the Federal Rules of Criminal Procedure.</text></paragraph></subsection><subsection id="H34DA68D8E87E422F84086852968ECA20"><enum>(c)</enum><header>Private right of action</header><paragraph id="HF97A4B056B9245089EF0D101D212E996"><enum>(1)</enum><header>In general</header><text>A person, the account, content, speech, or other information of which has been affected in violation of this section, may bring a civil action in an appropriate district court of the United States (and a State government, the government of the District of Columbia, or the government of a territory of the United States may bring a civil action in an appropriate district court of the United States on behalf of such a person, if that person is subject to the jurisdiction of the applicable government) for reasonable attorneys’ fees, injunctive relief, and actual damages against—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2EAFEC7150BD42E8BEC670EEB4267DF5"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable Executive agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H26C6B96336B043BABF3D28F8FFA4A93F"><enum>(B)</enum><text display-inline="yes-display-inline">the employee of the applicable Executive agency who committed the violation.</text></subparagraph></paragraph><paragraph id="HA0953BF1EBBF4A699EE8E7363FBED683"><enum>(2)</enum><header>Presumption of liability</header><text>In a civil action brought under paragraph (1), there shall be a rebuttable presumption against the applicable Executive agency or employee if the person bringing the action, or the government bringing the action on behalf of a person, demonstrates that the applicable employee communicated with a provider on a matter relating to— </text><subparagraph id="H8147942CC4414AF3B9F9D79E270E4FBF"><enum>(A)</enum><text>covered information with respect to that person; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8596C654B8D4B5B8E2DC38B7D94CDB8"><enum>(B)</enum><text>a statement made by that person on the applicable covered platform. </text></subparagraph></paragraph><paragraph id="H4623499FECDA4E49B1E635B8C1046837"><enum>(3)</enum><header>Applicability</header><text>A person or government described in paragraph (1) may bring a civil action under this subsection with respect to any violation of this section committed before, on, or after the date of enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
