which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to modify provisions relating to kidnapping, sexual abuse, and illicit sexual conduct with respect to minors.</official-title></form><legis-body id="H4B86463DDD454B42A373B34CA90C5E29" style="OLC"><section id="HDC72B74EEDA34B218DEDEEE8DEDF220F" section-type="section-one"><enum>1.</enum><header>Kidnapping; sexual abuse; illicit sexual conduct with respect to minors</header><subsection commented="no" display-inline="no-display-inline" id="H8C3F082C994940BFA11D47696E528ECE"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part I of title 18, United States Code, is amended—</text><paragraph id="HFDF7399FF7AE4E12AC3FFAF3C8A594DD"><enum>(1)</enum><text>in section 1201—</text><subparagraph commented="no" display-inline="no-display-inline" id="H757FD52BE0594B219324049A777106BA"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1), by inserting <quote>obtains by defrauding or deceiving any person,</quote> after <quote>abducts,</quote>; </text></subparagraph><subparagraph id="HC4BE504654DC4332A40481B0FED5CB31"><enum>(B)</enum><text>in subsection (b), by inserting <quote>obtained by defrauding or deceiving any person,</quote> after <quote>abducted,</quote>; and </text></subparagraph><subparagraph id="H0C9F7C859765405E856247ACD4258C0E"><enum>(C)</enum><text>in subsection (g), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC1D90989330241DB9F7398B08C6DA17D"><paragraph id="H4C6B6B0356894DAEBFF12995B5872177"><enum>(2)</enum><header>Defense</header><text>For an offense described in this subsection involving a victim who has not attained the age of 16 years, it is not a defense that the victim consented to the conduct of the offender, unless the offender can establish by a preponderance of the evidence that the offender reasonably believed that the victim had attained the age of 16 years.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H881DE533D3384CB0A23B6CA6D25FBC03"><enum>(2)</enum><text>in chapter 109A—</text><subparagraph id="H12F2B45F948443EC8B7712186BBD4F3A"><enum>(A)</enum><text>in section 2241(c), by striking <quote>crosses a State line</quote> and inserting <quote>travels in interstate or foreign commerce</quote>;</text></subparagraph><subparagraph id="H13BAD6803AEA41B1A8692D471589A490"><enum>(B)</enum><text>in section 2242(3), by striking <quote>, to include doing so</quote> and inserting <quote>or</quote>;</text></subparagraph><subparagraph id="H80E0C4F1329D483EAB0F0707BC25B1E7"><enum>(C)</enum><text>in section 2243, by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1C39059B28DC443DA712C716DEF363EA"><subsection id="HDD254979BF33417B9C08C1F48FCC561B"><enum>(f)</enum><header>Intentional touching involving individuals under the age of 16</header><paragraph commented="no" display-inline="no-display-inline" id="HB2F7D5253C01441F83038A5563514FC8"><enum>(1)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline">It shall be unlawful, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, to knowingly cause the intentional touching, not through the clothing, of the genitalia of any person by a person who has not attained the age of 16 years, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person, or attempt to do so, if to do so would violate subsection (a), (b), or (c) of this section, section 2241, or section 2242 had such intentional touching been a sexual act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9FB5D88A1634334956CC55791DFE281"><enum>(2)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who violates paragraph (1) shall be fined under this title, imprisoned as provided in the applicable provision of law described in that paragraph, or both.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6C599A4E658E4888A9E024CE3CC494E7"><enum>(D)</enum><text>in section 2244—</text><clause id="HFD2827ECD5D649688D0D15DEA4349C4B"><enum>(i)</enum><text>in subsection (a)—</text><subclause id="HFDC6330F38D448AEB804A5F91CC46D95"><enum>(I)</enum><text>by redesignating paragraphs (1) through (6) as subparagraphs (A) through (F), respectively, and adjusting the margins accordingly;</text></subclause><subclause id="HDC93C41411FA401CAD42F21601DD5D29"><enum>(II)</enum><text>by striking <quote>Whoever</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE75D86ACEADC4C1FAB8B341D5625A3EB"><paragraph id="H2485D358AF054CD28873C4241CF7D6C6"><enum>(1)</enum><header>In general</header><text>Whoever</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="H75192F7DF7D84D5280644BC215C35A5C"><enum>(III)</enum><text>in paragraph (1), as so designated—</text><item id="HC595D0B644A54D03AFC3D75C298D45DF"><enum>(aa)</enum><text>in the matter preceding subparagraph (A), as so redesignated, by striking <quote>if so to do</quote> and inserting <quote>if to do so</quote>;</text></item><item id="H94B6AFC3FCED45A28840659B00AEE70A"><enum>(bb)</enum><text>in subparagraph (A), as so redesignated, by striking <quote>ten</quote> and inserting <quote>10</quote>;</text></item><item id="HB2B3E08BEC394470978D35866AA83173"><enum>(cc)</enum><text>in subparagraph (B), as so redesignated, by striking <quote>three</quote> and inserting <quote>3</quote>;</text></item><item id="H8556F6F7756F4AF2921B89F7E22B77B7"><enum>(dd)</enum><text>in subparagraph (C), as so redesignated, by striking <quote>two</quote> and inserting <quote>2</quote>;</text></item><item id="H88CDAE6E0AF74D8AA5B95395104C042E"><enum>(ee)</enum><text>in subparagraph (D), as so redesignated, by striking <quote>two</quote> and inserting <quote>2</quote>; and</text></item><item id="H31D4CC8872BC457196CAA9CC14E33B29"><enum>(ff)</enum><text>in subparagraph (F), as so redesignated, by striking the semicolon at the end and inserting a period; and</text></item></subclause><subclause id="H6243217809DE4E6DBBA5067F6F5992B4"><enum>(IV)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H29DA6B44C8A247499C45E669B60CDB1E"><paragraph id="H29F31FCF71B34361ADDE0F5301FF2F0E"><enum>(2)</enum><header>Attempt</header><text>Whoever attempts to commit an offense under paragraph (1) shall be subject to the same penalty as for a completed offense.