which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to define intimate partner to include someone with whom there is or was a dating relationship, and for other purposes.</official-title></form><legis-body id="HD7A8811FC0C7471F8077FA1255F3633C" style="OLC"><section section-type="section-one" id="H93FD943DD9B546E4A88EC198F220B5DC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Protections for Domestic Violence and Stalking Survivors Act of 2023</short-title></quote>.</text></section><section id="H497A2192436E4A008686ECFED9052E7B"><enum>2.</enum><header>Addressing intimate partner violence</header><subsection id="H05C46DD72CFD4393820910D9DBC262F9"><enum>(a)</enum><header>Inclusion of current and former dating partners in definition of <quote>intimate partner</quote></header><text>Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="H0E179BBC17D64D4EBDE51EAD4CA7B58D"><enum>(1)</enum><text>in paragraph (32)—</text><subparagraph id="H939442806B2743F5BDACDDC5A9B1E0C1"><enum>(A)</enum><text>by striking <quote>and an individual</quote> and inserting <quote>an individual</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94FA950A182E49D6B0AA611E761BE862"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before the period at the end the following: <quote>, an individual who is or was in a dating relationship with the person, or any other individual similarly situated to a spouse, including a person who is protected by the domestic or family violence laws of the State or Tribal jurisdiction in which the abuse occurred or the victim resides</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF338B93B2BB84E5BB2EB4F4164DC0698"><enum>(2)</enum><text>by striking paragraph (37)(A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3D12CDCCA5334B779FB2ABC17A4C8312"><paragraph id="H40775FB08C1D4D7497C2BE7C44BC9B01"><enum>(37)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H120C4691C54A4961AAC41B890E05E914"><enum>(A)</enum><text>The term <term>dating relationship</term> means a relationship between individuals who have or have had, or in the case of a misdemeanor crime of domestic violence have or have recently had, a continuing serious relationship of a romantic or intimate nature.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H3CE25584C59A486E9DF3D8F476DD685B"><enum>(3)</enum><text>in paragraph (37)(C), by striking <quote>dating</quote> and inserting <quote>continuing serious</quote>. </text></paragraph></subsection><subsection id="H79E45D53A7874EAA8747A1B481848631"><enum>(b)</enum><header>New prohibitor for misdemeanor crimes of stalking</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HB114680B0F58448193933F2430B87912"><enum>(1)</enum><text>in section 921(a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H89ADD437CF6A4F4AA50F8F9E51629614"><paragraph id="HBD73E03A443C4388965B5F4C08A57ABA" indent="up1"><enum>(38)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4B1415306AF241C59DFE3C04C67E087F"><enum>(A)</enum><text>Except as provided in subparagraphs (B) and (C), the term <term>misdemeanor crime of stalking</term> means an offense that—</text><clause id="H2703AED0EECC412E9CD7C9FF98F51F20" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">is a misdemeanor under Federal, State, Tribal, or local law; and</text></clause><clause id="H86FEB01CEE9B4EA390A8C1FD9A031052" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">has as an element a course of harassment, intimidation, or surveillance that—</text><subclause id="HA43AF1A0621B4ECAA2ED40D4D979DC53"><enum>(I)</enum><text display-inline="yes-display-inline">places a person in reasonable fear of actual harm to the health or safety of—</text><item id="H5F1859BFF20F4871B6084610590FCCF1"><enum>(aa)</enum><text>that person;</text></item><item id="HB3C797B570B7461AABF25E9626748369"><enum>(bb)</enum><text display-inline="yes-display-inline">an immediate family member (as defined in section 115) of that person;</text></item><item id="HA90BB6CB73BB4939A5511F755E062307"><enum>(cc)</enum><text display-inline="yes-display-inline">an individual who shares or has shared a residence with that person, without regard to whether the individual is related to that person;</text></item><item id="HFBFAB7B798FE4C0FBCFF01698B3AC11C"><enum>(dd)</enum><text display-inline="yes-display-inline">an intimate partner of that person; or</text></item><item id="H472C78722916429AA2566A914805818F"><enum>(ee)</enum><text display-inline="yes-display-inline">the pet, service animal, or emotional support animal (as those terms are defined in section 2266) of that person; or</text></item></subclause><subclause id="H680DBAA87C314354B96F231341C462A3"><enum>(II)</enum><text display-inline="yes-display-inline">causes, attempts to cause, or would reasonably be expected to cause emotional distress to a person described in item (aa), (bb), (cc), or (dd) of subclause (I).</text></subclause></clause></subparagraph><subparagraph id="HE34647C22AC543A0A9833327234FB1C5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of such an offense for purposes of this chapter, unless—</text><clause id="H37EBE2A91AAE4828B48CC535DFEA7361"><enum>(i)</enum><text display-inline="yes-display-inline">the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and</text></clause><clause id="H885D4FB18B404F61841C8CCC01AB6831"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a prosecution for an offense described in this paragraph for which a person was entitled to a jury trial in the jurisdiction in which the case was tried, either—</text><subclause id="HA73B84A2EEB94CE8A28A2F24AC5E31AA"><enum>(I)</enum><text display-inline="yes-display-inline">the case was tried by a jury; or</text></subclause><subclause id="HAAF7DF8D273E4EB8BCFCBB0DC98E219A"><enum>(II)</enum><text display-inline="yes-display-inline">the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise.</text></subclause></clause></subparagraph><subparagraph id="H59DFEEB5B8524DF7802F5B489EC0E4E5" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H58DF341A56F5464EA275F037AA01C468"><enum>(2)</enum><text>in section 922—</text><subparagraph id="H96C52157E0BF403C90AD13004330B185"><enum>(A)</enum><text>in subsection (d)—</text><clause id="H9C90E5C2CF044502BC59222E5D459DBD"><enum>(i)</enum><text>by redesignating paragraphs (10) and (11) as paragraphs (11) and (12), respectively;</text></clause><clause id="H0E9BC4AA80B74E97AF5F9B3ADE870526"><enum>(ii)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEEA8CD7F90A84993869C2EDCA59F46C2"><paragraph id="HDFE1F7AB4BC64EC88E50462B86C808EE"><enum>(10)</enum><text>has been convicted in any court of a misdemeanor crime of stalking;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HBE113954E88E46208F9CFE45C21359C5"><enum>(iii)</enum><text>in paragraph (12), as so redesignated, by striking <quote>(10)</quote> and inserting <quote>(11)</quote>; and</text></clause></subparagraph><subparagraph id="H94F2BAA93DEA4360BD98D2A21D6CF71D"><enum>(B)</enum><text>in subsection (g)—</text><clause id="H97C973E95CA34A18942A2AAD540442D4"><enum>(i)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></clause><clause id="H8A3753CE175847ED949D18EEA145CCC5"><enum>(ii)</enum><text>in paragraph (9), by striking the comma at the end and inserting <quote>; or</quote>; and</text></clause><clause id="H1357A4E429284493BC8051F484BAD253"><enum>(iii)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC49D41EC08464E828DD3327EC9A31F43"><paragraph id="H4F7995FD834F4DC28C1066100A7FA78A"><enum>(10)</enum><text>has been convicted in any court of a misdemeanor crime of stalking,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
