which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide coverage and payment under such title for certain treatments for dialysis-related amyloidosis, and for other purposes.</official-title></form><legis-body id="H22E5874329D84E94B7149A3239710132" style="OLC"><section id="H0B482B05CD7742FCBFD141008602A89E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dialysis-Related Amyloidosis Treatment Act of 2024</short-title></quote>.</text></section><section id="H4415A0C043454FA184E7F070C70867DF"><enum>2.</enum><header>Coverage and payment for treatments for dialysis-related amyloidosis under the Medicare program</header><subsection id="H0965474EEF5241C9A153B9E91A71ED7E"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>), is amended—</text><paragraph id="HF8027496700A4AAFBADF1EFCA647DCE7"><enum>(1)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> at the end; and</text></paragraph><paragraph id="H54004A397915450E8AF1B8B28817FCBB"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HDB4E2621E1024B6187F2F3A04389F0BE" display-inline="no-display-inline"><subparagraph id="H042909079B564ED29869CC9E8CA2C826" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">treatments for dialysis-related amyloidosis (as defined in subsection (nnn));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H13190EA39B9D47DDBAB4E7E1E2B02C46"><enum>(b)</enum><header>Treatments for dialysis-Related amyloidosis defined</header><paragraph id="H4C5AA31EAB6346DFAFC18568552F5DEA"><enum>(1)</enum><header>In general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>), is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H85808443A06247AF9C3788617E0AD5F6" display-inline="no-display-inline"><subsection id="H030BBAE2071C441BA8B256B6DE2C0C37"><enum>(nnn)</enum><header>Treatments for dialysis-Related amyloidosis</header><text display-inline="yes-display-inline">The term <term>treatments for dialysis-related amyloidosis</term> means any item or service that is furnished in a dialysis facility (freestanding or hospital-based) that is approved by the Food and Drug Administration for the treatment of dialysis-related amyloidosis, and any supplies or services that are provided adjunct to and are necessary for such treatment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H245E384C239148FFA61CD409E3804F4E"><enum>(2)</enum><header>Exclusion from renal dialysis services</header><text>Section 1881(b)(14)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395rr">42 U.S.C. 1395rr(b)(14)(B)</external-xref>) is amended by inserting before the period at the end the following: <quote>or <quote>treatments for dialysis-related amyloidosis</quote> (as defined in section 1861(nnn))</quote>.</text></paragraph></subsection><subsection id="H51A94517A26448C9AC0CE539451B86D8"><enum>(c)</enum><header>Payment</header><text display-inline="yes-display-inline">Section 1833(a)(1)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(E)</external-xref>) is amended by inserting at the end the following: <quote>except for treatments for dialysis-related amyloidosis, which may not be included as a renal dialysis service for purposes of payment under any prospective payment amount or comprehensive fee established under section 1881, and for which payment shall be made separately in the amount of 100 percent of the reasonable charges for such items and services,</quote>.</text></subsection><subsection id="H8A105A13E349487787164E101614E63F"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