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="H318782EFF9DE4933B52A38C9DF0C02A3"><enum>(ii)</enum><text>in subsection (b)—</text><subclause id="H870DC3A661F74EB5B27533F0733AD574"><enum>(I)</enum><text>by inserting <quote>or causes</quote> after <quote>engages in</quote>;</text></subclause><subclause id="H1F6341D7DD8B4883A649FC5FF1ABD4DE"><enum>(II)</enum><text>by inserting <quote>or by</quote> after <quote>sexual contact with</quote>;</text></subclause><subclause id="H1FB1702E5C744DB7B90C3DEC769B5D36"><enum>(III)</enum><text>by inserting <quote>, or attempts to do so,</quote> after <quote>other person’s permission</quote>; and</text></subclause><subclause id="HA4DDC21FE12F40A1B5A936B0C76EC960"><enum>(IV)</enum><text>by striking <quote>two</quote> and inserting <quote>2</quote>; and</text></subclause></clause><clause id="H36D00156A4524726AC3D1ECD739D4F95" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>in subsection (c), by striking <quote>If the sexual contact that violates this section (other than subsection (a)(5)) is with an individual</quote> and inserting <quote>If the sexual contact or attempted sexual contact that a person engages in or causes in violation of this section (other than subsection (a)(1)(E)) is with or by an individual</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H1B1BEFB5BD73455684A5C131FB238D2F"><enum>(3)</enum><text>in section 2423(f)(1)—</text><subparagraph id="HAC887519017A4684B275242F7B72B69B"><enum>(A)</enum><text>by striking <quote>a sexual act (as defined in section 2246) with</quote> and inserting <quote>any conduct involving</quote>; and</text></subparagraph><subparagraph id="H534431078A514458888667DE36FEA089"><enum>(B)</enum><text>by striking <quote>sexual act occurred</quote> and inserting <quote>conduct occurred</quote>.</text></subparagraph></paragraph></subsection><subsection id="HF45C6D1516CD45BEB7D98FDE33D4A2B8"><enum>(b)</enum><header>Effective date</header><text>The amendment to section 2241(c) of title 18, United States Code, made by subsection (a) shall apply to conduct that occurred before, on, or after the date of enactment of this Act.</text></subsection></section><section id="HFD23A9B6E07949478651AE8CE93174B1"><enum>2.</enum><header>Conforming amendments relating to abusive sexual contact</header><subsection commented="no" display-inline="no-display-inline" id="H35D2AEDF10CE4274916C1512D81DDBEB"><enum>(a)</enum><header display-inline="yes-display-inline">Penalties for civil rights offenses involving sexual misconduct</header><text display-inline="yes-display-inline">Section 250(b) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H8F24DDCDF1EB4F189975E71C6A3B1948"><enum>(1)</enum><text>in paragraph (2), by striking <quote>section 2244(a)(5),</quote> and inserting <quote>section 2244(a)(1)(E), or an attempt to engage in or cause such contact as prohibited by section 2244(a)(2),</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H52315B17ACE543B78DEACF8525BED13C"><enum>(2)</enum><text>in paragraph (4), in the matter preceding subparagraph (A), by striking <quote>subsection (a)(1) or (b) of section 2244, but excluding abusive sexual contact through the clothing</quote> and inserting <quote>section 2244(a)(1)(A), an attempt to engage in or cause such contact as prohibited by section 2244(a)(2), or abusive sexual contact of the type prohibited by section 2244(b), but excluding abusive sexual contact through the clothing or an attempt to engage in or cause such contact</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32485BC0F84F4C2CB2D17A9B3F86A529"><enum>(3)</enum><text>in paragraph (5), in the matter preceding subparagraph (A), by striking <quote>section 2244(a)(2)</quote> and inserting <quote>section 2244(a)(1)(B) or an attempt to engage in or cause such contact as prohibited by section 2244(a)(2)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB45F51112B5345D292122703359E3925"><enum>(4)</enum><text>in paragraph (6), in the matter preceding subparagraph (A), by striking <quote>subsection (a)(3), (a)(4), or (b) of section 2244</quote> and inserting <quote>subparagraph (C) or (D) of section 2244(a)(1), an attempt to engage in or cause such contact as prohibited by section 2244(a)(2), or abusive sexual contact of the type prohibited by section 2244(b)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8971FE6A210444D4BF3369E510AF4E9C"><enum>(b)</enum><header>Sentencing classification of offenses</header><text>Section 3559 of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H09A48E1AC8D44EB79F942BF5E540CD1B"><enum>(1)</enum><text>in subsection (c)(2)(F)(i), by striking <quote>sections 2244(a)(1) and (a)(2)</quote> and inserting <quote>subparagraphs (A) and (B) of section 2244(a)(1)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02931D9414AF4E8EAAAF9E7FEB939108"><enum>(2)</enum><text>in subsection (e)(2)(A), by striking <quote>2244(a)(1)</quote> and inserting <quote>2244(a)(1)(A)</quote>.</text></paragraph></subsection></section></legis-body></bill>
