from the retirement earnings test, and for other purposes.</official-title></form><legis-body id="H85C5E4717BD748A685F6C437EFFF9851" style="OLC"><section id="H4915E9DDC03142B6ADDA68300DD8DD91" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Worker and First Responder Fairness Act</short-title></quote>.</text></section><section id="HE3FCCB0C80D1404EB6C6DC6217F2EDF2"><enum>2.</enum><header>Exemption of certain earnings from retirement earnings test</header><subsection id="H0211C85041DC4CD9B3FEACC1A682363B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subsection (b) of section 203 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/403">42 U.S.C. 403(b)</external-xref>), wages paid during the period beginning on January 31, 2020, and ending on May 11, 2023, to an individual who attests to and provides evidence of being employed as a health care professional or first responder during such period shall not be included in the determination of the individual’s excess earnings under subsection (f)(3) of such section for any taxable year.</text></subsection><subsection id="H0F9F76FD4AD649199DDC3CB9C135E6CF"><enum>(b)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Commissioner of Social Security shall issue guidance providing for appropriate procedures for the implementation of subsection (a).</text></subsection></section><section id="H5C5BE6BD9CDB41768360ED05FD0E04D0"><enum>3.</enum><header>Future pandemic preparedness</header><subsection id="H70E5BD832B0040C4AD3EFE7347DDB7CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subsection (b) of section 203 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/403">42 U.S.C. 403(b)</external-xref>), wages paid to an eligible individual during any public health emergency declared by the Secretary of Health and Human Services under section 319(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d(a)</external-xref>) shall not be included in the determination of the individual’s excess earnings under subsection (f)(3) of such section for any taxable year.</text></subsection><subsection id="H170F09669C874ABCAA9B980292A784A4"><enum>(b)</enum><header>Issuance of waivers</header><text display-inline="yes-display-inline">During a public health emergency declared by the Secretary under section 319(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d(a)</external-xref>) in which the Secretary has determined that, wholly or partially as a result of the public health emergency, there is a shortage of healthcare workers, the Commissioner of Social Security may issue a waiver to an individual who attests to and provides evidence of being employed as a health care professional or first responder during such public health emergency.</text></subsection><subsection id="H664BF23CB9F9441FAEE40454EECF40FB"><enum>(c)</enum><header>Report</header><text>The Commissioner shall annually submit a report to Congress describing each waiver that has been issued under this section during the previous year.</text></subsection><subsection id="H0F5EA8877CEB4ACB8AE7F86BC0446490"><enum>(d)</enum><header>Eligible individual defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>eligible individual</quote> means an individual to whom the Commissioner has issued a waiver in accordance with subsection (b).</text></subsection></section><section id="H2A6E576CDC174ABDA4FEA5544DDE83CB"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HE4E017E67DF74D07BF0AC595F7583B36"><enum>(1)</enum><header>Commissioner</header><text display-inline="yes-display-inline">The term <quote>Commissioner</quote> means the Commissioner of Social Security. </text></paragraph><paragraph id="H2A6B69CF2DC2446FB80E8F1DBA2B00D7"><enum>(2)</enum><header>Health care professional</header><text>The term <quote>health care professional</quote> has the meaning given such term in section 225(d)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/234">42 U.S.C. 234(d)(1)</external-xref>).</text></paragraph><paragraph id="H11E83BC13BBC4165858B15F41E631B3E"><enum>(3)</enum><header>First responder</header><text display-inline="yes-display-inline">The term <quote>first responder</quote> has the meaning given such term in section 3025(1) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10705">34 U.S.C. 10705(1)</external-xref>).</text></paragraph><paragraph id="HCF21E7A371B04F239071F211E8919E76"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Health and Human Services. </text></paragraph></section></legis-body></bill>
